29 jurors retained, 26 still need to be questioned
(June 14, 2013)

Lawyers interviewed seven potential jurors Friday and 41 overall since jury selection began Monday.

Six from Friday's group were asked to return Tuesday, along with 23 jurors retained earlier in the week for a total of 29 jurors retained for the second round of voir dire questioning.

Judge Debra Nelson also ordered 26 jurors who have yet to be questioned to return Monday. Lawyers want a pool of 40 before they move on to round two of juror interviews.

As court began Friday, the judge asked the defense about their last voice expert witness, so they can complete a Frye hearing regarding expert testimony about who was screaming in a 911 call made by a witness of the 2012 shooting.

The judge incidated the Frye hearing could happen one evening next week after regular jury selection. The defense's expert lives in California, so a 5 p.m. Frye hearing would mean it's 2 p.m. on the West Coast.

In Trayvon Martin case, history's ghosts linger

Focus on the details, and the cases seem very different. One was killed by virulent white racists, the other by a part-Hispanic neighborhood watchman who insists he faced a vicious attack. One was weighted down and dumped in a river; in the other case, police were called by the shooter himself.

Six decades and myriad details separate the deaths of Emmett Till and Trayvon Martin, two black teenagers felled by violence. Yet in the way America reacted to Martin's death - and the issues that echoed afterward - his case has created a national racial conversation in the much same manner as the saga of Till, infamously murdered in 1955 for flirting with a white woman.

Plenty of people do not see the Martin case as about race at all. But for others who study America's racial past and present, each killing is a defining moment for its era - a fraught microcosm of what we are, and what we are trying to become.

"Trayvon Martin is today's race case," says Christopher Darden, a prosecutor in the O.J. Simpson murder trial, another defining American moment. "I don't know that anybody can really sit there and objectively look at the evidence. It arrives with so many different kinds of emotions."

Just as the Till saga remains a searing archetype of the brutal segregation that gave rise to the civil rights movement, the Martin case captures the ambiguous meanings of race in America at a time when both the president and the lowest segments of society are black.

Emmett Till showed what needed to be done in 1955. Now, Trayvon Martin reveals to us the racial landscape of 2013.

"Trayvon Martin certainly is the Emmett Till of the hoodie generation," says Michael Skolnik, a board member of The Trayvon Martin Foundation and president of GlobalGrind.com.

"This case represents so much for our country," Skolnik says. "It represents issues of race, issues of police priorities for different communities. It represents the status of young black men in America."
 

"I've been doing work around police brutality and racial hate crimes for over 20 years, but I've never seen one resonate with so many people like the Trayvon Martin situation," says Kevin Powell, president of the advocacy group BK Nation and editor of "The Black Male Handbook: A Blueprint for Life."

"He became this symbolic figure for how much has not changed in America in spite of a black man being in the White House," Powell says.

To some, the Martin-Zimmerman case is about media distortion when it comes to race. Some view it through the prism of whether Florida's "stand-your-ground" law is legitimate.



 
And for others, the case symbolizes that black people see racism when there is no evidence of it.

"I reject the idea that this happened specifically because of color," says Mychal Massie, a columnist and former chairman of the black conservatives leadership group Project 21.

"I'm not saying that Martin deserved to be shot," Massie says. "I'm also not saying he was a paragon of virtue. Indications are he was not singled out because he was black. He was singled out because he was there, Zimmerman was doing his job as a neighborhood watchperson, and he saw a stranger."

Massie strenuously objects to any comparison between Till and Martin. Till, Massie says, died in "a different time."

There certainly is no comparison between the killers, or the circumstances surrounding their actions: Two white men abducted the 14-year-old Till, pistol-whipped and shot him, then dumped him in a river with a weight barb-wired around his neck. Zimmerman, whose father is white and mother is from Peru, identifies himself as Hispanic. He says he fired in self-defense because he was being viciously beaten by Martin.
 
For Massie, the significance of the Martin case is simple: Black males commit a disproportionate percentage of crimes. "What it shows," he says, "is the continued predilection for misbehavior by so many young urban people, regardless of color."

"The tragedy of Trayvon Martin is that, if as many of us believe he initiated this assault, he paid the ultimate price for a bad decision," Massie says.

I agree, some of them are softballing their knowledge of the case but my husband abhors the news and avoids topics about anything in the news so this could be true of at least some of the jurors as well.

Also, we watch very little tv and never watch news channels.  I'm just waiting for a potential juror to say they get their case info from Scared Monkeys

I agree, some of them are softballing their knowledge of the case but my husband abhors the news and avoids topics about anything in the news so this could be true of at least some of the jurors as well.

Also, we watch very little tv and never watch news channels.  I'm just waiting for a potential juror to say they get their case info from Scared Monkeys

Jerry Counelis, 55, eliminated from jury pool after defense finds 2012 Facebook post

The potential juror, 55-year-old unemployed painter and guitar player Jerry Counelis, was eliminated from the jury pool on Wednesday after defense attorneys found a posting from him on a Facebook page from 2012.

Counelis was at the courthouse on Friday during the lunch hour complaining about his anonymity and saying he is hiring an attorney. According to the trespassing report, Counelis walked into the foyer of the jury assembly and expressed his privacy concerns and animosity toward the jury process to the clerk.

Authorities approached him and said that as a dismissed juror he could not be in the jury assembly area or have any contact with potential jurors until after the trial.

Counelis then said, "do they know what they are in for!" pointing to the jury assembly room.
He was trespassed by authorities after about 30 minutes.

Zimmerman's attorney, Mark O'Mara said at a news conference after the proceedings that if Counelis had approached the potential jurors he would have cost the court system "a week of time, thousands of dollars," and more.

"That's devastating to this process," he said.

Counelis' March 21, 2012 posting in question was on the Facebook page called "The Coffee Party Progressive," a political Facebook page that posted a comment calling for "justice for Trayvon."

Counelis told attorneys during questioning that he only determined that Zimmerman should be arrested after an arrest was made in the case. The posting was found on Facebook more than two weeks before Zimmerman was arrested.

SANFORD, Fla. — Within days of becoming the police chief in this small city outside Orlando, Cecil E. Smith began to see clearly the scope of the challenges he faced.

There were grumblings within the Police Department’s ranks: at least one supervisor said he did not want to work for a black man.

Out on the streets, some black residents voiced misgivings of a different sort. Chief Smith may be black, but he is a Northerner. How could he ever understand them?

“This has been a slave town forever,” one resident said to Chief Smith in a low voice. “There are people who still feel white people are the devil. You’re not from here. You don’t understand.”

Peering through his glasses, Chief Smith locked eyes with the man, he later recalled. “Enlighten me,” he said, “so I can enlighten my people.”

The department Chief Smith now leads and the city it serves are in the arduous stages of trying to integrate lessons drawn from the episode that brought infamy to Sanford 16 months ago. The fatal shooting of Trayvon Martin, an unarmed black teenager, by George Zimmerman, a volunteer neighborhood watchman, compelled many to assert that racial profiling and citizen vigilantism had taken place.

Sandford’s Police Department became the focus of much of the rage. That the agency neither arrested nor charged Mr. Zimmerman, who claimed self-defense, was taken by some as proof of not only ineptness but also bias.

PINSKY: Todd, you told our producers that you worried about your son. Why is that?

TODD BRIDGES, COMMENTATOR: Well, my son`s a Black male and he walks around and it`s very frightening, because they always assume -- like when we -- when something -- one black person does something, they lump us all in together, that we`ve all done it.

And I`ve noticed it when I walk in stores before, people follow me around the stores thinking I`m going to steal or I`m going to do something. And to me, it`s atrocious in this country and I think that we all should be treated equally.

PINSKY: All right.

BRIDGES: I just want to be treated like everybody else. And I really believe that no matter who was in those clothes, no matter who was walking looking like that, because I`ve got just as many White friends who get pulled over who dressed like Black guys or dress like gang members and get pulled over as anybody.

PINSKY: Back with my co-host, Jenny Hutt. It`s day four of George Zimmerman`s second-degree murder trial. Lawyers have been interviewing hundreds of potential jurors. None have been seated so far, Jenny. Back with us is Mark Eiglarsh and Danine Manette, and joining the panel Crystal Wright of ConservativeBlackChick.com, Michaek Skolnik, editor-in-chief of GlobalGrind.com. He`s on the board of the Trayvon Martin Foundation.

Danine, I know you had a hugecrush on Todd Bridges. I didn`t share that with him last night, but I understand --

(LAUGHTER)

PINSKY: It was a few years ago, mind you. But I understand you wanted to react to what he said last night?

DANINE MANETTE, CRIMINAL INVESTIGATOR: Yes. In seventh grade, my locker was covered with Todd Bridges pictures.

(LAUGHTER)

PINSKY: There you go.

MANETTE: So, with that being said --

EIGLARSH: Mine, too.

(LAUGHTER)

PINSKY: Todd, man, that entire statement about I have friends who dress black, what does it mean to dress Black? I don`t understand what he meant by that. I mean, he`s sitting up here talking about gross generalizations and racial profiling, but I`m assuming that he means that he has friends that dress like thugs so he`s interchanging the words Black and thugs, which is a problem to me for two reasons.

Number one, Trayvon was not dressed like a thug. He was dressed like a young man who was covering his head to stay out of the rain that night. And number two, to use a negative connotation of equating Black and thug together, it makes what he`s saying no different than what he`s complaining about. He`s complaining about these gross generalizations and he just made one.

PINSKY: Got it. Crystal, your reaction?

CRYSTAL WRIGHT, CONSERVATIVEBLACKCHICK.COM: Bingo, bingo, bingo. I mean, that`s what it is. I think it`s really funny whenever we talk about Black people, all Black people dress alike. We all pray alike. We all eat alike. And apparently, you know, we all live in the same neighborhood. I never got the Black memo.

(LAUGHTER)

WRIGHT: You know, I agree with a lot of what was Todd is saying. We can`t minimize that Black males in this country are profiled and stigmatized. But at the same time, as you just mentioned, you know, Todd is saying that he doesn`t want to be put so much in a Black box, so to speak.

So, he doesn`t want to be lumped together with all the bad Blacks in many ways. So, I just think we need to end the stereotypes. I mean, come on. Black people --

PINSKY: That would be wonderful. That is a great goal. Michael, I`m going to have you comment on the other side after we get back from the break. So, just (ph) after the break. More of this conversation after this.

PINSKY: Welcome back. My co-host, Jenny Hutt, still with me as well as my panel. Michael, here you go, weigh in.

MICHAEL SKOLNIK, EDITOR-IN-CHIEF GLOBALGRIND.COM: Yes. I got a problem with what Crystal just said, because on one hand, you say all Black men look alike, that`s a problem. But then, you defend George Zimmerman.

That`s exactly what George Zimmerman did. Black teenagers were allegedly robbing some houses in the neighborhood, and then, George sees Trayvon, thinks he`s one of those kids, and profiles him because he`s Black and chases him and then executes him and puts a bullet in his chest after stalking him.

PINSKY: Crystal, you want to respond?

SKOLNIK: Isn`t that exactly what Zimmerman did?

WRIGHT: Michael, Michael, you know, wait a minute, Michael. I`m really sick of you and your stereotypes and your blanket statements about what you think. That`s the very problem why George Zimmerman is not going to get a fair trial because you`ve already convicted him in a court of public opinion. And don`t tell me about --

SKOLNIK: You just said that all Black males don`t look alike.

WRIGHT: Right. Blacks should be individuals. Thank you very much. And this case --

SKOLNIK: And Trayvon Martin should be an individual.

WRIGHT: But not race --

SKOLNIK: Trayvon Martin had nothing to do, had nothing to do with the kids who were robbing houses, nothing.

WRIGHT: This reminds me of O.J. Simpson all over again. Remember when O.J. was accused of murdering Nicole and Nicole Simpson`s boyfriend? Everybody said, no matter what, Black Americans, the majority of Black Americans were like, O.J. has to get off. He has to get off because he`s going to --

SKOLNIK: I`m not black, Crystal, I`m White, and I think George Zimmerman is guilty.

PINSKY: Hold on, guys. We got to play fair. Mark, I want to go to you. Can he get a fair trial?

EIGLARSH: Well, the answer is yes. If fair trial is simply defined by finding six people who can focus exclusively on the evidence and the law that`s given to the judge and make a decision based on that. And they did it in the Arias case. I think they can do it here.

PINSKY: I`ve got a twitter. It comes from one Crystal Wright. Let`s put it up there. Come on. Get up on the screen. "No. Zimmerman won`t have a fair trial." That`s Crystal.

WRIGHT: Yes, I really -- I don`t think he will. i think it`s going to be really hard because you have the president of the United States come out and say -- interject himself, if I had a son, President Obama said he would look like Trayvon. That, to me, is saying that he`s biased toward Zimmerman being a killer.


MANETTE: Jurors are a lot smarter than you give them credit for being, though.

PINSKY: I hope so. I hope so, Danine.

MANETTE: They`re a lot smarter.

MANETTE: They don`t do what we say.
