9/11 'mastermind' back before Guantanamo judge
May 5, 2012

GUANTANAMO BAY NAVAL BASE, Cuba (AP) -- The self-proclaimed mastermind of the Sept. 11 attacks and four accused co-conspirators will appear in public for the first time in more than three years Saturday, when U.S. officials start a second attempt at what is likely to be a drawn out legal battle that could lead to the men's executions.

Khalid Sheikh Mohammed and his co-defendants are to be arraigned at a military tribunal at Guantanamo Bay on charges that include that include 2,976 counts of murder for the worst terrorist attack on U.S. soil.

In the past, during the failed first effort to prosecute them at the U.S. base in Cuba, Mohammed has mocked the tribunal and said he and his co-defendants would plead guilty and welcome execution. But there were signs that at least some of the defense teams were preparing for a lengthy fight, planning challenges of the military tribunals and the secrecy that shrouds the case.

The arraignment is "only the beginning of a trial that will take years to complete, followed by years of appellate review," attorney James Connell, who represents defendant Ali Abd al-Aziz Ali, told reporters gathered at the base to observe the hearing.

"I can't imagine any scenario where this thing gets wrapped up in six months," Connell said.

Mohammed Appears in Courtroom With Security, Not Grandeur
By David Lerman and David Glovin -
April 5, 2012

Khalid Sheikh Mohammed sported a long beard in a reddish hue that appeared to be dyed and a white tunic when he entered a courtroom today at the U.S. naval base at Guantanamo Bay, Cuba.

The accused mastermind of the Sept. 11, 2001, terror attacks bore little resemblance to the disheveled figure in stubble and a black mustache in the famous photo released after his capture in Pakistan nine years ago.

The close-up look at Mohammed, who last appeared in court in 2008, was afforded to a few dozen journalists and other guests. They were permitted to witness the arraignment of Mohammed and his codefendants from a small room separated from the courtroom by a glass wall. Family members of victims of the attacks also sat in the viewing room, their privacy protected from other guests by a blue curtain.

Mohammed was the last of the five accused terrorists to enter the courtroom in Guantanamo Bay, ushered to his seat by three guards. Minutes later, he wrapped a white cloth around his black skullcap to form a turban. He looked thinner than his capture photo and was now wearing glasses. A large callus showed at the center of his forehead, a mark that sometimes results from hitting the face against the floor during fervent Muslim prayer.

The defendants today deferred entering pleas, and the military judge, U.S. Army Colonel James Pohl, said he is planning to hold the next court sessions June 12 to June 15.

9/11 defendants ignore judge at Guantanamo hearing
May 6, 2012

GUANTANAMO BAY NAVAL BASE, Cuba (AP) — They knelt in prayer, ignored the judge and wouldn't listen to Arabic translations as they confronted nearly 3,000 counts of murder. The self-proclaimed mastermind of the Sept. 11 attacks and four co-defendants defiantly disrupted an arraignment that dragged into Saturday night in the opening act of the long-stalled effort to prosecute them in a military court.

More than seven hours into the hearing, the judge at the U.S. military base in Cuba hadn't yet read the charges against the men, including 2,976 counts of murder and terrorism in the 2001 attacks that sent hijacked jetliners into New York's World Trade Center and the Pentagon.

Khalid Sheikh Mohammed, the admitted 9/11 architect, and the four men accused of aiding the 9/11 conspiracy put off their pleas until a later date.

Earlier, Mohammed cast off his earphones providing Arabic translations of the proceeding and refused to answer Army Col. James Pohl's questions or acknowledge he understood them. All five men refused to participate in the hearing; two passed around a copy of The Economist magazine and leafed through the articles.

Walid bin Attash was confined to a restraint chair when he came into court, released only after he promised to behave.

Ramzi Binalshibh knelt in prayer alongside his defense table with Ali Abd al-Aziz Ali in the middle of the hearing, then launched into an incoherent tirade about the late Libyan leader Moammar Gadhafi and declared he was in danger. "Maybe they will kill me and say I committed suicide," he said in a mix of Arabic and broken English.

The detainees' lawyers spent hours questioning the judge about his qualifications to hear the case and suggested their clients were being mistreated at the hearing, in a strategy that could pave the way for future appeals. Mohammed was subjected to a strip search and "inflammatory and unnecessary" treatment before court, said his attorney, David Nevin.

Prayer rugs and legal moves in trial of 9/11 defendants
Defendants in the trial of alleged 9/11 mastermind Khalid Sheikh Mohammed and four others insisted on having their full charges read, an unusual move. Yet most seemed not to pay attention, then took a break for prayer.

Think of jihadis’ wrongs, not civil rights
By ROBERT REEG
May 7, 2012

Now-retired firefighter Robert Reeg, 59, of Rockland County had been assigned to Engine 44 on the Upper East Side when the first plane struck the World Trade Center on 9/11. He was then nearly killed by flying debris when the South Tower collapsed, suffering busted ribs and a collapsed lung and losing five units of blood. In the decade since, he’s fought along with other 9/11 families to make sure the plotters pay the price and the victims’ survivors get justice. On Saturday, he watched the arraignment of terror mastermind Khalid Sheik Mohammed and his four accomplices at Fort Hamilton in Brooklyn.

Missing words from 9-11 tribunal: CIA and "big-boy pants"
By Jane Sutton
May 9, 2012

(Reuters) - The Pentagon revealed on Wednesday what was said when an over-cautious court security officer blocked the sound during Saturday's arraignment of five Guantanamo prisoners charged with plotting the September 11 attacks.

It was a snide reference to Bush-era CIA interrogators, a transcript showed. Air Force Captain Michael Schwartz was explaining why defendant Walid Bin Attash was refusing to cooperate during the hearing in the Guantanamo war crimes tribunal.

"The reason for that is the torture that my client was subjected to by the men and women wearing the big-boy pants down at the CIA, it makes it impossible ..." Schwartz said during the blocked portion of the arraignment.

Who Is Taking Photos of Khalid Sheikh Mohammed at Guantanamo Bay?
Alexander Abad-Santos
May 25, 2012

This isn't the way we should start your Memorial Day weekend, but here it goes: apparently someone at Guantanamo Bay might be taking photos of alleged 9/11 mastermind Khalid Sheikh Mohammed, smuggling them out, and posting them on a jihadist website.  So where do we start with this?
