Prosecutors said George Zimmerman defense attorney Mark O'Mara is "grandstanding" in his motion that asks for the state to be fined.
O’Mara said the state violated the discovery process by not revealing significant information about the state’s "star" witness -- the girl known as Witness 8.
We obtained a copy of the state's response to O'Mara's request for the fines.
Assistant State Attorney Bernie de la Rionda was certainly not happy about it.

The STATE'S RESPONSE TO DEFENDANT'S MOTION FOR SANCTIONS AGAINST STATE ATTORNEY'S OFFICE FOR DISCOVERY VIOLATIONS, while pointed, has little substance that addresses the very serious motion we have before the Court.
From a legal perspective, the Zimmerman case is about whether George Zimmerman acted in self-defense, but we understand that the case has also become important to the national conversation about race relations, about gun control, and about “Stand Your Ground” laws. Although the Court will not be able to resolve these larger issues, we as the defense team, have chosen to engage in the national conversation in a responsible and respectful way.
George Zimmerman was arrested under an extraordinary set of circumstances, and he is being prosecuted under similar circumstances. As we prepare for a jury trial in June, we have real concerns about George’s ability to receive a fair trial. The DEFENDANT'S MOTION FOR SANCTIONS AGAINST STATE ATTORNEY'S OFFICE FOR DISCOVERY VIOLATIONS is not a frivolous attack on the prosecution, it is a serious attempt to seek remedy for discovery violations that have a substantial impact on our ability to defend George.
What is at stake is George Zimmerman’s right to a fair trial, and in a broader sense, what is at stake is the sanctity of the criminal justice system and its ability to function properly under the incredible public and political pressures that have been placed upon it.

News 13 legal analyst Mark NeJame says the back and forth jabs between attorneys in the George Zimmerman case appear to be getting personal, which could have an outcome on the case.
In a state response filed Thursday, Assistant State Attorney Bernie de la Rionda uses a scene from Shakespeare’s “Macbeth” to describe Zimmerman’s defense.
“[A] walking shadow, a poor player That struts and frets his hour upon the stage…”
It’s part of a scathing response by the Zimmerman case prosecutor to the defense attorney’s motion asking for prosecution to be sanctioned because of prosecutorial misconduct.
“He believes that he was basically defamed, accused of prosecutorial misconduct, which is the worst thing you can accuse a prosecutor of,” said Nejame.
Zimmerman’s defense accuses the state of withholding that their star witness, the young woman believed to be Trayvon Martin’s girlfriend, lied under oath when she said the reason she wasn’t at Trayvon’s funeral is because she was at the hospital.
“I think it hurts the state’s case, because if she’s a key witness, and her credibility is under attack, then there’s really not a lot left standing,” said Nejame.

In the girl's letter to Martin's parents, dated March 19. 2012, she misspells Trayvon's first name twice (referring to him as Trevon). She writes that she was "on the phone with Trevon when he decided to go to the cornerstore [sic]."
She continues: "It started to rain so he decided to walk through another complex because it was raining to [sic] hard. He started walking then noticed someone was following him. Then he decided to find a shortcut cause the man wouldn't follow him. Then he said the man didn't follow him again. Then he looked back and saw the man again. The man started getting closer. Then Trevon turned around and said why are you following me. Then I heard him fall, then the phone hung up."
The Sentinel reports that Witness 8 has been caught in two apparent lies: she reportedly misstated her age and lied about being hospitalized during Martin's wake.
The defense reportedly denied any misconduct regarding its handling of the girl's statements.

Attorneys for George Zimmerman Thursday asked an appeals court to reverse the decision of a Sanford judge and allow them to make Benjamin Crump, the attorney for Trayvon Martin's family, answer their questions under oath.
It is a battle defense attorneys have been fighting – and losing - for months.
They twice asked Circuit Judge Debra S. Nelson to allow them to depose Crump, and she twice said no, most recently one week ago.
Now, they've asked the Fifth District Court of Appeal in Daytona Beach to overturn her decision.
"A civil lawyer with a vested interest in the outcome of the case should not be allowed to keep evidence from law enforcement; potentially influence significant witnesses; speak on national television about evidence he claims to exist and witnesses he has spoken with; accuse several law enforcement agencies of dishonesty; otherwise play a central role in the media persecution … yet claim he is not subject to a deposition regarding non-privileged matters," wrote defense attorneys Mark O'Mara and Don West.

grace-land...TY for the link re: MOM/West filing a writ with the 5th Circuit Court of Appeals, asking that the appeals court overturn the Judge's denial for the defense team to depose Crump.

Trayvon Martin's family has reached a settlement in a wrongful death suit they filed against the homeowners association of the sub-division where Martin was killed, the Orlando Sentinel reports.
Martin was shot to death just steps from his father's home on Feb. 26, 2012, by volunteer neighborhood watchman George Zimmerman. The case drew national attention last year as the Sanford Police Department vacillated on whether to file charges against Zimmerman, who indicated that he'd shot Martin only after being attacked. Zimmerman has been charged with second degree murder and is currently awaiting trial.
Portions of the settlement released Friday do not specify how much money Martin's family will receive, but according to the Sentinel, the figure is believed to be in excess of $1 million. The settlement does, however, state that Zimmerman is not part of the agreement. Lawyers for Martin's family have made it clear that they still plan to file a civil claim against Zimmerman at a later point.

They settled already before the trial?
Didn't Trayvon's parents say that it wasn't about the money? Sure it wasn't.
Sickening really in my opinion. Sue Zimmerman if he is found guilty, not the innocent homeowners association...of course Trayvon's parents went after the deeper pockets...

George Zimmerman's attorneys say the state wasted time and money in a squabble over videotaping depositions in his murder case, but prosecutor Bernie de la Rionda countered that claim Thursday, arguing he was protecting a witness from harassment.
In a recent motion, Zimmerman's legal team asked Circuit Judge Debra Nelson for about $4,500 in financial sanctions, stemming from the deposition last month of a key state witness: The young woman commonly referred to as "Witness 8," who was on the phone with 17-year-old Trayvon Martin in the moments before he was shot by Zimmerman Feb. 26.
The defense says prosecutors were told in advance that the deposition would be videotaped, but objected on the morning it was scheduled, March 13, leading to a costly, unnecessary five-plus-hour delay.
But in the state's response, de la Rionda notes only one of the 56 depositions taken to that point had been videotaped. Despite written notice by the defense, the prosecutor says he didn't realize until he arrived that Witness 8 was going to be taped.
De la Rionda objected: Witness 8, he argues, "was scared and didn't want to be videotaped... The State felt the only reason for, all of a sudden, videotaping... was to intimidate and harass Witness 8" and Trayvon's family members, who were set for deposition in the following days.
De la Rionda's new filing acknowledges that Nelson ultimately denied his objection, but he argues no sanctions are merited
. The state's objection which led to the delay was "perfectly legal... grounded in law and made in good faith," he says.
There are two defense requests for sanctions against the state currently pending: The other also involves Witness 8, and alleges that the state failed to reveal in a timely fashion that she had made false statements. In response, de la Rionda blasted that claim as "craven" grandstanding by defense lawyer Mark O'Mara.

::snipping2::Under the terms of the settlement, Trayvon Martin's parents and his estate agreed to set aside their wrongful-death claim and claims for pain and suffering, loss of earnings and expenses, the Sentinel reported.
According to a cover page attached to the settlement that was placed in Zimmerman's criminal case file, copies of the settlement were given Thursday to Zimmerman's attorney, as well as to the prosecutor and the judge, the newspaper reported.
Crump has previously said he intends to file suit later against Zimmerman, and the settlement specified that Zimmerman was not part of the homeowner association's deal. ::snipping2::

Robert Taylor, founding partner of Taylor & Carls P.A., a law firm that represents homeowner associations but has no connection to the Retreat at Twin Lakes, told the Orlando Sentinel that the settlement did not mean the association admitted any wrongdoing or liability. Taylor said the decision to settle was most likely a business decision.
“It’s really nothing more than a risk-versus-reward analysis,” Taylor said.
“When claims are filed, they’re filed against anybody who could possibly have any culpability,” he said.
He said Martin’s parents must have concluded that Zimmerman’s homeowners association had culpability.
The association’s insurer, Travelers Casualty and Surety Co. of America, issued a statement saying it wasn’t party to the settlement.
“The settlement would have been with other insurers of the homeowners association and/or the property managers,” the statement said.
“It is understood and agreed that the payment made herein is not to be construed as an admission of any liability by or on behalf of the releasing parties; but instead the monies being paid hereunder is consideration for avoiding litigation, the uncertainties stemming from litigation as well as to protect and secure the good name and good will of the released parties,” said the language in the settlement.
Under the terms of the settlement, Martin’s parents, Sybrina Fulton and Tracy Martin, and his estate agreed to set aside their wrongful-death claim and claims for pain and suffering, loss of earnings and expenses.
Crump has said he will be filing a wrongful death suit later against Zimmerman. The settlement stated that Zimmerman was not part of this deal.
