Yeah, my guess is Wendy Holland knows all about having a predisposition to lie.  Bet she's never volunteered to be hooked up to a lie detector and answer questions about Brittney's disappearance or her husband's death either.  She makes me sick!

An Alabama woman accused of being part of an alleged family sex ring is challenging the testimony of a key witness.

Wendy Wood Holland says a child witness against her has made numerous false statements and has a predisposition for giving false testimony.

A judge has scheduled a hearing for Monday in Bay Minette on the claims.

Holland is charged with sodomy, sexual abuse and other crimes as part of what authorities say was a group of relatives who shared children for sex.

BAY MINETTE, Alabama - A Baldwin County judge wants to take time before deciding whether to grant a hearing into the suitability of a witness in a case against one of the key figures accused of being involved in a string of sex-related crimes against children.

Judge Jody Bishop will also consider whether one of the co-defendants in the case was "coerced" to testify against Wendy Wood Holland during her trial, scheduled to begin Dec. 8. Also, Bishop said he will consider whether Holland's sexual history with consenting adults should be mentioned during the trial.

Bishop's requests to take the issues up for consideration came after a hearing on Monday on five separate court motions by defense attorney Mitzi Johnson-Theodoro, who claims that Holland, 35, is ready for her trial to begin.

Bishop ruled against two of those motions: The case will not be relocated to another county because of pre-trial publicity, and the Mobile County's Department of Human Resources office does not have to hand over camera footage and other documents to the defense.

Holland is accused of sodomy, child sexual abuse, sexual torture and endangering child welfare as part of an alleged circle of family members and friends who shared children for sex.

Holland is the maternal aunt of missing mother Brittney Wood, who hasn't been seen since 2012, and who authorities presume is dead. Wood was last seen with Holland's late husband, Donnie Holland, who died from a gunshot suicide a few days after she disappeared.

Authorities suspect Donnie Holland was the alleged ringleader.

Holland, who was dressed in a red inmate jumpsuit, did not comment during the court hearing or to the local media afterward. Heavily shackled, she was escorted to the Baldwin County Jail following her court appearance.

 

Sex with adults

Johnson-Theodoro said that Holland's sexual history pertaining to her encounters with adults should not be part of testimony before a jury. It's one of the three motions that Bishop is mulling over.

"It could be very prejudicial," she said. "There is no relevance to those relationships that she had with her husband and adult-related persons that should be allowed in this trial. It is irrelevant to this case to the four counts she has alleged to have committed."

Heinz disagreed, and said the sexual history will describe a "set of circumstance" and the "lifestyle" that one of the victims claimed she grew up in.

"I don't know any other way for my victim to describe what she saw on a daily basis than what she saw on a daily basis," Heinz said.


A "tainted" victim?

Johnson-Theodoro said there are "some documents" that have since been issued by the state questioning the "veracity and truthfulness" of a witness in the case. As such, she is requesting Bishop to consider a hearing on the reliability of the witness.

Heinz said the victim hasn't been coerced to give any statements.

"I think our victim is more than competent to testify in the case," she said.

BALDWIN COUNTY, Ala. (WALA) – It’s been nearly three years since authorities in Baldwin County began investigating allegations of child sex abuse surrounding the family of missing teen Brittney Wood.  In that time 11 different suspects in both Mobile and Baldwin Counties have surfaced.  In Baldwin County, six suspects have been indicted so far.  Monday, December 8, 2014 the trial for Wendy Holland, Wood’s aunt will get underway.

Baldwin County Assistant District Attorney, Teresa Heinz was busy Thursday reading witness statements and preparing for another trial.  With the conviction of Brittney Wood family friend, William Brownlee in October, Heinz is now focused on getting the same result for Wendy Holland.

Holland faces charges of endangering the welfare of a child, sodomy first degree, sexual torture and sexual abuse of a child less than 12.  Holland’s defense had asked for a change of venue, a hearing to question the credibility of the  prosecutions’ key witness and they filed a motion to force the prosecution to clarify their indictment.  Circuit Judge, Jody Bishop denied all motions.  There will however be a larger jury pool from which to choose.

“In a case like this potentially because there has been a large amount of media attention, we are extra careful in that we have enough people in the pool from which to choose from so that’s what we’ve done in this case is we’ve gotten a larger panel,” Heinz said.

BAY MINETTE, Alabama - A Baldwin County judge has denied a request to dismiss the charges against a key figure in a family sex ring.

An attorney for Wendy Wood Holland, 35, requested Monday that charges of sodomy, child sexual abuse, sexual torture and endangering child welfare, be dropped because not enough facts were given by the District Attorney's Office to support the charges and that the statute of limitations had run out on them.

Judge Jody Bishop, on Thursday, denied the requests. He also denied a request to continue the case, setting up the stage for a jury trial to begin 9 a.m. Monday.

The dismissal request were the latest in a series of motions filed by defense attorney Mitzi Johnson-Theodoro in an attempt to get the case tossed out before it goes to trial. She had previously attempted to get the case heard outside of Baldwin County, and questioned the suitability of a child witness.

Holland's attorney Mitzi Johnson-Theodoro accused the office of not forwarding more than 1,000 pages of what she said was important information pertinent to a jury trial that is slated to begin within hours.

BAY MINETTE, Alabama - Approximately 75 jurors were questioned Monday on their views about sexual abuse, how they felt about lying and whether they were exposed to media publicity in the case against Wendy Holland her missing niece, Brittany Wood.

The juror questioning lasted most of Monday afternoon and into the evening as attorneys screened potential jurors for seating in Holland's trial. She faces up to 50 years in prison on charges of sodomy, child sexual abuse, sexual torture and endangering child welfare as part of an alleged circle of family members and friends who shared children for sex.

Jurors took two hours to convict Wendy Wood Holland, 35, of sodomy, sexual abuse, sexual torture and child endangerment. She showed no emotion when the verdict was read. Prosecutors say Holland faces at least 20 years in prison and could get a life sentence.

BAY MINETTE, Alabama -- Wendy Holland, the 35-year-old woman accused of multiple sex crimes involving a child, has been convicted of guilty of sex abuse of a child, sodomy, endangering welfare of a child and sexual torture.

The Baldwin County District Attorney's Office presented its case on Tuesday, which was highlighted with testimony from the child victim. The emotional statements were backed with similar testimony from participants in the family sex ring. Authorities have arrested 11 people total, eight of whom are related.

Holland faces up to 50 years in prison -- the equivalent of a "life sentence," according to her attorney - on charges of sodomy, child sexual abuse, sexual torture and endangering child welfare as part of an alleged circle of family members and friends who shared children for sex.

3:56 p.m. - Sentencing will be at 9 a.m. Jan. 15 in Baldwin County.

3:53 p.m. - Holland is guilty of sex abuse of a child, sodomy, endangering welfare of a child and sexual torture. More soon at al.com/mobile

3:50 p.m. - The jury is ready. A verdict will be announced real soon.

2:59 p.m. - The jury is requesting the journal of the victim, which will be given to them. They are now more than an hour into deliberations.

2:20 p.m. - Bishop read the definition to jurors -- sodomy of the 1st degree involves an adult with a minor under age 12. It also involves sexual acts to the mouth or anus.

2:17 p.m. - The jury is returning to the courtroom because they want the definition of sodomy in the 1st degree re-read to them.

2:12 p.m. - I will post the verdict immediately on here once the jury returns from its deliberations. In October, it took a jury 20 minutes in Mobile County to return guilty verdicts of family friend, William Brownlee, on sodomy and sexual abuse.

2:02 p.m. - The jurors officially begin their deliberations at 1:57 p.m.

1:55 p.m. - The jurors, 12 of them, have to come back with an unanimous decision. There are two alternative jurors.

1:29 p.m. - Bishop is back in the courtroom and we're awaiting the jury's arrival before they head off into deliberations.

12:23 p.m. - Lunch break now for 1 hour. The jury will return at 1:30 p.m.

12:20 p.m. - Heinz on the defense witnesses: "Who wants to be involved in this. No one wants to be involved with this."

12:18 p.m. - Heinz said that she doesn't have any physical evidence. Regarding pictures and videos, Yvonne Hall said that Holland erased it.

12:16 p.m. - Heinz tells the jury to use their common sense when thinking about the child's testimony: "They don't lie to get into trouble. They lie to get out of trouble."

12:13 p.m. - Assistant D.A. in Baldwin County Teresa Heinz is now speaking. She said that someone's job doesn't define them.

12:10 p.m. - Defense attorney Mitzi Johnson-Theodoro on Holland:

"Wendy worked. She took care of her veterans. That is who she was. She changed bed pans, cared for them and washed and bathed them. She cared for her elderly. They want you to believe that a woman who cared for the elderly abused children?"

12:05 p.m. - Johnson-Theodoro said that if the jury believes the victim, then they have to also believe some of the false accusations the victim has made in the past.

12:03 p.m. - Johnson-Theodoro has brought props to her closing statements. She purchased red flags from the hardware store to illustrate why some people who took the stand might have testified in this case. For instance, with Kent, she said he's looking at a life sentence -- a "red flag," she said.

11:57 a.m. - Johnson-Theodoro is beginning her closing statements. She said there has been no evidence presented in the case.

"Almost all of the state's witnesses had huge reasons to lie. It's easy to get up on the witness stand and say whatever the government wants you to say for leniency."

11:55 a.m. - The only hope, Patterson said, is that the jury believe that the victim, Dustin Kent, Derek Wood and others are lying.

11:50 a.m. - Patterson: "How many generations will this go on?" She said that the victim had the courage to stand up and say this can't go on any longer.

11:44 a.m. - Patterson said the sex crimes were something that went on and on and on: "There are so many different configurations of people that over and over again, this was their life. It was a life created in large part by this woman."

11:40 a.m. - Patterson: "It's the ultimate betrayal."

11:35 a.m. - Patterson: "What (Holland) told that child is if you tell you anyone, the family will be broken up."

11:33 a.m. - Mobile County Assistant District Attorney Nicki Patterson is giving the closing statements for the state.

11:24 a.m. - Getting ready for closing statements before lunch.

11:05 a.m. - There will be no more witnesses for the defense. Prosecutors have left the court room to preparing their closing statements.

10:54 a.m. - Johnson-Theodoro is asking the judge to acquit Holland, saying the state has failed to establish much of a case. Bishop denied the motion.

10:52 a.m. - Johnson-Theodoro is asking for Judge Jody Bishop to continue the case because Kay Howard is not present. Bishop denied the motion.

10:45 a.m. - Johnson-Theodoro wants to have Kay Howard to testify, but she is recovering from a kidney transplant. Howard is a DHR investigator involved in this case.

10:31 a.m. - We are still in recess, but I'm going to add a quick editorial note to this -- there really is a lot I cannot report due to the sensitivity of revealing the victim and victims in this case. However, it's evident that the sexual abuses involving family members span at least three generations and, perhaps more.

10:23 a.m - The trial has been recessed for 20 minutes.

10:18 a.m. - The victim claimed that Wheeler was trying to starve her, but it was something that was told at school. Wheeler said the victim, who was living with her in January 2012, lost some weight and was eating healthier at the time.

10:03 a.m. - The victim's journal has been submitted into the case. Wheeler said there was nothing in there linking abuse to the victim by Holland.

9:57 a.m. - Wheeler said she was concerned about some of the false allegations that the victim made against some people, including the investigator in the case.

9:55 a.m. - Wheeler said she confronted the victim on more than one occasion about some the crimes. She also said that victim lied to her as well.

9:49 a.m. - Krystina Wheeler, 25, Wendy Holland's stepdaughter -- Donnie Holland's daughter, is on the stand.

9:46 a.m. - The friend said that the victim never told her about any of the 11 people who was charged in the case.

9:44 a.m. - The victim's friend never confided in her about any harm that was done to her.

9:37 a.m. - The friend said that victim made untruthful statements about her while she was interviewed by a DHR investigator.

9:33 a.m. - A 16-year-old friend of the victim is now speaking.

9:29 a.m. - On cross-examination, Congo said the revelations about the criminal sex ring has been stressful on her daughter. She has had seizures and has trouble in school. Congo also said she doesn't want to deal with the "drama" of the crimes.

9:25 p.m. - Congo said she simply doesn't believe the victim and her concerns about lying while her daughter and the victim were friends for about 10 years. The victim is no longer allowed over at their house: "I just don't want to deal with the drama."

9:15 a.m. - Congo said her daughter quit talking to the victim after 2012.

9:13 a.m. - Congo said her only problem with the victim, over the years, was with lying.

9:12 a.m. - Trial resumes with Sherri Lynn Congo testifying. Congo's daughter was good friends with the victim in this case.

"Justice! Justice for Brittney! Justice for the victims," cries Brittney Wood's stepmother Stephanie Hanke after the sentencing of Wendy Wood Holland.

You could hear gasps in the court room as the judge handed down the maximum sentence to one of the leaders of the Wood family child sex ring.

"Wendy Wood Holland 99 years sex torture, 99 years sodomy 1st, 20 years sex abuse of a child, one year endangering the welfare of a child," says assistant district attorney Teresa Hienz.

A total of 219 years behind bars. "That's pathetic that is all the time they are getting," says Hanke.

A victory for prosecutor Hienz but one filled with mixed emotions. "As a Mom, as a person, I can't fix my victim. I can't make her whole and there's nothing that me or that judge could have done to undo this."

The victim in the case, who is now 16, did not want to speak at Wendy Holland's sentencing but she did write a letter.

"She talked about running through a maze her entire life," says Hienz. "She was always looking in the shadows. Waiting for the next person to hurt her."

She also ask that Holland be put in a place where she couldn't hurt other children. "These were people that regardless of what they had done to her she loved, she cared for and she protected and they didn't do the same for her."

 

Holland is 35 years old. She will have to serve at least 50 years of that 219 year sentence before she can be considered for parole.

She wasn't the only one facing the judge in this case.

Wood family friend William Brownlee, convicted last summer of sodomy and child sex abuse, also was given the maximum sentences, 20 years in prison.

The judge called Brownlee's behavior "depraved, disgusting and sickening."

The victim also wrote a letter to the judge about Brownlee asking the judge to show the same mercy Brownlee showed to her, none.

Brownlee and Holland both faces similar charges in Mobile county. No trial dates have been set.

Baldwin Council Circuit Judge Jody Bishop gave both Holland and Brownlee the maximum sentence and said each deserved more time. Each still faces additional charges involving other alleged victims.

In a letter read in court, the underage female victim in both cases said years of abuse left her traumatized. She has a hard time trusting anyone, gets angry easily and rarely feels safe.

“I was a little girl being held down and raped,” wrote the victim, who was in court.

Authorities said the two were part of a group of relatives and friends who sexually abused children and swapped their own kids for sex for years.

Holland is the widow of the alleged leader of the group, Donnie Holland, who was Brittney Wood’s uncle. The teen went missing around the time Holland was found with a gunshot to the head; his death was later ruled a suicide.

Wendy and Donnie Holland’s 22-year-old son Donald Paul Holland Jr. — charged with incest, rape and sexual abuse as another alleged participant in the ring — appeared before the judge in a closed hearing after his mother’s sentencing.

He was seen being arrested and led away in handcuffs afterward, but the outcome of his case wasn’t made public because he was handled as a youthful offender following a request by the defense.

Even without Brittney Wood to testify, two of her uncles and an older brother already pleaded guilty to sex charges before juries convicted Wendy Holland and Brownlee.

In the letter read in court, the underage teen abused by both Holland, a relative, and Brownlee, a family friend, compared her youth to being lost in a maze.

The teen said she felt like she was constantly looking into shadows around corners in fear of more sexual torture.

“The people who were supposed to protect me were the ones hurting me,” she wrote in the letter.

219 years. That was the maximum sentence Wendy Wood Holland faced this morning and that's exactly what she got.

 

"For a judge to basically say I'm imposing the maximum and if I could impose more I would. That sends such a positive message to my victim, sends such a positive message to all child victims that they would be believed," Baldwin County ADA Teresa Heinz said.

As part of their closing arguments, prosecutors read a letter from one of Holland and Brownlee's victims. It read in part:

"My momma didn't hold my hand unless it was to walk me off to one of those creatures in the shadows."

"She talked about running through a maze her entire life waiting for the next person to hurt her and if it was Billy Brownlee, she knew she would be hurt. She talked about Wendy and how she trusted her. And how she should've been the one to hold her hand through that. And she wasn't. She was only holding her hand to lead her to the next person who was going to abuse her," Heinz said.

Neither Holland nor Brownlee had anything to say before the sentences were read. But for Brittney Wood's stepmother Stephanie Hanke, today was absolutely a win.

"This is not giving us Brittney today, but this is a victory for Brittney," Hanke said.

And with Jennifer Moore still yet to be prosecuted in Baldwin County and more trials awaiting in Mobile County, Hanke hopes the events of Thursday will have a domino effect on the others charged and maybe bring Brittney home.

"I pray every night that when I wake up every morning that somebody's going to come and tell us where she is. That something's going to break, one of them's going to grow a conscience or one of them's going to get tired of sitting around in jail. One of them's going to turn on the other," Hanke said.

Mobile County court cases to move forward in Wood family sex ring, while Brittney Wood's stepmom continues public awareness push

Members of an incestuous family sex ring facing criminal charges against children will have their cases scheduled in Mobile County Court during a March 19 status hearing, Mobile County Assistant District Attorney Nicki Patterson said Wednesday.

The scheduling session will take place after Randall Scott Wood, 45, 1656 Darwood Drive, Mobile, goes before Judge Roderick Stout for an 8:30 a.m. court appearance on charges of rape, sodomy and enticing a child for sex. Wood is scheduled for a plea hearing.

The Mobile County cases are following court action in Baldwin County. Wendy Wood Holland, 35, was sentenced Jan. 15 by Baldwin County Judge Jody Bishop to 219 years in prison on charges of sodomy, sexual torture, and sex abuse to a child under age 12. She faces two sodomy counts in Mobile County.

 

Two others in the family sex ring will be sentenced in Baldwin County Court on Feb. 26: Wood and Dustin Kent.

The latest in the Mobile County Court hearings comes as more attention continues to surface on the whereabouts of Brittney Wood who, in 2012, went missing and was last seen by Donnie Holland Sr., who was married to Wendy at the time.

Donnie Holland was found dead with a bullet wound to the back of the head a short time after Brittney Wood disappeared. She was 19 years old at the time.

His death has since been ruled a suicide and Wood is presumed dead.

Meanwhile, Stephanie Hanke -- Wood's stepmother who has lead a public awareness campaign in the search for the missing woman - will speak about the case during an appearance on True Crime Radio.

The show will air at 7 p.m. Thursday.

"My goal, really, is that I don't want Brittney to ever be forgotten," Hanke, who keeps the public updated about the case on Facebook, said Wednesday. "I want to make sure Brittney's name will always be known. If nothing else, I don't want anyone to forget the name, 'Brittney Wood.'"

Hanke said she believes family members know the woman's whereabouts and are not talking.

"I think the ultimate goal, just the way everything seems to be laid out, is to get rid of her and blame everything on Donnie and that everything would go away," Hanke said. "It backfired."

Hanke said Brittney's daughter, Payton, "is going to know what her momma went through and she is not gone and forgotten."

Wood family member involved in incestuous sex ring to be sentenced Thursday

A member of the Wood family sex ring will be in the Baldwin County Courthouse Thursday to go before a judge for sentencing, while a non-related participant's judgment day has been delayed until May.

Randall "Scott" Wood, 45, of 1656 Darwood Drive, Mobile, faces prison time for a felony sodomy offense when he goes before Judge Jody Bishop during a 9 a.m. sentencing hearing in Bay Minette.

Meanwhile, Dustin Kent, 38, 7041 Marle Road, Mobile, had his sentencing pushed back from Thursday to 9 a.m. May 21, as an investigation continues.

Kent sentencing on hold

According to a court filing Thursday, Kent is cooperating with authorities in Mobile and Baldwin counties in several ongoing investigations. His involvement, the court documents reads, "is expected to have a potentially significant impact on his sentencing" and that a 120-day postponement was necessary.

Kent, on July 31, 2014, was the first of the people involved in the criminal sex acts to plead guilty. He faces sentencing on a guilty plea of second-degree rape and sodomy.

Wood and Kent are guilty of being involved in a family sex ring that involved children that has already led to lengthy prison sentences against Wendy Wood Holland and William Brownlee.

 

Stephanie Hanke, Wood's stepmother who runs a Facebook page keeping followers up-to-date on the latest happenings involving the legal proceedings, said she plans to attend Thursday's sentencing and is still hopeful some new information will surface on the missing teen's whereabouts.

"No one seems to be talking," she said. "(Randall Scott Wood) is one of the ones who went underground. He has stayed away from the cameras ... you have not seen or heard anything from him other than that he was arrested."

Hanke was critical of Wendy Holland, who she said showed "no remorse" during a jury trial that included the victim's jarring testimony about years of sexual abuse.

"For the victim's sake, I am ready to see some remorse from the guilty parties," Hanke said.

A Mobile man and uncle to missing teen Brittney Wood was sentenced to prison Thursday for his involvement in an incestuous sex ring that has resulted in 11 arrests in Mobile and Baldwin counties.

Randall "Scott" Wood, 45, was sentenced to 15 years in prison, but he will only have to serve up to three years under a split-sentence imposed by Judge Jody Bishop.

Under terms of the sentencing guidelines, Wood will serve five years probation after he is released from prison. The balance of his sentence is suspended, meaning that if Wood serves out the terms of his probation, the remainder of his sentence is dismissed.

Wood was one of the family members to plead guilty to sex-related crimes that involved minors and which led to Bishop rendering a 219-year sentence to Wendy Holland, who is believed to be one of the ringleaders in a string of sex crimes to children.

Wood faces additional sentencing in Mobile County. He is scheduled for an 8:30 a.m. plea hearing on March 19 on felony charges of rape and sodomy. He also faces a charge of child enticement.

Bishop ruled that Wood's sentencing in Baldwin County will run concurrent with whatever sentence he might get in Mobile County.
