Paterno apology from Penn State hinges on Freeh report, official says

Ron Tomalis, Pennsylvania's secretary of education and an ex-officio member of Penn State's board of trustees, said the board will wait until the Freeh report is issued before deciding whether to apologize to the Paterno family for how the university handled the firing of the former coach.

Tomalis was asked about an apology after his remarks at a luncheon hosted by the Chamber of Business and Industry of Centre County in College Township on Tuesday.

"[We'll] see what comes out of the Freeh report," he said in response to the question. "I don't want to speculate about what may or may not happen in the future."

Tomalis, who along with Merck CEO Ken Frazier is co-chairman of former FBI director Louis Freeh's investigation into the Jerry Sandusky child sex abuse scandal, said he is looking forward to seeing the final version of Freeh's report, which he said will guide the university through its time of crisis.

Joe Amendola urges judge to throw out 2 of Jerry Sandusky's cases

It’s been about seven months since state Attorney General Linda Kelly made a plea for two boys — now presumably men — who witnesses allege were being molested by Jerry Sandusky in a Penn State locker room shower to come forward.
With Sandusky’s trial on more than 50 criminal counts stemming from the alleged molestation of 10 boys due to start in about three weeks, prosecutors said they have received calls from several people claiming they were abused.

But none have fit the descriptions of the two boys, prosecutors said.

So, when a jury convenes in Centre County Court to hear the case against the 68-year-old former Penn State football legend, prosecutors will have to rely on eyewitnesses in two of their 10 cases.

Sandusky’s attorney, Joe Amendola, says it should never get that far.

He wants Judge John Cleland to throw the cases out now, arguing that if there was any merit to the allegations, the alleged victims would have already come forward.

Sandusky defense gets OK on some probation and parole records of accusers

Jerry Sandusky’s attorney was given approval this week to get access to some documents in the Centre County Office of Probation and Parole juvenile file for one of the alleged victims.

Centre County President Judge Thomas King Kistler authorized the release Tuesday, and the approval was filed in court Thursday.

Probation and Parole received a subpoena for the records from defense attorney Joe Amendola on April 9.

The defense can get police reports, court orders, social case histories that aren’t privileged, supervision plans, and conditions of in-home detention.

But Kistler said school records such as psychological evaluations and behavior reports, drug and alcohol treatment reports, and internal notes written by staff of Probation and Parole won’t be released.

Also Thursday, Amendola filed a brief citing case law to support motions he filed on Wednesday to throw out the case.

W¯ith Jerry Sandusky’s criminal trial approaching, his attorney, Joe Amendola, is conducting a “fishing expedition” by issuing subpoenas to find documentation about the alleged victims’ backgrounds, such as behavioral issues, mental health problems, arrest records and drug or alcohol use.
The information contained in these records is protected by state and federal privacy rights. It is not relevant to the case but serves to intimidate current and future victims from coming forward.

Amendola’s questioning of victim credibility directs the attention of the media and public to the boys’ personal histories rather than focusing on Sandusky’s alleged abuse. This victim-blaming tactic relies on the public to focus on victim behaviors and distracts from the actions of the offender.

Amendola is wagering that the public’s understanding of the horrible nature of child sexual abuse does not extend to victims who have a complex personal history or any signs of an imperfect past. Misconceptions about abuse, trauma and victimization are often used in defense of offenders, and in this case, the goal is to get Sandusky acquitted on these charges.

Judge denies request to delay Sandusky trial

CNN) -- A judge Monday denied a request to postpone the trial of a former Penn State assistant football coach on child sex assault charges.
 
Jerry Sandusky's trial is scheduled to begin on June 5.
 
Sandusky has been under house arrest since December, when he was charged with sexually abusing 10 young boys over a 14-year period. He has pleaded not guilty to the charges.
 
Sandusky's lawyer, Joe Amendola, filed a motion earlier this month asking for the trial to be delayed. He had made similar motions in the past.
 
Pennsylvania Superior Court Judge John Cleland denied the motion in a brief written ruling Monday.   ::snipping2::

Joe Paterno earned $13.4 million pension at Penn State

STATE COLLEGE, Pa. — Joe Paterno earned a state pension of $13.4 million for his 61-year coaching career at Penn State.

Paterno's family announced Tuesday through a spokesman that Paterno's widow, Sue, would receive an initial payment of $10.1 million by the end of May, with the rest to be paid out over the next two years.

The family says calculations were made through the standard formula for anyone in the State Employees' Retirement System. Paterno never accessed his pension.

Family spokesman Dan McGinn says the Paternos will also donate $1.5 million to Penn State-related or State College-area charities.

Cleland, in a terse one-paragraph order denying a defense request for a continuance, sent the strongest signal possible that he wants prosecution and defense attorneys to be ready for the start of jury selection June 5.

Insurer, Jerry Sandusky attorneys clash in federal court

Attorneys for former Penn State football coach Jerry Sandusky and the company that insures the youth charity he founded clashed in federal court on Tuesday over whether Sandusky should get coverage for his legal defense.
Federal Insurance Co., which has paid at least $125,000 to Joe Amendola, Sandusky’s lead attorney, seeks a rare “public policy” ruling that would exempt an insurer from having to pay for costs incurred by an individual as a result of allegations of child sexual abuse.

Federal would continue to insure The Second Mile, the youth charity Sandusky founded and through which, prosecutors allege, he met all of his accusers.

But the company wants to be cleared of responsibility to Sandusky, who has argued that he is entitled to uncapped coverage for legal expenses under a policy covering the charity’s directors and officers.

Ex-Penn State coach Sandusky's children's charity The Second Mile to fold.

The children's charity at the center of the child molestation case against Penn State coach, Jerry Sandusky, will fold....requesting court approval to transfer its programs to Houston-based Arrow Child & Family Ministries.

A grand jury report indicated Sandusky met his alleged victims through The Second Mile, which he founded in 1977 to help disadvantaged children. The former Penn State defensive coordinator is accused of molesting 10 boys over a 15-year period. He will stand trial June 5.

Around $2 million in current cash assets will be transferred to Arrow to fund programs in Pennsylvania for up to two years. The Second Mile will continue as a legal entity and will continue to cooperate fully with any investigations.  ::snipping2::

Penn State is trying to move forward from the Jerry Sandusky child sex abuse scandal. A trial dates looms, but an upcoming issue of Esquire Magazine will bring Joe Paterno back in the public discussion about whether he knew of allegations of sexual misconduct by Sandusky in 1998.

The magazine, on newsstands soon, will feature an article by Luke Dittrich that casts doubt on Paterno’s denial he knew of a 1998 Penn State Police investigation into Sandusky.

The sports website Deadspin.com ran an article Wednesday briefly outlining some of the legwork Dittrich did for the story. He reportedly combed through scores of documents from the university library and found some interesting notes from around the time police interviewed Sandusky in 1998 about an alleged shower incident involving a young boy.

According to Deadspin, Luke Dittrich of the magazine Esquire will soon be releasing a story in which he -- despite treading "very, very carefully" -- casts doubt over Paterno's version of a sequence of events from 1998. In his final interview before his death, Paterno told Sally Jenkins of The Wasington Post that he knew nothing about the 1998 police investigation into Sandusky, who was then an assistant at Penn State under Coach Paterno. The Attorney General's Office filed its response to the defense's pre-trial motions Friday in the Jerry Sandusky case, and asked the court to deny the defense's request.

Prosecutors requested the court deny Sandusky's request to dismiss all charges against him.

Due to a lack of a factual record, since Sandusky waived his preliminary hearing, the court should be obliged to deny his request, the Attorney General's Office said.

Prosecutors said Sandusky's claim that the allegations against him are too vague should be dismissed because of the sensitive information involved in a child sex abuse case.

The Attorney General's Office also asked that the defense's motion to compel be denied or considered satisfied.

PITTSBURGH (AP) — A defense request to dismiss child sexual abuse charges against former Penn State assistant football coach Jerry Sandusky is premature because there has been no sworn testimony in the case, state prosecutors told a judge Friday.

Sandusky's attorney asked a Centre County judge to dismiss the charges last week, arguing some counts are too vague to defend and others involve victims whose identities haven't been determined.

But Chief Deputy Attorney General Frank Fina said in his response Friday that the defense's arguments are based on "assertions," not "facts," because there's been no sworn testimony.

"The absence of a factual record requires this Court to deny those requests," the prosecutor wrote.

Fina also argued that because Sandusky waived his right to a preliminary hearing — thus acknowledging prosecutors had sufficient probable cause to take the charges to trial — dismissing the charges now would effectively nullify the waiver.

Graham Spanier sues over emails

STATE COLLEGE, Pa. -- Former Penn State University president Graham Spanier has filed a civil lawsuit to force the school to release emails related to the Jerry Sandusky child sex abuse scandal.

The lawsuit was filed late Friday in Centre County court and concerns an internal investigation, led by ex-FBI chief Louis Freeh, that Penn State is conducting about the scandal. It was first reported by the Centre Daily Times newspaper on its website.

Spanier isn't asking for money in the lawsuit, which claims that he first was told Penn State emails from before 2004 didn't exist and that he recently learned at least some of those emails have been retrieved but the school refuses to allow him to see them.

Spanier's lawyers claim that Penn State attorneys were willing to send copies of the emails but allege the attorney general's office asked the school not to do so. The lawsuit seeks to have a court force the school to give copies of the emails to Spanier so he can be better prepared to testify for the internal investigation.

Spanier also claims in the lawsuit that he offered to resign on Nov. 9 and trustees accepted that offer. Previous reports have said that he was fired or resigned under pressure.

Penn State spokeswoman Lisa Powers said Friday the school may not have a copy of the lawsuit and didn't immediately respond to questions.

Second Mile foundation to close, transfer cash and programs to Texas-based charity

The move, Second Mile interim CEO Dave Woodle acknowledged in an interview with The Patriot-News, is a direct result of the taint the charity suffered when its founder and longtime public face, former Penn State football coach Jerry Sandusky, was charged with serial child molestation last year.

Sandusky is accused of abusing 10 different young boys between 1994 and 2008, and is scheduled to stand trial in June. According to case files, he made the acquaintance of all of his accusers through Second Mile programs - a revelation that dealt a body blow to the organization's reputation.

"There's no doubt the indictment of Jerry Sandusky really caused a significant drop-off in our financial support," Woodle said.

Today's move had been expected.
Woodle noted that as the organization tried to chart its future this winter, it became clear that the agency's supporters, school partners and clients all cited great value in The Second Mile programs, the allegations surrounding Sandusky had simply made the name toxic to donors and fundraising "virtually ceased...

In the months that followed, the foundation's top paid staffer quit, and most other employees were laid off. The U.S. Postal Inspection Service has launched an investigation that could touch on the charity's fund-raising activities.

Court filings show Second Mile has about $8 million in total assets, including real estate and outstanding pledges to a suspended capital campaign.

Under the proposed settlement, Woodle said, Arrow would receive enough funding to take on The Second Mile programs for about 18 months, during which time it will be trying to ramp up its own funding and volunteer bases.

The Second Mile will remain in existence primarily to sell its property and close its affairs.

At that point, in consultation with its donors, Woodle said, the agency would go back to court with a plan for disbursement of the remaining assets. Whether any of the remaining assets would also go to Arrow remains to be seen.

Those emails “would refresh his recollection significantly and allow him to assist the university fully in its investigation,” the suit said.

University trustees hired former FBI director Louis Freeh to investigate Penn State’s handling of the Sandusky situation. That report is expected in the fall.

The emails in question apparently only recently surfaced, according to a letter from an attorney who is part of the Freeh investigative team.

In the filing, Spanier’s attorneys, Philadelphia-based Vaira & Riley, wrote that they’ve asked the university to turn over emails sent from 1998 to 2004, but Penn State is refusing.

The emails are needed “especially when dealing with events which may have occurred over 10 years ago, and, in Dr. Spanier’s case, well over 10,000 emails ago and thousands of meetings ago.”Withholding the documents “smacks of game playing and would constitute fundamental unfairness and prejudice to Dr. Spanier,” the filing said.

Penn State spokesman David La Torre issued a statement, saying the university “cannot comment on any specifics related to pending litigation. However, the university has cooperated fully with the Office of Attorney General and the Freeh Group and expects all of its faculty, staff and administrators, including Dr. Spanier, to cooperate to the fullest extent. The university believes it has done nothing that would prevent Dr. Spanier from meeting with the Freeh Group, which has already met with hundreds of university employees.”

Penn State releases 2011 report with salaries of Spanier, Paterno and other officials

Penn State paid former President Graham Spanier $1.1 million, when benefits are included, and Joe Paterno $1.098 million, last year, according to the latest report from the university.

The university filed its annual Right to Know report, which includes salaries paid to top officers and the 25 highest paid employees for the 2011 fiscal year.

Spanier's compensation is listed as $937,955, with other compensation of $168,630. The late football coach received $1,002,464 in compensation and another $35,543 in other compensation.

Penn State trustees terminated Spanier as president and Paterno as head football coach in November 2011 as the Jerry Sandusky scandal began to unfold. Spanier, now a tenured member of the faculty, on Friday filed a suit in Centre County to force the university to give him access to archived emails from when he was president.
