Sheriff: Slaying of South Bay girl 'purely random'


DNA found on discarded clothes belonging to Sierra LaMar linked 21-year-old Antolin Garcia-Torres to the girl's March disappearance and apparent slaying, Sheriff Laurie Smith said at a news conference.

She would not specify the nature of the DNA, but said it was not blood. The girl's body has not been found, but Smith said "direct and circumstantial evidence, including forensic evidence, have contributed to our belief that Sierra is a victim of murder."

Garcia-Torres attended Central High School in Morgan Hill and still lives in the city, Smith said. He has a misdemeanor conviction for "interfering with an officer" and a separate felony arrest for assault, for which he was not prosecuted, the sheriff said.

Garcia-Torres is believed to be linked to a 2009 assault in Morgan Hill, Smith said. She did not specify whether that was the case in which he was arrested.

Smith said investigators have not linked Garcia-Torres to two similar assaults that also took place in 2009 in Morgan Hill. Of the three assaults, one involved a Taser and another involved a knife, Smith said.

You're welcome Janet.  I wonder how he knew her or, if he didn't know her where did he see her to decide and kidnap her?  Was he just driving by?  I guess we need to look where Safeway (his place of employment is) compared to her house.  Did he drive home or to work and see her and decide to take her?  Or what?  I'm so sad for this precious girl that was taken away too soon.

Investigators must have a lot a evidence in making this arrest.  I thought maybe the suspect had confessed but ... not revealing the location of Sierra's remains implies otherwise.

DNA was found on several of the teen's belongings and was run through a state database, said Santa Clara County Sheriff Laurie Smith. That DNA was a match for Antolin Garcia Torres who had a submitted DNA during a felony arrest that had not been prosecuted, she said.

Smith also revealed that Garcia-Torres has been linked by DNA to at least one of three sexual assaults in the Morgan Hill area in March 2009.

The Santa Clara County Sheriff said Garcia-Torres was linked to the disappearance not only by his red Jetta, but also by DNA evidence found in LaMar’s abandoned backpack and other evidence found in the car.

Garcia-Torres had been arrested for a prior felony assault and while he was prosecuted, his DNA was entered into a database.

The backpack containing LaMar’s clothing carefully folded clothing and other personal items had been found in a field near the missing girl’s within 48 hours of her March 16th disappearance.

"We have evidence that leads us to believe and we have probable cause to believe that he has committed the murder and kidnapping. We are charging him with murder,” Smith said. “It's very, very difficult to come to that position where we believe that she is dead."

Smith revealed that Garcia-Torres has been under constant surveillance by law enforcement since March 28th when investigators received forensic evidence .

”We had hoped he would lead us to Sierra,” she told reporters.

Authorities also studied video surveillance video from cameras located in the area and reviewed eyewitness reports to determine that the red Jetta with a distinctive black hood owned by Garcia-Torres was in LaMar’s neighborhood at the time of the disappearance.

Deputies impounded the car on April 7th and a forensic team searched it for clues.

Suspect in murder of missing California teen has history of assault

SANTA CLARA, Calif. -- The man arrested in connection with the kidnapping and murder of California teen Sierra LaMar is linked to several previous attempted assaults, police said Tuesday.

Antolin Garcia-Torres, 21, was arrested Monday night at the grocery store in Morgan Hill -- about 70 miles (112km) south of San Francisco -- where he works.

DNA evidence on clothing found in Sierra's discarded handbag led detectives to the suspect, Santa Clara County Sheriff Laurie Smith confirmed Tuesday at a press conference.

Garcia-Torres was booked into Santa Clara County jail on one count of murder and one count of kidnapping.

Police believe 15-year-old Sierra was murdered, although her body and a murder weapon have not yet been recovered. Detectives do not know how long she was alive after she was abducted.

Smith said Garcia-Torres was linked to three attempted assaults on women in Morgan Hill in March 2009. In all three incidents, the would-be victims were able to escape.

Garcia-Torres was previously arrested on a felony assault charge that was not prosecuted and was convicted on a misdemeanor charge of interfering with a police officer, according to Smith.

I appreciate that LE wanted to keep the community safe and invested resources to do that.  We don't always see that in these cases so I feel gratitude that they saw value in it.  I also appreciate that the speaker at the news conference was honest and forthright without revealing too much.  She shared the concerns of their department and took us on the journey they've been traveling the last few months. 

Mostly I wish for this broken family to find healing.  Though Sierra's mom appears stoic, I can see that she has not allowed herself to fully take in what has happened and she's afraid of going there emotionally.  I'm praying that she and Sierra's father, sister, and stepfather are able to continue to experience life and find happiness when this nightmare is over.

May the perpetrator get exactly what he deserves.

"As I was walking to my car I felt something wasn't right," said one of the victims.

She has asked ABC7 to remain anonymous, but was willing to tell her story. Just four days ago, she ran for her life. The victim was walking to her car at around 11 p.m. in the Safeway parking lot on East Dunne Avenue in Morgan Hill, when she realized a man was chasing after her.

"I just threw myself in the car. I could just see his shadow overtaking the car and he was running. And I just slammed on the locks with my fist and right after I did that, he grabbed onto the handle and he was trying to get in. And I sped away," said the victim.

But 25 minutes later, the same man managed to get into the unlocked car of a woman parked at the Safeway on Tennant Station. Police say he hit her repeatedly in the head before Tasing her twice with a stun gun.

Luckily, a man parked nearby came to help. When he heard her screaming for help, he drove up next to her vehicle and shined his lights in the car which startled the suspect and caused him to leave.

Police have no idea what the suspect's ultimate objective was. He is believed to be in his 20s, about 5'10" tall and weighs 200 pounds.

Police notified other agencies and haven't heard of any similar stories, but they fear the suspect will strike again, which is why they want women to be on alert.

A sex offender seldom ceases with one incident.  Unless held accountabile ... esculation is where it is at.  The offender's sick perversion sentences his victims to a lifetime of an emotion h--- and ... relatively speaking ... those victims are the fortunate ones.

An international news agency is reporting Joran Van Der Sloot is a suspect in the murder of a 21 year old woman in Peru. Van Der Sloot was the prime suspect in the disappearance of Natalee Holloway in Aruba five years ago.  According to BNO News the victim in this new case is Stephany Tatiana Flores Ramirez who was found dead this morning after disappearing Friday. Her family says she was last seen leaving a casino with Van Der Sloot.

Cardoza said a pair of pants, a shirt, a bra and a pair of underwear were neatly folded inside a Juicy brand purse. It was not clear if they were the clothes Sierra put on the morning she was last seen or if they were something she brought along with her. He said they contained no forensic evidence that pointed to a crime or a person of interest in the case. They said they did not release the information earlier because they were waiting on forensic evidence analysis.

Cardoza would not confirm reports that the purse or clothing had urine on it."The specific details on the condition of the clothing - whether they were wet or had urine on them - we are holding that specific detail as confidential," Cardoza said.
