The families of both children had been investigated for abuse and neglect, but a number of times DYFS workers considered the concerns "unfounded."

A man accused of fatally throwing his 2-year-old daughter, still strapped in her car seat and tied to a car jack, into a New Jersey creek said he planned for the girl's mother to accompany him the night the little girl died, according to a letter read Thursday at his trial.

"You should have came with us," Arthur Morgan III wrote in the jailhouse letter to his ex-girlfriend, Imani Benton. "It would have been so different, I'm sure. That was the plan, to go as a family."

Morgan is on trial in the November 2011 death of the couple's daughter, Tierra Morgan-Glover. The toddler's body was found in a creek in a Jersey shore park about 20 miles from her Lakehurst home, one tiny black and purple sneaker sticking out of the water.

Tierra was still securely strapped into her pink car seat, which was weighed down with a heavy metal car tire jack, which prosecutors said was done to ensure it would sink.

Benton testified that she believes she, too, would be dead if she had gone along with Morgan on an outing that was supposed to be a father-daughter trip to a movie.

"If I would have went to the movie, we wouldn't have gone to the movie," she testified. "We all would have died."

Benton tearfully described to the jury how she learned of the girl's death, hours after her father angrily sped off with their daughter in his car.

She called police after Morgan was four hours overdue bringing Tierra home. Eight hours earlier, Benton said, Morgan had berated her, saying she wasn't a good mother and yelling that she was a whore.

Police came and took a report. Hours later, they returned, this time with an FBI agent who asked about a specific item of clothing Tierra was wearing, a pink Hello Kitty hat.

"I never told police about the hat," she testified. "When they asked, I knew something was wrong. I started hyperventilating, I had a panic attack and I would end up in the hospital."

Morgan, 29, of Eatontown, is charged with killing his daughter in what prosecutors claim was a premeditated, jealous rage because Benton would not get back together with him. Benton testified that days before the child's death, she broke up with Morgan for the last time, returning jewelry including an engagement ring to him.

Morgan's state of mind the day of his daughter's death will be a key part of the case. In his opening statement, defense attorney Ryan Moriarty indicated Morgan would not deny responsibility for Tierra's death. He told the jurors their task is to decide "what form of homicide applies to this defendant."

If convicted of "knowing and purposeful" murder, Morgan could get life in prison without parole. But if convicted of a lesser form of homicide, like reckless manslaughter, he could be freed in as little as five years.

Prosecutors said Morgan gave a statement to authorities in San Diego, where he was arrested, indicating "he could have done it that way" when asked if he had tossed the child into the creek.

FREEHOLD, N.J. — Months before a New Jersey man was accused of killing his toddler daughter, he told a girlfriend that he would rather see his child dead than with her mother.
Arthur Morgan III made the statement shortly after moving in with Catherine Taylor in July 2011, she said Thursday in Morgan's murder trial in Monmouth County Superior Court here.

"He really wanted to be with her and to be a family," Taylor said, but he was distraught that he and his former girlfriend had broken up. Taylor said she had allowed him to move in with her in Lakewood Township, N.J., soon after they met because he told her he was homeless. "He stated to me that he would rather see his daughter dead than to be with her mother."

His 2½-year-old daughter was found Nov. 22, 2011, submerged in a stream in Shark River Park in Wall Township, N.J. Morgan had fled the area the day before when he was supposed to return the girl to her mother after father and daughter were to see an afternoon movie. He was found a week later in San Diego after a nationwide manhunt.

Morgan was calm when he spoke those chilling words, Taylor said. He told her than he hadn't seen Tierra Morgan-Glover since her mother broke up with him.
"I advised him he shouldn't speak like that," she said. "As a parent, he has rights and he should go (to court) and apply for visitation."
He assuaged any alarm she felt at the time by saying he would look into going to court, Taylor said. But she remembered his exact words and reported them to investigators after Tierra was found dead, strapped in her car seat with a car jack tethered to it.

"That's the type of statement that no one could forget," she said. Later in July, Morgan borrowed a car jack that belonged in her Honda Accord but never returned it; witnesses have not mentioned the origin of the jack found with Tierra.

Morgan's lawyers have not disputed that their client was responsible for Tierra's death. But they say that Morgan's judgment was clouded by his homelessness — he was no longer living with Taylor — recent loss of a job and lack of sleep.

They maintain that Morgan set his daughter in the stream instead of tossing her from a bridge, as prosecutors say, and wanted God to decide Tierra's fate.

FREEHOLD, N.J. — When Arthur E. Morgan III faces a judge Wednesday, he can expect to be sent to prison for the rest of his life for the horrific murder of his 2½-year-old daughter, Tierra Morgan-Glover.

Morgan, 29, whose last known address was in Eatontown, is to appear before Superior Court Judge Anthony J. Mellaci at 10 a.m. to be sentenced for his daughter's murder and other crimes related to the events of Nov. 21, 2011, when the toddler was strapped in a weighted car seat and tossed into a stream to die.

Morgan stood trial before Mellaci earlier this year and was convicted last month by a Monmouth County jury of Tierra's intentional murder. He also was convicted of child endangerment and interfering with the baby's custody for failing to return her home to Lakehurst on the day she was killed.

Because the victim of the murder was a child, Morgan faces life in prison without the possibility of parole. Before New Jersey abolished the death penalty in 2007, that factor could have qualified Morgan for execution.

After the jury foreman announced the verdict on April 3, Morgan flashed a smile and winked at prosecutors before being led out of the courtroom in handcuffs and one of the typically flashy suits he wore to court each day.

During the trial, his attorneys, Deputy Public Defender Jeffrey Coghlan and Deputy Assistant Public Defender Ryan Moriarty, unsuccessfully tried to convince the jury that Morgan was distraught over how Tierra's mother was raising the child and that he simply placed Tierra in a stream in Shark River Park in Wall to let God decide her fate.

In arguing that Morgan should be convicted of the lesser crime of manslaughter rather than murder, the defense attorneys suggested Morgan wasn't thinking clearly because he was beleaguered by his own homelessness, lack of sleep and loss of a job.

But First Assistant Prosecutor Marc LeMieux and Assistant Prosecutor Jordan Williams argued that Morgan planned the crime, pawning items beforehand and making arrangements to escape to California. They portrayed Morgan as a narcissistic, manipulative and controlling man who killed his daughter to get back at her mother, Imani Benton, for breaking off an engagement.

In stark contrast to the defense attorneys' portrayal of Morgan as a man worried about his baby, the prosecutors pointed out that Morgan, despite being homeless, bought expensive Prada and Gucci clothing and accessories for himself while living in his 1995 Cadillac Deville rather than providing a home for the daughter he claimed to have so much concern for.

Morgan picked up Tierra from her mother on the afternoon of Nov. 21, 2011, saying he was going to take the girl to see "Happy Feet II," a film about dancing penguins. Instead, he brought her to Shark River Park, strapped her into her car seat, tethered a metal car jack to the seat and tossed the contraption from a bridge about 17 feet below into the stream.

He later would tell authorities that Tierra was still crying when he turned and walked away, leaving her in the stream to die.

I was reading about Tierra Morgan's murder again.  I came across this same article online and it just bothers the heck out of me.  The headline and usage in the article about Tierra being "tossed into a creek" and "tossing her into a creek" is not a real description of the hideous crime her father committed.  If one were to read that headline casually, you might think, oh, tossed in the creek, like tossed into the pool.  Not.  Two year old Tierra was viciously dumped seventeen feet from a bridge down into a creek in her car seat, weighted down with a tire jack.  She didn't have a chance.     What kind of reporting is this?!  SMH
