That's what it sounds like to me also grace-land.  Thank you for clarification.  I was looking around the net yesterday for information on Holly Bobo's case and as happens sometimes, I came across something else, and that was the bit about Antolin Garcia-Torres.  I posted the bit on Sierra's thread so I didn't lose it and didn't get back over here.  I continue to hope and pray there will be justice for Sierra.

Holding Out Hope 2 Years After Sierra Lamar Disappeared

Sunday marks the two-year anniversary of the disappearance and suspected murder of Morgan Hill teenager Sierra Lamar, who was last seen near the bus stop near her home but whose body has never been found. And a private investigator hopes that the man suspected of taking and killing her will "find God."

Antolin Garica Torres, a 22-year-old former supermarket employee, was charged with her kidnapping and murder, and is currently in Santa Clara County Jail.

He pleaded not guilty in February.
Volunteers, such as Roger Nelson, continue to search for her body. While Nelson stopped short of saying he thought he'd find the missing 15-year-old, he did tell NBC Bay Area on Friday that he wouldn't stop trying. He continues to help because he draws strength from her family.
 
The family's private investigator, Mark Garcia of Golden State Investigations, also told NBC Bay Area that he has donations totaling $10,000 for information that would lead to her. Garcia has spent countless hours driving the routes where he thinks Sierra might have been taken, and says he calls dive teams on where her body may be.

"I have some ideas," Garcia said, adding that he wouldn't disclose any details of the investigation. But he added that he wishes Garcia Torres will "find God" in jail and tell investigators what he allegedly knows. "There's only one person who knows."

Family, friends gather on 2-year anniversary of Sierra Lamar’s disappearance



Family, friends, and classmates of Sierra LaMar gathered Sunday afternoon at her former high school to mark the two year anniversary of the teenager's disappearance.

“Today has been really heart wrenching. The wounds run really deep for us as a family.” said Sierra's mother, Marlene LaMar, as she wiped away tears.

In a short ceremony, the LaMar family helped dedicate a bench in Sierra's honor. It is a five-sided brown wooden seat that surrounds a tree known as the “cheerleading tree” on the Washington High School campus in Fremont. Sierra was a cheerleader at Washington High before moving to Morgan Hill shortly before she went missing.

“She would have been by that tree, practicing, cheering her heart out,” said LaMar's mother.

The family released balloons as “I Will Remember You” by artist, Sarah McLachlan, played in the background.

“I am doing OK, it’s tough, especially at this time. It’s been very frustrating two years – we haven’t really found anything with the searches but we are still doing that,” Steve LaMar said.

LaMar described the length of the court process as “frustrating.”

“We were warned of that but it’s still frustrating,” he said, adding that the district attorney’s office had warned the family that high-profile murder cases could drag on for years.
 
LaMar said that the family has never gone to court to see Garcia-Torres during his preliminary appearances. “It’s a personal decision – I’ve talked about it with my family and pretty much all of us are not inclined to go until it’s necessary or basically until when the trial begins.”

When asked whether he had a message for Garcia-Torres, LaMar said “No.”

His message to the public: “Just keep hoping and help us to search for her.”

A dedicated group of about 25 volunteers still meets on Saturdays to search for Sierra in the Morgan Hill area.

In a new twist in the heated battle for sheriff of Santa Clara County, missing-child advocate Marc Klaas has come out against sitting Sheriff Laurie Smith, saying she's "stonewalled" the search for the body of Sierra LaMar.

Klaas is the father of Polly Klaas, the 12-year-old Petaluma girl who was kidnapped and murdered in 1993 by Richard Allen Davis, now on California’s Death Row. Klaas has since been active in helping dozens of families across the country search for missing loved ones.

On Friday, Klaas announced he is endorsing Smith’s opponent retired Sheriff’s Capt. Kevin Jensen. The two are the only ones running in the June 3 election.

 Below is Marc Klaas's statement, obtained exclusively by NBC Bay Area. Smith declined to respond to requests for comment, but her campaign political consultant did send a statement via text message. That response, which calls Klaas's statement "misinformed," is also pasted below.

Who Will Find Your Child?

I was asked the other day to explain just how I believe Sheriff Smith has stonewalled the civilian search for Sierra Lamar. BTW, one of the definitions of stonewall is “to behave in an obstructive manner as by withholding information.” I was also asked to explain how other law enforcement jurisdictions have responded to a KlaasKids organized search effort as opposed to how Sheriff Laurie Smith has responded. I need only to go back to the Hayward search for Michelle Le as a perfect example.

Within a few days after the KlaasKids Organization entered the search for Michelle Le our search leaders were given the following information by the detectives assigned to the case. We were advised that cell phone pings from Michelle Le’s phone showed that her phone went from the area of Kaiser Hospital in Hayward to the Sunol Valley. The phone stayed in the Sunol Valley for less than an hour before returning to the area of Kaiser Hospital. We were given much more information but the above information proved crucial to finding Michelle Le. For those of you unfamiliar with the Michelle Le case, the suspect killed her in the parking garage of the Kaiser Hospital in Hayward and then hid the victim’s body in a field in the Sunol Valley. The KlaasKids search focused on the Sunol Valley because that is where Hayward PD Investigators told us they believed her body would be found. Our civilian search team found Michelle Le in Sunol Valley on September 17, 2011.

Can someone please tell me how the Michelle Le case was prejudiced in any way by the fact that the Hayward Police Department assisted the civilian search effort?

It was the goal of the Hayward Police Department to find Michelle Le and they were willing to use ALL available resources to accomplish that goal. It is a terrible injustice to Sierra Lamar and her family that the Sheriff Laurie Smith is not willing to do the same. Let’s face the facts here. If Michelle Le had disappeared in Santa Clara County, Sheriff Smith would not have shared the information about the cell phone pings with the civilian search team and Michelle Le would still be missing.

Voters of Santa Clara County should know this. If your child turns up missing Sheriff Smith will NOT pull out all the stops to find your child. How scary is that?

But wait, I have more Mr. Robinson. And each time Sheriff Smith or her representatives bring up how she CAN’T help the civilian search I will give you more examples of how other law enforcement agencies have done exactly what Sheriff Smith says she CAN’T do. And there are many examples. Believe me. And just as important, I still cannot find a single case, nationwide, that was jeopardized, prejudiced, nor evidence excluded, as a result of any law enforcement agency assisting a civilian search team.

“Sheriff Smith says she will not prejudice the case against the suspect.” It sounds like she is more concerned about the suspect’s rights than the victim’s rights.

When A Victim Has No Voice

My name is Danny Domingo and I am a retired police veteran of an east bay Police Department.  I have also volunteered with the KlaasKids Organization since 2000.  Currently I am embedded with the search for Sierra Lamar and have volunteered my time in this worthwhile effort for the past two years.  The Sierra Lamar search is the fourth high profile search in which I have been involved since meeting Marc Klaas in 1999.  The Sierra Lamar search is also the ONLY ONE of the four searches in which I’ve been involved where the local law enforcement jurisdiction has refused to assist the civilian search effort.  Instead, Sheriff Smith and her media representatives have stated multiple times, in one way or another that they wish they could discuss the case with the civilian search leaders but they CAN’T.  Allow me to make this point very clear.  The leaders of the search for Sierra Lamar have never asked Sheriff Smith or her representatives to discuss the case with us.  What we have asked for is assistance in identifying viable search areas.

In the first days, weeks and months of the search effort we asked Sheriff Smith and her Search and Rescue leaders to share the areas where they’ve searched so that the civilian team could leap frog those areas thereby searching a larger area in a shorter period of time.  The requests led to empty promises of assistance from the Sheriff.  Finally, in October 2013, nineteen months after Sierra Lamar disappeared; civilian search leaders finally received a map outlining search areas covered by county Search & Rescue teams.  Nineteen months during which body decomposition, animal destruction and weather conditions have taken its toll on any evidence which might have been recovered.

In my personal estimation, Sheriff Smith has hampered the search effort for Sierra Lamar.  A couple of examples if I may; 1) for several months in the beginning of the search Sheriff Smith refused to disclose that all of the clothing connected with Sierra Lamar had been recovered.  Hence, civilian search teams spent countless hours searching for, logging and documenting an exorbitant amount of female clothing found during searches.  All of this documentation was then turned over to the Sheriff’s Office.  Hundreds of hours could have been saved by a simple statement by the Sheriff’s Office saying, “We are not looking for any outstanding clothing.”  Yet, Sheriff Smith forced her investigators to remain mum about any information at all.  2) The civilian search leaders have asked the Sheriff Investigators to assist the civilian search effort by suggesting areas in which the suspect and his friends might have frequented so that searches could be conducted in those areas.  These requests have been met with no response by the Sheriff or her investigators.  3) There are rumors of the existence of a video surveillance photograph taken of the suspect showing his clothing in a particular state of disarray taken on the date of Sierra’s disappearance and the existence of medical records indicating the suspect was treated for a particular condition days after the disappearance of Sierra Lamar.  A simple confirmation or denial of these two rumors could do a lot to steer this search in a particular direction.  Once again, the requests were met with no response.  Having been an investigator for 16 of the 25 years I served in law enforcement, I fail to see how assistance in any of the above would jeopardize this case.

Death penalty sought in missing teen case


SAN JOSE, Calif. (AP) — Prosecutors are seeking the death penalty against a man charged with kidnapping and killing a 15-year-old Northern California girl whose body has not been found, the District Attorney's Office said on Monday.

Santa Clara County District Attorney Jeff Rosen said he made the decision to seek capital punishment against Antolin Garcia-Torres in the 2012 disappearance of Sierra LaMar after a "comprehensive review" by a committee of senior prosecutors.

"I have concluded that this defendant should face the ultimate penalty," Rosen said. He said he would not be making any additional comments to ensure that Garcia-Torres receives a fair trial.

Garcia-Torres has pleaded not guilty to murder and kidnapping charges in the Sierra case. He is also accused of attempting to kidnap three women during carjackings in 2009.

Judge rules to unseal grand jury testimony in Sierra LaMar case

A South Bay judge Friday morning ruled to unseal grand jury transcripts in the murder trial of Antolin Garcia-Torres, the man accused of kidnapping and killing Morgan Hill teen Sierra LaMar.

The release of the grand jury transcripts will make the evidence the district attorney has against the suspect Garcia-Torres public. One legal analyst told KTVU too much information out in the public could lead to the trial being moved to another county.

Garcia-Torres was present in court Friday as his defense attorney and the prosecutor both argued against unsealing the grand jury transcripts. Garcia-Torres is charged with murdering LaMar two years ago.

The defense argued more information out in the public would prejudice the jury and it would be difficult to seat an impartial jury. The prosecutor was concerned this would lead to a change of venue for the trial and it would delay it.

The judge ruled in favor of releasing the documents after hearing the attorney for the San Jose Mercury News who argued the public has a right to know.

SAN JOSE -- Attorneys for the man accused of kidnapping and killing Morgan Hill teen Sierra LaMar all but lost their bid Friday to keep the transcript of the grand jury hearing that led to his indictment on murder charges secret.

Responding to a request by this newspaper, Judge Griffin M.J. Bonini ordered the transcript unsealed July 11 unless defendant Antolin Garcia-Torres' lawyers manage to convince an appellate court to review the ruling. The paper argued that the public's right of access to court documents trumped Garcia-Torres' overstated concerns that pre-trial publicity will hurt his chances for a fair trial.

The release of the 2,000-plus-page transcript will make public for the first time some of the evidence prosecutors have against Garcia-Torres, who has been in custody for more than two years without bail on suspicion of killing Sierra . The 15-year-old vanished in March 2012 on her way to her school bus stop. Her body hasn't been found.

Once a defendant is indicted, the grand jury transcript is presumed to be public, putting the burden of proof on Garcia-Torres' attorneys to show why it should remain sealed. The document has been under seal for slightly more than four months.

The testimony was collected on DVDs and given to media outlets that paid the court clerk the over $1,000 fee for access. The testimony includes 1,900 pages of evidence in twelve volumes, one for each day of testimony and all pertaining to the Sierra Lamar Murder Case.
The grand jury indicted Antolin Garcia-Torres on murder charges based on information in the stack of documents released early Friday evening.
One detail that surfaced in the testimony was the discovery of hair on a rope inside the trunk of Antolin Garcia-Torres's car when it was seized on April 7, 2012.
The hair was the first and only bit of physical evidence from LaMar’s person that was found during the investigation where it wouldn’t already be expected such as at her home or on her own clothing.
The transcript also talked in detail about the discovery of his vehicle and Sierra LaMar’s cell phone also about black polyester fibers from the floor mats in Garcia-Torres's car similar to fibers that were found on one of her sweatshirts.
The DNA analysis of the evidence found figured prominently in the case attorneys made against Garcia-Torres.
The documents also show attorneys presenting evidence regarding earlier attempted kidnappings by Garcia-Torres of three women in March of 2009.
Those women also testified during the grand jury, describing their frightening and violent encounters with the suspect.
