Adding to the pressure for the jury we also have the race issue.  Do any of the whites on the jury harbor racism that they won't reveal during selection?  Will any of the black folks on the jury vote to convict only because the victim is a black boy?  Based on these possibilities, what will deliberations look like? 

Seriously, this is one for the history books.  Hopefully twelve jurors of high character and clear thought can set aside any personal issues and focus on the law and the facts of the case.

The Fifth District Court of Appeal today ruled that Benjamin Crump, an attorney for Trayvon Martin’s family, must sit down and answer questions under oath by George Zimmerman’s attorneys.

In the just-released ruling, the court wrote that Zimmerman’s lawyers have a right to question Crump about his dealings with a woman who’s expected to be the state’s most important witness.

She’s a young Miami woman who was on the phone with Trayvon moments before he was shot.
 
It returned a unanimous five-page ruling this afternoon in Zimmerman’s favor.

Nelson was wrong, the court wrote, when she said Crump is protected by a work product privilege. He conducted a March 19, 2012, interview of the woman and made an audio recording while in the same room with two employees of ABC News.

The network broadcast portions of it shortly thereafter.

The appeals court said because that news crew was present during the recording, Crump had waived his work product privilege.

It also ruled that Crump deserves no protection, despite his claim of being opposing counsel, because he’s not. In this case he’d have to be a prosecutor to qualify.

Defense attorneys obtained a copy of the recording Crump made, but the appeals court described it as “incomplete and of very poor quality.”

It ruled that Zimmerman’s attorneys may question Crump but only on a very narrow set of things. They may ask him about the contents of the interview and about the circumstances surrounding it.

They may not, however, ask why he tracked her down or what methods he used to do that.

Meanwhile, Zimmerman’s defense team wants “certain witnesses”  to be granted anonymity and confidentiality, as the judge prepares for the final hearings before his trial in the death of Martin.

The motion is among three issues set to be heard by Judge Debra Nelson, beginning Thursday.

Also on the agenda: a hearing to determine if a state expert is using generally accepted scientific principles to claim he can discern not only who is speaking in the background of a 911 call, but also the exact words being uttered.

The judge will also continue an inquiry into whether prosecutors lied when they told her in March they had turned over to the defense all material they had gleaned from Martin’s cell phone. The defense is seeking sanctions for what they claim were discovery violations.

Former assistant state attorney Wesley White said Wednesday that Fourth Judicial Circuit information technology director Ben Kruidbos was placed on administrative leave shortly after White testified during a hearing in George Zimmerman's murder case on Tuesday.

White testified that Kruidbos retrieved three photographs and deleted text messages from Martin's cellphone that were not disclosed to Zimmerman's attorneys by the prosecutor.

White says Kruidbos was interviewed by state attorney investigators before being placed on leave.

A hearing on the issue is scheduled for next week.



There should be consequences for this misconduct.  JMHO

MuffyBee, here's more information about the withholding of evidence.  It should be an interesting court hearing this week.  I wonder how it's going to be explained to the judge and how she will rule.  They're running out of time; the trial begins next week.

She'll also take up another issue then: Did de la Rionda lie when he told her he had turned over every scrap of evidence related to Trayvon's cell phone to Zimmerman's attorneys.

Wesley White, a lawyer and former co-worker of de la Rionda, testified Tuesday that the office's information technology director had found three photos plus some deleted text messages from Trayvon's cell phone and given them to de la Rionda.

One photo was of a hand holding a gun and one was of drugs, White said.

O'Mara said those had not been handed over.

White said Tuesday afternoon that the IT director, Ben Kruidbos, was placed on administrative leave "about five minutes after I got off the stand."

A spokeswoman for de la Rionda's office did not respond to a phone call or email seeking more information.

As the late Senator Daniel Moynihan reportedly said, "[e]veryone is entitled to his own opinion, but not his own facts."  The commentary on the George Zimmerman case, I've noticed, gets edgy when those who know the facts argue with those who venture opinions.  The facts that follow are the ones with which both the defense and the prosecutor must contend.

SANFORD — Prosecutors have filed paperwork revealing that murder defendant George Zimmerman applied to become a police officer in a county near Washington, D.C. but was turned down.

His application and rejection letter are among the latest pieces of evidence the state has notified defense attorneys they may use at Zimmerman's trial, which begins Monday.
 

The new list of evidence, filed Monday, says Zimmerman applied to become an officer in Prince William County, Md., but that appears to be an error. There is no Prince William County in Maryland, however, there is one in Virginia, and it's the site of Zimmerman's hometown: Manassas.

The paperwork does not spell out when Zimmerman applied for the job, but it is not the first indication that he had an interest in police work.

He was a student at Seminole State College, about to complete a two-year degree in criminal justice, at the time of the shooting.
 
The new evidence list includes information that Zimmerman trained at a Longwood gym that specializes in boxing and kickboxing.

A webpage for the business, Kokopelli's Gym, describes it as "the most complete fight gym in the world."

In a separate pleading, defense attorney Mark O'Mara has asked the judge to ban prosecutors from using several specific terms, ones he describes as "inflammatory".

They include "profiled", "vigilante", "self-appointed Neighborhood Watch captain", "wannabe cop" and the phrases "He got out of the car after the police told him not to", and "He confronted Trayvon Martin".

In his paperwork, filed Monday, O'Mara writes that there is no evidence Zimmerman confronted Trayvon and that it's a oft-repeated "misstatement" that a police dispatcher told Zimmerman not to get out of his vehicle.

Wrote O'Mara, "There is little probative value by the use if these terms and the danger of unfair prejudice to the jury is substantial."

The identities of potential jurors in the Florida trial of George Zimmerman, the neighborhood watch volunteer accused of murdering teenager Trayvon Martin, will be kept confidential, the presiding judge ruled Wednesday.

Zimmerman is pleading not guilty to second-degree murder charges, contending he acted in self-defense.

Circuit Judge Debra Nelson also ruled that the potential jurors won’t be sequestered, and that during the selection process -- which is scheduled to get underway on Monday -- members of the jury pool will be referred to by numbers, not names.

The judge also said photographers would be prohibited from taking pictures of jurors, but noted that the media outlets that will be covering the trial had already agreed to that.

Defense attorney Mark O'Mara had asked the judge to sequester the jury pool, but Nelson ruled that out, saying "such drastic measures are unnecessary and, in fact, not practical based upon the resources available to the court," the Sentinel reported.

Thanks to the Internet and media coverage and in some cases TV, the high-profile cases are filled with more drama and chaos.  imo

And the drama is not limited to the lawyers and judge.  In one recent criminal trial, the jurors started wearing color-coordinated clothes to court...one day blue the next day red, etc....they even had a sports day...wearing shirts with their favorite professional team!

(CBS/AP) ORLANDO, Fla. - George Zimmerman's defense fund has raised over $77,000 in the past week through "a handful of large donations," according to a post Wednesday on the fund's website.

PICTURES: George Zimmerman faces murder charge

The site says the donations will go towards paying off outstanding liabilities in excess of $20,000, and to pay for deposition transcripts and securing experts for Zimmerman's murder trial, which is scheduled to begin with jury selection on Monday.

Last week, Zimmerman's defenders claimed the fund had less than $5,000 left.  Zimmerman's defense team said they calculated that another $120,000 was needed to put on a good defense,  or just another $75,000 to even give him a fighting chance.

The defense team says they expect additional operating expenses and increased security expenses during the trial.

Zimmerman's attorneys Mark O'Mara and Don West said they hadn't been paid a cent and that many interns were working on the case without pay.

Attorneys for George Zimmerman subpoenaed the information technology director in State Attorney Angela Corey’s office for a Thursday hearing hashing out whether prosecutors intentionally withheld reports from Zimmerman’s defense team.

Corey’s office is prosecuting the second-degree murder charge against Zimmerman in the killing of 17-year-old Trayvon Martin, a case that is set for trial next week in Seminole County.

The hearing Thursday will feature testimony by Ben Kruidbos, the information technology director. His attorney said Kruidbos is prepared to testify he recovered deleted photos and messages from Martin’s cellphone data, and that Kruidbos told Assistant State Attorney Bernie de la Rionda about that information in January.
