Orlando Sentinel reporting A Dozen Law Enforcement Officers in Command Will testify for the DEFENSE in Zimmerman trial

(snip)   The list has on it a dozen names, including former chief Bill Lee; Bob O’Connor, the major crimes captain who oversaw the investigation; Lt. Randy Smith, the former sergeant who supervised the detectives investigating the case; and lead Investigator Chris Serino.

This doesn't surprise me.  They are defending themselves as well as GZ.

George Zimmerman's lawyers: Cops will testify for us in murder case
6:08 p.m. EDT, October 24, 2012

George Zimmerman's lawyers Wednesday notified prosecutors that their witness list now includes a who's who of the Sanford Police Department's chain of command at the time of Trayvon Martin's death, including the police chief, major crimes captain, sergeant and case detectives.

It is an unusual defense strategy. Police officers typically testify for the state, explaining how they gathered the evidence that led to charges. In this case, it suggests that Zimmerman's attorneys believe the testimony of Sanford officers will help — not hurt — their client.

So far, defense attorneys have subpoenaed eight Sanford officers, requiring them to appear. There is no indication that the officers have approached defense attorneys, saying they wanted to help Zimmerman.

George Zimmerman's attorney asks to question Sanford officers
Mark O'Mara requests state's evidence in gag order against him
Published On: Oct 24 2012 07:19:15 PM EDT

ORLANDO, Fla. -
The attorney for George Zimmerman, the neighborhood watchman who shot and killed Trayvon Martin, has filed two motions on Wednesday asking to question more Sanford Police personnel and for the state's evidence in its gag order.

Attorney Mark O'Mara is asking in his supplemental witness list to question many personnel involved in the investigation into Martin's shooting, including. former police chief Bill Lee and Chris Serino, the lead investigator.

O’Mara also filed a demand for specific discovery, asking the special prosecutors to give him all of the evidence the state will use to ask for a gag order against O’Mara.

Zimmerman's defense to witnesses: Stop talking
updated 5:11 PM EDT, Wed October 24, 2012

George Zimmerman’s defense wants to stop witnesses from discussing the criminal investigation into Trayvon Martin’s shooting.

This comes after the defense attorneys say the prosecution failed to disclose private meetings between investigators, where they talked about whether there was enough evidence to charge Zimmerman. In the motion filed Friday, Zimmerman’s defense attorneys said that they were made aware of the meetings after an October 18 deposition of Sgt. Joseph Santiago, a Sanford Police Department officer.

The defense says these discussions could contain relevant information about whether their client is guilty, or “most notably the lack of guilt, of Mr. Zimmerman." They want the judge to order all the attorneys involved in the trial to not talk to the witnesses about the meetings until they’ve had their depositions.

The next hearing in the case is scheduled for Friday.

Prosecutor's new filing: Zimmerman defense using social media for 'spin'
6:16 p.m. EDT, October 25, 2012

In support of his latest request for a gag order, the lead prosecutor in the George Zimmerman murder case filed paperwork today attacking a wide array of public statements made by the defense via traditional and social media.

Prosecutor Bernie de la Rionda lists in his new court filing the Zimmerman defense team's website, their social media accounts and comments from interviews with local and national media. The comments made by defense attorney Mark O'Mara, de la Rionda argues, risk tainting the jury pool with the defense's "spin" on the evidence.
 ::snipping2::
A hearing has been set on the motion for a gag order for Friday at 1:30 p.m. before Circuit Judge Debra Nelson. The previous judge in the case rejected a prior such request by the state. In addition to the defense, lawyers for more than a dozen media outlets are expected to argue against the gag order at the hearing.

Prosecutor at gag-order hearing: Zimmerman lawyer trying to 'influence public opinion'
1:57 p.m. EDT, October 26, 2012

SANFORD – A hearing is under way in the second-degree murder case against George Zimmerman.

The hearing began just after 1:30 p.m. The primary issue to be decided by Circuit Judge Debra S. Nelson today is a request by prosecutors for a gag order to silence defense attorney Mark O'Mara.

Prosecutor Bernie de la Rionda told the judge that he doesn't oppose freedom of speech or the freedom of the press.

"We firmly believe in it, too, your honor," he said. But "neither party should be commenting about the evidence" in the media and risking tainting the jury pool, he said.

"That's my concern: Are we going to be able to pick a jury in Seminole County or for that matter the state of Florida?" de la Rionda said.

He called O'Mara's use of social media as an attempt to circumvent the traditional media,  spread a "biased" account of the case and wage a PR campaign.

"Was it done to influence public opinion? I would submit that's the real reason," de la Rionda said.

George Zimmerman gag order hearing: No decision today
2:38 p.m. EDT, October 26, 2012

 ::snipping2::
Defense lawyer Mark O'Mara countered that when he took on the case, damage had already been done to the jury pool: By the family and attorneys of 17-year-old Trayvon Martin, who he said "decided they were going to make this a national media case" and spun the facts.

Martin family attorney Benjamin Crump's plan "is to completely sway national public opinion in this case in favor of his client," O'Mara said, and against Zimmerman.

"I contend to you that the case against Mr. Zimmerman was created for reasons far outside the facts of what happened that night" and was driven by "political influence," O'Mara said.

De la Rionda argued that O'Mara is using social media to circumvent the traditional media,  spread a "biased" account of the case and "influence public opinion."

O'Mara countered that his use of social media is necessary to cope with the "tidal wave" of information, commentary and discussion concerning his client that exists online.

"What we have done was deal with a case that... was already in the throes of an enormous overriding tidal wave of misinformation," O'Mara said.

This afternoon, both sides returned to the courtroom to argue the gag order and other issues. So did attorneys for the Orlando Sentinel and a dozen other news organizations, including The New York Times, The Wall Street Journal and CNN. They oppose the gag order.

Media attorney Scott Ponce argued that a gag order is only meant to be used as a "last resort," and the state hasn't proved that one is necessary.

A previous judge, Kenneth Lester Jr., said no de la Rionda first asked for one in April.

If I heard it correctly, I think that the judge has denied the emergency motion regarding witnesses as asked by defense last week.

They are continuing to discuss scheduling issues, etc.

George Zimmerman judge: 'Stand your ground' hearing in April
4:01 p.m. EDT, October 26, 2012

SANFORD – After more than two hours of argument, the judge in the second-degree murder case against George Zimmerman said she will not rule today on the state's request for a gag order.

Circuit Judge Debra Nelson said she hopes to rule by Monday. The hearing began just after 1:30 p.m., and the gag order was the primary issue at hand.

However, near the end of the hearing, the judge and lawyers agreed to put another high profile issue on their calendars: Zimmerman's "stand your ground" hearing, where he will ask to have the case thrown out, was set for 45 days before the June 10 trial.

George Zimmerman to argue self-defense at hearing slated in April
October 26, 2012, 3:54 p.m.

 ::snipping2::
Most of Friday afternoon was taken up by arguments over the gag order that the state has sought before without success. An earlier judge, Kenneth Lester Jr., denied a state request in April.

The request for a gag order is not unusual in cases that have generated a great deal of publicity. Prosecutor Bernie de la Rionda argued that the order was needed to protect the selection of jurors, who might be swayed by comments by lawyers.

“Neither party should be commenting about the evidence"  he said, adding later: "That's my concern. Are we going to be able to pick a jury in Seminole County or for that matter the state of Florida?"

De la Rionda argued that Zimmerman’s defense lawyer had used the media, including new Web-based communication, to spread a biased account of the case and influence public opinion.

Defense lawyer Mark O'Mara replied that the jury pool had already been damaged by the family and allies of Martin, who made the shooting a national cause with demonstrations and demands that Zimmerman be charged. Zimmerman was not arrested by local police on the night of the shooting, but was charged after a special prosecutor was appointed by the governor.

"I contend to you that the case against Mr. Zimmerman was created for reasons far outside the facts of what happened that night" and was driven by "political influence," O'Mara said.

Attorneys representing various media outlets also argued against the gag order.

Someone on Youtube said (and I 100% agree) IF GZ planned on killing TM WHY in the world would he call 911, give his full name AND where he lives if he was planning on killing someone?

Something to think about folks.

JMO

I don't think for one second that GZ planned on killing TM.  IMO, He just wanted to see what was up with this 17 year old walking in the rain etc.

Truly a sad situation for all involved.

Q: when GZ was trying to find TM, is there any way at all he would have caught up to him in order to kill him?

I'm not very good at math so I'm trying to find out how far away GZ was from TM at the time he made his 911 call.

Thanks.

It wasn't premeditated that's why it's second degree murder and not first degree.  The prosecution isn't suggesting GZ left his truck intending to kill Trayvon.

http://www.richardhornsby.com/crimes/homicide/second-degree-murder.html#Definition

 ::snipping2::Definition of Second Degree Murder

Murder with a Depraved Mind

Murder with a Depraved Mind occurs when a person is killed, without any premeditated design, by an act imminently dangerous to another and evincing a depraved mind showing no regard for human life.

The primary distinction between Premeditated First Degree Murder and Second Degree Murder with a Depraved Mind is that First Degree Murder requires a specific and premeditated intent to kill.

George was 80 yards from his truck when he shot Trayvon, that much can be proven.  I don't think anyone will know for sure how far away Trayvon was when George called 911 but he did state that Trayvon was running away at the time.

wow, so TM was already back at Brandy's place? I knew she gave an interview but i've never listened to it.

If this is true then that means he went back to find GZ.

Where did you find this out?
