House approves Kansas child abuse reporting changes

TOPEKA, Kan. (AP) – House members have approved a bill that would amend Kansas laws regarding mandatory reporting of alleged child abuse.
Thursday’s 123-1 vote sends the measure to the Senate.
Supporters say the changes were in response to the allegations of child sex abuse at Penn State University involving former football defensive coordinator Jerry Sandusky.
The bill expands the list of individuals required to report allegations of child abuse to authorities for investigation. It also strengthens the penalty for failure to report cases of suspected sexual abuse.

Federal authorities are apparently conducting an investigation involving Penn State, Jerry Sandusky and his charity, The Second Mile, parallel to the case already being prosecuted by the state attorney general's office.
A Penn State spokeswoman confirmed Thursday that the university received a subpoena Feb. 2 from Peter J. Smith, U.S. attorney for the Middle District of Pennsylvania, requesting information about the university, former President Graham Spanier, and Tim Curley and Gary Schultz, top Penn State officials who are charged with perjury and failure to report a crime.

According to the state grand jury's presentment, one of the alleged victims said he was taken across state lines at least twice — to bowl games in Tampa, Fla., and San Antonio, Texas.
Local police in both cities have said they opened their own child abuse investigations as a result of the grand jury presentment. Police would not comment beyond that.
Typically, when an investigation involves more than one state, federal authorities assume jurisdiction.

A House panel unanimously approved a measure that would punish universities, colleges and schools for failing to report child molestation with a $1 million fine per incident and heightened penalties for child molesters.
Child sexual abuse scandals at Penn State University
, Syracuse University and the Citadel prompted Rep. Chris Dorworth to sponsor the measure at the request of influential lobbyist Ron Book, whose daughter Lauren is a child abuse survivor.
The scandals at the universities outside Florida exposed loopholes in state law, Book said, about required reporting of suspected sexual abuse on minors.
Current law only requires people to report suspected child sexual abuse if the perpetrator is believed to be a caretaker of the child. The bill (HB 1355) would change that, and also require that the Department of Children and Families child abuse hotline handle reports of any kind. Currently hotline operators accept all calls but refer some callers to law enforcement agencies.
"What you find is that universities, especially ones that have popular athletic programs, people try to protect those institutions. And when they do that, they make a decision that the institution is more important than the child," Dorworth, R-Lake Mary.

You're welcome Sister. It's my opinion Jerry Sandusky has been given preferential treatment, given the charges against him and the number of victims. The first judge should have recused herself because of her connections with The Second Mile and in the process, allowed him a low, unsecured bond with few restrictions considering the number & severity of the charges and the number of victims. After that judge got removed from his case, the next judge raised the amount to a paltry $250,000.00 but he and his wife did have to put their home up for $200,000 for security and a $50,000.00 bond. He ended up with an ankle monitor at home with some restrictions and is allowed to leave the house with permission and allowed to have visitors with permission. What bothers me is his attorney Joe Amendola was concerned at the time the additional charges were brought, that the bail would change (it did by only 50k) and that he wouldn't be able to make bail and would have to go to jail. If the extremely low $100,000 bail hadn't been set in the first place, he would have already been in jail, and with the added charges and victims, he should be in jail. I've seen a number of cases with fewer charges & vics and the bail amount is a million dollars. But what that galls me in Jerry Sandusky's case is he is allowed to see his grandchildren with a parent present. Under the circumstances, he shouldn't be around children at ALL! And I think because the judge has allowed him to see his grandchildren, this will be used in his trial in his favor.
With all the cronyism, power and money (football program) and the bits I hear about Governor Corbett, I wonder if there will be justice for the victims.

Muffy, I absolutely agree with you. Football at Penn State is big money and as we know, money talks and walks. It should not be around any children . . . ever again IMO.

(AP) — A federal subpoena related to the child sex abuse scandal involving a former Penn State assistant football coach, sent to the university's top lawyer earlier this month, sought records of payments made by trustees to the school, or to third parties on the school's behalf, the university said Friday.
A copy of the Feb. 2 subpoena for general counsel Cynthia Baldwin, posted on the school's website Friday evening, listed eight categories of records, including "reporting requirements on the part of employers and staff relating to misconduct" by staff and others associated with Penn State.
It directed Baldwin, a former state Supreme Court justice, to bring the documents with her to a federal grand jury meeting in Harrisburg on Wednesday, but the school said that deadline had been extended by U.S. Attorney Peter J. Smith because of the volume of records.

A Penn State spokesperson confirmed to the Harrisburg Patriot-News Thursday that federal authorities signed a subpoena on Feb. 2 requesting information from Penn State board members, as well as former PSU president Graham Spanier, athletic director Tim Curley and top university official Gary Schultz.
The subpoena, which you can view HERE, looks to assist in investigating what top PSU officials may have known about Sandusky and the allegations against him. Sources told NBC the subpoena asks for a variety of documents, including emails, dating back to 1998.

This is an interesting and informative article and needs to be read in full. In regard to the Clery Act, I'll just say it's as good as the information is reported. Universities have a way of classifying crimes different ways, that can circumvent the reporting.

Penn State, board of trustees money trails under investigation by feds

Federal investigators are looking at trails of money from Penn State and its board of trustees, computer hard drives of top officials and complaints that the university might have received about Jerry Sandusky or his charity, The Second Mile.
The information was released by Penn State on Friday after news that it had been subpoenaed by the U.S. attorney for the Middle District of Pennsylvania.
The subpoena seems to indicate that the feds are conducting an investigation simultaneously with the one by a state grand jury, which led to more than 50 counts of child sex abuse charges against Jerry Sandusky and perjury charges against two top Penn State officials.
It also seems to show that The Second Mile could be under investigation, too.

Later, the video shows Corbett saying there is “no indication that The Second Mile is under investigation.”
It is clear from what is public — the grand jury presentments against Sandusky and two Penn State officials and the public knowledge of certain subpoenas — that the investigation does involve issues related to the charity.
State grand jurors alleged Sandusky met almost all of the 10 victims he is accused of sexually abusing through the charity, plus travel and financial records have been requested from charity officials.
At least two Second Mile employees testified before the grand jury, including the former CEO, Jack Raykovitz.
Thursday, The Patriot-News confirmed that the U.S. attorney’s office has begun to issue subpoenas on the topic, too.
Federal prosecutors also informally requested documents from The Second Mile, a source said.
An attorney for the late Joe Paterno, fired as the scandal unfolded, confirmed that files regarding Sandusky and kept by Paterno will be shared with federal prosecutors, too.

First, the state attorney general’s investigation is ongoing. The grand jury continues to meet in Harrisburg.
Penn State also is in the midst of an internal review being conducted by former FBI Director Louis Freeh.
There is an NCAA inquiry.
And officials from the U.S. Department of Education are checking to see if the university is in compliance with the Clery Act, the federal law that mandates that universities report crimes.
In late November, a team of officers began gathering thousands of pages of documents and interviewing officials about possible Clery Act violations. The gathering process was expected to take weeks.
Penn State said it can’t give the Department of Education the 1998 police investigation in which Sandusky was never charged after two boys alleged he touched them during showers in the Penn State locker room.
Under state law, the university can’t turn over “investigative information” to any noncriminal justice agency, Powers said.
The Clery Act investigation possibly also includes an alleged report in 2002, the reason that Curley and Schultz are charged.

A minority of states, including Pennsylvania, allows reporting up the chain of responsibility or chain of command. In other words, workers in organizations can legitimately tell their superiors, not child welfare or law enforcement officials, to satisfy the duty to report child abuse.
That’s why neither McQueary nor Paterno was charged with failure to report. In hearing that their subordinate McQueary suspected child abuse — just as low a threshold of proof as it sounds — Schultz and Curley became mandated reporters.
These provisions have come under intense scrutiny in the wake of the Penn State scandal with many suggesting that the mechanism is fundamentally flawed.

Still, the law and regulations are clear, as they were in 2002: The report by the superior must be immediate and followed up with a written form to authorities. Because McQueary was a mandated reporter, Schultz and Curley were, too, and their charges for failure to report should stand against them.

Sandusky's defense sought to delay jury selection in the trial -- scheduled to begin on May 14 -- until mid-July.
But Judge John M. Cleland denied the request despite it going unopposed by the commonwealth.
He wrote that "postponement of a trial should be the last resort, and granted only after all other attempts to remedy the impediments to the conduct of a prompt trial have been exhausted."
The trial date was set in January and the court has worked backwards from it to establish other scheduling deadlines. The defense sought a delay to have more time to locate and interview witnesses, issue subpoenas, hire experts and accommodate witnesses who won't be available to testify in May.

Cleland granted a request by the defense for more time to file an omnibus pretrial motion that was due Thursday. The defense will have until March 22.

— In "hindsight" top officials at the Pennsylvania State University should have been more aware of the activities of former football coach Jerry Sandusky and done more to stop them, university President Rodney Erickson told a state Senate panel Wednesday.
"It was clear that there were signs there that should have been followed up that weren't," Erickson said during a hearing on the school's annual budget request.
"From everything that I have been able to learn from the board, the information that had been conveyed to them was that it was a former employee who had been gone for 12 years," Erickson said. "There were no indications that anyone at the university had been the target of charges. Looking back, it's seemingly easier to see that."
Sandusky, the Nittany Lions' famed former defensive coordinator who left Penn State in 1999 has been charged with more than 50 counts of child sexual abuse. He has said he is innocent.
After his 90-minute appearance before the Senate Appropriations Committee, Erickson said the university's Board of Trustees is taking steps to streamline its operations. The changes, he told lawmakers earlier, will allow it to be "much more aggressive in being able to respond" to potential problems.
"As president, that's a good move in the ways it will open up the lines of communication," he said.

n unprecedented 86 candidates are running for three seats on Penn State's Board of Trustees, which has been scrutinized by some alumni for decisions in the aftermath of child sex abuse charges against a retired assistant football coach.
Typically about six to nine candidates run. The slate has included as many as 15.
Interest is up this year because of the board's actions after Jerry Sandusky was arrested in November, including the firing of late head coach Joe Paterno.
Other critics have called for more transparency on the 32-member board and see election as a way to enact change.
The trustees' office Wednesday announced the names of candidates and drew for ballot positions. Any of the school's more than 557,000 alumni can vote. The ballots are due back in May.
