Lima, May 14 (ANDINA). Peru and the Netherlands have agreed an extradition treaty which allows some Dutch prisoners in Peru and Peruvians jailed in the Netherlands to apply to complete their prison terms in their homeland once their appeal process has been completed.

Foreign Minister Uri Rosenthal and his Peruvian opposite number Jose Antonio Garcia Belaunde signed a treaty on the transfer of sentenced persons and the enforcement of criminal judgments on Thursday. "The treaty allows residents of the Kingdom of the Netherlands who have been sentenced to prison by final and irrevocable judgment in Peru" to serve their sentence in the Netherlands, said Rosenthal.

Peruvians who are in prison in the Netherlands are also entitled to invoke the treaty. Both countries are under obligation to grant a detainee's request. The treaty will enter into force as soon as both parliaments have approved it.

I'm hoping that the word "SOME" is the operable word here, and that some refers to prisoners convicted of drug offenses and not murder charges.

Also of interest is that the prisoner has to have finished his appeals process, having a final & irrevocable sentence, then he can apply for the extradition and it is automatically accepted.  What the hell-o?

Please don't let it apply to convicted murderers, and if it does, please let the extradition to the US take precedent before the extradition to the NL.

Maybe this treaty is why Joran's lawyer is basing his appeal on the confession that they asked to be thrown out anyway.

Van der Sloot's case is not yet concluded. Depending on the sentence his client receives, his lawyer Maximo Altez does plan to make use of the new regulation.

Altez hopes that his client will be convicted of 'manslaughter by violence,' carrying a jail sentence of 3 to 5 years. "If he is given a sentence of five years, I will advise him to apply for the transfer to the Netherlands. If it is longer, we must look at this again separately."

Although, Altez is no longer Joran's lawyer, I wonder if this is part of Jiminez's plan.

Of note here is the convicted of "manslaughter by violence" phrase.  Hopefully since Joran was convicted of MURDER and not manslaughter, he isn't eligible for the treaty. Then Jiminez will have to fight to expand the treaty.

LIMA -- Convicted killer Joran van der Sloot's health has deteriorated since he was moved to a high security prison in Peru, RadarOnline.com reported.

The Dutchman, who was jailed for 28 years for the 2010 murder of Peruvian woman Stephany Flores, was transferred to maximum security prison Piedras Gordas, in the north of capital Lima, following criticism that conditions at Lima's Castro Castro jail, where he spent 18 months, were too comfortable.

In contrast to Castro Castro, where van der Sloot reportedly bonded with inmates and guards and enjoyed perks such as conjugal visits and internet access, the 24 year old has been placed in solitary confinement at Piedras Gordas and has complained he feels ill and depressed.

"His health has suffered and he is not doing well there," a source told RadarOnline.com. "Joran blames the food and the water. He says that he is depressed and feeling weak all the time."

Mary Hamer, a Florida woman who pays the killer's legal bills, told the gossip site she was "very worried about his deteriorating health."

hmmm...wonder if that rash is from a leash around his neck?  Maybe his guards are treating him like the wild animal he is.
