Sandusky Defense Seeks Partial Dismissal of Charges

Jerry Sandusky's defense team is seeking a partial dismissal of charges against Sandusky, according to an omnibus pretrial motion released Thursday.

Prosecution-provided details about Sandusky's contact with a number of alleged victims are "so general and non-specific that (Sandusky) cannot adequately prepare a defense to those charges," the filing reads.

Prepared by Sandusky attorney Joseph Amendola, the pretrial motion seeks the dismissal of some criminal counts involving at least nine alleged victims.

"The commonwealth has failed to provide the dates of the commission of (some) alleged offenses with reasonable certainty and with sufficient particularity in order for (Sandusky) to adequately prepare his defense," Amendola wrote.

In addition, he wrote, state prosecutors have "advised (they) cannot provide more specific information and details as to times, dates and locations of (some) alleged offenses, thus violating the notions of fundamental fairness embedded in our legal process."

The full text of the Sandusky motion is posted via the Centre County website. The document, including supporting materials, is 95 pages long.

Lawyer Seeks Dismissal of Charges Against Sandusky

erry Sandusky asked a judge Thursday to throw out the criminal charges against him in a filing that argued some counts were not specific enough, evidence was lacking in others and the statute of limitations may have run out for eight of the 10 alleged victims.

The catch-all pretrial motion also sought to delay the May 14 start of his trial on child sexual abuse allegations, saying more time was needed to prepare a defense.

The omnibus pretrial motion, as it is called, is standard in Pennsylvania criminal cases, and will likely prompt a response by prosecutors, after which Judge John Cleland could order oral argument to hash out any remaining disputes.

A message seeking comment was left for a spokesman at the state attorney general's office.

The U.S. Postal Inspection Service has launched an investigation into Jerry Sandusky’s children’s charity, The Second Mile.

It is the seventh formal investigation to start since the former Penn State defensive coordinator was charged last year with more than 50 counts of child sex abuse; most of the alleged victims were from the charity.

A former regional board member from the Harrisburg area told The Patriot-News that she was interviewed Thursday by investigators from the Philadelphia division of the office and was told to keep the nature of the questions confidential.
However former board member Claudia Williams, who is an attorney, said she was also told that “it’s public knowledge that we are investigating the Second Mile’s use of mail to solicit donations.” Her impression was that the investigation was about the organization’s practices, and not Sandusky-specific.

He argued in the filing that many of the counts contain "non-specific allegations," that the statute of limitations has expired with regard to eight alleged victims' allegations and that the prosecution has failed to turn over enough information for Sandusky to adequately prepare for his defense.

Amendola also asked to delay the start of the trial, scheduled to begin May 14.

A spokesman for the Pennsylvania Attorney General's office, which filed the charges against Sandusky in November, said the motion was "expected," and that it is “being reviewed and we will respond to the court."

Jerry Sandusky’s attorney asked a judge on Thursday to dismiss all 52 sex-abuse counts against the former Pennsylvania State University assistant football coach, saying they were too vague, too flimsy, or happened too long ago to be adequately defended in court.

In a catchall pretrial motion, Joseph Amendola argued that charges involving at least eight of the 10 boys his client is accused of molesting fell outside the statute of limitations and that others could not be sufficiently substantiated by witnesses.

The routine court filing is unlikely to lead to a dismissal of the case against Sandusky. But it exposes several potential weak spots prosecutors will have to address as they move toward a May trial.

The filing contained a few surprises, including references to previously undisclosed recordings investigators made of phone calls between Sandusky and at least two of his purported victims.

Though Amendola did not describe what was discussed in the tapes, he objected to their use in court. Their existence shows that at least some of Sandusky’s accusers took an active role in helping investigators gather evidence against him.

Other requests in Thursday’s motion included another plea to postpone Sandusky’s May 14 trial date and a request that potential jurors be sequestered throughout the trial.

Ryland Boggess, 19, pleaded guilty yesterday to misdemeanor counts of criminal mischief and disorderly conduct. He’ll be on probation for a year upon his release.

The Centre Daily Times of State College reports Boggess was arrested for shaking and pulling down a light pole during the riots that followed Paterno’s firing Nov. 9 as a child sex-abuse scandal involving a former assistant engulfed the university. A felony riot charge was withdrawn.

The state Department of Public Welfare investigator who closed a child sexual abuse investigation against Jerry Sandusky in 1998 said he likely would not have closed it had he seen reports from two psychologists who interviewed the young accuser.

"The course of history could have been changed,” Lauro said.

Jerry Lauro, brought in to investigate the child abuse claims against Sandusky, said Wednesday that Penn State police never shared those conflicting reports with him before he closed the case. Lauro said he closed the case because he did not believe there was enough evidence based solely on interviews.

Lauro was interviewed by the state grand jury that recently brought 52 child sex abuse charges involving 10 boys against Sandusky, but he said he did not even know that psychologists had evaluated the boy, then 11, until a reporter who acquired the 100-page report approached Lauro and showed him the reports.

Penn State “Detective [Ron] Schreffler never shared any of these with me,” Lauro said, referring to reports from psychologist John Seasock and a female psychologist. Seasock concluded that the boy was not sexually abused two days before the case was closed. The report of the female psychologist who evaluated the boy right after the incident found Sandusky was exhibiting signs of grooming a victim for sexual abuse.

“The conclusions she had drawn in her report were pretty damaging,” Lauro said. “I would have made a different decision. ... It’s unbelievable, and it gets my blood pressure going when I think about it.”

Schreffler, when reached by phone, declined comment. “My report speaks for itself,” he said before hanging up.

A source who reviewed the documents told The Patriot-News that he believed Seasock’s report that the boy was not abused was the reason that former and missing District Attorney Ray Gricar never pursued charges against Sandusky in 1998.

Gricar’s role has become the subject of much fodder and conjecture for two reasons: The case is the only other known time that police knew of allegations against Sandusky. And Gricar vanished in 2005. He was declared dead last summer but his case still stumps investigators, who say they have no evidence that his disappearance is linked to the Sandusky case.

Amendola wants to be able to question prospective jurors individually and said jurors should be sequestered at trial because the case has received extensive publicity.

He said it could take up to two weeks to pick a jury.

The filing argues that a June search of Sandusky's home was illegal and seeks to prevent prosecutors from using the material at trial. That search yielded computers, records, CDs, DVDs, photos and other items.

A similar suppression motion was filed regarding conversations between Sandusky and two alleged victims, identified as Victim 1 and Victim 9 in court records. Amendola said prosecutors have said they plan to use at trial a seven-minute conversation with Victim 1 in June 2009, as well as a conversation with Victim 9 about four days after Sandusky was arrested in early November.

The motion said Sandusky was not read his Miranda rights when he was questioned once or twice by a Penn State police detective in 1998, so the record of those interviews should not be allowed as evidence. The 1998 investigation, begun after a mother complained to authorities that her son showered with Sandusky, did not result in any charges being filed at the time.

Prominent advocates for the survivors of sexual abuse have questions about Penn State’s program to pay for counseling for Jerry Sandusky’s alleged victims.

Specifically, they want to know if Praesidium — the company Penn State hired to arrange for any counseling — has the experience and training to handle the delicate situation.

The advocates wanted to know more about the plan, they said, because of how little they knew about Praesidium.
“To be frank, this is the first time I’ve ever heard of this company,” said Jennifer Marsh, the director of the national sexual abuse hotline for RAINN, the Rape, Abuse and Incest National Network.

I don't care for Jerry Sandusky or his wife Dottie.  And I don't like the way this went down at ALL!   
IMO, Dottie is in this up to her eyeballs as well.  She may never admit that she knew what was going on but imo, she'd have to be blind, deaf, & dumb as a rock to have lived with JS's behavior for this long and not have figured it all out by now.

The court announced that at 9 a.m., Thursday, April 5, a hearing will be held to address Joe Amendola's request that all criminal charges against Jerry Sandusky be dropped and the case be dismissed.

According to the Centre County Government website, the Omnibus Pretrial Motion hearing will be held in Courtroom No. 1 of the Centre County Courthouse.

Sandusky is expected to attend the hearing next week, Amendola said, which is something that he feels is "appropriate."

"This proceeding represents a significant point in his case," Amendola said.

On March 22, Amendola filed a 95-page omnibus pretrial motion that requested all 52 counts against Sandusky be dropped, making the case that the prosecution did not provide adequate information in the pretrial proceedings for the defense to properly move forward.
