Will a conscience prevail with the passing of time and the truth will be exposed?

There are those who were involved in the happenings encompassing the disappearance of Natalee Holloway.  There are those higher ups within and without of the corrupt Aruban investigation who from the getgo were never on a mission of justice for Natalee Holloway.  There were those aboard the Persistence who actively or passively participated in the betrayal of Natalee Holloway and her family by furthering the Dutch/Aruban cover up agenda to protect Joran van der Sloot.

This morning's testimony of a 35 (?) year old husband/father in front the church congregation renewed my fading hope that answers will be forthcoming in the Natalee Holloway case.  Brett is on a mission seeking forgiveness for past transgressions from those who he caused others so much grief.

He usually focuses on relationship problems, but even Dr. Phil couldn't resist joining the media circus surrounding the Natalie Holloway case. And now it may cost him.

Deepak and Satish Kalpoe, teenage brothers who were once considered prime suspects in the 18-year-old's May 30, 2005, disappearance while vacationing in Aruba, is suing the Dr. Phil show, claiming they were defamed on national TV.

The lawsuit, filed Wednesday in Los Angeles Superior Court, accuses McGraw, along with private investigator Jamie Skeeters and the CBS Television Group, of committing libel and slander, invasion of privacy, emotional distress, fraud, deceit and civil conspiracy by editing and airing an interview between Skeeters and Deepak Kalpoe to suggest the brothers somehow committed a crime.

The show's producer, Paramount Studios, slammed the lawsuit. "We stand by the integrity of the Dr. Phil show, our editing process and the accuracy of the program that we aired. We will vigorously defend against these baseless claims."

The episode in question aired Sept. 15, 2005, on the nationally syndicated show, days after the brothers were released from custody by Aruban police. Holloway was last seen getting in a car with the siblings and Dutch teen Joran Van Der Sloot, but authorities said they lacked sufficient evidence to hold the teens, in part because investigators could not determine whether Holloway was dead or alive since her body had yet to be found.

The complaint states that Skeeter secretly videotaped an interview with Deepak Kalpoe and then aired the illicit recording on Dr. Phil—after cutting it in such a way as to "create false, incriminating and defamatory statements that the plaintiffs engaged in criminal activity against Natalee Holloway."

Per court documents, McGraw & Co. specifically implied that the siblings slipped Holloway a date-rape drug, forced her to have nonconsensual sex and then supposedly aided in killing her and hiding the body, allegations which the Kalpoes and Van Der Sloot have denied.

But Paramount disputes the charge. "Deepak Kalpoe’s statements, which aired on the Dr. Phil show, were his own words presented in a manner that the show believed accurately reflected the sum and substance of what he said in a recorded interview with Jamie Skeeters in Aruba."

The suit claims Deepak Kalpoe agreed to the sit-down with the P.I. in the assumption that Skeeter might help clear him and his brother. Skeeter allegedly told Kalpoe that the gruff McGraw was a "god" who could "influence a country" and help their case.

A lawyer for the Kalpoes could not be reached for comment Friday. Their suit seeks unspecified general, special and punitive damages.

In a parting shot in its statement, Paramount says, "We also intend to discover who or what has motivated this lawsuit from the Kalpoe brothers, two of the primary suspects in Natalee’s disappearance and two of the last people seen driving away with her in their car."

There is no competent evidence offered as to Defendant Skeeter’s liability for the emotional distress or fraud claims either. As such, the motion is properly granted in favor of Defendant Skeeter given Plaintiffs’ failure to offer sufficient competent evidence on essential elements of all causes of action in the FAC to show a possibility of success on the merits of their claims as against Defendant Skeeters. Natalee's Parents Sue Kalpoe Brothers

Two brothers from Aruba, twice arrested in connection with the disappearance of Natalee Holloway, filed a lawsuit this week in Los Angeles against talk show host Dr. Phil, opening themselves up to the jurisdiction of the California courts. Natalee's parents, Beth Twitty and Dave Holloway, immediately filed a wrongful death lawsuit against the Kalpoes in the same court.

Deepak and Satish Kalpoe filed a defamation suit against Dr. Phil, CBS, Paramount, and others over an interview they claimed "was manipulated and later broadcast by the 'Dr. Phil' show as being accurate and which portrays Deepak Kalpoe and Satish Kalpoe 'as engaging in criminal activity against Natalee Holloway and constitutes defamation per se.'"

When the Kalpoes filed their lawsuit Wednesday, it opened them up to civil jurisdiction of the California courts under a "related case" lawsuit, according to the attorney for Natalee's parents. A day after the Kalpoes filed, the Alabama teen's parents filed against the Kalpoes.

The family's lawsuit claims the Kalpoes caused the death of Natalee Holloway by "intentionally, negligently, wantonly ... unlawfully conducting themselves" to bring about her fatal injuries.

"All we want is justice for our daughter. There is no doubt in my mind that Deepak and Satish played a role in my daughter's death and should be held accountable," Beth Twitty said in a news release. "It is unconscionable that they have not been punished so far."

LOS ANGELES —  A judge dismissed a wrongful-death lawsuit Friday against two Aruba brothers filed by the parents of a teenager who vanished during a vacation there.

The parents of Natalee Holloway cannot sue in Los Angeles because the case has no California connection and the courts lack jurisdiction over the brothers, Superior Court Judge Charles C. Lee said in granting a motion to toss out the lawsuit.

Elizabeth Ann Twitty of Alabama and Dave E. Holloway of Mississippi will decide whether to appeal, said their attorney, John Q. Kelly.

"There are all kinds of promising issues," Kelly said after the ruling.

A similar lawsuit filed in a New York court against another Aruba man, Joran van der Sloot, was thrown out by a judge last summer.

And everybody knows of their repeated lies that they told the authorities, even their father, Paulus Van Der Sloot. That`s why he was arrested. There was a reason that he was arrested in Natalee`s disappearance. It was not unwarranted whatsoever.

And you know -- and being dismissed in New York, it was on a procedure ruling.  Here again, jurisdiction.  We have faced that issue since May 30 of 2005.  Jurisdiction and extradition hve hit us in the face every time.

LOS ANGELES - A judge refused to dismiss a defamation suit Tuesday against CBS and television psychologist "Dr. Phil" McGraw brought by two brothers who were questioned in the disappearance of Natalee Holloway.

William Cremer, the lead attorney for Surinamese brothers Deepak and Satish Kalpoe, praised the decision by Superior Court Judge Edward A. Ferns.

In their dismissal motion, attorneys for CBS Television and McGraw maintained lawyers for the Kalpoes did not meet deadlines to produce all documents they have demanded concerning the criminal case investigation against the brothers in Aruba.

But the judge gave the Kalpoes’ lawyers another five days to satisfy the document deadline.

"The documents are relevant to the most fundamental issues in this case," Ferns stated in his ruling. "There is no other (information) which can substitute for the documents sought by the defendants due to the nature of this case."

John ... it apparent that the years have proven the Kalpoes can and they have and ... Phil McGraw's high profile attorneys appear to be powerless to stop it.  The court has ruled on behalf of the plaintiffs every time.  What's up?

Janet - Los Angeles courts are very busy.  I'm sure the extensions allowed are as much for the courts sake as the Kalpoes or Dr. Phil.  I'm also sure this case isn't high priority for the courts.

.... but six years is sooo long ... six years of the Kalpoes failing to produce court requested documents ... documents that are crucial if Phil McGraw is to prove that defamation did not happen even if the "editing" of the recording is deemed "manipulation".  Six years of the court placing deadlines and not following through with dismissal of the lawsuit is so frustrating.

At 65 years of age ... I know in all likelihood I'll be pushing up daisies when Peru extradites Joran to Birmingham in 28 years.  The slow progression of the defamation lawsuit implies .... there may be another verdict that I am not privy to.

It would be more helpful to put together the pieces of who is behind the lawsuit. 
And helpful to put together a document showing/evidence of the Kalpoes seeking public figure status.

I've thought about Sage a couple times this week, hadn't checked in on her in a while...

Saying Good Bye to Hero Dog Sage

On August 13 @ about 1225 hours, Diane Whetsel gave K-9 Sage Her last command. The command was to travel on to the rainbow bridge.

Diane told Sage that she couldn't go with her on this trip, that this trip she would have go alone. Sage understood. Before she left, Sage had a short game of frisbee that she enjoyed and then she popped about ten balloons, all in record time.

After the balloon popping Diane gave Sage permission to go and in doing so Diane was able to fulfill her promise to Sage that she would never suffer or be in pain.

Sage is truly a remarkable Hero Dog. We miss her terribly.

Sage’s career hit the ground running. At age 2, after passing the FEMA Canine Readiness Evaluation at just 18 months old, she was called to the Pentagon in recovery efforts immediately following the 9/11 terrorist attacks. Sage’s acute search abilities resulted in the detection of one of the terrorists’ remains.

Along with numerous local missing person searches, Sage’s missions have included Hurricanes Katrina and Rita, and searching for missing teenager Natalee Holloway.

In 2007-2008 Sage was deployed to Iraq to search for missing U.S. soldiers. In 2009, she was diagnosed with two types of lung cancer, both uncommon in dogs and believed to be the result of searching several highly toxic sites in service to our country.

Sage has lost two lung lobes and has undergone chemotherapy. No cancer is detected at present, but she will have x-rays every three months for the rest of her life.

Sage’s latest mission is inspiring cancer patients and survivors with her resilience, enthusiasm and passion for life. She has been a hero at Camp Enchantment, a children’s cancer camp, by helping them see that their illness doesn’t have to dampen their spirits. She also happily walks alongside human cancer survivors at “Relay for Life” events.
