A lectern has been set up outside the courtroom, and lawyers are expected to emerge to make statements. We're waiting in the freezing cold. This is not a complete surprise. Legal analysts have often said Mr. Sandusky would be prudent to waive the hearing, which would bring yet more public scrutiny to allegedly monstrous crimes. A parade of witnesses was expected this morning. By waiving the hearing, Mr. Amendola and Mr. Sandusky now have months to prepare their defense.

BELLEFONTE, Pa. –  Former Penn State assistant football coach Jerry Sandusky opted against a preliminary hearing in his child molestation case, sparing his accusers from making their claims in a packed courtroom Tuesday but still vowing "to fight for four quarters" as he defends himself.

His decision to waive the hearing, though unexpected, is not unusual in Pennsylvania.

At the hearings, prosecutors must show that they have probable cause to bring the case to trial. Prosecutors in this case were expected to meet that relatively low bar, in part because the case been through a grand jury.

Sandusky's lawyer, Joseph Amendola, called the decision a "tactical measure" to head off a repeat of the child sex-abuse allegations. He said having the allegations aired anew "really would have left us with the worst of all worlds."

He said the decision had nothing to do with "cowardice or gamesmanship" and that the defense was not conceding guilt.

Senior Deputy Attorney General E. Marc Costanzo said: "This development we believe provides maximum protection to most importantly the victims in this case. It avoids their having to testify for a second time. They will of course testify at a trial in the case."

Costanzo said the amount of publicity generated by Amendola made the move unexpected, but said the decision to waive was not unusual given the strength of the state's case.

There have been no discussions about a plea bargain, Costanzo said, echoing statements from Amendola. Sandusky's next court appearance, an arraignment, is scheduled for Jan. 11. He remains under house arrest.

BELLEFONTE, Pa. — Jerry Sandusky, the disgraced former assistant football coach at Penn State, waived his right to a preliminary hearing on Tuesday, which was supposed to feature the first public testimony of some of the 10 boys he is accused of sexually molesting.

Prosecutors said the case will now enter the trial phase and Sandusky would be arraigned on Jan. 11.

“We fully intend to put together the best defense we can,” Sandusky told reporters as he left the courtroom. “We’re going to stay the course, and fight for four quarters.”

Sandusky could have indicated his intention to waive the hearing earlier, but his attorney, Joseph Amendola, said they would proceed with it and the accusers planned to testify in open court. Without this hearing, the accusers will now only have to testify publicly once, at the trial.

Dec. 13 (Bloomberg) -- Jerry Sandusky’s lawyer and prosecutors negotiated late into last night to set the stage for the abbreviated preliminary hearing in the child sex-abuse case against the former Pennsylvania State University assistant football coach.

Sandusky, 67, waived his right to the hearing at the start of the 8:30 a.m. session today in Bellefonte, Pennsylvania, where some of his accusers were set to testify. He also waived an arraignment, pleading not guilty to more than 40 criminal counts related to the alleged molestation of 10 boys from 1994 to 2009. The decision was made at 10:30 p.m. yesterday after talks with prosecutors by phone, his attorney, Joseph Amendola, said in an interview.

Amendola said he got commitments from the prosecutors to expedite evidence sharing and to maintain bail terms in exchange for the waiver. The deal may backfire on the defense, a former prosecutor said. By choosing not to question the 11 witnesses set to testify today, Amendola and his client are forgoing valuable information they could use at trial.

“In a preliminary hearing, you have the right to confront your accusers, you have the right to cross-examine witnesses. It’s a very helpful and powerful tool for a trial lawyer,” said Jack McMahon, a former prosecutor in the Philadelphia District Attorney’s office. “It doesn’t make sense to give up that important right.”

It sounds to me like the good ole' boy system facilitates the continued abuse of youth. Despite the failed background check, despite letters and warning from the athletic director, Jerry Sandusky continued to come onto campus and had contact with players.  I guess it's a question of who wanted to bell the cat?

PHILADELPHIA - Despite being told he'd failed a background check after he applied to be a volunteer coach at a central Pennsylvania college last year, Jerry Sandusky continued to have contact with the football team, even ramping up his role throughout the season over the protests of the athletic director, school officials said Tuesday.

The retired Penn State assistant attended games at Juniata College and interacted with players on the practice field despite repeated attempts by the then-athletic director to keep him away from the program, school spokesman John Wall said Tuesday.

Wall said Sandusky worked last season as a consultant for the former head coach, Carmen Felus, despite the rejection letter and two orders from the former athletic director that Sandusky have no contact with the program.

But Sandusky was spotted in the press box during a Sept. 25, 2010, game at Franklin & Marshall College in Lancaster, and Felus was given a third warning by then-athletic director Larry Bock, Wall said.

"It got actually more active toward the end of the season, after this Sept. 25 ultimatum," Wall said.


Felus left Juniata after last season to take a coaching job at the University of Tennessee at Martin. A message left for a school spokesman Tuesday was not immediately returned.

No other red flags were raised about Sandusky's involvement with the football team during the season, said Bock, now the women's volleyball coach at Navy.

Bock recalled that Sandusky had a personal relationship with Felus and had visited the campus a few other times, once to give a motivational talk to the team.

The extent of Sandusky's involvement with the program was not clear until the following semester, Wall said.

Sandusky's application to be a volunteer assistant was denied in June 2010 after a background check revealed that he was under investigation by a high school where he'd previously volunteered, Wall said.

Juniata did not know the details of the investigation, Wall said, only that Sandusky was ineligible to work at the high school.

Ultimately, that investigation led to a pair of grand jury reports that allege Sandusky repeatedly assaulted young boys, including attacks that happened on Penn State's campus and the basement of his State College home.

Sandusky waived a preliminary hearing Thursday. He has acknowledged showering with and embracing young boys but denied sexually assaulting them.

Wall blamed Felus for failing to cut ties with Sandusky as directed.

"We gave our coach three distinct orders to get rid of this guy," he said.

Even if Mike McQueary is found to be questionable, I frankly don't think that is a reflection on thevictims. That's just Jerry Sandusky's attorney talking. I think with the testimony of each and every victim, it's going to be worse for Sandusky.  And that's why Joe Amendola waived the pretrial.  They didn't want to inflame everyone with hearing about what Sandusky did to the victims.  JMHO  BTW, I've noticed a second attorney has been added by Jerry Sandusky for his defense against the 52 charges of the 10 victims.  I wonder who's paying for that?

Sandusky also waived a January arraignment and requested a jury trial, his lawyer said. A pretrial conference was set for March.

"If he wants to change his mind at the last minute, that's his prerogative," senior deputy attorney general E. Marc Costanzo said.

Sandusky was accompanied to court by his wife, Dottie, some of their adopted children and alumni of The Second Mile, an organization that he founded in 1977 to help struggling children. The grand jury report said he used the charity to meet and lure his alleged victims.

Too bad Sandusky doesn't have to foot the bill for all the costs associated with the non-court day.  I tend to agree with the comments in the article concerning yesterday's ploy being nothing more than a power play by Sandusky and atty to try to exert a little control over the lives of these victims.  Like raping them all over again.
