According to the information cited from the extradition treaty in the article, both parties to the treaty "may" postpone extradition. So...it is not
must
postpone because the Supreme Court made the recommendation?

A copy of the decision obtained by the AP cites the U.S.-Peru extradition treaty, first signed in 1899 and an additional 1990 agreement, as specifying that
both parties may postpone extradition
until after a condemned criminal has finished serving his or her sentence.
The decision cites three recent cases involving convicted criminals wanted by Spain, Argentina and the United States as precedents.

I am anticipating the reaction of Birmingham prosecutors and John Kelly to the decision of the Peruvian Supreme Court in regards to extradition. Extradition 28 years down the road does not make sense when it comes witness testimonies.
Then again ... maybe ... just maybe ... in the year 2040 a 93 year old Monkey named Tamikosmom will be following two trials ... the extortion of Beth Holloway and ... the defamation of the Kalpoe brothers.

Peru court: Can extradite Dutchman after prison

LIMA, Peru (AP) — U.S. prosecutors who want to try Joran van der Sloot for extortion related to the 2005 disappearance of U.S. teen Natalee Holloway will have to wait until he finishes serving a murder sentence in Peru, this nation's Supreme Court has ruled.
Van der Sloot's lawyer, who was notified of the decision Friday, said Monday that he expects his client will be made to serve at least two-thirds of the 28-year sentence.
The court's May 23 decision on extradition is not final, however. Peru's justice minister and Cabinet must endorse it, said the lawyer, Maximo Altez.
Van der Sloot, 24, faces extortion and wire fraud charges in Alabama in connection with Holloway's unsolved disappearance in Aruba exactly five years before he killed Peruvian college student Stephany Flores after meeting her in a Lima casino.

The Peruvian Supreme court has effectively afforded Joran van der Sloot a pass in regards to the extortion charges waiting in the States. Even if Joran receives full reduction credits and is released in 9 years ... the Birmingham case against this psychopath ... in all probability ... will have been compromised and ... the charges dropped. IMO.
When the furthering of justice is considered ... the Peruvian Supreme Court ruling and simple logic do not equate. IMO.
If the the Peruvian Justice Minister and Cabinet rule likewise ... could the implication be that there are forces behind the scenes protecting Joran van der Sloot.

What on earth makes you say that? Why do you think the case will be compromised and charges dropped? That doesn't make sense. I fully expect in 9 years for Joran to be extradited to the US for trial. Hopefully he'll then get life in prison and begin serving his life term in Federal Prison. I'm not worried one bit.

IF Joran qualifies for full reduction credits ... in 9 years all witnesses involved in the sting may not be available for varying reasons to testify on behalf of the Beth Holloway. If he does not qualify ... in 28 years ... the number of witnesses will be reduced substantially. IMO
Anyways ... why did the Peruvian Supreme Court rule against immediate extradition of Joran to the States to face extortion charges once there was a ruling on the appeal of his sentence? Joran would have been returned to Peru to finish his Peruvian sentence at the completion of the trial. In the name of justice for Beth Holloway ... an immediate trial would have made so much more sense. IMO

All of the witnesses have already given their statements it's not like they will forget what happened. Why would Peru let loose of Joran to come to the US when he murdered one of their own? Murder trumps extortion IMO (even though we believe he also murdered Natalee). What we want and what is the expected are two different things.
Yes, I would love for Peru to let Joran come to the USA for a trial then go back to jail in Peru after but I would have been shocked if it happened that way.

There aren't any forces behind the scenes protecting Joran.
Joran got lucky in Aruba b/c his Daddy knew people in a corrupt society who were willing to do anything to protect their precious island and therefore their own lifestyles. Daddy is DEAD.
Joran screwed up and got caught at killing Stephany and extorting Beth. Now he has to pay for his crimes. He was convicted of the murder of Stephany and received a 28 year sentence in a Peruvian prison with horrendous living conditions.
He was indicted in the USA for his extortion of Beth and wire fraud. His extradition to the USA has been approved.
Doesn't sound to me like he has friends in high places protecting him. There is nothing to be read between the lines, no conspiracies, no requests from the Netherlands for extradition, no protection for Joran. Joran is frightened to come to the USA and miserable in Peru, as well he should be. He is just beginning his paybacks!!

Are statements sufficient in a court of law? Do defence attorneys not have the right to cross examine a witness?
Klaas ... less than one month ago Joran's own attorney believed that the extradition of Joran was imminent. I am anticipating John Kelly's reaction and ... the Birmingham prosecutor's reaction.
Anyways ... I am so disappointed in the Peruvian Supreme Courts ruling. my heart breaks for Beth. The emotional roller coaster of hope and dispair must be h---.

Joran Van Der Sloot’s Lawyer Says U.S. Extradition Inevitable
ABC News’ Joe Goldman in Lima, Peru, reports:
The extradition of Joran van der Sloot to the U.S. on charges of wire fraud and extortion in connection with the death of Natalee Holloway will likely take place this summer, his lawyer told ABC News today.
“The power of the United States will assure that Joran has to face a U.S. judge and I think the extradition will happen probably in two or three months,” Maximo Altez said in an exclusve interview with ABC News.

Homosexual Cannibal" would only get 25 years in Canada for his crimes -- that's less than Peru gave Joran!! Go figure.

Court systems in other countries all interpret things differently -- not because of corruption, but because they are just plain different. We don't have to like it. I just read that the "
Canadian
Homosexual Cannibal" would only get 25 years in Canada for his crimes -- that's less than Peru gave Joran!! Go figure.
The scales of justice do not balance in any system if he/she who premeditatively takes a life is not legally required to forfeit his/her life. Anything less is devaluing the life of the victim. IMO

. Similarly, Freedom House 2011 reports that corruption in the judiciary remains rampant. There aren't any forces behind the scenes protecting Joran.
Joran got lucky in Aruba b/c his Daddy knew people in a corrupt society who were willing to do anything to protect their precious island and therefore their own lifestyles. Daddy is DEAD.
Joran screwed up and got caught at killing Stephany and extorting Beth. Now he has to pay for his crimes. He was convicted of the murder of Stephany and received a 28 year sentence in a Peruvian prison with horrendous living conditions.
He was indicted in the USA for his extortion of Beth and wire fraud. His extradition to the USA has been approved.
Doesn't sound to me like he has friends in high places protecting him. There is nothing to be read between the lines, no conspiracies, no requests from the Netherlands for extradition, no protection for Joran. Joran is frightened to come to the USA and miserable in Peru, as well he should be. He is just beginning his paybacks!!

Consider the truth originating from a credible source remains elusive ... speculating is where it is at. I could be wrong but I suspect that San's prediction never happened because Joran is being appeased to assure his silence?
1. According to Stephany's father ... privileges Joran has received since "day one" implies he "lives like a king" in the Peruvian lockup.
2. Rather than a life sentence ... Joran received a 28 year sentence which translates into 9 years with credit reductions for a murder beyond brutal.
3. According to Joran's attorney the Peru-Netherland prisoner exchange agreement implies Joran may qualify to serve his Peruvian sentence in the Netherlands.
4. The Peruvian Supreme Court ruled against the immediate extradition of Joran to the States to face charges pertaining to the extortion beyond cruel of Beth Holloway.

of Birmingham and I have to have faith in the FBI here. I know some of them socially, not privy to their work, but folks, believe in them. The FBI does not fool around and Natalee is "their daughter" too. Trust me they will handle this.
