I hope I am wrong, but when attorneys ask to be removed from a case and are not, an appeal for incompetent counsel is often a given.

 



It's my belief part of Sandusky's defenseplan  all along was to appeal on the grounds of incompetent counsel.  JMHO  I think there's some articles back in this thread somewhere that discuss this.

Commonwealth granted extension to file response in Jerry Sandusky appeal
October 12, 2015

A court has granted the Commonwealth of Pennsylvania an extension on its deadline to file a response to former assistant football coach Jerry Sandusky’s list of discovery requests in his appeal against his child sex abuse conviction.
The commonwealth has until 9 a.m. on Oct. 22 to file its response, according to court documents filed on Monday.
In addition, the court orders that argument will proceed as scheduled on Oct. 29.
Sandusky was convicted in 2012 on 45 counts of child sex abuse and is now serving between 30 and 60 years in prison. He is now on his third, and final, appeal of his conviction.
The commonwealth filed a response to Sandusky’s third appeal on Sept. 21, asking his counsel to submit a list of discovery requests backed by legal authority.

Jerry Sandusky request to examine grand jury participants denied
November 5, 2015

Jerry Sandusky lost a round in his latest appeal Thursday, while the media spotlight was trained on an extraordinary court appearance by embattled Attorney General Kathleen Kane.

Largely because of what Kane said in that appearance, a McKean County senior judge shot down Sandusky's request for court orders compelling cooperation from persons involved with the once-secret grand jury investigation into Sandusky's alleged sexual abuse of boys.

Judge John Cleland ruled after an unusual, closed-door session with Kane in which, according to the judge's order, she provided no evidence or information of leaks from her predecessors' staffs in the case.

Cleland wrote openly about Kane's testimony in his Thursday afternoon order, which he noted he had initially kept closed out of caution that information protected by grand jury secrecy rules might come out.

Instead, the judge wrote, Kane "testified that she is aware of no information, including emails or oral or written communications, that either prove to her, or persuade her, that Judge (Barry) Feudale and/or any attorneys for the Office of Attorney General orchestrated, facilitated, cooperated in, or arranged for the disclosure of otherwise secret grand jury information in this case."

With that, Cleland denied Sandusky's request to subpoena persons involved in the 2009-11 investigation as part of his quest to determine how The Patriot-News was able to publish a story on the investigation in March, 2011.

The defense wanted those powers as it tests a theory that leaks were strategically fed to the media in order to try to tease out other alleged witnesses who would build the case against the one-time Penn State football icon.

The door is not completely shut for Sandusky, however, as Cleland's order said defense attorney Al Lindsay is still free to pursue that angle with the current grand jury supervising judge, Norman Krumenacker.
 
Cleland did not rule on other aspects of Sandusky's appeal Thursday, including requests to:

* Compel testimony from a man who has claimed - without corroboration from prosecutors - to be the boy that former Penn State assistant coach Mike McQueary saw after-hours in a Penn State shower with Sandusky.

* Force private attorneys who represented the eight men who testified at trial against Sandusky to turn over copies of any contracts for representation in future civil settlements they had with the victims.

Cleland also explained in his order that he held the expedited hearing Thursday in part because of an Oct. 28 press release issued by Kane's office.

In it, Kane argued that Feudale, the judge who supervised the Sandusky grand jury investigation, had sought to leak sealed Supreme Court documents pertaining to her successful 2013 effort to have him removed from his grand jury position.

In her release - which was released the day before a previously scheduled argument on Sandusky's appeal - Kane did not directly level accusations about leaks on the Sandusky case.

But Kane also noted that Feudale had sent emails complaining about his ouster to some of the same prosecutors and reporters who were involved in the prosecution and/or reporting of Sandusky and other high profile cases.

Because that connection, to Cleland, cut to the core of the pending matters before him, he issued special orders last week compelling Kane to turn over what she had on Sandusky leaks by Wednesday.

The judge said he ordered her follow-up testimony on Thursday for clarification, and by Thursday night he felt he had it:

Kane, in Cleland's view, has "no information implicating Judge Feudale or any attorneys in the participation in any grand jury leaks in this case," the judge wrote, nor was it her intention to give that impression.

Jerry Sandusky, the former Penn State assistant football coach convicted of abusing and molesting numerous boys over more than a decade, will get to keep his taxpayer-funded state pension.

A state judge ruled Friday that Sandusky is entitled to receive his nearly $5,000 per-month pension, concluding the State Employee Retirement System erred when it forfeited his pension following his 2012 conviction. It’s unclear whether SERS will appeal the ruling.

In the unanimous opinion, Judge Dan Pelligrini wrote Sandusky could not be stripped of his pension because his crimes weren’t committed while he was a state employee. After retiring from Penn State in 1999, Sandusky continued to work on the campus and ran the Second Mile, a youth charity he used to identify and target vulnerable boys.

“Mr. Sandusky’s performance of services that benefited PSU does not render him a PSU employee,” Pelligrini concluded.

The court order reinstates Sandusky’s pension retroactively, meaning he’s able to collect all payments since his pension was forfeited in 2012, plus interest.

Jay Pagni, spokesman for SERS, told the Associated Press the SERS Board will review the court’s decision and determine what further action, including a possible appeal, will be taken.

NBC News, citing university documents published this week, reported that Penn State has spent more than $92 million in the last two years on settlements and related costs to the Sandusky scandal.

The $92.8 million - paid or set aside for 32 claims, according to an audited financial statement released by the university this week - includes $33.2 million for related costs on top of what had been previously reported.

Additional claims could be paid in the future," Penn State's financial statement said, according to NBC News. The report said the extra money went for "internal investigation, legal, communications and other related costs."

Former Penn State assistant football coach Jerry Sandusky is appearing in court today as he appeals his child-sex abuse conviction.

Sandusky's attorneys claim he was wrongly convicted and want the charges thrown out, or for the former coach to be granted a new trial, according to The Associated Press.

Defense attorneys and prosecutors are expected to present their arguments today to Judge John Cleland at a Centre County, Pennsylvania, courtroom, near Penn State's State College campus, The AP said.

In 2012, Sandusky was sentenced to 30 to 60 years in prison for the sexual abuse of 10 boys following tearful testimony from his victims. If his sentence stands, Sandusky, now 72, would be 98 at his earliest possible release date.

Notice this article uses the term "sources" and  "allegedly".  And when I see "bombshell" I think of sensationalism.  I would like to see any evidence brought forth and dealt with to the full extent of the law.

As many as six assistant coaches at Penn State witnessed "inappropriate behavior" between Jerry Sandusky and boys, stretching as far back as the 1970s, NBC News has learned.

It is unclear if any of the men reported what they saw to higher-ups at Penn State before the sex-abuse scandal erupted in 2011.

The information, which comes from court documents and multiple sources with direct knowledge of legal proceedings, raises new questions about how long the abuse went on, why no one stopped it and whether there could be even more victims than previously known.

Sandusky — who worked in the football program at Penn State under legendary head coach Joe Paterno for three decades — is serving 30 to 60 years in prison after being convicted of molesting 10 boys he met through a charity starting in 1994.

But sources told NBC News that one former Penn State assistant coach witnessed an incident in the late 1970s. Three other coaches — who have gone on to work in the NFL and at Division I colleges — allegedly saw inappropriate conduct between Sandusky and boys in the early and mid-1990s.

Penn State's legal settlements with Jerry Sandusky's accusers cover alleged abuse dating to 1971, which was 40 years before his arrest, the university said Sunday in providing the first confirmation of the time frame of abuse claims that have led to big payouts.

The disclosure came as Penn State president Eric Barron decried newly revealed allegations that former football coach Joe Paterno was told in 1976 that Sandusky had sexually abused a child and that two assistant coaches witnessed either inappropriate or sexual contact in the late 1980s. Paterno, who died in 2012, said that the first time he received a complaint against Sandusky was in 2001.

Barron said the accusations were unsubstantiated and suggested that the university is being subjected unfairly to what he called rumor and innuendo.

Responding to questions about the president's statement and claims against the school, university spokesman Lawrence Lokman told The Associated Press and ESPN's Josh Moyer that he could confirm that the earliest year of alleged abuse covered in Penn State's settlements is 1971.

Sandusky graduated from Penn State in 1965 and returned as a full-time defensive coach in 1969.

The university has paid out more than $90 million to settle more than 30 civil claims involving Sandusky, now 72 and serving a lengthy prison sentence for the sexual abuse of 10 children. The trial involved only allegations dating back to the mid-1990s.

The settlements, including the one covering the 1971 allegation, were reached after Sandusky's 2012 conviction. But few details have been provided on the payouts by either the school or lawyers for those who said Sandusky victimized them.

The allegations about Paterno and the assistant coaches were cited last week in a ruling by Philadelphia Judge Gary Glazer in litigation between an insurance company and Penn State over how much of the settlement costs the school must bear.

The insurers cited an allegation that in 1976 a boy told the longtime Penn State football coach that he had been molested by Sandusky. The court document also cited statements, from those claiming they had been Sandusky's victims, that two unidentified assistant coaches said they witnessed inappropriate contact between Sandusky and children in the late 1980s.

Lokman declined to answer questions about what steps the university took to verify abuse claims during the settlement process or about what it had done to investigate the new allegations that Paterno and members of his coaching staff knew about Sandusky's abuse decades before his 2011 arrest.

The university hired settlement experts Kenneth Feinberg and Michael Rozen to handle the claims. Feinberg declined comment. Rozen did not respond to an email from the AP.

In 2001, Paterno told high-ranking university officials that one of his assistant coaches reported seeing Sandusky acting inappropriately with a child in a team shower. In 2011, Paterno told a grand jury that he did not know of any other incidents involving Sandusky, who retired from Penn State in 1999.

Paterno was fired following Sandusky's November 2011 arrest, and he died of lung cancer in January 2012. He was not charged with any crime, and his family is pursuing a lawsuit against the NCAA for commercial disparagement.

Three university officials, including former president Graham Spanier, await trial on criminal charges for their handling of the Sandusky scandal.

Kathleen Kane's top aides asked a judge to remove the attorney general from the proposed witness list in Jerry Sandusky's petition for a new trial in the child sex abuse case, and a judge has granted the request.

Sandusky's attorneys provided Bruce Castor, Kane's new second-in-command, with a document outlining the testimony they expected to hear from Kane, according to a motion filed by the Attorney General's Office on Friday.

"Kane did not agree with, nor would she testify to, factual assertions suggested in the rough draft of the witness certification," the filing reads.

Judge John M. Cleland, who's presiding over the appeal, granted Kane's motion.

Kane's team argued that the certification filed by Sandusky's attorneys on Monday should be stricken because they "elected not to wait for such verification" from Kane herself.

Several media organizations want a judge to make public sealed court records in a dispute between Penn State and an insurance company over settlement payments to people who said former Penn State assistant football coach Jerry Sandusky abused them as children.

The Associated Press and three other news organizations filed a motion May 13 asking a Philadelphia court for access to the records a judge referred to earlier this month in a public court order.

Judge Gary Glazer’s opinion says Pennsylvania Manufacturers’ Association Insurance Co. alleged that a boy told head coach Joe Paterno in 1976 that Sandusky had molested him and that two assistant coaches witnessed abuse of other children in the 1980s.

Judge orders Penn State to ask victims for discovery
May 15, 2016

The parties that received settlements from Penn State will be asked to cooperate in another lawsuit.

In an order Monday, Potter County Senior Judge John Leete, specially presiding in Centre County, directed the university to make the request.

“Counsel for Penn State University will, as appropriate, approach victims in the Sandusky matter to ascertain their willingness to take part in voluntary discovery in the above-captioned matter,” Leete wrote.

The order came after a conference between the parties in the civil suit between the estate of longtime Nittany Lions football coach Joe Paterno and former assistant coaches Jay Paterno and Bill Kenney against the NCAA, its president, Mark Emmert, and former executive committee chairman Ed Ray.

According to court documents, law firm Pepper Hamilton was directed to “promptly furnish to the court a plan for narrowing and at least in part resolving outstanding discovery issues.”

Pepper Hamilton has been fighting discovery in the case for years. The firm had merged with that of Louis Freeh, the former FBI director contracted by the university to investigate the Jerry Sandusky child sex abuse scandal. The two split up again this year, but Pepper Hamilton is still deeply involved in the Sandusky matter.

The investigation became more of a factor after revelations earlier this month from another court.

Philadelphia Judge Gary Glazer released an order in the case between Penn State and its insurer, Pennsylvania Manufacturers’ Association Insurance Co., that pointed to settlements for allegations that go back to the 1970s, reigniting curiosity and controversy about who knew what when.

In light of the new information, Leete made some adjustments to his case.

“Further, discovery will be re-opened for a period of 45 days from this date to complete discovery, said discovery being limited to outstanding discovery requests and depositions, as well as any discovery relating to recent allegations” from the Glazer order, Leete said.

“Our concern was to give victims’ counsel the opportunity to be heard and to ensure that victims’ wishes with respect to privacy were taken into account,” Penn State spokeswoman Lisa Powers said.

Sandusky is appealing his 2012 conviction, related to 10 boys from his now-defunct charity, The Second Mile. He maintains his innocence. He will be appearing in Bellefonte for another argument on his Post-Conviction Relief Act petition on Friday.
