Penn State trustees' retreat draws criticism over lack of transparency

Did Penn State’s board of trustees — newly pledged to promote openness and transparency — violate the Sunshine Act in planning to re-align its committee structure?

That’s what open government advocates and board critics are wondering after learning of the plan to change from three standing committees to five. The board is expected to approve the changes next week.
Why is the outcome expected?

    Because — according to board Chairwoman Karen Peetz — most of the trustees met at a private retreat at the university last month to lay out the new committee format, make assignments and set short and long-term goals.

    Since then, the steering committee, also a new creation from the Thon-weekend retreat, has met for an hour every Sunday by phone, Peetz said in an interview with The Patriot-News. The five new committees have been meeting by phone as well.
 
    After the retreat, university spokesman Bill Mahon said “no business deliberations occurred” and “no decisions were made.”

    The Penn State board of trustees must follow the public meeting rules laid out in Pennsylvania’s sunshine act. When asked how the board could have decided to fundamentally change the committee structure without holding a public meeting, Peetz replied: “No decisions were made. I would say work has begun.”

    When asked specially about the sunshine act, Peetz said,
    “I don’t see it as a sunshine law issue until we vote. If you waited for all meetings to be public, you wouldn’t get anything done.”

Jerry Sandusky won't be present in court Monday in Centre County for a hearing about issues between his attorneys and state prosecutors in preparation for his May 14 trial on more than 50 counts of child sex abuse.

Sandusky's attorney Joe Amendola said that in a statement issued Friday. The hearing for the former Penn State defensive coordinator, 68, begins Monday at 11 a.m.

The next pre-trial proceeding in the Jerry Sandusky criminal case, set for Monday morning, should be a relatively short, straightforward event, according to Centre County court officials.

Scheduled for 11 a.m. in Bellefonte, the public hearing is to last 30 minutes or fewer and will include no witnesses, the court has announced. It will be held in the county's Annex Courtroom, across High Street from the main courthouse.

That facility has only limited seating, as court officials have noted. Sandusky himself is not expected to appear, as the Patriot-News has reported.

At issue is exactly how much information state prosecutors should turn over to Sandusky's defense team before a planned trial. The lead defense attorney, Joseph Amendola, is seeking a more-specific Bill of Particulars in the case's pre-trial discovery phase. He wants the state to share the precise times, dates and days of the week when Sandusky's alleged offenses happened.

Sandusky, 68, of College Township, is charged with 52 criminal counts in the child-sexual-abuse case.

You have to wonder if some of these guys are jumping off a sinking ship.  I wouldn't blame them.

The judge presiding over the child sex abuse case against Jerry Sandusky says it would be "futile" to direct prosecutors to give the former Penn State defensive coordinator more details about the allegations brought by 10 different accusers.

Judge John Cleland dismissed the request made by Sandusky's attorney Joe Amendola, saying that ordering the state prosecutors to give information they say they can't supply makes little sense.

Sandusky to seek dismissal, citing lack of specifics

Slade McLaughlin, one of the lawyers representing the alleged victim designated by a state grand jury as "Victim 1", said it was "asking too much" for young victims to recall specific dates and times of incidents that they have "spent years attempting to block from their minds."

While some of the abuse involving Victim 1 is alleged to have occurred at Sandusky's State College, Pa., home, a local hotel and an area high school, the "exact dates are unknown," prosecutors said in court documents.

Without the detailed information, McLaughlin said the prosecution's case remains "very strong" and he said he believed there was "zero chance" the case would be dismissed based on Amendola's claim.

"I can't blame him for trying," the attorney said.
