Liberty County toddler’s death ruled accidental drowning

The death of the 2-year-old Liberty County boy found in a pond  last week was ruled an accidental drowning, officials said. Visitation and funeral services for the child will be held at the end of the week.

The body of Devon Davis was found Saturday after four days of searching the woods and bayous of Liberty County.  An autopsy showed that the child drowned to death, according to the Jefferson County Medical Examiner’s Office.  The toxicology results are pending.

Capt. Rex Evans with Liberty County Sheriff’s office said the visitation service will be from 5 p.m. to 9 p.m. at Neal Funeral Home in Cleveland on Washington St. The service will be at 1 p.m. Friday at Cornerstone Baptist Church on Highway 105 between Cleveland and Conroe.

The Liberty County Sheriff’s office, Texas Rangers, Texas Equusearch and other volunteers who helped in the search will attend the visitation, Evans said.

Davis was found in a pond that had been searched before this weekend, but plants covering the surface kept the boy’s body from view, officials said.

03/31/12 — It is with extremely heavy hearts that we have to report that little Devin Davis’ body was located today in lake near his home. Please keep Devin’s families and friends in your prayers during their time of grief. We want to thank all of the people from all the different agencies, along with our members who searched in very treacherous conditions to find Devin and bring him home. We want to extend a very special thank you to Gene Robinson, a long time volunteer of Texas EquuSearch for traveling from Central Texas to bring out his drone airplane, which was invaluable in helping bring this family some closure. Additionally, please keep all of the searchers in your prayers too, as this was a very emotional search for everyone involved. We would also like to thank all of the people who brought food, water and bug spray out to the search site. Those donations were very much appreciated by everyone who was out looking for Devin. We will post funeral arrangements when they become available.

It is unfortunately true that accidents can happen, even with small children.  I am glad nothing sinister happened.  May the family cherish their memories of this sweet boy.

Devon Michael Davis, age 2, went to be with his heavenly father on Saturday, March 31, 2012. Devon was born on Tuesday, September 1, 2009 in Lawrenceville, GA. He is survived by his loving parents, Gary Michael and April Lee Davis; brothers, Michael Lane Davis and Nathaniel Thomas Allen; sister, Abbygail Lee Davis; great-grandmother, Shirley Lee Allen of Woodbridge, VA; great-great grandmother, Laura Frances Cook of Woodbridge, VA; uncle, Bobby Lee Herren and wife Monica of Cleveland, TX; along with numerous other loving family and friends. Visitation for Devon will be held at Neal Funeral Home on Thursday, April 5, 2012 from 5:00-9:00 pm. Service for Devon will be held at Cornerstone Church of Cleveland on Friday, April 6, 2012 at 1:00 pm. The family would like to extend their thanks and gratitude to Liberty County Sheriff’s Office, Texas Rangers, All Volunteer Fire Fighters, Texas Equusearch and the Community of Tarkington and Cleveland who provided water, food and supplies.

Oh my gosh.   I have seen the little angel's name spelled "Devin" the majority of time, and occasionally "Devon".  With his obituary spelling "Devon", I wonder if this is correct?  If the header and subject lines are in error due to the initial article, I'll go back and edit them to the correct spelling in the morning, since it's after midnight now.  It's important for his name to be correct. It will take some time, but we'll make it right.  an angelic monkey

Funeral service held for 2-year-old Devon Davis
April 6, 2012

A funeral service was held for 2-year-old Devon Davis at Cornerstone Church of Cleveland on Friday, April 6.

The little boy’s casket rode atop Cleveland Fire Department’s Engine 41 from Neal Funeral Home to the church at 12:30 p.m., escorted by other fire trucks and emergency vehicles.

Family members, including Devon’s parents, Mike and April Davis, followed Engine 41 in a black limousine.

The procession was greeted by well-wishers all along the route to the church. As it passed Walmart, a flurry of white balloons were released in a touching tribute to the young toddler.

His funeral was attended by a multitude of law enforcement officers, and other emergency personnel who helped with the search, as well as friends, neighbors, and other community members.

Texas Rangers who helped in the search served as Devon’s pallbearers.

Liberty County Sheriff’s Captain Rex Evans spoke at the funeral, thanking all of the workers again for “pouring their hearts out,” and reminding the family that storms come in life, but after the storm is over, the sun does come out again and life continues.

“Just because the service will end today, the people in this room will not just simply walk away,” Evans told the Davis family. “We will be here for you so long as you need us. God bless you.”

EquuSearch founder Tim Miller echoed the same sentiment and spoke about a conversation he had with Devon’s mom, April, while the search was still ongoing.

That's the way I read it.  But I don't understand if the child was taken before or after little Devon was determined to have drown accidentally.  Either way, why wasn't she given back to her parents after Devon's situation was resolved?  It almost sounds like one of those cases where CPS took their sweet time reuniting a family.

CPS Spokeswoman Gwen Carter says Mike and April Davis on Tuesday broke an agreement with the agency by taking their 18-month-old daughter, Abbygail, during a supervised visit at the home of a family friend, with whom the girl had been staying.

The family friend, Evelyn Johnson, says the parents loaded the baby into their SUV and took off as she was cooking dinner.

"So when I checked, some of the baby's clothes were missing and I looked outside and here was Mike. He had the baby in his arms and then mama was at the car," Johnson said. "So mama went over there and got the baby, threw her into the car and took off."

Liberty County Sheriff's Office Capt. Rex Evans said he was able to get into contact with the Davises and had them pull over in the town of Woodville, which is about 35 miles east of their home. But because CPS does not have custody of Abbygail and her parents did not commit any crime, no Amber Alert could be issued and officers could not detain the parents. However, officers did conduct a welfare check on the parents and the baby before allowing them to continue on, possibly headed back home to Virginia.

But after Devon's drowning incident, the Davises met with CPS in a family team meeting, and together, they determined the couple needed some services in order to properly care for baby Abbygail. That's when CPS and the parents entered into what's called the Child Safety Plan. The agreement essentially states the Davises would let their daughter stay with a family friend until they got the help they needed and CPS approved their living conditions.

Capt. Evans says it's now up to CPS to decide if they want to investigation. They agency has not yet said what, if any, steps will be taken to get the Davises to return Abbygail.

Thanks Muffy for the articles.  Ya know Mom could have been charged easily with neglect and I'm not picking on them but why not take all the help they can get at the moment.  It says the State doesn't have custody but if they don't follow the agreement they could easily take it if they don't follow the plan.  I really understand them losing a child and just wanting to be close to this one but goodness don't just snatch the child!

It's really sad.  I don't believe just taking the little one and going was a good decision, especially since it could really work against them.  The parents must really feel torn and broken-hearted with the loss of little Devon and not having their little girl too.  I don't have all the information, and having your two year old staying with family friends might be a better alternative than having CPS take custody.  Maybe the parents felt things weren't going to go their way, I don't  know.  I hope wherever the parent and their little girl are, they get some help with their grief of losing Devon, help and some support in raising little sister.  I don't know what resources may be available to them, whether it's from family, friends, community etc., I hope they can trust enough for the sake of their daughter.  JMHO
