Her body has never been found, but Sierra LaMar’s suspected killer remains in a South Bay jail, and after countless delays, a trial date has finally been set.

LaMar’s family and longtime supporters were stunned and relieved on Wednesday when Judge Thang Barrett set a trial date of April 25, 2016, for Antolin Garcia-Torres.

SAN JOSE -- Defense attorneys lost their bid Friday to persuade a judge to dismiss the grand jury indictment of a man accused of abducting and killing 15-year-old South County resident Sierra LaMar.

Santa Clara County Superior Court Judge Helen E. Williams denied the motion to dismiss the 2014 indictment of Antolin Garcia-Torres in the death penalty case. The trial is now set to proceed on April 25. Garcia-Torres has pleaded not guilty.

On March 16, 2012, 15-year-old Sierra Lamar disappeared on her way to school
 
Sierra's father says the family is still filled with sorrow, pain and unanswered questions four years later.

"It's pretty much the same state," said Steve LaMar. "Year after year."

"It's a nightmare," said Santa Clara County Sheriff Laurie Smith. "My heart will always go out to the family, to the friends, to the community."

Sierra's family says they have pleaded with Garcia-Torres to say something that would lead investigators to Sierra, but he has so far remained silent.

His trial is set to begin next month.

A murder trial regarding Sierra LaMar could be delayed.
 
When a crime lab tested the DNA on LaMar's pants they got a hit on 12 profiles. One of those profiles was Garcia-Torres.

Without a body, experts said the DNA evidence pointing to Garcia-Torres is crucial in the case. But the crime lab also got hits on 11 other people, or profiles. The defense lawyers now want to know who those people are.

"This is very critical to the defense case because they have to attack the DNA evidence entirely," legal analyst Steven Clark said. "Because there is no body and DNA evidence points to Garcia-Torres."

Family, Friends to Hold Search for Sierra LaMar

Garcia-Torres' lawyers filed a motion in court Thursday, requesting the profiles of the other 11 people who also were hits in the DNA database. If the defense attorneys get their wish, Clark said the trial will likely not start next month, as scheduled.
 
A judge is set to rule on Monday.

MORGAN HILL, Calif. —Wednesday marks four years since 15-year-old Sierra LaMar of Morgan Hill vanished while walking to her school bus stop.

LaMar was likely kidnapped and murdered on March 16, 2012, although her body has never been found.

 

When LaMar first disappeared, hundreds of volunteers joined sheriff's search teams to help find her. Daily searches turned into weekly. And now just a few devoted volunteers regularly search on their own.

Prosecutors said Garcia-Torres' DNA was found on LaMar's jeans. The teen girl's clothing and cellphone were found a few miles from her home. LaMar's DNA was found in his car. Investigators said they found a strand of her hair wrapped around a rope that was in the trunk of Garcia-Torres' car.

Saturday's search for LaMar will begin at 9:15 a.m. in Morgan Hill on Eastman Canyon Road. The search is being organized by the girl's friends and family.

Attorneys representing the suspect in the Sierra LaMar murder trial will now be getting access to a potential key piece of evidence: DNA analysis.

The lawyers for Antolin Garcia-Torres filed a motion last week to obtain the evidence. A crime lab previously tested the DNA on LaMar's pants and received a hit on 12 profiles, with one of those profiles being Garcia-Torres.

•  Lab Tests Show DNA in Sierra LaMar Murder Case Got 12 Hits

Lawyers representing Garcia-Torres escorted the suspect into court on Monday and announced the defense "went over both protective orders and came to an agreement" to gain access to the evidence.

The defense wants to know who the other 11 profiles from the lab test belong to.
 
Without a body, experts said the DNA evidence pointing to Garcia-Torres is crucial in the case. The 11 profiles that got DNA hits belong to people who are also on the state criminal database. Defense lawyers now have to figure out if they may have been anywhere near Morgan Hill when LaMar disappeared.

"That is a tremendous amount of evidence to review," Clark said. "They will prepare a report and give it to the prosecution, which could significantly delay the trial."

SAN JOSE (BCN) — A trial has been delayed to next month for a man charged with kidnapping and murdering 15-year-old Sierra LaMar nearly four years ago.

Antolin Garcia-Torres, now 25, is accused of killing Sierra, who was last seen on the morning of March 16, 2012. She left her home in unincorporated Morgan Hill and never showed up to her bus stop for school.

Garcia-Torres’ trial was scheduled for today but Santa Clara County Superior Court Judge Deborah Ryan continued the case to May 23 for his defense attorneys to submit additional evidence for testing.

Garcia-Torres withdrew his waiver for a speedy trial within 60 days, his defense attorneys said.

Santa Clara County Deputy District Attorney David Boyd told the judge that prosecutors were prepared to proceed with the trial during today’s hearing at the Hall of Justice in San Jose.

Antolin Garcia-Torres said he is frustrated with the slow pace of his case and has asserted his constitutional right to a speedy trial within 60 days. In this case, that means June 21.

The judge will have to decide whether the defendant has met the legal burden to be assigned new lawyers.

SAN JOSE, Calif. - Sierra Lamar's accused killer was supposed to stand trial Monday, but the trial has been delayed again.

That's because an attorney for Antolin Garcia-Torres is busy with another case.

Not to mention, the defense said it's going to file more motions that will put the case on hold for at least two more months.

The biggest of the three motions is a change of venue in light of all of the media attention in Santa Clara County.
 
The defense also wants to file a motion to suppress evidence, although they did not specify what exactly.

Attorneys for Garcia-Torres have until June 20 to file motions and the prosecution has 30 days to respond.
 
Antolin Garcia Torres' next court appointment is June 17 for a status check.
