NASHVILLE, Tenn. — Experts in Tennessee law say it's not clear whether allegations of sexual abuse against the former president of the Amateur Athletic Union have come too late for the accusers to seek relief in either the civil or criminal courts.

Steve Farese, the attorney for former AAU president Bobby Dodd, has told The Associated Press that Dodd is innocent and that there is nothing to the claims by two men who told ESPN that Dodd abused them during the 1980s while they played on his youth basketball teams.

The results of a Memphis Police investigation will determine whether the statute of limitations has expired on possible criminal charges.

"The statute of limitation has changed probably six times in the last 30 years or so, so everything is very fact specific and time specific," said Brian Holmgren, an assistant district attorney in Nashville who prosecutes child abuse cases.

He said the statute of limitations may differ depending on the charge. Also, he said, it would depend on whether the alleged abuse took place on trips outside the state.

One month after sexual-abuse allegations surfaced against former Memphian and AAU president Bobby Dodd, the Memphis Police Department's investigation essentially remains the same: It's waiting on an accuser to file a formal complaint.

Two men -- Ralph West of Miami and another unnamed man -- accused Dodd, who coached youth basketball teams and worked at a YMCA in East Memphis in the 1980s and early 1990s, of misconduct in the mid-1980s in an ESPN "Outside the Lines" investigation that broke Dec. 9.

"We don't want to act like we're seeking a complaint, but we want to make sure that everyone who knew about the situation is aware that even though it was possibly a long time ago that we're here, we're available," MPD deputy chief Dave Martello said Monday afternoon.

Satisfied that their disclosures led to Robert "Bobby" Dodd losing his longtime job as president of the Amateur Athletic Union, the two former players who went public with their allegations of sexual molestation last month say they will not file a formal criminal complaint with Memphis police.

Both players had stated that their goal in sharing their accounts of sexual abuse was to prevent Dodd from having access to children through his roles with the AAU and his personal Memphis club, Youth of Memphis Competitors Association (YOMCA). West said he plans to "keep my eye on him" and hasn't ruled out a civil lawsuit if Dodd's lawyer threatens him, or if Dodd re-emerges on the youth sports scene.

Dodd also lost his AAU membership that allows him to affiliate with his YOMCA club, said Ron Sachs, a crisis-management consultant for the AAU. But officials will allow the AAU boys' national championships for seventh graders and second graders -- lucrative tournaments Dodd hosted annually in Memphis -- to stay with YOMCA, which according to tax filings had revenues of $284,506 in 2010.

erry Sandusky and Bernie Fine had been affiliated with two of the nation's most highly recognizable college athletic programs — Penn State football and Syracuse basketball, respectively.

Within the last year, they also have been linked to sexual assault of children.

But have you heard of Bobby Dodd and Andy King?

Dodd was the former head of the Amateur Athletic Union (AAU). King was a California amateur swimming coach.

They also have been accused of horrible acts involving children.

Sandusky is standing trial on 52 counts of child sexual abuse during a 15-year period.

More than two years ago, King pleaded no contest and is serving 40 years in prison for 20 counts of molestation.

Fine and Dodd have not been formally charged.


Like the universities and respective conferences that are investigating the actions of Penn State and Syracuse, the AAU got busy after allegations were made and young lives damaged.

The AAU announced Tuesday that it is making sweeping changes to its processes involving adults connected in any way to its organization.

This comes at the behest of two independent task forces.

"It's hard to imagine anything more insidious than predators who would take advantage of the trust of unsuspecting young athletes," said Tim Moore, retired commissioner of Florida Department of Law Enforcement and a member of one of the AAU's task forces.

"These recommendations will go a long way toward making sure those despicable few will not find a safe haven within the AAU."

Great news, but why did it take so long?

Beginning with each membership renewal, adults involved in AAU will be subject to a full background check. One-on-one contact also will be banned, and all involved adults will be required to report any suspected inappropriate behavior to law enforcement officials, child abuse hotlines and the AAU.

But doesn't this all seem like common sense, like this should have been in place when an organization solely in existence for kids was formed?

It took Little League Baseball, based in Williamsport, until 2003 to make sure every adult hired by the organization received a thorough background check. With AAU, we're talking nearly a decade later.

Here's hoping that AAU (and others) won't stop after making these overdue policy changes and keep the children it is designed to serve safe.

Better safe than sorry. It's a simple motto, really.

But this is the latest example of sorry then safe.
