Judge to rule on stay in Mike McQueary case against Penn State in the next two weeks

BELLEFONTE — Judge Thomas Gavin will issue a ruling regarding Penn State’s request for a stay in the next two weeks regarding Mike McQueary’s whistle-blower lawsuit against the university.

This decision was reached Friday after a hearing in which the judge heard arguments from both sides. McQueary was not present.

Nancy Conrad, an attorney for the university, presented a seven-point argument mostly centered on the criminal trials of former Penn State administrators Graham Spanier, Tim Curley and Gary Schultz. The three men are scheduled for a preliminary hearing Dec. 13.

Conrad also said there is no risk that evidence will be destroyed as everything has been preserved, McQueary will not suffer more harm if the stay is granted, and it would make for a smoother trial if the stay is granted now rather than later.

McQueary’s attorney, Elliot Strokoff, said a delay would infringe on his client’s right to a speedy trial. The former assistant coach is alleging that he was made a scapegoat by the university in relation to the Jerry Sandusky child sex abuse scandal, tarnishing his reputation and impairing his ability to find work as a football coach. Sandusky was convicted on 45 counts in June.

Penn State to enforce athletic code of conduct

UNIVERSITY PARK — Penn State’s athletic department is now bound by a code of conduct that means athletes must stick to team rules, coaches cannot intimidate an athlete’s professor, and senior athletics management and staff must treat athletes like any other students.

And the university cannot retaliate against anyone who reports someone for breaking the code of conduct.

These policies and procedures have already been in place at Penn State, but the university pooled them together in adopting a new code of conduct that was required in the athletics integrity agreement with the NCAA and the Big Ten after university President Rodney Erickson accepted the NCAA sanctions this summer. The code also includes the NCAA’s and the Big Ten’s rules.

The code of conduct got the formal OK from the board of trustees Friday.

Student-athletes, coaches, administrators, athletics staff, and the 32 members of the board of trustees are those who will have to sign the six-page document. If someone does not sign it, the university will have to explain the person’s reasoning.

Among other provisions in the code:

•  Students have to adhere to all policies established by the university’s student code of conduct as well as the coach’s rules.

•  Coaches are not allowed to pressure admissions staff to accept a student merely because of his or her athletic ability.

Earlier this week, state Auditor General Jack Wagner called on state lawmakers to reform Penn State’s governance, and among his recommendations was that trustees should not be appointed to high-ranking university positions as Joyner was.

More than $3 million in pay for ousted Penn State president
11/28/12

Pennsylvania State University's ousted president Graham B. Spanier received $3.25 million in taxable compensation for 2011 - including a $1.2 million severance payment given in the wake of his forced resignation that year, the university announced on Wednesday.
 
University officials said the severance payment and $1.24 million in deferred compensation earned over his 16 years as president were required under Spanier's 2010 employment agreement. The deferred compensation - actually $860,637 after tax withholdings - will be paid in June 2017, the university said.
 
However, the full $3.25 million will appear as Spanier's compensation for 2011 in public disclosure forms.
 
Also included in that amount is Spanier's $700,000 annual salary and $82,557 in taxable benefits.  snip

Former Penn State administrators seek delay in hearing on new charges
11/27/12

Penn State Athletic Director-on-leave Tim Curley and retired Senior Vice President for Business and Finance Gary Schultz have asked for a postponement of their Dec. 13 preliminary hearing on obstruction of justice and other charges.

In their motion filed today in Harrisburg, they argue that extra time will be needed to resolve multiple challenges they have raised against the validity of the charges against them and, if needed, appeals to higher courts on those arguments.

The defense is hanging its case on arguments that prosecutors are improperly relying on testimony of former Penn State Counsel Cynthia Baldwin to make their case, in violation of attorney-client privileges.

Spanier filed a similar motion for continuance with the court on Monday.

HARRISBURG, Pa. (AP) — Gov. Tom Corbett said Thursday that he probably would agree to meet with investigators as part of state Attorney General-elect Kathleen Kane's promised probe of that office's handling of the Jerry Sandusky child sex-abuse case.

"If I believe it's a political game, no. If I believe that they want to know exactly what was going on when I was there and my thought process, sure," Corbett told reporters.

The topic of Kane's planned investigation cropped up during a year-end interview of Corbett by reporters from several news organizations.

Corbett was attorney general when the state took over the investigation of Sandusky in early 2009 and continued through his 2010 election campaign. He had been governor for nearly a year when the ex-Penn State assistant football coach was charged in November 2011.

The Republican governor's political adversaries have repeatedly suggested that he stretched out the investigation to ensure that it did not become public during the campaign and — theoretically — prompt Penn State loyalists to vote against him.

A: It's going to be interesting who the state investigators are going to be 'cause they're going to be the ones reporting to me in the first place.

Like me, you’re probably feeling awful about poor Graham Spanier.

We can assume that, like the rest of us in Pennsylvania, he didn’t win the gazillion-dollar Powerball. So now he’ll have to be content with the $600,000 a year Penn State is paying him as a tenured professor doing nothing.

Before you tear up at the thought of his financial circumstances, you might want to assume that he has something left over from the $2.5 million severance paid to him when he left Penn State last year.

Really, I have to ask: Who is worth that kind of money? And why does he need it? When you consider that the job of college president comes with a house, what expenses are left?

Some person from the American Council on Education said Spanier deserved all that dough because his was a 24/7 job.

The quote from this person continued, “I think fair-minded people will recognize Graham Spanier was president of Penn State for a long time, and he helped move it from being a nationally respected university to being an internationally recognized university.”

Frankly, I think if anybody took it from respected to internationally recognized, it was Jerry Sandusky, and not for good reasons.

So, with apologies to the American Council of Education, put me in the category of unfair-minded people.

I’m not jumping into that category because of what Spanier did or didn’t know or did or didn’t do. I’m there because I don’t think anyone in education deserves all that dough.

While thousands of people struggle and borrow and mortgage the house again to put junior through college, it’s unseemly to pay someone that much to oversee a university.

Explain why Spanier’s job was any tougher than the governor’s, who is earning in the ballpark of $175,000. Or how about the president of the country, who has what I’d consider a 24/7 job and earns $400,000 a year?

Spanier was being paid $700,000 a year as president, an obscene amount. And apparently that was just some sort of base. The Chronicle of Higher Education posted his salary at $1,068,763, or the third highest in the country, behind Texas A&M and Ohio State, where the president’s compensation was $1,992,221 in the 2011 fiscal year.   ::snipping2::

Former Penn State President Graham Spanier wants a Dauphin County district judge to lift the out-of-state and international travel bans put in place when he was released on bail last month.

District Judge William Wenner is weighing the motion, which was filed by defense attorney Edward F. Spreha Jr. on Nov. 13. The motion was not made available by Dauphin County’s court system until this morning .

At Spanier’s Nov. 7 arraignment, Wenner ordered that the former Penn State president hand over his passport and not go out of state. Spanier was indicted on obstruction of justice, perjury and related charges Nov. 1 for what the attorney general said was a “conspiracy of silence” to cover up abuse allegations against former Penn State assistant football coach Jerry Sandusky.

In the motion, Spanier’s attorney told the judge that someone in Spanier’s family is getting married in Europe in May and that Spanier wants to attend a Holocaust dedication the same month in Germany.Spanier also wants to be able to go to his home in New York and travel to see his family in Iowa for the holidays. He has colleagues out of state, including in Washington, who are working in the “national security arena,” according to the motion.

A spokesman for Spanier declined to comment on whether Spanier is still working in national security.Prosecutors from the Attorney General’s Office told the judge in their response that they do not mind if Spanier travels out of state or out of the country. But they think Spanier should get court approval in advance of any trips.

As a Pennsylvanian, I am all for allowing him to leave the Commonwealth...but I don't think he should be able to travel overseas for leisure (such as the wedding). He has serious charges hanging over him, and he continues to behave like he had no part in failing to report abuse. And how does this guy still have a security clearance???

Centre County receives thousands to cover costs from Jerry Sandusky case
Published December 4, 2012, Updated December 5, 2012


Centre County has received a $95,000 check from the state to cover the cost of Jerry Sandusky’s trial and incarceration in county jail.

Court Administrator Maxine Ishler said Tuesday the money is reimbursement from the state Attorney General’s Office for costs tracked by both the county and local police departments.

Ishler said the figure covers costs up to Sandusky’s sentencing on Oct 8. One last invoice will be sent later this month to recoup the county’s final expenses related to its most high-profile case.

In a notice of appeal filed with the State Employees Retirement System last month, Sandusky said his $59,000 annual pension was wrongly forfeited in the wake of his October sentencing for molesting 10 boys.

The Patriot-News received the letter from SERS in response to an open records request today.

Sandusky has based his appeal on two major points:
* That he joined the system in 1969, before the pension forfeiture act was enacted.
* That he was not an employee of Penn State after 2004 and therefore had no students, when the act was amended to make sex crimes against students a cause for forfeiture.

In its initial ruling, SERS staff held that Sandusky remained a "de facto" employee of Penn State in the years after his 1999 retirement, and that he was in position to commit the crimes in question because of that relationship.

Sandusky's post-sentencing motions will be the subject of arguments before a judge Jan. 10 in Bellefonte, and Rominger said preparations would be much easier if Sandusky had more regular access to a phone.

Family members have visited Sandusky, but Friday was the first time he has met with his legal team at the prison.

"It's a tough life, Level 5," Rominger said. "And I know some people in the public will say, 'Who cares?' But the answer is, I thought we believe in equality in America. And while he's a convicted sex offender in Pennsylvania, he would like to be treated like every other convicted sex offender."

Sandusky believes he would be safe in the prison's general population, Rominger said.

"He said to me he can understand where some of the concern comes from, but he's not happy being stuck in a cell 23 hours a day," Rominger said.

The jerk probably thinks he'll be a football legend to all those gen pop guys.  And he misses the showers.

Put him in gen pop.  He'll be begging quick enough to be level 5 again.  Stupid, self-absorbed, monster doesn't have the sense to know when he's safe.

I agree KittyMom  cat . Jerry thinks he'll still have an adoring football fan base.  There are probably a few die hards that will still think he's a legend, (he's still in PA, after all) but all it takes is one man that may have been abused by someone just like Jerry, or one that has a son or younger brother that may have been abused, or one that has better morals when it comes to children and Jerry may find himself in a not so pleasant situation if he's released in the general population.  He may find himself in a role reversal of his infamous bear hugs in the showers and getting his back cracked, but it won't be with young boys.
