An out-of-court agreement has been reach that afford Terri VERY restrictive parenting time with Kiara?  It does not make sense unless Stephen Houze was unable to back up his allegation in court that he could produce witnesses who would testify that Terri was not the last person observed at Skyline with Kyron on the morning of June 4, 2010?

Kaine Horman granted custody of 5-year-old daughter

In court documents filed Wednesday, on the fourth anniversary of Kyron's disappearance, a judge granted Kaine Horman legal and physical custody of Kiara.

According to the court documents, Terri Horman will have the opportunity to re-connect with her daughter as part of a process including individual counseling for both of them. Initial contact will be solely through the exchange of cards and letters and eventually video conferencing which can then progress to supervised visits, the judge's order states.

Terri Horman will maintain the right to inspect and receive school records, as well as medical, dental and psychological records for her daughter.

As part of Wednesday's custody decision, court documents state Kaine and Terri Horman are not to knowingly be within 150 feet of each other, unless granted by the court. Terri Horman is also not allowed within 150 feet of Kaine Horman's home, work, gym or Skyline School.

Kaine Horman will keep full custody of daughter

The judgment issued Wednesday determined that Terri Horman can initiate contact with Kiara through "the exchange of cards and letters." Terri must participate in "parent training with a knowledgeable instructor" before she can be reunited with Kiara.

Kiara must also be enrolled in counseling to address issues including the reconciliation with her mother and the status of Kyron's disappearance.

"I believe where we are today is still keeping my daughter safe, that status quo is still maintained, so I think we are doing what we need to be doing," Kaine told KGW Wednesday.

The father of a Portland boy who disappeared four years ago has settled a custody case with a former wife, the last person known to have seen the child alive.

Search for Kyron Horman still on four years later
June 4, 2010


It's been four years, and still no sign of seven-year-old Kyron Horman. The memory of the day the little boy went missing, is still fresh in his father's mind.

"I remember the day, I remember being at the bus stop, I remember driving up to the school like it was yesterday," said Kaine Horman, Kyron's father.

Kyron was last seen by his step mother, Terri Horman. She has not been labeled as a person of interest or suspect. However Kane Horman has said he believes she played a role in Kyron's disappearance. But still, four years later Kaine hasn't given up hope.

"I figured we'd have this case resolved and he would have been done and we would have moved on a long time ago. That said, we haven't and I still feel very strongly that he is alive and he is out there," said Kaine Horman.

Could it be that it was Stephen Houze who initiated negotiations regarding his client's parenting time with her daughter?

Could it be that Houze realized that he would be unable to provide witness testimony at the scheduled June 11, 2014 custody hearing ... witness testimony that would back up his claim that Terri was not the last person seen with Kyron on the morning of June 4, 2010?

Also ... could it be that Houze was unsure just how much "weight" the judge may give to the testimony of Rudy Sanchez regarding the MFH restaurant meeting?

In other words ... when contact with Kiara was in the balance "something would be better than nothing".

Kyron Horman vanished from school on June 4, 2010, after his stepmother, Terri Horman, brought him there early that day to attend a science fair. The 7-year-old boy never made it to his regular class, but he wasn't reported missing until later that afternoon when he didn't return home on the school bus.

A massive search came up empty, and no arrests have been made. Investigators have long focused on Terri Horman, although they have not named her as a suspect.

In a settlement signed Tuesday, Kaine Horman got custody of 5-year-old Kiara Horman, the daughter he had with Terri Horman.

Kaine Horman filed for divorce about a month after Kyron disappeared and obtained a restraining order that prohibited Terri Horman from having parenting time with Kiara, who was 19 months old at the time. The divorce was finalized Dec. 31, 2013.

The custody settlement made public on the fourth anniversary of Kyron's disappearance allows Terri Horman eventual visits with her daughter.

The question was asked on another forum "Why did Kaine agree to negotiate rather that let the judge rule in the June 11-13, 2014 custody hearing?"

Could it be that other than Rudy Sanchez' testimony regarding the MFH restaurant meeting .. Kaine had nothing?  The restraining order of June 28, 2010 denying Terri contact with Kiara stated that investigators had informed Kaine that there was probable cause to believe that Terri was involved in the disappearance of Kyron and an attempted MFH against him.

To avoid compromising the investigation ... Don Rees has prevented Kaine from sharing anything with the court at the scheduled custody hearing  regarding gatherings pertaining to the case encompassing his missing son.  All Kaine is left with is Rudy Sanchez' testimony ... Rudy Sanchez' testimony which the judge already warned on February 20, 2014 would be restricted and may not hold a lot of weight.

Kaine was between a legal rock and a legal hard place.  How would he convince the judge that Kiara's well-being implied that Terri was not  afforded parenting time with their daughter?

Could it be that the terms of the custody agreement that were revealed on the fourth anniversary of Kyron's disappearance ... the custody agreement that implies a time period will lapse prior to Terri having contact with Kiara ... will provide a window of opportunity for investigators to bring closure to the Kyron Horman case?

A STRATEGY?

1.  Considering the restrictive provisions of that custody agreement ... Kaine has peace of mind that Terri will not be afforded supervised visiting privileges in the foreseeable future.  Could it be that Kaine is anticipating an investigative closure to the Kyron Horman case in this period of time.

2.  Considering Rudy Sanchez' testimony was not heard in a custody dispute hearing ... could it be that it will become an investigative tool for the prosecution in the Kyron Horman case.

THE CUSTODY SETTLEMENT

In his efforts to convince the judge if Terri is afforded parenting it would not be in the best interest of Kiara ... Kaine is put in a position of compromising the investigation into the disappearance of Kyron.  In other words ... Kaine is between "rock and a hard place".

Could it be that the June 2014 custody settlement that denies Terri supervised parenting time for the immediate future also affords Kaine assurance that Kiara is safe while at the same time provides investigators a window of opportunity to bring closure to the Kyron Horman case?

1.  The Kyron Horman Investigation


In 2013 ... Don Rees made it clear in a document submitted to the court that he does not want Kaine's testimony in the custody dispute revealing any investigative gatherings that relates to the disappearance of his son.

"The fact that law enforcement has necessarily conveyed this information to Kaine Horman does not waive the longstanding and well-recognized privileged and confidential nature of information relating to a pending criminal investigation,'' Rees wrote.

Kaine Horman should be prohibited from answering any questions about law enforcement methods used to investigate his son's disappearance, physical evidence gathered, witness statements or questions asked by law enforcement, or whether he has testified before a grand jury, Rees wrote.

2.  The June 2010 Sting

In 2013 ... Don Rees also implies in a court document that the testimony of Rudy Sanchez regarding happenings encompassing the "sting" of June 2010 was related to the Kyron Homan investigation and if revealed would compromised the Kyron Horman investigation.

3.  The MFH Restaurant Meeting

In 2014 ... in a court document Don Rees appears to now have concerns about ANY testimony from Rudy Sanchez in the custody dispute.  Kaine is counting on Sanchez' testimony regarding the MFH meeting to support his efforts to prevent Terri from being afforded parenting time with Kiara.

Reynolds High School shooting: Grim day ends with anxious parents waiting in a parking lot

TROUTDALE -- One student was shot to death, a teacher injured and the shooter was dead after gunfire broke out inside Reynolds High School in Troutdale Tuesday morning, police said.

The student victim was identified as Emilio Hoffman, according to a family spokesman.  He was a student at Reynolds.  Police still have not released the name of the shooter.

The shooting started just after 8 a.m., Tuesday. Students said it sounded like fireworks inside the school and police raced to the scene.

SWAT officers quickly surrounded the campus and searched each hallway and classroom as students filed out with their hands on their heads.

Just over an hour later, police confirmed that the lone gunman was dead and the campus was "stabilized."

Teacher and track coach Todd Rispler told KGW he was grazed by a bullet on his hip, but he was not seriously hurt.

Police said the gunman was a teenager, but they have not confirmed if he was a Reynolds student.  They said he was found dead in a school bathroom and likely killed himself.

A robot with a camera used to investigate the shooting found the suspect slumped over in a bathroom stall, according to police spokesman Sgt. Carey Kaer.

Troutdale Police Chief Scott Anderson said one other person was found on campus with a gun and was arrested.

As SWAT teams continued to work their way through the school, evacuated students were bused to a nearby grocery store parking lot.

Each student was patted down by officers and then reunited with their worried parents.

Oregon high school shooting: Portland Public Schools bond rebuilds will upgrade security at three high schools

The three high schools that will be rebuilt under a $482 million bond will also get significant security upgrades, including video surveillance and a key-swipe system.

Portland Public Schools in October had already pledged to equip all of its K-8, elementary and middle school with new video camera systems by the end of the next school year. So far, the district has completed about three-fourths of those upgrades.

Roosevelt, Franklin and Grant high schools will get similar security updates with their full modernizations, but there is currently no timeline to equip all high schools with cameras.

School security has been under the microscope for years, but will only receive more scrutiny after a Reynolds High School shooting left one student and one gunman dead this morning.

In Portland Public Schools, which weathered one of the biggest abduction cases in recent years with Skyline School's Kyron Horman, security upgrades have long been in the works.

George Weatheroy, who is charge of the district's security, said officials have made it a policy to secure all perimeter doors except for the main entrances. He said the recommendation came from the Department of Homeland Security.

And when people do come into the main entrance, they must check in with the front office before continuing into the school.

"We constantly re-evaluate our practices," he said.

On the high school level, each building has at least two campus monitors. The district also has access to 12 school resource officers for the Portland Police Bureau, which they share with Parkrose and David Douglas.

But Weatheroy said technology isn't the only way to protect campuses. It's important to change the culture of security within schools, he said.

"We're asking staff and students to notice if someone comes in and they're not wearing a badge, to escort them to the office," he said.

Kyron Horman's mother pledges to never give up searching for her son on the 4th anniversary of his disappearance

Kyron Horman's mother, Desiree Young, posted a Facebook message Wednesday morning, the fourth anniversary of her son's disappearance, promising a private search for the missing boy later this month.

As I sit here in the silence of our home, my mind wanders to Kyron. I miss all of the giggles that have filled our home since he was born. The smiles that Kyron gives us are infectious and I am a different person without them to brighten my days. I need my Kyron home so that I can smile again. I miss him even more today.

I will never give up looking for Kyron, I will never stop, and I promise all of my Kyron supporters....

I will find my Kyron.

I don't want to be here in another year and certainly not in another four years either. I pray God look over us and help us have a successful search on the 20th, 21st & 22nd. I want to thank everyone who donated to help us bring in Klaas Kids to head up the search.

Now let's bring Kyron home!
