Documents from the Lafayette Parish Correctional Center confirm Brandon Scott Lavergne was checked out of the jail Tuesday. According to the document, Lavergne was checked out at 6:40 Tuesday morning. Officials with the Lafayette Parish Sheriff's Office say Lavergne was returned to the jail between 3:00 P. M. and 3:30 P

Also Tuesday, authorities said Brandon Scott Lavergne, 33, the man accused of kidnapping and killing Shunick, was checked out of the Lafayette Parish Correctional Center for an unspecified amount of time, but it was not clear late Tuesday who checked him out and why.

The inmate custody sheet shows that Lt. Jack Lightfoot, an investigator with the Lafayette Parish Sheriff’s Office assigned to the Shunick task force, checked out Lavergne from the facility at 6:40 a.m. Capt. Kip Judice, spokesman for the Lafayette Parish Sheriff’s Office, said Lightfoot returned Lavergne at 3 p.m. or 3:30 p.m. Tuesday.

Police would not say whether Lavergne led authorities to the body.

Mickey Shunick' Body Is Excavated, Jewelry and Clothing Found

The body that police believe belongs to missing Louisiana student Mickey Shunick was excavated from a remote wooded area along with some clothing and jewelry.

"Right now, the body is in the hands of the coroner's office and forensic experts," Cpl. Paul Mouton of the Lafayette Police Department told ABCNews.com today. "We feel very strongly that this is Mickey Shunick. We just can't say with 100 percent certainty that it is, in fact, hers."

Mouton said it could take "a day or two" before the body can be positively identified. The body was found in a remote wooded area near a cemetary, about 45 miles from where Shunick disappeared.

"There were some things such as clothing and jewelry that were removed from the site," Mouton said. The site has been fully excavated and the crime scene has already been released, he said.  ::snipping2::

According to Lafayette Parish Coroner Chief Medicolegal Investigator Keith Talamo, dental records received today and sent to LSU FACES Laboratory identified the body found in Evangeline Parish as that of Mickey Shunick.
 
LSU FACES Dir. Mary Manhein told the coroner's office she will complete her examination and determine cause and manner of death in about two weeks and a report will be sent to Lafayette Coroner Dr. Kenneth Odinet., said Talamo.  ::snipping2::

Police say the body discovered in Evangeline Parish was that of Michaela "Mickey" Shunick. Her family said today they can begin the healing process now and are asking for privacy from the media.

They say "she deserved a long and happy life filled with love and laughter" but news that the body was Shunick's has proved otherwise

Shunick Family Statement

Our world became a better place on May 21, 1990, when Mickey came into this world. She brightened the lives of everyone she touched. She deserved a long and happy life filled with love and laughter; but unfortunately today's news has proved otherwise.

Today, we begin our lives without Mickey. We have not just lost our daughter, and our children have not just lost their sister; but all of us have all lost a part of ourselves. Now, as we begin our healing process, we can only ask for a bit of privacy from the media and the public during this somber time.

We have been so touched by the thousands of strangers who have shown us their support during this difficult journey. We can never begin to repay all of you for you time, generosity, and unending support and love, and we know that Mickey would feel the same.

Also, we have to remember that we are not the only family that has been hurt by this tragedy. Please consider in your thoughts the other families that have unwillingly been made a part of this crisis.

As we close, let us remember to always be inspired by who Mickey was: her contagious smile, her love for all creatures, her devotion to family and friends, her passion for her students (for whom she served as a role model), and last but not least, the ray of sunshine she projects that will continue to make our world a little brighter.

We thank you for respecting our privacy in this difficult time by allowing us this opportunity to share these words with all of you today. Again, though we may now grieve for the loss of our daughter, let us also move forward by celebrating her life.

Hearing set Friday in Brandon Lavergne case
August 14, 2012

Fifteenth Judicial District Court Judge Herman Clause set an evidentiary hearing for 10 a.m. Friday in the case of Brandon Scott Lavergne, the man accused of killing Mickey Shunick and Lisa Pate.

Assistant District Attorney Keith Stutes, lead prosecutor in the case, requested the hearing this morning.

The request states that the evidentiary hearing be "limited to the perpetuation of testimony."

Lavergne was indicted July 18 by a Lafayette grand jury for the first-degree murder of Shunick and Pate.

Lafayette defense attorney Bill Goode, who is not involved with Lavergne’s case, said “perpetuation of testimony” is a procedure used to preserve testimony for a future trial and is usually limited to instances where a witness is sick, dying or leaving the state and would be unable to testify at the trial.

“It’s kind of unusual in criminal cases,” Goode said.

The court-issued summonses for the hearing are limited to Stutes, Lavergne and his attorneys, Burleigh Doga and Clay Lejeune, according to court records.

Attorney Kevin Stockstill, who is also not involved in the case, said testimony at the hearing would not be limited to just those who received a summons.

The state could withhold the name of a witness who may be testifying, he said.

Stockstill said the only way defense attorneys would allow Lavergne to testify at the hearing “is if they have struck a deal and there was a plea agreement. … Other than that, they wouldn’t allow him to get under oath.”

5:51 p.m. CDT, August 15, 2012

LAFAYETTE, LA— As the case against the man accused of killing Mickey Shunick moves forward, family and friends begin planning a public memorial to celebrate the life of a young woman who captured the attention of a nation.

Josh Cohen, a representative for the Find Mickey Now volunteer group, told NBC33 News that a public memorial is in the works and should happen sometime within the next month. He says the event will most likely occur in downtown Lafayette and will include live music.

Shunick's body is currently being processed for evidence at the FACES lab in Baton Rouge. We're told it could take up to two weeks before that part of the investigation is completed.
Cohen tells us that a funeral will be held once Shunick is returned to Lafayette. We're told the funeral service will be closed to the public and only close family and friends will be allowed to attend.

LAFAYETTE -- Testimony will be given Friday in a murder case involving a sex offender who has been charged with killing two Lafayette women, but court officials have not disclosed the identity of the person to testify.

Judge Herman Clause of 15th Judicial District Court granted a request Tuesday by Assistant District Attorney Keith Stutes, lead prosecutor on the case, for an evidentiary hearing. The hearing is set for 10 a.m. Friday.

"If you're afraid that one of your witnesses ... is not going to be available to testify at trial, then you can perpetuate their testimony," he said.
