Is Stephen Houze no longer representing Terri Horman in the custody dispute?  The recent January 23, 2014 sixteen page document/brief was submitted with only Peter Bunch's signature.  Think about it.  Houze was very much involved in December, 2013 when the brief was requested by the Judge.

Could it be that the defence of Jeffrey Brian Johnson has become Houze' primary focus?

If the scheduled February 10, 2014 custody hearing is not postponed ... my questions regarding Houze will be answered.

Compare the signature/last page of the above January 23, 2014 filing by Terri's attorney Peter Bunch and then compare the signature/last page of an October 10, 2010 filing contesting the RO ... an October 10, 2010 filing that reveals signatures of BOTH Stephen Houze and Peter Bunch.

Could the implication be that something is up that will negate a ruling in the upcoming February 10, 2014 custody hearing?  Could it be that indictments in the Kyron Horman case and/or the MFH case are forthcoming?

Terri Horman's lawyers continue to press court to allow further questioning of landscaper

Terri Moulton Horman's lawyers argue in court papers that their client would be unfairly prejudiced in her pending child custody case if they cannot further question her former landscaper about his involvement with law enforcement.

"There can be no more important decision for the court to make regarding custody and parenting time in this case than its decision regarding the scope of the (landscaper's) testimony and the circumstances surrounding his involvement with law enforcement,'' attorney Peter Bunch wrote in a legal brief filed Thursday in Multnomah County Circuit Court.

Multnomah County Judge Henry Kantor ruled that Kaine Horman's lawyer can call the landscaper, Rodolfo Sanchez, as a witness to testify about the alleged murder-for-hire plot in the custody case, but that Terri Horman's lawyers can't cross-examine Sanchez about his communications with investigators. The judge said those details are protected by "law enforcement privilege.''

But the judge has invited each side to submit legal briefs to guide him on how he should use Sanchez's testimony for the custody case. Kaine Horman's response is due by Feb. 10 and oral argument is set for Feb. 12 at 9 a.m.

Offices run by the state of Oregon will remain closed today in the Portland metro area, including Wilsonville, and in Columbia County, officials have announced.

State offices are open in the Salem metro area and are operating on normal hours. The state Capitol in Salem is also open normal hours. The Legislature will be in session, though with some schedule changes.

Wednesday, June 30, 2010 is the day when the sexting/texting between Terri Horman and Michael Cook began ... the day that ... according to his own words to media ... Michael had spoken to Kaine.

Could it be that the "communication" between Terri and Michael had everything to do with Kaine and/or LE attempting to gain evidence in the Kyron Horman case and/or the MFH case.

The 100's of texts may or may not have revealed anything concrete in regards to the disappearance of Kyron but it did provide a wide open window into the character of a woman with a mindset that the majority could never comprehend.

Think about it.  On June 30th when the sexting/texting began ... Kyron had been missing for less than a month.  Kiara had been taken from the home by Kaine four days previous on June 26th.  A restraining order had been served two days previous on June 28th denying Terri contact with her daughter.

He parked among the 10 or so news vehicles hugging the shoulder on Sheltered Nook Road, dropped off a cooler filled with beverages -- an olive branch to the cameramen and reporters -- then drove up to the home and dropped off 12-packs of Coca-Cola and 7-Up, bottles of Arrowhead water, Hefty kitchen garbage bags, Quaker Chewy granola bars and catfood.

He declined to talk about the mood inside the home, saying he feared his words would be twisted.

When I put myself in Desiree and Kaine's place my heart breaks for them.  For over 3 1/2 years Kyron's parents been forced to face each day not knowing if their precious son is deceased, safe or at risk.  It must be h---.

There is unconfirmed chatter that another search is planned for tomorrow.

It makes sense that Desiree would not be doing what she feels led to do in her almost four year desperate search for answers without receiving the green light from LE.  Think about the dropping of the civil lawsuit she had filed again Terri.  In other words ... Desiree would do NOTHING that investigators believed would compromise the case involving her missing son.

At a news conference on the steps of the Multnomah County Justice Center, an emotional Desiree Young said that going forward with the lawsuit would interfere with the criminal investigation, something she was not willing to do.

“In order for my lawyers to move forward with the case at this point, it would be necessary for them to seek access to the police criminal investigation files,” Young said. “My lawyers have advised me that the Oregon Public Records Disclosure Law does not provide the release of ongoing police investigation files.”

“I don’t want anything to compromise the ongoing investigation for Kyron,” Young said Tuesday. “For these reasons, I have instructed my attorneys to dismiss the civil case.”

Young’s attorney Elden Rosenthal told reporters that the DA’s office did not pressure her to drop the lawsuit, but did say that “they do not wish” to release the files.

Chuck Cox said it’s clearer than ever, in his mind, that Powell was responsible for the disappearance of Susan Cox Powell – the Coxes' daughter and Powell’s wife – in Utah two years ago. He said he thought Powell was feeling pressure from the investigation into his wife’s disappearance, in which police had called Powell a person of interest.
 
“He was going to lose in his way,” Chuck Cox said. “It was cowardly.”
 
Cox said he warned police, social workers, lawyers and anyone else who would listen that he felt Powell might try something desperate.
 
“We felt that if he – Josh – felt that there was no hope -- that he was losing, or was gonna end up in jail or something – that he would do something very desperate and could possibly harm the children or take them with him in a murder-suicide thing,” Cox said. “Well, there you go.”
 
Powell, despite being the only person of interest in the case, had refused to cooperate with detectives. For that reason and many others, Chuck Cox said he thinks the deaths of his grandsons could have, and should have, been avoided.
 
“There were too many warning signs that were known, but due to legal limitations, were unable to be acted upon,” he said. “So we ended up where we ended up.”

Judge Henry Kantor referred to her as a “prime suspect” in the investigation, although Terri Horman has never been formally named a suspect in any criminal case.

Think about it.  Terri expresses her hatred of Kyron in emails and then Kyron goes missing.

I cannot comprehend why anyone could fault Kaine in regards to his 3 1/2 year quest to prevent Terri from contact with Kiara.  Who would not do likewise if he/she were in Kaine's place.

Could it be that these emails will be released to the judge for consideration in the rescheduled February 14th custody dispute?

Don Rees is between a legal rock and a legal hard place.  The compromising of the Kyron Horman investigation?  The well-being of a little girl named Kiara?

I have full confidence that God will reveal all and then we will be able to bring Kyron home. He is not ready for us to know everything yet, but soon he will. We must learn from all that is going on as hard as it is, God teaches us through the hard times in our lives. And man is this one of those hard times, the hardest ever. We must honor Kyron by doing something good with it and that is what I intend to do. Thank you all for your support and thoughts.

I have full confidence in the truth and in God, he will reveal all that I know and all that the police know when he feels it is time for everyone to see and when he can bring my Kyron home. That is when people will see the true Terri Horman and you will be disappointed and sickened to point of throwing up. No one person should ever harm another especially a child that can’t defend themselves. Children and my Kyron only ask for one thing in life and that is to be loved and protected.

It appears that investigative documentations that would reveal that Kiara would be at risk if Terri was afforded any custody will understandably not be released by LE.

It is my prayer that the deposition of Rudy Sanchez ... the deposition encompassing the attempted MFH plot restaurant meeting will convince the judge that Kaine's concerns regarding Kiara's well-being are not without substance.

Also ... the sexual content of June 30, 2010 texts between Terri and Michael Cook ... texts  that were  submitted to the court by Kaine's attorney for its consideration ... may cause the judge to ponder the mindset and lack of discretion pertaining to the woman who is seeking contact with her daughter.  Think about it.  The only objection that Terri's attorney stated in his filing was that the texts were meant to be private.

Considering the deposition of Rudy Sanchez is crucial in furthering Kaine's contention that Terri should not have contact with Kiara ... I contend that the following statement by Don Rees and Carlos J. Calandriello appear to be influencing the judge's ruling in Terri's favor.  In other words ... Rees and Calandriello's "hands off" approach is not a reality.

Think about it.  Terri's failed MFH plot meeting happened five months prior to Kyron disappearance.

Could it be that Stephen Houze is not longer representing Terri Horman in the custody dispute?  It appears that copies of the latest documents were forward to only one member of the team ... Peter Bunch.  Also ... the briefing requested by the judge on December 16, 2013 was filed by only Bunch.

However ... on December 16, 2013 ... Stephen Houze was very much in the picture.

Stephen Houze said he wants to find out "the rest of the story'' and question Sanchez about his 15-minute recorded meeting with Terri Horman when Sanchez was "acting as an agent of law enforcement.''

Houze said the deposition of the landscaper by Kaine Horman's lawyer has "opened the door'' for further questioning, especially since Kaine Horman's lawyers are using Sanchez's testimony to show that Terri Horman is an extreme risk to their daughter.
 
"They hung their hat on Rudy Sanchez,'' Houze said. "We're entitled to explore his story fully.''

Houze said Terri Horman has the right to question Sanchez's credibility. He also pointed out that Sanchez's deposition was taken through an interpreter.

"Is he to be believed or not?'' Houze asked. "Did he get some kind of deal with law enforcement in order to propel him to become an agent of law enforcement?

If Terri Horman's attorneys are not allowed to question Sanchez, Houze argued that the court is left with "an incomplete and self-serving account of events.'' He also pointed out that Terri Horman has never been charged with solicitation for murder.
