Spanier never informed Penn State’s board of trustees about the incidents in 1998 and 2001 and also failed to tell anyone on the board about the grand jury investigation and subpoenas or the grand jury testimonies of Schultz, Curley and Paterno until April 2011.

In May 2011, Spanier allegedly told the board that the criminal probe had nothing to do with Penn State and that the investigation was centered on a child in Clinton County, Pennsylvania, with no ties to the school, according to the report. He made no further mention of the issue until Sandusky’s arrest in November.

The grand jury report blames the pace of the investigation on Spanier’s attempts to thwart the efforts of prosecutors to get information. A grand jury subpoena issued in December 2010 for information concerning Sandusky and inappropriate contact with minor boys went unfulfilled until April.

It wasn’t until Spanier was terminated that the university began to comply with the grand jury subpoenas, according to the grand jury report. Large amounts of evidence were provided to investigators in the first four months of this year. Searches conducted for the first time of the athletic facilities where Sandusky had offices revealed about 22 boxes of Sandusky documents including letters he sent to some victims, photographs of some of the boys and lists of children who attended Second Mile camps.

“In addition, significant e-mails were discovered reflecting direct evidence of involvement by Graham Spanier, Gary Schultz and Tim Curley in the failure of Penn State” to report the crimes, according to the grand jury report.

The case against Spanier is Commonwealth of Pennsylvania v. Graham B. Spanier, MJ-12303-CR-0000419-2012, Magisterial District Judge 12-3-03, Dauphin County (Harrisburg). The case against Curley and Schultz is Commonwealth of Pennsylvania v. Schultz, CP-22-CR-5164-2011, Court of Common Pleas of Dauphin County, Pennsylvania (Harrisburg).

Curley and Schultz are set once again to enter District Justice William Wenner's office in Dauphin County to face arraignment on six new charges including conspiracy. The newest man arrested is former Penn State President Graham Spanier. The Attorney General says the three men worked together to cover up the wrongdoings which lead to the assault of at least four more boys.

Curley and Schultz are set to be arraigned on the new charges they are facing. That will happen later this afternoon at 2 pm. These new charges are separate from the two accusations they are already facing and set to go trial on in January.

As for Spanier, he faces arraignment that is scheduled for next Wednesday. Spanier is facing up to 40 years in prison and over $75,000 in fines if convicted if all of the sentences were to run consecutively.

Former Penn State University President Graham Spanier was arraigned Wednesday morning on charges he helped to cover up allegations that Jerry Sandusky was sexually abusing boys on campus, CNN contributor Sara Ganim reports.
 
Spanier was fired in November 2011 when the scandal broke, and was charged last week with obstruction of justice, conspiracy, endangering the welfare of children, failure to report a crime and perjury. He had been Penn State's president for about 16 years.

District Judge William Wenner set his bail at $125,000 unsecured – meaning he won't have to pay any unless he fails to show up for future court dates – and the judge ordered that Spanier not leave the state of Pennsylvania without permission.

Spanier’s one year sabbatical ended today, a year since he was removed from his post as president. Additionally, Spanier will receive $600,000 as part of an agreement  in his employment contract, which also ended today.

Spanier still holds the position of president emeritus and his status as a tenured professor will be reviewed, according to the Daily Collegian article.

Last week, Spanier was charged with eight counts of crimes relating to the Jerry Sandusky sex abuse scandal. Like fellow accused administrators Tim Curley and Gary Schultz, Penn State will pay for Spanier’s legal expenses.

Gov. Corbett said the state’s Attorney General elect is welcome to make good on her promises to investigate the agency’s handling of the Jerry Sandusky child sex abuse case. He’s even giving her a timetable.
Democrat Kathleen Kane said repeatedly on the campaign trail that she fully intends to open an investigation into why it took nearly three years to arrest Sandusky, and why the case was handled the way it was.
She also said if she found no evidence of foot-dragging, she’d move on.
Corbett said, if that’s so, then there’s no reason Kane’s investigation into the Sandusky case should take go past April.
“Since she’s the one who wants speed in investigations, I hope that she does this very quickly, because it’s not going to take too long to sit down and talk to everybody and say, ‘Did you ever receive orders? Are there any e-mails?’ There is nothing out there,” said Corbett during an appearance on the Radio Pennsylvania show, “Ask the Governor.”

Kane said, through her campaign spokesman, that she would determine the length of any investigation. In an e-mail, her spokesman wrote: “Kathleen Kane said during the campaign that, like a lot of Pennsylvanians, she doesn't understand why it took the Attorney General's office 33 months to arrest Jerry Sandusky. Newly elected Pennsylvania attorney general Kathleen Kane says she'll make good on a campaign promise to investigate Gov. Tom Corbett's handling of the Jerry Sandusky child sex abuse case when Corbett was the state's chief law-enforcement officer.
Specifically, Democrat Kane wants to know why it took then-attorney general Corbett's office 33 months to charge Sandusky, a former assistant football coach under Joe Paterno at Penn State.
Sandusky is serving 40 to 60 years in state prison for abusing 10 boys over a period of 15 years.
On the campaign trail, Kane repeatedly criticized Corbett and, by extension, his "hand-picked candidate" for attorney general, Republican David Freed, over the Sandusky controversy.
Kane also questioned the need for involving an investigative grand jury in the high-profile case.
"I have never once put a child sexual assault case before a grand jury. Never. It has never taken me three years to get a pedophile off the streets," says Kane, who served for 12 years as a Lackawanna County assistant district attorney, specializing in child abuse cases.
During the campaign, Kane and other Democrats repeatedly questioned whether Corbett, as attorney general, sat on the probe so as not to interfere with his run for governor.
But Corbett has steadfastly denied he dragged out the probe or that he directed anyone in the attorney general's office to do so.
Corbett also sharply questioned Kane's motives.

Sandusky attorneys seeks more time to file briefs for new trial

The defense team for convicted pedophile Jerry Sandusky says it needs more time to submit legal briefs the judge wants to have to consider the former Penn State coach’s request for a new trial.

Attorney Joe Amendola wrote in the court papers filed today that the lead defense attorney handling the post-conviction legal defense has been recovering from a heart attack and could not work. Amendola said the new attorney, Norris Gelman, has many materials to review and a lot of research to do before filing the legal brief in support of the post-sentence motions from a month ago.

Senior Judge John Cleland previously set the deadline for Friday. Amendola said Gelman could finish submit the documents in two weeks.

Penn State's costs in the fallout of the Jerry Sandusky child abuse scandal are almost $21 million, according to updated figures from the university.
The latest update put the total bill at $20,972,633, as of Aug. 31. The tally reflects the latest invoices the university has received for legal services, public relations firms and consultants.
The university has been updating the figures each month. The latest costs are up from $19.2 million, announced in October, that the university had been billed for through the end of July.Of the nearly $21 million, $11.7 million was billed by the legal team led by former FBI director Louis Freeh and for crisis communications.

When it comes to running major public universities, Penn State under Graham Spanier was - and to a large extent still is - an outlier with its reliance on a strong executive and relatively weak board of trustees.
That's the conclusion of a new report from Pennsylvania Auditor General Jack Wagner, who said he believes that closed and centralized power structure was a major contributor to the severity of the Jerry Sandusky child sex scandal.

Wagner called for quick changes, including:
Removal of the university's president and the governor as voting members of the board, and cutting the size of the board from 32 to 21.
Removing most of Penn State's current exemptions from the state's Open Records Act.
Changing bylaws at the university to require a simple majority of the board to be present at a meeting before official action can be taken, and to lock a revolving door between the university's senior management and trustee membership.
Taking additional steps - beyond adding a public comment period - to improve public access to the board, including a hotline for people wanting to report concerns, and earlier publication of board meeting agendas.
Wagner said there is no guarantee the proposals contained in his report would have prevented the Sandusky scandal, which he laid at a "breakdown in human character."

But he argued Penn State's leadership culture under Spanier helped create conditions where such a problem could fester, and the proposed changes would "reduce the potential that similar breakdowns in human character will remain undetected for decades."

Wagner buttressed his arguments for reform of the "Penn State Way" with findings that of the nation's 20 largest public universities, none has their president as a voting board member.

None of those schools has more than 19 board members, and all require a majority to be present for action, as opposed to Penn State's 13 of 32.

He also complained that, for all the turmoil the university has been through in the past year, President Rodney Erickson and the board have made only minimal changes to university governance.

"It's pretty much the same operation," Wagner said.

I was really hoping Jerry Sandusky would do some more interviews.  Who knows what else he may have blurted out?  But I also think Amendola KNEW Jerry Sandusky was guilty, guilty, guilty!!  JMHO
