Judge Cleland Asks Superior Court to Dismiss Appeal

Judge John Cleland asked the Pennsylvania Superior Court on Thursday to dismiss Karl Rominger's appeal of a gag order issued after Jerry Sandusky was convicted.

Rominger filed the appeal the appeal in June after Cleland ruled that information not used in trial was prohibited from being disseminated to any parties outside of counsel. According to his appeal, Rominger said the court "erred" in issuing the order.

Cleland issued the order in an effort to protect the integrity of the ongoing grand jury investigation and to protect the identities of any alleged victims of Sandusky or witnesses who did not take the stand.

In August, Cleland released the transcript of a hearing in which Frank Fina, one of the Sandusky trial prosecutors from the Attorney General's Office, explained why the order should be in place.

Fina said included in the protected material is "highly incriminating information" against Sandusky.

"I'm talking about incriminating information beyond that which was presented during the trial. There's a great deal of that in the discovery. Evidence that, for a variety of reasons, was highly incriminating against Mr. Sandusky," Fina said.

 BELLEFONTE — The judge in the Jerry Sandusky case is contesting a defense attorney's appeal of the order that the attorney reveal the names of those he gave trial and grand jury materials.

Senior Judge John Cleland said in court papers today that Karl Rominger did not comply with the order from June 26.

Cleland's order arose after a meeting among him, the grand jury judge, and defense and prosecuting attorneys about protecting materials that were not introduced at trial.

The major issue during the discussion was about a police interview with Sandusky's adopted son Matt, who said he had been touched inappropriately, that was leaked to NBC during the trial.

Sept. 20 (Bloomberg) -- Pennsylvania State University is standing fast against efforts to open its records to public scrutiny as it overhauls its administration after the Jerry Sandusky child-sex case, President Rodney Erickson said.

Lawmakers and Republican Governor Tom Corbett, who sits on the school’s Board of Trustees, say they want to make it subject to all the provisions in the state’s Right-to-Know law, which permits people to seek e-mails, contracts and other records from government institutions. While almost all U.S. public universities are subject to such statutes, Penn State was excluded when Pennsylvania overhauled its law in 2008.

“We’re not the Department of Labor and Industry,” Erickson said in an interview this week at Bloomberg LP’s headquarters in New York. “We’re a somewhat different operation.”

The adolescent boy credited with launching the child sexual abuse investigation against former Penn State football coach Jerry Sandusky will soon publish a "tell-all" book, and give his first media interview to ABC.

The New York Post reported Sept. 20 that ABC had landed the interview with "Victim 1," which will coincide with the release of the book.  It's unclear when the ABC interview will air. The New York Post was first to report the ABC exclusive. An ABC representative had no comment.

The New York Post, which reported in July that the book was being "shopped" with publishers, says it "could hit shelves in mid- to late October." The paper did not identify the publisher and said a representative for "Victim 1" could not be reached.

Sept. 20, an attorney for the unidentified man, who testified against Sandusky as "Victim 1," confirmed to The Patriot-News of Harrisburg that a book about the scandal is forthcoming.

48-year-old Greg Bucceroni of Philadelphia told the Daily News he sent the e-mail this past Monday, with specific mentions of Poly Prep’s former football coach, Phil Foglietta.

Jerry Sandusky reversed course and decided not to take the witness stand after his adopted son came forward and told prosecutors the former Penn State assistant football coach had abused him, documents show.

Trial transcripts posted online Friday offer a glimpse into Sandusky's decision to remain silent during his child sex-abuse trial.

Matt Sandusky, whom the defense had planned to call as a witness, abruptly switched sides late in the trial, approaching prosecutors and offering to testify that he had suffered abuse at the hands of his father, the transcript shows.

Prosecutors planned to call Matt as a rebuttal witness if Jerry Sandusky testified in his own defense, the transcript shows. They later backed off, but wouldn't agree to a defense request to refrain from asking Sandusky about his son's claims on cross examination.

Shortly after the former coach's arrest in November, Matt Sandusky's ex-wife went to court to keep her former father-in-law away from their three young children. Jill Jones successfully obtained a restraining order forbidding the children from sleeping over at their grandparents' home.

Jerry Sandusky's plan to take the witness stand at his trial was foiled after his adopted son came forward and told prosecutors the former Penn State assistant football coach had abused him, it has emerged.

 
Trial transcripts posted online on Friday reveal that Sandusky was forced to remain silent during his child sex-abuse trial because of concerns over his son's allegations.
 
'Mr. Sandusky had always wanted to testify on his own behalf. He always wanted to tell people his side to the allegations in this case,' said defense lawyer Joe Amendola.


'That potential evidence, whether true or not, was so devastating' that Sandusky felt he could not run the risk of testifying and subjecting himself to questions about Matt, he continued.

 BELLEFONTE — Closed-door conversations revealed in the transcript of the Jerry Sandusky trial drop hints that The Second Mile is under investigation.

In a meeting in chambers during Sandusky’s trial, Judge John Cleland said that it was “general knowledge that the Second Mile and its various fundraisings have been the object of some investigations by some agencies.”

“I don’t know if it’s the grand jury, FBI, U.S. attorney or somewhat, but there are certainly ongoing investigations,” Cleland said.

Prosecutor Frank Fina replied, “I think that’s very fair to say, your honor.”

The discussion was part of the 2,586-page transcript from the Sandusky trial that was released Friday and included many of the sidebars and meetings in chambers that took place during the nine-day trial.

That closed-door meeting and another one focused on then-Juror 6 and concerns about her serving on the jury. She was later excused from jury duty — Cleland announced in court that she had become ill — and replaced by an alternate.

At least one of Jerry Sandusky's victims is expected to speak at the convicted pedophile's Oct. 9 sentencing.

Victim 5, who testified during the June trial that Sandusky molested him in 2001 during a shared shower in Penn State's coach's locker room, will likely give a statement to the court during the part of the sentencing hearing where victims are allowed to give a statement about the impact of the crime, his attorney Tom Kline said.

Attorneys for other victims said a decision about speaking hadn't been made. That includes the Clinton County boy known as Victim 1, who is writing a book about his abuse due to be released in October.

Sandusky, however, is preparing to speak in his own defense. He continues to claim he was wrongly convicted, and wants to tell his story to the judge, hoping for a light sentence, his attorney Joe Amendola has said.

Earlier this week, transcripts of the trial were released and revealed that during sidebar conversations, Sandusky's attorney said the 68-year-old was going to take the stand, but decided against it at the last minute because his youngest adopted son, Matt, came forward and said he was also abused.

In addition to victims in the case, Sandusky can also ask friends, family or supporters to make statements on his behalf asking for leniency. Although the judge typically limits them for time, written letters can be submitted to the judge for private review.

Prosecutors have the opportunity to do the same thing — having victims who don't want to speak publicly write letters for the judge to read before the hearing begins.

Judge rejects bid by ex-Penn State officials to dismiss perjury charges

A judge in Pennsylvania on Wednesday rejected a bid by two former Penn State administrators to dismiss perjury charges against them arising from their testimony before a grand jury investigating child sex abuse allegations against former assistant football coach Jerry Sandusky.

In rejecting motions by former university Vice President Gary Schultz and ex-Athletic Director Tim Curley to dismiss the perjury counts against them, Dauphin County Judge Todd Hoover wrote that their contention that there is insufficient evidence to corroborate the charges will be more appropriately determined at trial. He also said prosecutors have given the defendants adequate information about which portions of their grand jury testimony are at the heart of the perjury charges.
 
Hoover did not rule on a motion by the defendants to dismiss the other count against them -- failure to properly report suspected child abuse. The judge indicated that he will issue a separate ruling on that motion, in which Shultz and Curley argue that the statute of limitations has expired. snip

Pennsylvania voters still have the Jerry Sandusky scandal on their minds, and many question Gov. Tom Corbett's handling of the investigation when he was attorney general.

A new poll from Franklin & Marshall College's Center for Opinion Research found only 17 percent think Corbett did an excellent or good job of investigating the Sandusky child sexual abuse case, while 65 percent think he did a fair or poor job.

"Tom Corbett not arguably has taken a hit," said G. Terry Madonna, director of the poll. "He has suffered. People think the investigation should have been done differently."

Sandusky was convicted in June on 45 counts for sexually molesting 10 boys. More than 90 percent of voters reported knowing a great deal or a fair amount about the scandal involving the former assistant Penn State football coach, according to the poll.

Penn State fared better in the findings, Madonna said, with most registered voters (54 percent) saying NCAA sanctions imposed against the university are unfair.

It's unclear, Madonna said, what effect the scandal and its aftermath will have on Corbett's future.

That could depend, in part, on who is elected attorney general this fall, Madonna said. Both candidates have called for a review of the case.

The survey findings are based on the responses of 632 registered voters from interviews conducted between Sept. 18 and Sunday. The poll has a margin of error of 3.9 percentage points.

ravis Weaver said he found himself “pinned on the bed” of a Philadelphia hotel room held down by former Penn State defensive coordinator Jerry Sandusky after the 14-year-old had come out of the shower.

“I told (Sandusky) I was going to call the cops. He just laughed at me,” Weaver said on the “Dr. Phil” TV program Friday. “(Sandusky) told me no one was ever going to believe me over him. I was scared. I believed him.”

Weaver’s graphic account of the abuse he says he suffered at the hands of Sandusky was part of his interview with Dr. Phil McGraw Friday. Weaver appeared alongside Greg Bucceroni, a Philadelphia native who has said in several interviews with the Daily News that he was sexually abused by now-deceased Philly businessman Ed Savitz during the late ’70s. Weaver first went public with his story in June — shortly before Sandusky was convicted on 45 counts of sex abuse of minors.
