In an interview Tuesday with Anderson Cooper, NeJame floated a possibility for Recksiedler’s replacement: Judge O.H. Eaton Jr., who was an Anthony analyst for WESH-Channel 2.
 
NeJame said it was a long shot, but added that Eaton is “very scholarly, very well-respected jurist. And he is a senior retired judge … He knows death cases. He knows murder cases as well as anybody probably in the state. And he’s handled the tough cases before and is not afraid of controversy. He’ll do the right thing legally. He doesn’t look for what’s popular. He looks at what’s right and follows the law.”
 
NeJame listed the three judges who could get the case in a random rotation: John Galluzzo, Kenneth Lester Jr. and Debra Nelson.
 
Rod Smith, a former Florida state attorney, told Cooper: “Judge Eaton, of course, had a great reputation. It’s somewhat unlikely in high-profile cases that they keep a senior judge. They’ll probably put it into rotation.”

Judge in the George Zimmerman second-degree murder case expected to step aside from case

(CBS) SANFORD, Fla. - Florida Judge Jessica Recksiedler, overseeing the George Zimmerman second-degree murder case is expected to step down Wednesday, reports the Sun-Sentinel.

Pictures: George Zimmerman charged with murder

Recksiedler's replacement will be someone chosen from among three remaining felony judges in Seminole County.

In a statement issued by court officials Tuesday, Recksiedler will decide what to do no later than Friday. However, that decision should be made clear Wednesday, when the judge is expected to sign an order taking herself off the case.

Ken Lester named new judge in Zimmerman murder case

SANFORD – The new judge in the George Zimmerman murder case will be Circuit Judge Kenneth Lester Jr., who's been on the bench 15 years.

The case passed to him today, but not before things got a bit complicated.

It was originally assigned to Circuit Judge Jessica Recksiedler, but she recused herself today after Zimmerman's attorney asked her to step aside because of a possible conflict of interest: Her husband is the law partner of Mark NeJame, who's been hired to comment on the case for CNN.

All criminal cases in Seminole County are assigned by chance, based on a rotation system. Next up in that rotation was Circuit Judge John Galluzzo. He, though, could not accept the case because he formerly practiced law with Zimmerman's attorney, Mark O'Mara.

O'Mara is also the godfather of one of Galluzzo's four children.

So Galluzzo stepped aside, passing the case to the next judge in the rotation: Lester.

He has already made plans to preside at Zimmerman's bond hearing. It'll start at 9 a.m. Friday and be in Recksiedler's courtroom, 5D at the Seminole Criminal Justice Center.

The judge in the Trayvon Martin murder case recused herself Wednesday because her husband’s law partner has been hired to comment on the trial by CNN.

Circuit Judge Jessica Recksiedler had been expected to bow out.

The next judge in the roster, Judge John Galluzzo, then declined to take the case against George Zimmerman because of his own conflict of interest: He used to practice law with Zimmerman’s attorney, Mark O’Mara.

O’Mara is also the godfather of one of Galluzzo’s children.

The case — sure to be a media sensation if it goes to trial — then fell to Judge Kenneth Lester, Jr.

Lester, 58, who has a reputation for keeping things moving and doling out tough sentences, will preside over Zimmerman’s bond hearing slated for Friday.

A friend of Zimmerman’s told the Daily News that Zimmerman has graphic photos he took of his own face showing serious injuries.

“He was beaten to a bloody pulp that night, and he’s lucky to be alive. There’s proof of that,” the friend of Zimmerman said.

“He took the pictures himself...to protect himself. He knew they would come back for him. He had a good idea this wasn’t over. He’s not a dumb man.”

The friend said the national media wrongly portrayed Trayvon as the victim and Zimmerman the aggressor — and the photos would reveal the truth.

“You (the media) are going to feel pretty stupid when you see them,” he said. “Soon enough everyone will see the damage this kid did to his head. A lot of people are going to have egg on their faces.

“Once the judge gets a look at these pictures he will dismiss this case and all you can crawl back into your holes,” he told a News reporter.

Interesting that GZ took photos of himself.  That was smart, but I wonder how well they will hold up in court, unless they are poloroids, even then.....

The medical records taken at the scene by EMS are going to be a key piece of evidence.  I hope they measured or approximated the size and carefully detailed the extent of the injuries.  Of course the bruising takes time to develop.

I'm glad the media fervor is starting to die down. But what upsets me, is the release of all the information the MSM media had to have withheld, ie: that neighbors saw GZ with bandages and injuries, the existence of the photos documenting injuries, etc.

It's obvious to me, at least, that MSM, wanted to make GZ look guilty of a racial hate crime. Just think of all the sensational media coverage that could come out of a race riot or another killing in this case.

It makes me sick!  I think we should hold the media accountable, and ask for a federal investigation into this practice of journalism.

Didn't Richard Jewell eventually sue and win his case against the Atlanta newspaper?

If the photos are digital they should have embedded data on there about when they were taken and where.  It will be interesting to find out.

Who knows if GZ took the photos after inflicting injuries to himself because he knew that he was gonna be in some trouble...wouldn't the police have taken pictures of GZ's injuries? If not, why not? No visible injuries at that time?
Just throwing that out there as I have no idea at this point what really happened that night..

I will be anxious to see the photos and other details from  GZ's side of the events

The best case on the photos would be if they were documented and photographed by a second party, preferably medical personnel. Hopefully, GZ had someone help with the photos b/c of the location on the back of the head.

Supposedly,the EMS would have records documenting the extent of the cuts and injuries visible immediately after the shooting. It takes hours for the blood flow to show up as black & blue marks.

The problem with taking one's own photos, is that one can apply makeup to enhance the extent of the injuries, and also that photos can be digitally altered.

I guess we'll have to wait and see what happens at trial. Very interesting.

Last December, George Zimmerman hosted a small gathering at a clubhouse in Lake Mary, Florida. He invited family members and some close friends, and he made a brief speech. He wanted to share with them, he said, the news that he’d earned his associates degree in criminal justice.
 

“He gathered us all together,” said a family friend who lives near Zimmerman’s parents and was present at the clubhouse that night, “to thank us for helping us define his life and what path he was going to take and who he was.”
 

The friend, who asked not to be identified, told The Daily Beast that he and his wife pulled Zimmerman aside afterward and asked him about his career: What did he want to do with his life? Zimmerman responded that he had a specific goal. First, he would go to law school. After that, the friend said, “his ambition was to be a judge.”
 

Now, Zimmerman is wearing a gray prison jumpsuit instead of black robes, as he faces second-degree murder charges in the Feb. 26 shooting of Trayvon Martin, an unarmed black teenager who was walking home through the housing complex where Zimmerman served as a neighborhood-watch captain.
 

As the legal case against Zimmerman begins to grind forward, The Daily Beast has learned new details about Zimmerman’s accounts to various police agencies in the moments and days after the shooting. A law-enforcement source familiar with Zimmerman’s account, but not directly involved in the case, said that in his statement to police, he said Martin’s final words after being shot were, “Okay, you got it.”
 
Locals in Sanford, the Orlando suburb where the shooting took place, and in nearby Lake Mary, where Zimmerman’s parents lived, appear to be exhaling after a month of national controversy and protests. “I hope and pray everything quiets down and we let the system do justice,” said Patricia Howard, a neighbor of Zimmerman’s parents.   ::snipping2::

The law-enforcement source familiar with the case, who told The Daily Beast that he personally believes Zimmerman’s account, said Zimmerman has told three different law enforcement agencies his version of the events: the Sanford Police Department, the Florida Department of Law Enforcement, and the U.S. Department of Justice. The source said Zimmerman has not talked about the case directly with the office of special prosecutor Angela Corey, which filed the murder charges against him on Apr. 11. Will George Zimmerman get bond? Local lawyers say it's likely

A 9 a.m. bond hearing before Judge Kenneth Lester Jr. could offer more drama in the racially charged case, potentially including never-before-seen-or-heard evidence against Zimmerman, who faces a second-degree-murder charge in the Feb. 26 shooting death of 17-year-old Trayvon Martin.

Will Zimmerman be allowed to bond out? Several local defense lawyers told the Sentinel they fully expect he will be given the opportunity to await trial outside a jail cell.

"Generally, it's a constitutional right to get out on pretrial release of some type," said David Fussell of the Fussell Law Firm. Denying bond in this case, he said, "would not be consistent with the law."

The public "should expect him to get a bond," added Andrew Moses of Moses & Rooth.

The bar for denying bond is high, as criminal defendants have a basic right to reasonable bail. However, a few factors could play into Lester's decision.

For one, is Zimmerman a flight risk? Mark O'Mara, Zimmerman's attorney, will likely argue his client hasn't failed to appear for court before and has "ties to the community," Moses said. "He's got family here."

On Thursday, court administrators said members of Zimmerman's family will testify by phone.

Also in Zimmerman's favor is his behavior, Fussell said. When charges were announced, "he turned himself in," Fussell said, and before that, "he stayed in touch with law enforcement."

Is he a danger to the community? Zimmerman has only one known arrest, when he was accused of shoving a law-enforcement officer outside a bar near the University of Central Florida in 2005. Fussell said the danger standard best applies to defendants accused of repeated criminal acts — a serial rapist, for example — or prone to sudden, unprovoked or random acts of violence.

Because the charge Zimmerman faces carries a possible life sentence, there is a third standard the state could argue, known as "proof evident, presumption great."

It's a higher standard than "beyond a reasonable doubt," the burden necessary for a criminal conviction.

"It's not an absolute certainty, but it's just short of that," Fussell said.

Meeting that standard would require strong evidence. According to Lyle Mazin of Mazin Law, Special Prosecutor Angela Corey would have to reveal more specific details of the state's case against Zimmerman than have been made public.

That could include "videos, photos, witnesses' statements, confessions or any other admissible evidence the state has," Mazin said.

The state could also agree to Zimmerman's release on bond and negotiate terms with the defense, Mazin said. If that doesn't happen, Lester would lay out any release terms.

He could order GPS monitoring, home confinement or drug testing, for example. He likely would order Zimmerman to surrender any firearms he owns, as well as his passport. The gun he used in the shooting has already been confiscated as evidence.

Legal experts say setting a bond amount is a balancing act, aimed at choosing a figure the defendant can afford but which also reflects the severity of the charge.

"A bond needs to be … reasonable for the unique defendant," Mazin says. As Moses explained, bond is meant to ensure a defendant shows up for court, "not to punish."

ABC News: Photo taken after Trayvon Martin shooting shows bloody George Zimmerman

SEMINOLE COUNTY, Fla. —


ABC News exclusively obtained a graphic photograph of George Zimmerman’s head covered in blood that was taken just three minutes after the shooting that left 17-year-old Trayvon Martin dead.

The picture  shows two cuts on the back of Zimmerman's head with blood trickling down.

Zimmerman, who shot and killed 17-year-old Martin on February 26 in a gated Sanford community, claimed he killed Martin in self-defense. Zimmerman is charged with second-degree murder for the shooting death of Martin.

The photograph appears to be the first publicly disclosed piece of evidence that could help support Zimmerman’s claim of self-defense. Sources tell ABC News that investigators have seen the photograph and are aware of the photographer’s story.

The person who took the photograph told ABC News he heard Martin and Zimmerman fighting before the shooting and that after Martin was killed,  Zimmerman asked the photographer to call Zimmerman’s wife, allegedly blurting out, “Man, just tell her I shot someone.”

GPS and other data embedded in the photo shows it was taken at the scene with an iPhone just three minutes after the shooting, according to ABC News.

ABC News said the photographer said gunpowder marks were clearly visible on Martin’s hooded sweatshirt.

Zimmerman was treated at the scene, then transferred to the police station, where his wounds appear to be less visible in surveillance video.  ::snipping2::

Florida officials prepare for backlash if Zimmerman released on bail

SANFORD, Fla. -- Florida officials were preparing for a possible backlash today if fatal shooter George Zimmerman walks free from a bond hearing.
 
Barricades were placed outside Seminole County Courthouse in Sanford ahead of today's hearing. An Emergency Operations Center was on standby and a SWAT team will be placed on alert.
 
"We are prepared for all the contingencies," Sanford city manager Norton Bonaparte told myFOXorlando.com.
 
Zimmerman's attorney took extra steps to keep the shooter's relatives safe. Mark O'Mara asked a judge Thursday to keep phone numbers of family members private. They planned to testify by telephone to support Zimmerman.
 
O'Mara added, "[There is] a lot of built-up emotion, there have been threats and concerns."
 
He said his client had a good chance of bonding out of jail, as long as it was a reasonable amount of money.
 
He said, "He's very worried about the process, but we have built a trust relationship which is great, and he's hopeful he'll be out on bond tomorrow [Friday]. He certainly wants to be back with his family and safe."
 
The family of Trayvon Martin, who was fatally shot in Sanford in February, planned to testify at the hearing

The family of Trayvon Martin on Friday will sit in the same courtroom as George Zimmerman for the first time but will not meet with the neighborhood watch leader who shot and killed their son.

Benjamin Crump said the Martin family is attending the hearing at the request of special prosecutor Angela Corey. Crump said the family is bracing themselves to be the same room with Zimmerman and hopes bond is not issued.

Zimmerman's attorney, Mark O'Mara, said Zimmerman would like to meet with the Martin family.

"There's no reason not to have a conversation," O'Mara said Thursday. "It should be personal, it should be private."

Crump said the Martin family has considered Zimmerman's proposal but won't meet with him.

"The meeting is not appropriate right now," Crump said. "We think that it's self-serving, right now, to say, 'I want to apologize the day before my bond hearing.'"  ::snipping2::

George Zimmerman, the neighborhood watch volunteer charged with killing 17-year-old Trayvon Martin, appeared in court today to ask to be freed from jail on bond until his trial for second-degree murder.

Update at 9:17 a.m. ET: Zimmerman's wife Shelley, says the family has discussed how to "scrape up" enough money for bail, if it is granted.

Update at 9:10 a.m. ET: Zimmerman's family gives testimony by phone, beginning with his wife.
