Instead of turning anger and grief on the Board of Trustees, place the blame where it belongs:  Jerry Sandusky.  JMHO  Why aren't people picketing and raising heck in front of his home?  Again, jmho.

Dauphin County President Judge Todd A. Hoover will preside over the criminal cases lodged against two former Penn State University officials in connection with the Jerry Sandusky scandal.

Curley, the university's former athletic director, and Schultz, a former vice president, are charged by the state attorney general's office with perjury and failing to report a crime.

The two are accused of failing in 2002 to tell police about an alleged incident in a university shower room involving Sandusky, a former assistant football coach, and a young boy that was reported to them by another coach, Mike McQueary, who was a graduate assistant at the time.

Schultz, 57, and Curley, 62, both of Boalsburg, have insisted they are innocent. The two were ordered to stand trial in Dauphin County Court after a preliminary hearing in December.

Hoover has been on the county bench since 1994 and became the county's president judge in February 2010.

Jan. 24 (Bloomberg) -- Pennsylvania State University's board of trustees survived a no-confidence vote by the school's faculty as students lined up to pay their respects to late football coach Joe Paterno amid a sexual abuse scandal involving his assistant.

The motion, which also included a call for the trustees' resignations, was largely a symbolic one. The faculty senate's actions must be approved by the current university President Rodney Erickson, according the faculty website. The president is confirmed by the board of trustees.

A vote of no-confidence would be "destructive, counter productive and not in the best interest" of Penn State, said Jean Landa Pytel, associate professor of engineering science and mechanics, who spoke against the motion. The faculty voted 128 to 65 against it.

STATE COLLEGE, Pa. –  A Pennsylvania businessman and former board member of The Second Mile has sued the charity, seeking a refund of a $250,000 donation, The Patriot-News reported Wednesday.

Lance Shaner is seeking to get back the hefty contribution he provided to aid the construction of the Center for Excellence, a Second Mile project that was scrapped in the wake of the child sex abuse scandal involving the charity's founder Jerry Sandusky.

According to court documents, filed Tuesday, Shaner sent new Second Mile CEO David Woodle a letter in November requesting a refund of his donation, which he made in five separate payments of $50,000 between 2005 and 2010.

Court records indicated Woodle responded to Shaner's request two weeks later, acknowledging Second Mile had "received similar requests from [other] donors."

Woodle wrote that the charity's board of directors would honor Shaner's request "just as soon as it can obtain the necessary approvals from the Pennsylvania Attorney General and the appropriate court to make these refunds."

Former Penn State defensive coordinator Jerry Sandusky, currently under house arrest as he awaits trial for over 50 counts of child sex abuse, will ask a judge if he can regain contact with his grandchildren, the Harrisburg Patriot-News reports.

As part of his bail, Sandusky is out of jail and on house arrest. However, he cannot have any contact with children, including family members. Sandusky has a hearing scheduled on Feb. 10 to ask a judge to reverse that portion of the agreement.

Sandusky is also asking that friends be allowed to visit him in his home. The only other instance where Sandusky requests to leave the confines of his home is to visit his attorney and private investigators.

Keep in mind that last year Sandusky’s attorney, Joe Amdendola, said that one of two new cases of sexual abuse involving his client included a member of Sandusky’s family. It is unclear if those investigations have led to any additional charges.

Jerry Sandusky wants judge to let him see his grandchildren

Jerry Sandusky, accused of child sex abuse, will be in court soon asking a judge to modify the terms of his bail so he can see his grandchildren.
Sandusky, 68, was charged in November with abusing 10 boys over 15 years, many of whom he met through his charity, The Second Mile.

As part of a bail agreement that keeps him out of jail but on house arrest, Sandusky is not to have any contact with kids, including his grandchildren.

The request, filed by his attorney Friday, also asks that he be allowed to talk on the phone, by text, or Skype with them.

The motion also requests that Sandusky be allowed to visit with friends at his home, and travel to meet his attorney and private investigators to work on his case.

The hearing has been scheduled for 10 a.m. Feb. 10 at the Centre County Courthouse.

The judge assigned to the case, John Cleland, has also given prosecutors until Feb. 3 to answer a different request by Sandusky's attorney for the names, addresses and ages of the accusers, along with exact dates and locations of where each alleged assault outlined in the grand jury presentment took place.

Joe Amendola filed a request for a bill of particulars last week from the Attorney General’s Office seeking names, dates of birth, and addresses of the accusers and other witnesses. He also sought dates and locations from where the allegations happened.

On Thursday, Amendola filed a request to Senior Judge John Cleland, asking the judge to order prosecutors to provide that information.

A bill of particulars is standard procedure and requires the prosecutors to provide details such as the names and ages of people who say they’re victims and the names and addresses of witnesses.

She didn’t know at the time that she’d soon be reporting on Sandusky’s indictment on 40 counts of sex crimes against young boys, the forced resignation of the university president and the firing of legendary football coach Joe Paterno.

“I was never a sports reporter, and this was never a sports story to me,” said Ganim, 24, the reporter for the Patriot-News in Harrisburg, Pa., who last March broke the news of the grand jury investigation. “I approached it like I would any crime story.”


Ganim was in town Monday to speak to journalism students at the University of Notre Dame.

Ganim is a Penn State graduate and was teaching a course at Penn State last spring when her initial story about the Sandusky probe broke.

Senior Deputy Attorney General Joseph McGettigan laid out the prosecution's request, noting that the Centre County community has been saturated by the coverage of Sandusky's case and writing that there "can be absolutely no doubt that the media coverage of this matter has been spectacular in its breadth and intensity."

"The nature of the crimes committed, and the location and circumstances of their commission, have catapulted this case into the national conversation," he wrote in the motion to Judge John M. Cleland.

McGettigan called the publicity Sandusky's case has received "the very definition of extensive, sustained, and pervasive" and argued that it is without peer in the history of Pennsylvania.

Overwhelming pretrial publicity and Penn State's linchpin role in Centre County will make it impossible to impanel an impartial jury in the case against Jerry Sandusky, state prosecutors said.

In a motion filed Tuesday, Deputy Attorney General Joseph McGettigan urged a judge to seek out-of-county jurors for the former assistant football coach's trial on charges of child sex abuse.

"The university and Centre County are inextricably intertwined both philosophically and economically," he wrote. "Prospective jurors . . . would face a Gordian knot of conscious and even subconscious conflicts and difficulties."

Sandusky's attorney vowed to fight the move.

The state's argument poses an unusual role reversal. Typically, defense lawyers are the ones to argue that pretrial publicity has harmed their clients' chance at a fair trial.

But as McGettigan noted in court filings, the media scrutiny surrounding the Sandusky case has no "analogue or peer within the history of this commonwealth."

He compared the publicity so far to that in cases against industrialists Henry Clay Frick and Andrew Carnegie in the early 1900s.
"The complete saturation of the Centre County community by coverage of this matter and, indeed, the unique nature of that community itself requires the jury be selected from another county," he wrote.

His motion comes a week after tens of thousands of mourners turned out to the funeral of Joe Paterno, the university's longtime football coach, who was fired in November for what administrators deemed an inadequate response to allegations involving Sandusky.

That tension exemplifies the unique relationship the community has to Penn State, McGettigan said.

Common Pleas Court Judge John M. Cleland is expected to rule on the state's motion at a hearing Feb. 10, at which he will also consider a modification to Sandusky's bail conditions.

Amendola has asked the court to allow the former coach access to his 11 grandchildren as long as at least one parent is there to supervise. Sandusky remains confined to his home and is prevented from having contact with anyone under the age of 18.

Also Tuesday, prosecutors said they would hand over the names of the 10 alleged victims to Sandusky's defense by Friday.

Penn State already manages to skirt the Freedom of Information act in some ways.  This does NOT help the questions already raised about transparency.  JMHO Why slow down the delivery of news?  Why can't selected or pre-cleared journalists tweet the news from the courtroom?

As soon as Mike McQueary testified in court last month that he saw Jerry Sandusky sexually assault a boy in a Penn State locker room shower, reporters tweeted his words, giving the public an instant online news update.

Under a new state court proposal, that wouldn’t be allowed.

Court officials are considering an addition to the ban on the “transmission of communications” to include electronic devices like cellphones, computers, iPads or other tablets during court proceedings. It would amend the broadcasting rule that prohibits cameras in courtrooms and would essentially define tweeting — posting messages via the Twitter website — as broadcasting.

The rule change was proposed by a subcommittee of the two committees that govern criminal and civil court procedures in Pennsylvania. The subcommittee is recommending the change because judges across the state have interpreted the existing rules differently, with some allowing tweeting and others banning it, said court spokesman Art Heinz.

For instance, a Dauphin County judge allowed reporters to tweet and disseminate information in real time from the preliminary hearing on perjury charges brought against Penn State officials Tim Curley and Gary Schultz. The Centre Daily Times, and other news outlets, provided tweets and posted stories throughout the Dec. 16 hearing.

A Dauphin County trial judge also permitted tweeting during a public corruption trial.

But tweeting is forbidden in Westmoreland County courts, and is treated there as a violation of the broadcasting rule, according to the subcommittee.

The subcommittee, in a report earlier this month, said the concerns that prompted Pennsylvania courts to ban cameras in the courtroom still exist. They include concerns about broadcasts disrupting court proceedings, and the potential they have to bias jurors or influence witness testimony.

A “balance must be struck,” the subcommittee wrote, “between the public’s right to observe and be informed of court proceedings and the equally important rights of the participants in the proceedings as well as the orderly administration of justice.”

Under the proposal, those found violating the rule could have their cellphone or device confiscated or could be held in contempt of court.

The Pennsylvania Newspaper Association and Pennsylvania Association of Broadcasters oppose the rule change.

Melissa Melewsky, media law counsel with the PNA, said the rule is too broad and doesn’t take into account positive experiences of reporting in real time, such as the public being able to follow developments as they happened in the public corruption trial or the Curley and Schultz hearing.

“At the very least, there should be discretion for judges to control their own courtrooms,” she said.

Richard Wyckoff, president of the broadcasters association, said tweeting is an updated way to inform the public.

n Centre County, President Judge Thomas Kistler objects to the proposed rule change, saying the court shouldn’t slow the speed at which news can be reported.

He said information can still be communicated quickly, whether it’s tweeted from the courtroom or if a reporter writes a note, hands the paper to someone who runs outside the courthouse and phones it to an editor or broadcasts it live.

Kistler plans to send a letter with his comments to the subcommittee.

The proposal does not recommend a change to broadcasting or tweeting during civil proceedings, said Heinz, the court spokesman.

The subcommittee is accepting comments through April 6 at criminalrules@pacourts.us. It then will decide what, if any, changes to make to its proposal. The state Supreme Court will then decide whether to make the change.
