PORTLAND, Ore. – A judge has delayed the civil suit filed by Kyron Horman’s mother, Desiree Young, against the boy’s step-mother, Terri Horman.

Judge Henry Kantor made the ruling last week following a request from Multnomah County District Attorney Michael Shrunk.

Shrunk wrote in his request that information from the civil case could jeopardize their ongoing investigation into Kyron’s disappearance.

In requesting that the civil case be put on hold and the related documents be sealed, Shrunk argued that the moves were “in the best interest of justice” and will “preserve the integrity of the investigation and promote the safety of the witnesses involved.”

At a news conference on the steps of the Multnomah County Justice Center, an emotional Desiree Young said that going forward with the lawsuit would interfere with the criminal investigation, something she was not willing to do.

"In order for my lawyers to move forward with the case at this point, it would be necessary for them to seek access to the police criminal investigation files," Young said. "My lawyers have advised me that the Oregon Public Records Disclosure Law does not provide the release of ongoing police investigation files."

PORTLAND – A judge in the civil lawsuit of missing Portland boy Kyron Horman has issued his decision not to grant a stay in the civil case, and laid out rules for attorneys to gather evidence.

Last week, a judge denied the motion by Kyron's stepmother Terri Horman to delay the civil lawsuit filed against her by the boy's mother Desiree Young.

Judge Henry Kantor referred to her as a “prime suspect” in the investigation, although Terri Horman has never been formally named a suspect in any criminal case.

THE 3 1/2 YEAR INVESTIGATIVE HOLD UP

Could it be that that the silent Kyron Horman investigation is far reaching as well as layered?

Could it be that investigators are not only focused on Terri but a small chain of participants?

Could it be that one link in the small chain of participants has a "safe haven" connection outside the borders of the United States?

Could it be that the "safe haven" link in the small chain of participants may be the smoking gun that will allow investigators to bring Kyron home?  That is my prayer.

On June 28, 2013 a restraining order preventing Terry access to her daughter was served and she was also being forced out of her home but ... Terry's attorneys did not challenge.  Why?

When all is said and done ... does Stephen Houze and Peter Bunch REALLY want to depose investigator Bobby O'Donnell in regards the "probable" cause to believe the allegations that Terri was involved in Kyron's disappearance as well as a MFH attempt against Kaine ... the allegations that formed the foundation of the restraining order?

Also could it be that Stephen Houze is also bluffing when he states that he wants to depose Rudy Sanchez in regards to what was gleaned by LE during the recorded sting?

Could it be that over three years later in June, 2013 Terri's attorneys finally made the decision to challenge the restraining order by taking full advantage of Don Rees' refusal to compromise the ongoing investigations in the releasing of investigative documents that could implicate their client in wrongdoing?

Think about it.  The judge ruled on September 17, 2013 in favour of the motions filed by Terri's attorneys ... the motions requesting permission to depose Skyline faculty as well as staff of designated businesses.  As it currently appears these depositions have yet to happen.  Could it be that Stephen Houze was bluffing when he asserted that the questioning of these alleged witnesses would further his claim that Terri was not the last known person to be seen with Kyron?  Could it be that Don Rees called his bluff because investigators were aware that NOTHING these alleged witness revealed would further the defence of Terri?

Terri Horman agrees to leave house

PORTLAND --  Kyron's stepmother Terri Moulton Horman will not challenge a request to move out of the former family home, a letter from her lawyer read Monday.

The boy's father Kaine Horman had added a clause to a restraining order that she leave the home last week. A July 22 scheduled hearing in the case was cancelled, according to the court.

Could it be that Bunch and Houze believed that the depositions of employees from the establishments that their client entered on the morning of June 4, 2010 WITHOUT Kyron would somehow affirm that he had been left at the school as Terri claimed?  One problem!  The owner of Magic Cleaners stated to media that not only was Kyron not with Terri ... neither was Kiara.  Terri was alone!!  Where was Kiara?  Who was watching Kiara?

Somehow I doubt that a deposition from Sari Shanti ... the owner of Magic Cleaners ... will be forthcoming.

PORTLAND -- Terri Moulton Horman's divorce attorneys will not be allowed to interview a lead investigator in the disappearance of her stepson, Kyron Horman, and the alleged murder-for-hire plot against her husband, Kaine Horman, a judge announced Monday.

Investigators said for years that Terri Horman was the last person to see Kyron before he disappeared from Skyline Elementary in July, 2010. But her attorneys said Friday that was not the case.

Judge Kantor Monday granted a motion filed by Kaine Horman's attorneys to stop Terri Horman's attorneys from questioning deputy O'Donnell.

However, Terri Horman's attorneys can conduct their own investigation. They will be allowed to interview witnesses, including teachers at Skyline Elementary and employees of Fred Meyer, Magic Cleaners and 24-hour Fitness. They will not be allowed to question Skyline students.

Angela Leckey testified that she had an encounter with Terri and Kiara at the Walker Rd Fred Meyer.  Sari Shanti ... owner of Magic Cleaners ... states to media that Terri was in her establishment alone on the morning of June 4, 2010.

There’s a disconnect between Mr. Bunch’s argument that Ms. Horman cannot defend herself because she would incriminate herself in the disappearance of her stepson, and his statement that “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.”

The apparent logic is that Ms. Horman admits that if she speaks, she will incriminate herself in some as-yet-to-be-named crime related to Kyron’s disappearance, yet Mr. Horman is now supposed to trust her to care for his other child, because that’s so obviously in their daughter’s best interest.

Staton said there had been "significant movements" in the 15-week investigation and there was a more defined scope, allowing them to not be as broad in their efforts. Investigators can now concentrate on their current course to support a theory of what happened to the boy. He said he had seen no evidence that indicated Kyron was not alive.

When asked if people would be shocked to find out what they know, Staton took a long silence.

"I know I'm taking a long pause on that, I have to think through that answer. I think there are things that come out of this investigation that will surprise you, that you'll think about later on when it's over.
