A judge has denied former Penn State football coach Jerry Sandusky's appeals.
Judge John M. Cleland, in a ruling issued this morning, denied Sandusky's argument that his defense against 48 child sexual assault counts was compromised last summer by an unnecessary rush to trial.
The ruling, in itself, was not a surprise. In this first step of the appeals process, trial judges rarely overrule decisions that they have already made prior to or during the trial.
Cleland, in his opinion, accepted the testimony from Sandusky's lead defense lawyer, Joe Amendola of Centre County, that he had not had an opportunity to thoroughly review all of the documents received from prosecutors prior to the trial.
But the judge said that in his analysis of the law, that does not trigger an automatic right to a new trial, and that Amendola would still have to show Sandusky's defense was in fact compromised by the circumstances.

Cleland also dismissed several claims of errors in his charge to the jury that the defense had raised.
Sandusky, 69, and facing a minimum jail sentence of 30 years, can now take his appeals to Pennsylvania Superior Court.

Pennsylvania State Senate passes bill requiring Penn State's Sandusky fines to stay in state

The State Senate has voted 50-0 to pass Senate Bill 187. a proposal by Senate Appropriations Committee Chairman Jake Corman, R-Centre County, to keep fines imposed on Penn State by the NCAA in Pennsylvania.
Corman's bill now goes to the state House of Representatives, which is not in session this week, but could take the measure up before it breaks for budget hearings in mid-February.
"I would not be surprised if we acted fairly quickly on passing that bill through," said Dave Thomas, chief counsel to House Speaker Sam Smith, R-Jefferson County.

NCAA leadership has suggested to date that it would only reserve up to 25 percent of the fine moneys for use in Pennsylvania.
Corman has said his bill could trump the task force because the consent decree setting out the penalties is silent on where the fine proceeds are to be used, and the legislature has a role in overseeing Penn State's expenditures.

Judge John Cleland denies defense’s request for new Jerry Sandusky trial

The judge in the Jerry Sandusky child sex abuse case has denied the convicted pedophile’s request for a new trial.
Sandusky’s attorneys sought to have the former Penn State coach’s conviction overturned, arguing they needed more time to prepare for the June trial and that Senior Judge John Cleland erred in not allowing delays.
But Cleland disagreed, ruling Wednesday morning to deny a series of post-trial motions filed by the defense. Cleland said Sandusky wasn’t deprived of a fair trial by the lack of a continuance.
His ruling means Sandusky, 69, will remain in state prison, where he is serving a 30- to 60-year sentence. It could also set the stage for future appeals.
Philadelphia attorney Norris Gelman, who is now representing Sandusky, told The Associated Press that the defense team plans to appeal the ruling to the state Superior Court. Gelman did not return phone calls and emails from the Centre Daily Times.

Investigation to Focus on Governor’s Handling of Penn State Abuse Case

Pennsylvania’s new attorney general is set to name a special prosecutor in the coming days to investigate Gov. Tom Corbett’s handling of the case, specifically why nearly three years elapsed before criminal charges were brought.
Attorney General Kathleen Kane, a Democrat elected in November, confirmed her plans in an interview here. She suggested that when he was attorney general Mr. Corbett, a Republican, slow-walked the investigation of a longtime football coach at the center of the scandal while campaigning for governor.
Mr. Corbett, who was elected in 2010, has flatly rejected the suggestion that he delayed the case.
But polls show that a majority of Pennsylvania voters are critical of his handling of the investigation, and Ms. Kane’s inquiry is likely to cast a shadow over his bid for a second term in 2014.

Mr. Corbett, 63, recently returned to the Penn State matter, an unhealed wound for many Pennsylvanians even after the conviction last year of the former coach, Jerry Sandusky, for molesting eight boys. In early January, the governor brought a lawsuit to lift the stiff penalties imposed on Penn State by the National Collegiate Athletic Association as a result of the episode.
The suit seeks to rescind a $60 million fine, a four-year ban on postseason football games and the forfeit of 112 Penn State football victories over a dozen years. It was filed six months after Mr. Corbett called on Pennsylvanians to accept the punishment, and it was widely viewed as calculated to win support from the legions of alumni who bleed Penn State blue and white.
Many Pennsylvania newspaper editorial boards concluded that the action was transparently political.
Mr. Corbett’s approval ratings are historically low for a first-term governor of his state. “I don’t think there’s any doubt” that Mr. Corbett’s handling of the case is “a contributing factor in his poor job performance” in polls, said G. Terry Madonna, who directs the Franklin & Marshall College Poll. “Do I think it’s an issue that will play out? The answer is yes.”

“The governor is happy to talk to anybody about it, including Kathleen Kane,” said his spokesman, Kevin Harley. “The proof is the conviction of Jerry Sandusky on 45 of 48 counts, and he will spend the rest of his life in jail because of the work of the men and women in the attorney general’s office and the State Police.”
Ms. Kane, 46, is a former county prosecutor who specialized in child sex abuse cases. She questioned why it took 33 months to arrest Mr. Sandusky in late 2011 after Mr. Corbett, as attorney general, received a complaint against Mr. Sandusky in the spring of 2009.
“It’s never taken me that long” to build a case against a molester, Ms. Kane said in the Harrisburg office she had just moved into, a Carpe Diem paperweight on her desk, adding that speed matters because child abusers seek new victims. “I was on the campaign trail almost two years; I didn’t go a single place without somebody asking me why it took so long.”
She also questioned the influence of campaign donations Mr. Corbett received from a charity Mr. Sandusky founded, the Second Mile, whose board members contributed to Mr. Corbett’s run for governor. Investigators at the time suspected Mr. Sandusky of using the foundation, which helped troubled youth, to find victims.
Mr. Corbett’s spokesman said he could not have returned the Second Mile contributions because at the time the case was before the grand jury and he was sworn to secrecy.
Ms. Kane also questioned whether Mr. Corbett devoted enough staff to the investigation and whether agents were trained to pursue child abusers.
Mr. Corbett has said his investigation moved slowly because for a long time there was only a single accuser against Mr. Sandusky. Investigators feared that the evidence was too weak to win a conviction.

Kathleen Kane, a Democrat who was sworn in as attorney general on Jan. 15, said that she will name a special prosecutor in the coming days to investigate Corbett's handling of the Sandusky case. Corbett is a Republican.
The investigation will look specifically at why it took the attorney general's office three years to bring criminal charges against Sandusky while he continued to have access to children.
"Attorney General Kane will appoint a special prosecutor to lead the office's internal investigation into how the Sandusky child abuse investigation was handled by the Office of the Attorney General," Kane's office said in a statement released today.

"Why did it take 33 months to get Sandusky off the streets? Was the use of a grand jury the right decision? Why were there so few resources dedicated to the investigation? Were the best practices implemented?" the statement from Kane's office read.
"At the end of this investigation, we will know the answers to these questions and be able to tell the people of Pennsylvania the facts and give them answers that they deserve," the statement said.
Describing an interview Kane gave the New York Times, the Times said Kane suggested that Corbett did not want to upset voters or donors in the Penn State community before his gubernatorial run in 2009.
Corbett has denied those suggestions. His office did not immediately return calls for comment.

Hearing set for Mike McQueary’s whistle-blower suit against Penn State

BELLEFONTE — The judge overseeing the Mike McQueary whistle-blower lawsuit against Penn State has set a hearing in March for arguments over the university’s objections to the suit.
Senior Judge Thomas Gavin ordered the hearing Friday afternoon, hours after McQueary’s attorney filed a separate motion in Centre County court asking that Penn State’s preliminary objections be thrown out.
McQueary has filed a $4 million whistle-blower and defamation lawsuit against Penn State for allegedly ruining his reputation and branding him as part of a cover-up of the Jerry Sandusky child sex abuse scandal.
In Penn State’s preliminary objections to the suit, university attorney Nancy Conrad wrote that McQueary was not defamed when former university president Graham Spanier issued a statement in November 2011 in support of then-administrators Tim Curley and Gary Schultz.

Jerry Sandusky investigation: Pa. attorney general names special prosecutor to review the case

A former federal prosecutor has been named to head Pennsylvania Attorney Kathleen Kane's long-promised review of the Jerry Sandusky child sex abuse investigation.
H. Geoffrey Moulton Jr., an associate professor at Widener University School of Law and a one-time first assistant in the U.S. Attorney's office in Philadelphia, will oversee the review.
As special investigator, Moulton in 1993 led a widely-praised investigation into the controversial federal raid on the Branch Davidian compound near Waco, Texas, for the U.S. Treasury Department, which has oversight of the federal Bureau of Alcohol, Tobacco and Firearms.
Kane, in a press release issued this afternoon, said Moulton will report directly to her and when his work is complete, "my office will make these findings available to the public."
The appointment signals the start of work on one of Kane’s central campaign promises to voters last year: Finding out why the investigation into the former Penn State defensive coordinator sexual predations took more than two-and-a-half years to complete.
Kane promised "a comprehensive and independent examination of the facts surrounding the handling of the Sandusky investigation," and the former Lackawanna County assistant district attorney rode that pledge to the first-ever victory by a Democrat since the attorney general's office became an elective office in 1980.

Graham Spanier’s bail no longer bans contact with Penn State trustees

A Dauphin County district judge has rescinded part of former Penn State President Graham Spanier’s bail that had barred him from contacting the university’s trustees and potential prosecution witnesses in the perjury case against him.
District Judge William Wenner changed on Friday the condition that Spanier’s attorneys argued was unconstitutional and did not accomplish the goals of bail, which are to make a defendant show up for court cases.

Lawyer for alleged Sandusky victim files motion to keep federal suit alive

WILLIAMSPORT — The lawyer for an alleged Jerry Sandusky victim is critical of a State College law firm for the wording in a motion seeking to be dismissed from a federal lawsuit in which it is one of the defendants.
Don Bailey, a former state auditor general, objects to his complaint being described by McQuaide Blasko as a “virtually incomprehensible rant” and part of an “opportunistic agenda.”
In a brief filed Monday in U.S. Middle District Court in opposition to the dismissal motion, Bailey states in his view “PSU could not have conducted, and its leaders would not have allowed, the unfortunate policies which permitted the abuses of Gerald Sandusky without advice from this defendant (McQuaide Blasko).”

The NCAA fired a strong pre-emptive strike today at Gov. Tom Corbett's suit seeking to overturn penalties levied against the Penn State football program over the Jerry Sandusky child sex abuse scandal.
In a motion to dismiss filed in U.S. Middle District Court in Harrisburg Thursday, the association said Corbett lacks standing to intervene in a voluntary "consent decree" in which Penn State accepted penalties including a bowl ban, scholarship reductions and a fine.

Late Penn State football coach Joe Paterno’s wife reportedly said in an interview with Katie Couric she never would have let her children near Jerry Sandusky if she had known the crimes he committed.
Couric recently interviewed Sue Paterno. The interview will air Monday at 3 p.m., locally on ABC27.
ABC27 reports Couric said the family is “still in a state of shock” and were not particularly close to Sandusky, who was Paterno's defensive coordinator.

Penn State trustee John Surma decides to leave the board

John P. Surma, the Penn State trustee who told Joe Paterno that he was fired, has decided that he is not seeking re-election to the university's governing board.
On Thursday, Penn State announced Surma's decision to step down from the board when his term ends in June.
In a statement on Penn State's website, the university said that Surma informed the board informally that he wanted to step down because of new business commitments. He recently re-affirmed that decision as the filing deadline for board elections approaches, the university said.
Surma announced the board's decision to fire Paterno in November 2011 just days after the indictment of Jerry Sandusky, the former Penn State defensive football coach. At that same meeting, the board announced the decision to oust then-Penn State President Graham Spanier.
The chairman and CEO of U.S. Steel, Surma had long been a powerful figure on Penn State's board of trustees. He was the board's face when Penn State let go of its iconic football coach and its longtime president.

The NCAA wants a federal judge to throw out the lawsuit Gov. Tom Corbett filed to overturn the sanctions against Penn State over the Jerry Sandusky child abuse scandal.
In a motion to dismiss filed Thursday, the NCAA’s lawyers said Corbett does not have the legal standing to sue and that the sanctions against Penn State do not violate antitrust laws as the governor contended.
“In this case the (g)overnor seeks, under the guise of antitrust law, to overrule his fellow (t)rustees and usurp discretion that the (l)egislature delegated to PSU,” the NCAA’s lawyers wrote. “This lawsuit is an inappropriate attempt to drag the federal courts into an intra-state political dispute.”
The NCAA said Judge Yvette Kane should dismiss it with prejudice, meaning Corbett would not be able to refile.
Penn State is not a party in the suit.

Scott Paterno said in a tweet this afternoon his family's review of the Freeh report that damaged the reputation of late Penn State coach Joe Paterno will be the subject of ESPN's "Outside the Lines" at 9 a.m Sunday.
Meanwhile, Onward State has published a new letter from Sue Paterno, the coach's widow, to former Penn State football players.
The publication posted the letter, which it said it found on the web site of former Penn State quarterback Michael Robinson.
The letter read, in part "Over the years I watched as he struggled with countless personal and professional challenges. Never – not once – did I see him compromise his principles or twist the truth to avoid bad publicity or protect his reputation. Joe was tough, sometimes difficult, always opinionated and extremely demanding. He was also scrupulously honest, rigidly moral and absolutely unafraid of the consequences of doing the right thing."

In an open letter to her husband's former players, Sue Paterno on Friday gave an advance endorsement to her family's long-awaited rebuttal to the Freeh Report on the Jerry Sandusky child sex abuse scandal at Penn State.
The Paterno report is set for release Sunday morning.
The report, compiled by a team of experts hired by the family's lawyer, Wick Sollers, will go to great lengths to attempt to distance former Penn State head football coach Joe Paterno from the years of missed opportunities to uncover or stop Sandusky's predations, sources familiar with its preparation said.

STATE COLLEGE — Sue Paterno on Friday blasted the report by former FBI director Louis Freeh that labeled her husband part of a cover-up and previewed the release of the long-in-the-works review of the document, which tarnished the legacy of the legendary Penn State coach.
“I am here to tell you as definitively and forcefully as I know that Mr. Freeh could not have been more wrong in his assessment of Joe,” Sue Paterno wrote in a letter to Penn State Nittany Lion lettermen that was released publicly by former Nittany Lions quarterback Michael Robinson on his website.

Lehigh Valley Congressman Charlie Dent said Penn State's culture is not to blame for Jerry Sandusky's decades of child sexual abuse, according to a review of the university's internal investigation by Joe Paterno's family.
Dent, in a telephone interview Friday, said he had read summaries of the review commissioned by the late head football coach's family. The review is set to be published Sunday morning.

Louis Freeh issued a response Sunday to the review of his investigation done by Sue Paterno, the wife of the late Penn State football coach, into the sex abuse scandal at the university. Here is Freeh's statement:
I respect the right of the Paterno family to hire private lawyers and former government officials to conduct public media campaigns in an effort to shape the legacy of Joe Paterno.
However, the self-serving report the Paterno family has issued today does not change the facts established in the Freeh Report or alter the conclusions reached in the Freeh Report. Joe Paterno's own testimony under oath before the grand jury that investigated this horrific case is of critical importance. Mr. Paterno testified in 2011 that he knew from Michael McQueary in 2001 that McQueary had seen Sandusky "fondling, whatever you might call it -- I'm not sure what the term would be -- a young boy" in the showers at the Lasch Building. Mr. Paterno explained, "
bviously, he was doing something with the youngster. It was a sexual nature. I'm not sure exactly what it was. I didn't push Mike to describe exactly what it was because he was very upset." Years later, Mr. Paterno would explain to a reporter he chose to discuss the event with that he told McQueary, "I said you did what you had to do. It's my job now to figure out what we want to do."
