Jerry Sandusky’s defense attorneys are seeking an evidentiary hearing to support claims made in post-trial motions they filed in the case.
Sandusky’s defense team argued in post-trial motions filed in October that the court erred in not giving them enough time to prepare for the trial.
In a court document filed Thursday, defense attorney Joe Amendola requested a hearing before trial Judge John Cleland to present testimony and exhibits that support the defense’s claims.
Amendola said he believes testimony wouldn’t take longer than two hours.

Ex-Penn State administrator Gary Schultz says he plans to sue former university lawyer Cynthia Baldwin

Retired Penn State administrator Gary Schultz filed paperwork Wednesday in Centre County court indicating he intends to sue Cynthia Baldwin, the former university lawyer who he thought was representing him when he testified to the grand jury investigating Jerry Sandusky.
The paperwork is a writ of summons for a civil case. The document does not include a formal complaint outlining the allegations and the monetary damages Schultz would seek, but it indicates Schultz is considering suing over “legal professional liability.”
Baldwin’s attorney, Charles De Monaco, said he not seen the writ and did not want to address any issues outside the courtroom.
Schultz’s civil attorney, Thomas Sprague, could not be reached for comment.
Baldwin, a former state Supreme Court justice and former Penn State trustee, has come under scrutiny over her being at the grand jury when Schultz and senior university administrator Tim Curley testified in January 2011. That was before the men were charged with perjury and failure to report abuse in November 2011.
Later, Baldwin became a key grand jury witness whose testimony was used by prosecutors bringing additional charges against Schultz and Curley and indicting former Penn State president Graham Spanier.
The criminal defense attorneys for Schultz and Curley want all the charges thrown out, saying Baldwin violated attorney-client privilege by testifying against the men. They also want to keep her from taking the stand when their clients head to court for the preliminary hearing.
De Monaco has refuted the accusations about his client.

Schultz, Curley and Spanier are awaiting a preliminary hearing on the new charges that stem from Attorney General Linda Kelly called a “conspiracy of silence” to cover up allegations of abuse against Sandusky. The hearing, originally scheduled for this week, is on hold until the district judge overseeing the case sorts out some matters, such as whether Baldwin should be allowed to testify.
Baldwin left her post as the in-house attorney June 30.

Gary Schultz set to file lawsuit against woman who claimed to represent him in court

Gary Schultz, a former Penn State executive accused of covering up complaints about Jerry Sandusky, took action to start filing a lawsuit against the woman who allegedly pretended to be his lawyer when he needed it most.
Gary Schultz filed what's called a writ of summons in Centre County Court, against Cynthia Baldwin. It explains the allegations he's making against her and states he intends to sue her for malpractice.
Former Penn State Executive Gary Schultz, accused of covering up complaints about Jerry Sandusky, made a civil court filing suggesting a lawsuit is being prepared against Cynthia Baldwin. She's the university's former attorney.
Schultz claims he thought Baldwin was his lawyer and allowed her to represent him at the Grand Jury proceedings two years ago. But at those same proceedings, she also testified against Schultz.
That's why now he plans to sue her for malpractice. Former Attorney General Walter Cohen says he's not surprised Schultz is filing the lawsuit.

Attorneys for former Penn State assistant football coach Jerry Sandusky asked a judge Thursday to let them present new testimony during initial appeals arguments set for next month.
In a motion filed in Centre County Court, Sandusky's lawyers said they would present evidence then about the "vast amount of material turned over... to the defense when trial was imminent."
Because so much was turned over so late, lead defense counsel Joe Amendola states, he had no time to thoroughly review or use it in Sandusky's defense against the sexual abuse charges he was fighting.
Sandusky's appeal of his June conviction hinges in large part on his lawyers' claims that presiding Judge John Cleland erred in failing to grant them a delay in the case.

The judge in the Jerry Sandusky child sexual abuse trial has granted the defense’s request for an evidentiary hearing on post-trial motions filed in the case.
Sandusky’s defense team is seeking the hearing to support claims it made in post-trial motions that the court erred in not giving the team enough time to prepare for trial.
In a court documents filed last week, defense attorney Joe Amendola requested the hearing before trial judge John Cleland to present testimony and exhibits that Amendola said will support the defense’s claims.
Cleland granted that request Tuesday, setting an evidentiary hearing for 9:30 a.m. on Jan. 10 in the Centre County Courthouse.
Amendola said he believes testimony wouldn’t take longer than two hours.

University attorney Michael Rozen said negotiations have reached the dollars-and-cents stage in many cases, and some will advance to final stage negotiations in the near future, keeping alive hopes the university can avoid a lengthy siege of civil court actions from Sandusky’s victims.
“The goal is 100 percent peace,” Rozen said, while confirming there are no agreements in place with any claimants at this point.
Peace is precisely why Penn State retained the Feinberg Rozen firm this year.
A national leader in mediation efforts with a portfolio that includes administering victims’ claims from the Sept. 11, 2001, terror attacks and the 2010 BP oil spill, the firm faces a daunting challenge: Help Penn State dig out from the layered roles it played in the scandal.
Penn State announced the day of Sandusky’s conviction in June that it wanted to “privately, expeditiously and fairly” settle with Sandusky’s victims.
Outside experts say the university is being smart in trying to avoid court.
“It gives them certainty,” said Tom Baker, a professor at the University of Pennsylvania law school. If successful, “they can put a dollar amount on the matter and be done with it, and they don’t have to keep reading about it in the newspaper.

Though playing out in private conference rooms, the settlement talks have begun to add some new layers of depth to the Sandusky scandal, especially on the unanswered questions of when it started, and how many children were victimized.
Many advocates for sexual abuse victims have maintained it was unlikely Sandusky’s attraction to boys started with the throw of a switch in 1994, the earliest date covered by any of the 10 young men from which criminal charges were developed.
Sandusky, who has continued to profess his innocence from behind bars to any sexual assaults, has provided no clarity.
Sketchy details emerging from the settlement talks, however, raise a clear potential that Sandusky’s victimization of young boys ran concurrent with a longer portion of his Penn State coaching career than has been revealed thus far.
Rozen said in an interview with The Patriot-News that there are 28 individuals who have entered into settlement talks with the university, with one claim dating to the 1970s.
He declined to offer specific details about that earliest case, citing the private nature of the talks.

The (Wilkes-Barre) Citizens’ Voice says Sandusky sent a handwritten note from his western Pennsylvania prison cell declining an interview request, saying his attorneys have told him to stay quiet.

The New Yorker must turn over unedited transcripts of interview with former Penn State President Graham Spanier

A judge overseeing the grand jury investigation of Penn State administrators' handling of early allegations against Jerry Sandusky has ordered "The New Yorker" magazine to give prosecutors unedited audio of lengthy interview sessions with former Penn State President Graham Spanier from this summer.
An attorney for the publication said this evening that the company will comply by a Dec. 28 deadline. Advance Magazine Publishers is a subsidiary of Advance Publications Inc., the company that owns The Patriot-News.
Spanier sat for the interview with Jeffrey Toobin shortly after release of the internal Penn State report that concluded the former president and his top administrators had tried to conceal knowledge of Sandusky's alleged crimes in order to avoid embarassing the university and its football program.
The sessions led to an article in The New Yorker in August.
In an unsealed opinion signed today, Judge Barry Feudale said that, after a private review of the materials sought by Chief Deputy Attorney General Frank Fina, "the information sought is clearly important and relevant to the investigation."
Furthermore, Feudale said that if The New Yorker's parent company, Advance Magazine Publishers Inc., did not turn over the unedited audio and transcripts he would consider civil sanctions likely to include "a very substantial financial penalty."
It is not clear from Feudale's opinion why prosecutors wanted the full transcripts. A spokesman for Attorney General Linda Kelly could not immediately be reached for comment.
The subpoena was initially issued in September. Spanier has since been charged with obstruction of justice, perjury, conspiracy and other charges in what prosecutors have called a "conspiracy of silence."

One of Jerry Sandusky’s lawyers called the trial judge’s order that he reveal to whom he gave discovery materials from the case “patently unfair,” the attorney wrote in appealing to the state’s Superior Court.
In court papers, Karl Rominger asked the Superior Court to dismiss John Cleland’s order, saying the McKean County judge who presided over the Sandusky case does not have the authority to make attorneys disclose privileged work-product materials. Rominger filed his brief in support of his appeal on Wednesday, the deadline set by the court.
Cleland’s order was handed down in June, after a police interview with Sandusky’s son Matt Sandusky was leaked to the news media. Cleland said it was to protect victims’ privacy by keeping materials not introduced at trial from being released to people not in the case.
Cleland said the prosecutors had to turn over the same information to the judge supervising the grand jury.
But in the appeal, Rominger said the prosecutors should be subject to the same standard and turn over their list to Cleland and not the grand jury judge.
“What is good for the goose is good for the gander,” Rominger wrote. “Here an (o)rder possibly revealing (w)ork (p)roduct and other confidential communications and consultations is being applied to only one set of lawyers.
“This is patently unfair.”
This issue, which has gone on for six months, developed from a small but nevertheless eyebrow-raising part of the Sandusky case.

Governor to announce lawsuit against NCAA over PSU sanctions
January 1, 2013
HARRISBURG -- Gov. Tom Corbett is expected to announce a lawsuit tomorrow against the NCAA regarding the sanctions that Penn State University agreed to last summer.
The federal lawsuit was first reported by Sports Illustrated this morning. A press release from the governor's office this afternoon said he will discuss the lawsuit at a news conference in State College.
"The details will be spelled out tomorrow," Corbett spokesman Kevin Harley said.
The lawsuit will be filed in the U.S. District Court for the Middle District of Pennsylvania, Mr. Harley said.
Penn State agreed in July to a set of NCAA sanctions that included paying $60 million -- approximately one year's gross football revenue, the agreement said -- into an endowment for programs preventing child sex abuse or assisting abuse victims.

The suit is hogwash. By the time it is fully litigated, if it is ever litigated, there is a strong likelihood that the sanctions against Penn State will have ended. But this is not a suit pivoting on legal merits. This is a suit filed by Corbett to ingratiate himself with the Penn State community and alumni, a valuable source of votes and campaign contributions when he is up for reelection in 2014 and may well face a formidable challenger in the Republican primary.

Democrat Kathleen Kane, a former prosecutor who will take office as Pennsylvania attorney general on Jan. 15, wants to know why the Sandusky investigation—which started in 2008 when Corbett was attorney general—took so long. Given Kane’s experience in child-abuse cases, she insists that in normal circumstances the predatory animal would have been arrested after the first allegation was proven to be founded. It would have gotten him off the street, and nothing would have precluded the state police from further investigation. Instead, a grand jury was impaneled. It went on for more than three years, which kept the predatory animal free to attack until his arrest.
In the meantime, Corbett took close to $202,000 in gubernatorial campaign donations from board members of the charity started by the predatory animal, called Second Mile, according to Deadspin.com.
In the meantime, there were all of two state investigators (some say it was only one) assigned to the case of the predatory animal until Corbett became governor in 2011. It was only afterwards that the investigation expanded into the scope it always deserved.

Corbett lawsuit: Penn State's NCAA sanctions baseless, harmful to innocent

UNIVERSITY PARK — The NCAA wanted to devastate Penn State for the Jerry Sandusky scandal.
Leaders at rival universities wanted to weaken their competitor on the football field. The NCAA, long seen as soft on discipline, thought it would be the perfect test case to flex its muscles and show how tough it is.
For Gov. Tom Corbett, that was the NCAA’s motivation in punishing Penn State with the $60 million fine, a four-year bowl ban and a reduction in scholarships, and now the Republican governor is taking the NCAA to task by filing a federal lawsuit on Wednesday that calls for the sanctions to be thrown out.
“These sanctions are an attack on past, present and future students of Penn State, the citizens of our commonwealth and our economy,” Corbett said Wednesday morning at a press conference on Penn State’s campus. “As governor of this commonwealth, I cannot and will not stand by and let it happen without a fight.”
Corbett is challenging the NCAA, saying that as a trade association, it violated antitrust laws by the way it sanctioned Penn State. The sanctions were imposed by the NCAA after the university-commissioned Freeh report found that senior leaders concealed abuse allegations against former defensive coach Jerry Sandusky, who is spending the next 30 to 60 years of his life in a state prison.
The lawsuit was filed Wednesday in federal court in Harrisburg.
The move is an about-face for the governor, who also is a university trustee. This summer when the sanctions were announced, Corbett said Penn State should accept them. But Corbett attributed his change of five six months later to research and hearing from people across the state about how the sanctions have hurt them.

NCAA officials were disappointed with the lawsuit, according to a statement released Wednesday.
“Not only does this forthcoming lawsuit appear to be without merit, it is an affront to all of the victims in this tragedy — lives that were destroyed by the criminal actions of Jerry Sandusky,” said Donald Remy, the executive vice president for the NCAA and its general counsel. “While the innocence that was stolen can never be restored, Penn State has accepted the consequences for its role and the role of its employees and is moving forward. Today’s announcement by the (g)overnor is a setback to the (u)niversity’s efforts.”
The NCAA will have to respond in writing within 30 days its objections to the Corbett’s accusations.
Penn State will not join the lawsuit, university spokesman David La Torre said Wednesday.
In a statement, university officials did not comment on the lawsuit. Instead, they said they are committed to complying with the terms of the consent decree, including paying the fine and implementing the recommendations from former FBI director Louis Freeh’s investigation. The university last month set aside the first payment, $12 million, in an escrow account on Dec. 20.

The NCAA today responded to Pennsylvania Gov. Tom Corbett’s announcement that he is planning to sue the Association for its handling of the Penn State sanctions. The following is a statement from Donald M. Remy, NCAA Executive Vice President and General Counsel:
“We are disappointed by the Governor's action today. Pennsylvania Gov. Tom Corbett is suing the NCAA over its sanctions against Penn State and its football team over the Jerry Sandusky child sex abuse scandal. Here's a reminder of who's who in the case:
JERRY SANDUSKY: Former assistant football coach and founder of The Second Mile charity for children, convicted of molesting boys over a 15-year period. Sentenced to 30 to 60 years in prison.
GRAHAM SPANIER: Penn State's longtime president, he was forced out by university trustees after Sandusky's arrest. Spanier was charged Nov. 1, 2012, with obstruction of justice, perjury, endangering the welfare of children and other counts for his role in what prosecutors have called a “conspiracy of silence” aimed at keeping allegations against Jerry Sandusky outside of the public eye.
