George Zimmerman: Attorney may not use Stand Your Ground defense
By Scott McDonnell, Reporter
Last Updated: Thursday, April 26, 2012 @ 07:05PM

ORLANDO --
The Stand Your Ground Statute.

It's a law that has been brought front and center through the Trayvon Martin case.

But George Zimmerman's attorney says he hasn't decided whether or not he will use the Stand your ground defense.

"It's really too early to say until we see the facts, once we see the evidence, and we can come up with an idea as to what defense applies to it. Stand your ground, traditional self defense, We just don't know yet," said Mark O'Mara.
 ::snipping2::
"It's already brought it to the forefront, and there has already been those conversations and discussions, I don't know yet if it applies to my case because the facts who have to support, there would have to have been an opportunity under that statute," said O'Mara.
 ::snipping2::
Elizabeth Megale, legal Expert and Professor at the Barry University School of Law says it's possible Zimmerman's case may never see a trial if the Stand Your Ground defense statute is applied.

Zimmerman's attorney would have to file a motion to dismiss the charges using the Stand Your Ground defense.

"At that hearing Mr. Zimmerman would have to establish by a preponderance of the evidence, which is a relatively low legal standard that he was in reasonable fear for his life," said Megale.

Megale says any number of items could be used as evidence at that hearing, like 911 calls, witnesses, even George Zimmerman himself.

"At that time if the court is satisfied that he was in reasonable fear and grant immunity at that time the case may never see a jury," said Megale.

Teen Charged With Hate Crime, Says He Was Mad About Trayvon Martin
April 26, 2012 6:32 AM

OAK PARK, Ill. (CBS) — A teen charged with a hate crime in Oak Park says he attacked and beat up his victim because he was angry about the Trayvon Martin case.

Alton Hayes III, 18, of Oak Park, is charged with attempted robbery and aggravated battery. He is also charged with a hate crime.

Hayes and his 15-year-old alleged accomplice are African-American, while the victim is white.

The Oak Park-River Forest Patch reports around 1 a.m. April 17, Hayes and the Chicago boy walked up behind the 19-year-old victim in the 1600 block of North Kenilworth Avenue in Oak Park.

Police say Hayes and his accomplice and pinned the victim’s arms to his side, police said. Hayes then picked up a large tree branch, pointed it at the man and said, “Empty your pockets, white boy,” police said.

The two allegedly rifled through the victim’s pockets, then threw him to the ground and punched him “numerous times” in the head and back before running away, police said.

George Zimmerman Bail Reverses All Hard Work Done for Trayvon Martin

What do you do when your municipality is holding arguably the most-hated and notorious killer on earth?  You grant him bail. That's exactly what Judge Kenneth Lester did for George Zimmerman, the man who killed 17-year-old Trayvon Martin.

As a condition of his bail, Zimmerman is not allowed to have possession of firearms, drink alcohol, or use drugs.  He must also maintain a curfew.  How nice.

If the city of Sanford wanted to embarrass itself any further, it just did.

The justice system that has obtained international prominence as one of the most inept, irresponsible, racist and unprofessional organizations in the country has set a new standard for judicial indecency.  The family of Trayvon Martin worked hard to get Zimmerman arrested because he was a flight risk, now he's a flight risk all over again.

Granting bail for George Zimmerman, for the most part, is a slap in the face to those around the world who worked for his arrest.  It simply says that without regard to the will of the people, those possessing the power of the state have no obligation to answer to anyone or even share whatever information they are using to come to their illogical decisions.

Granting bail to Zimmerman renders all the rallies, petitions and hard work done around the world to bring him to justice meaningless.  It effectively communicates defiance within the Sanford judicial system to say, "We don't care what you think.  We're going to do whatever we choose to do."  ::snipping2::

George Zimmerman turned himself in.  Bail is not considered punitive, but an assurance he will return for the trial.

Several celebrities are expected, including Stevie Wonder, Chaka Kahn, David Banner, Paul Rodriguez, radio host Big Boy and Magic Johnson.   ::snipping2::

A rally? Really? Why? To incite more unrest and division?
GZ was arrested as he should probably have been , as the family wanted..now we wait for all the facts to come in and we have a trial..what the family wanted..isn't it? Or is it?

IMO, they've had a taste of the spotlight and like it.

Absolutely...why is there a need for a civil rights rally...really?  Where is the racism?  Oh that's right...it's them.

Judge delays decision on Zimmerman contributions
April 27, 2012 -- Updated 1433 GMT (2233 HKT)

CNN) -- George Zimmerman, the neighborhood watch volunteer accused of wrongly killing Trayvon Martin, will not immediately have to turn over donations to his website, a Florida judge said Friday.

Zimmerman collected about $204,000 in donations through the website, but did not disclose the contributions during his bond hearing last week, according to Zimmerman's attorney, Mark O'Mara.

Assistant State Attorney Bernie de la Rionda asked Judge Kenneth Lester Jr. to increase Zimmerman's $150,000 bond. But the judge said he would delay ruling on the request, in part because he does not know if he has the authority to do so.

Lester said he is also concerned about revealing the names of donors.

"I'm not going to make a snap decision," Lester said.

Trayvon Martin Case: Judge considers adjusting George Zimmerman's bond amid $200K donation disclosure

 ::snipping2::
Of the donated money, O'Mara estimated that only about $5,000 was used from the website account to help pay for Zimmerman's bail.

Prosecutors requested that the judge revoke Zimmerman's bail for not disclosing how much money he had at the original bond hearing.

Martin's family attorney, Benjamin Crump, calls news that Zimmerman has raised about $200,000 on a website "a bombshell."

Crump said Martin's parents, Tracy Martin and Sybrina Fulton, were "offended" that Zimmerman failed to inform the court of the money.

Friday's hearing was initially scheduled to deal with several media organizations, including The Associated Press, asking the judge to unseal documents from Zimmerman's court file.

Lester said during the hearing that the media can file motions for release of certain evidence, but the issues of security will remain secret to the media. O'Mara told the judge he was worried about witness testimony being made public. Prosecutors argued that the 911 tapes should not have been made public.

Also during Friday's hearing, Lester also denied a gag order requested against O'Mara.

Think six figures: a little over $200,000. Speaking with CNN’s Anderson Cooper,

Statement From Mark O'Mara Regarding the Funds Raised by George Zimmerman's Website

I want to take a moment to clear up some of the confusion regarding the monies raised on Mr. Zimmerman’s website. My understanding is that there were three web sites which had PayPal accounts attached to them. One or two of them were run by friends of Mr. Zimmerman, and then there was the web site therealgeorgezimmerman.com , which George administered. Two accounts seem to have very little money in them, though I have not seen any records on those as they are not being administered by my client. Mr. Zimmerman’s former website and the PayPal attached to it raised approximately $200,000.00 over the period of time that it was up and running. Mr. Zimmerman was using this money, as mentioned on his website, for his ongoing living expenses and other necessary expenses based upon the charge and eventual arrest.

As I was ending any Internet presence George had, we removed any Facebook accounts, Twitter accounts and websites. As we shut down the web site entitled therealgeorgezimmerman.com my client asked what we should do about the outstanding fee monies in the PayPal account or that had been taken out of the PayPal account since its inception. George immediately gathered the funds that were in either his or his wife’s account, or the PayPal account, and has forwarded those funds to me presently. We are still awaiting a check from the PayPal company which takes several days.

I am also accomplishing a review of all of the monies in and expenses paid out of those accounts, so I will have that information by next week.

The large amount of money that has been raised to date for George’s defense, I believe, is a testament to the support for George as he goes through this most difficult time. Though the concept of a legal defense fund is quite unique, it serves a very valid purpose and gives an opportunity for people to show their support to Mr. Zimmerman.

George Zimmerman did not reveal he was sitting on $204,000.00 at the time of the bond hearing?

He's despicable and a liar.  I'm sorry... I think this guy is a lowlife.

Really, who chases after a person you know to be a teenager while you're armed when you've been told not to?

A lowlife.

DISGUSTING. yet we wouldn't be able to organize a march or protest or civil rights rally about this without being labeled racists.  I'm sick of the double standards.

A violent POS looking for a reason to express his inner rage and darkness and the Trayvon Martin case becomes the excuse.  If it wasn't Trayvon's case it would have been something else.

This attack should be a hate crime, though, based on the fact that the offender stated it was race based.

Anyone can commit a race based hate crime, not just white folk.

Questions remain about $200,000 in Zimmerman's PayPal accounts

They tried to portray themselves as indigent that they did not have any money," Trayvon family attorney Benjamin Crump told CNN.

Zimmerman's attorney, Mark O'Mara, said he has taken control of the money and was not aware of the donations during the April 20 bond hearing.

About $5,000 of the donor money was used to post Zimmerman's bond, O'Mara said.

At the bond hearing, Zimmerman had access to the funds and heard his wife say they had no savings.

O'Mara said he believed it was an oversight — not intentional deception — that his client didn't disclose the money during the bond hearing.

O'Mara said he found out about the money four days after the bond hearing when he asked his client to shut down his website. Zimmerman then asked him then what to do with all the PayPal donations.

O'Mara said there was about $150,000 left when he took control. The family also used the money on living expenses and on setting up somewhere secure for him to stay.

O'Mara said he did not foresee the judge increasing his client's bond because of the donations.

"150,000 dollars is a high bond," he said.

He said there was not one or two huge Internet donors but many people, some who gave hundreds of dollars.

He said he'd do everything in his power to keep their names private, including possibly risking a contempt ruling by keeping them secret if the judge orders him or Special Prosecutor Angela Corey to release them.

The money has since been deposited in trust accounts managed exclusively by O'Mara, he told Circuit Court Judge Kenneth Lester, Jr.

O'Mara asked the judge if he could disclose a donor list and information about who had authority over the accounts in a private meeting to avoid publicly exposing contributors to "ridicule and danger."   ::snipping2::
