Cincinnati babysitter claims ibuprofen, fall led to 1-year-old's death


CINCINNATI - New details emerged at an arraignment hearing Monday morning for the babysitter charged in connection with the death of a 1-year-old boy.

Marquita Burch, 27, faced a judge at the Hamilton County Justice Center after police found the body of the boy she was babysitting, 1-year-old William Cunningham, in a Winton Road apartment Saturday morning. Burch originally told Covington police on Friday that the baby was missing. She later changed her story, directing police to the Cincinnati apartment, where they found the boy's body in a hallway closet.

Burch was charged with abuse of a corpse and tampering with evidence after the discovery of the body.

Derek Gustafson, Burch's attorney, said the boy suffered an accidental injury after falling down steps. Burch gave the boy ibuprofen and put him to bed, and the following morning Cunningham was found dead according to Gustafson.

Police: Child Dead Hours Before Being Reported Missing


CINCINNATI -- Police say a toddler was dead hours before he was reported missing by his babysitter.

William Cunningham's body was found in a closet in a Winton Road apartment on Saturday. The 1-year-old appeared to have died of some sort of head trauma, police said Monday.

His babysitter, Marquita Burch, 26, led officers to the body after originally saying William was playing with other children when he disappeared Friday evening in Covington.

Investigators told News 5's Brian Hamrick that it appeared the toddler had been dead for at least 48 hours when he was found.

Family of dead baby vows to follow court case against babysitter


CINCINNATI - After a second vigil for 1-year-old William Cunningham in two days, his family is now vowing to follow the case of his babysitter through its run in court. They say they want to get answers as to what led to the baby's death as well as getting justice for the child and his family.

More than 100 family members, friends and neighbors showed up in Winton Terrace Sunday night to hold a candlelight vigil for the child. They also asked for the group to start giving what they could to a fund being set up to pay for the 1-year-old's funeral. Arrangements were still pending Sunday night.

Coroner: Child dead 'at least 48 hours' when found

Marquita Burch’s attorney said William Cunningham, the 1-year-old Burch was babysitting just before he died, fell down some steps Friday, so she gave him ibuprofen and put him to bed.

When Burch woke up the next morning, her attorney told Hamilton County Municipal Court Judge Fanon Rucker at Monday’s hearing, the 1-year-old was dead.

Hamilton County Coroner Dr. Lakshmi Kode Sammarco, though, said the child had been dead for two days or more when found Saturday in Winton Place.

“We’re still running some tests but we think it was at least 48 hours,” Sammarco said Monday.

The child “had head trauma. He had a bleed in the head.”

The coroner wants to X-ray the boy’s body, she said Monday “to look for any other fractures.”

It could take days before more definitive information is available.

Stand back, I'm gettin ready to blow my top!!!!!.....100 people showed up for a vigil but not one damn person could/would drive the so called Mother to get her 1yo child from a woman who did not bring him back after the first time she asked???????!!!!!!!  I don't know all the circumstances but if Mom asked more than once to bring him home then she must have been able to take care of him so I gonna say she should be charged with neglect!!!  I was sitting here wondering how the phone convo would go between me and someone with my child and I had to remind myself that no one but my Mother ever kept my child but after the first no I would have a police escort or a wellness check!  Sorry, I'm mad and I don't think the killer is the only one to blame!

Coroner: 1-year-old suffered head trauma


CINCINNATI - Hamilton County Coroner Dr. Lakshmi Sammarco released new information Tuesday on the death of 1-year-old William Cunningham.

Dr. Sammarco told 9 News an initial autopsy of William Cunningham showed the baby had trauma to his head, blood inside his skull and an injury to the brain. Although toxicology reports will take weeks to come back, the condition of the body when it was found Saturday morning already provided clues.

"I can tell you that his body was wrapped in a sheet inside a plastic bag that was placed inside another plastic bag with laundry in it and it was found in the closet of an apartment," Dr. Sammarco explained.

Coroner: Toddler Found Dead Suffered Head Trauma

William Cunningham may have been dead as long as five days before the babysitter who claimed to be his mother led police to him. Marquita Burch is facing charges for moving the boy's dead body, but no one has been charged with his death.

Today, the Hamilton County coroner updated Local 12 news reporter Joe Webb on the investigation.

People close to Burch had told us the boy was dumped in a laundry bag, and today, the coroner added details to how he was found. She also said the preliminary cause of the baby's death is a head injury. Now, they have to figure out if it was an accident or if someone intentionally hurt the boy and ultimately killed him.

Last Friday was the first day anyone suspected something happened to one-year-old William Cunningham. Burch told Covington police he walked away from a play area in the City Heights housing complex. That launched an unnecessary manhunt.

After she came clean, police found the baby Saturday in a closet in a Spring Grove Village apartment. He had been there a while. Hamilton County Coroner Lakshmi Kode Sammarco says, "Because of the decomposition of the body, we believe that it was in the range of two to five days."

That makes sense to people who grew up with Burch in City Heights. Nykiah Thomas says Burch, who she calls "Pumpkin," didn't just show up on Friday. Thomas says, "She had been around several days before Friday and had come, but she did not have him with her. One day she came over and was sad for a whole day and then came back and was just Pumpkin. That's why we never thought nothing of it."

In court, Burch's attorney said the boy fell down some steps.

Kiera Williams, the boy's mother, said it was not uncommon for Burch to watch her son for days at a time.

A Hamilton County grand jury handed up a Monday indictment against Marquita Burch but not for the death of 13-month-old William Cunningham – yet.

Burch, 26, was indicted for gross abuse of a corpse and tampering with evidence in the death of the child. No one has been charged with the child’s death, but that will change.

Prosecutor Joe Deters said Burch is the only suspect officials are looking at in connection with the child’s death.

“These are the initial charges to hold” Burch, Deters said. “Charges involving the death of the child will be presented to a grand jury at a later time.”

Monday’s charges carry a maximum prison sentence of four years. Any potential murder charge would carry a maximum sentence of life in prison.

Burch is in the Hamilton County Justice Center and has been for more than a week after she reported to Covington officials the child’s disappearance.

Babysitter charged in toddler's murder due in court

CINCINNATI - The babysitter who was caring for a 13-month-old boy who died, then took his body to an apartment instead of reporting his death was scheduled to be in court Wednesday, but her case was continued to Sept. 21.

Marquita Burch, 26, was charged with counts ranging from child endangerment to involuntary manslaughter and abuse of a corpse and she was indicted on six felony counts in July that could send her to jail for the rest of her life.
