I am having trouble with the wording of a sentence.....in Klaas' post on the second page of the Felony Complaint it states, " ATG was engaged in and an ACCOMPLICE in the commission, the attempted commission..".  Is that normal wording?  Is there possibly someone else involved?


I read it the same that they are saying that he was an accomplice in the crime.  Wonder if they have to word it that way legally to leave all doors open?

I guess the perp isn't doing any talking.  I really hoped that he'd tell where Sierra was by now.  Makes me sick that this jerks have this kind of power over victims' families and LE.  It isn't right.

Prosecutors are set to return to court Thursday to try to convict a Morgan Hill man for the murder of Sierra LaMar, even though they lack a major piece of evidence - the body of the 15-year-old South Bay girl.

It won't necessarily be an easy task.

David Boyd, the Santa Clara County deputy district attorney prosecuting the case, lacks not only a body but also a murder weapon and witnesses as 21-year-old Antolin Garcia-Torres goes to court to enter a plea to charges that could bring the death penalty.

If Garcia-Torres ends up at trial, Boyd could urge a jury to convict by quoting an appellate judge's line from the Charles Manson case about hiding a body: "That is one form of success for which society has no reward."

Ok so those of you whom are meeting up to go to the court hearing for Sierra LaMar that starts at 2pm, we are meeting at Orchard Supply Hardware parking lot @720 W San Carlos St, San Jose, CA 95126. We will be caravaning from there, since they charge for parking near the courthouses!

Suspected Sierra LaMar kidnapper and killer Antolin Garcia-Torres will appear in court today, Thursday, May 31 at 2 p.m. to be formally arraigned on one count of murder with the special circumstance of kidnapping.

Garcia-Torres’ formal reading of the murder charge will take place in Department 23 at the Hall of Justice, 190 W. Hedding St. in San Jose. He could enter a plea, but it may be too soon for his attorney to decide how he'll answer to the murder charge.

The 21-year-old former Morgan Hill Safeway employee appeared briefly in court the afternoon of May 24 before Santa Clara County Superior Court Judge Jerome Nadler for what was to be his arraignment, but the proceeding was postponed due to a lack of a public defender to represent him.

On May 24, however, Santa Clara County District Attorney Jeff Rosen filed the murder charge and held a press conference outside the courthouse announcing prosecutor David Boyd would try the high-profile case that's grabbed national headlines for the past few months since Sierra vanished on March 16 on her way to catch the morning bus to Sobrato High School in Morgan Hill.

Rosen said the murder charge is eligible for the death penalty.

SAN JOSE, Calif. — The suspect in the Sierra LaMar case is expected to enter a plea when he returns to court Thursday afternoon.

21-year-old Antolin Garcia-Torres made his first court appearance one week ago. He is charged with murder and kidnapping.

The 21-year-old former Safeway clerk accused of kidnapping and killing LaMar asked the judge for a delay in his arraignment during his first court appearance.

Garcia-Torres, who is facing one count of murder and one count of kidnapping, only appeared for a few moments and his public defender asked Santa Clara Superior Court Judge Jerome Nadler to continue the case for a week.

The judge ordered him to be held without bail.

District Attorney Jeff Rosen said after the hearing that Garcia-Torres is eligible for the death penalty, but that his office hasn't yet decided whether to pursue capital punishment.

"My office and law enforcement, aided by many volunteers in this county, continue to devote all available resources to finding her body," Rosen said of 15-year-old Sierra.

"We hope that will happen soon to give her family some measure of peace," he said.

Sierra Lamar's parents say no one in the family knew Garcia-Torres,

Garcia-Torres has declined several attempts to be interviewed in jail. His mother and sister told NBC Bay Area after his arrest that he couldn't have committed the crime, and that he never knew Sierra
