Former Drew Peterson attorney Joel Brodsky didn’t get to be part of the wife-killer’s appeal team, but someone has taken to a Twitter account in his name to insult the lawyers still on the case.

“Poor Drew, now he's got a pathological narcissist, an alcoholic, and a novice, for his appellate lawyers #drewpeterson,” reads a tweet sent from the account “Joel A. Brodsky Esq.” The tweet was sent to the account’s 39 followers at 11:35 p.m. on the Fourth of July.

The tweet also included a link to a news account of attorneys taking Peterson’s case from the state’s appellate defender’s office.

Attorneys Steve Greenberg, David Peilet and John Heiderscheidt last week requested leave to file an appearance in Peterson’s case. Greenberg represented Peterson, 59, during his murder trial last summer. Peilet was part of Peterson's defense team during the post-conviction push to win a new trial. Heiderscheidt represents Peterson in a pending wrongful death case brought against him by relatives of his slain third wife, Kathleen Savio.

Brodsky answered a phone call made to his office Monday afternoon. When asked about his Twitter account he hung up.

It is not clear which of the three attorneys is supposed to be the narcissist, the alcoholic or the novice.

Savio attorney wants ruling in Drew Peterson lawsuit
Friday, August 16, 2013

August 16, 2013 (JOLIET, Ill.) (WLS) --  The family of Drew Peterson's third wife has asked a Will County judge to rule in their favor in a wrongful death lawsuit they've filed again the imprisoned former police officer.

The Herald-News reports that an attorney representing Kathleen Savio's family made the request on Thursday. The attorney said the judge should rule in the Savios' favor without a trial. Judge Michael Powers said he would make a decision within 30 days.

Convicted murderer Drew Peterson now fears for his own life as he serves his 38-year prison sentence in an Illinois prison, according to letters written to his attorney and obtained by MyFoxChicago.com.

“Joel, did you ever feel that something was going to happen before it does? I feel I’m going to die in here. If the inmates don’t get me I’m gonna be killed by the cruel guards,” the former police officer wrote in a letter Brodsky shared with MyFoxChicago.com.

Peterson started writing letters to his attorney Joel Brodsky after his February sentencing for the killing of his third wife, Kathleen Savio. He is currently being held in protective custody and has complained of the "nightmarish," conditions.

 

Now he knows how Kathleen and Stacy felt

A Will County judge has denied motions that could have closed the wrongful death lawsuit filed by the family of Kathleen Savio against imprisoned former Bolingbrook police sergeant Drew Peterson.

Circuit Court Judge Michael Powers denied the motions for summary judgement — which is a decision by the judge without a trial — that were filed by the attorney for the estate of Savio, Peterson’s third wife, and by Peterson’s attorney. Powers set an Oct. 24 status hearing on the lawsuit.

In December 2012, the Savio estate’s lawyer filed the motion because of Peterson’s murder conviction that September and because a Will County judge found after a 2010 court hearing that prosecutors had established that Peterson likely killed Savio, 40, in her Bolingbrook house in March 2004.

During that hearing on the use of hearsay evidence, Peterson’s uncle, James Carroll, admitted that he turned all of Savio’s estate’s assets over to Peterson after she died, at Peterson’s request, according to the motion.

Drew Peterson is expected to formally challenge his conviction next month — and his attorneys apparently have plenty to say about it.

Peterson's lawyers recently submitted their third request for permission to exceed the 50-page limit imposed on appeal briefs in Illinois — only to be swiftly denied by the 3rd District Appellate Court for the third time.

In a motion filed this month, Peterson's attorneys said his case has generated more than 11,000 pages of court records, including 3,000 pages stemming from the landmark hearsay hearing held two years before his murder trial. The trial transcript contains more than 5,000 pages, according to the filing.

The 3rd District also prohibits defendants from using more than 15 pages to outline the facts of the case, a limit that Peterson's lawyers say is unfair given the history of the headline-grabbing legal drama.
 
Peterson must submit his appeal by Jan. 14. His attorneys expect appellate arguments to be held in late 2014.

Greenberg says the appeal is based on two issues. First, Greenberg believes Pastor Neil Shori should never been allowed to testify based on privileged information.

Second, a big part appeal is based on ineffective counsel. Former Peterson attorney Joel Brodsky's decision to call Kathleen Savio's divorce attorney Harry Smith to the stand proved to be a huge mistake and some jurors said Smith's testimony was the tipping point to a guilty verdict. However, some experts argue ineffective counsel won't hold water because Peterson was represented by several attorneys, including Greenberg.

"When you're talking about ineffective assistance, it's the consequences of counsels actions that matter, it doesn't matter if he had one attorney or six attorneys," Greenberg said.

A onetime attorney for Drew Peterson whose law license was suspended in October faces a new disciplinary charge from the state for allegedly mismanaging a client's criminal appeal.

David Peilet joined Peterson's defense team after the former Bolingbrook police sergeant was convicted in 2012 of drowning Kathleen Savio, his third wife. Peilet said Friday he has not been involved in the case since Peterson was sentenced last February to 38 years in prison.

Peterson's attorneys are expected to file an appeal Monday or Tuesday arguing for a new trial based on alleged ineffective assistance of council from Peterson's former lead attorney, Joel Brodsky.

CHICAGO — Drew Peterson's lawyer has mailed the former Chicago-area police officer's appeal of his conviction for killing his third wife.

Attorney Steve Greenberg said the appeal was sent in Monday — a day before the 3rd District Appellate Court's deadline.
 
A copy of the 55-page appeal that Greenberg provided cites, among other things, prosecutors' reliance on hearsay evidence.

Peterson lawyers cite attorney, judge mistakes in appeal
January 14, 2014

Drew Peterson continued the uphill battle to overturn his murder conviction this week, as his lawyers filed an appeal arguing that both his former defense attorney and the trial judge made mistakes that prejudiced the jury against him.

In a filing mailed to the 3rd District Appellate Court late Monday, Peterson's team states that Will County Judge Edward Burmila erred when he admitted controversial hearsay evidence and allowed a pastor to testify about conversations he had with Peterson's fourth wife, Stacy. It also criticizes Burmila for permitting divorce attorney Harry Smith to testify about a telephone call in which Stacy indicated Drew had killed his third wife, Kathleen Savio.

These errors, taken in their totality, stripped Peterson of his right to a fair trial, the appeal states.

"It is important to note at the onset that the state did not present a single eyewitness, physical evidence linking Drew with Kathleen's body, forensic evidence linking Drew with Kathleen's body, or a confession from Drew," the appeal states. "And while it is true there is no magic formula for a murder conviction, at least one of these pieces of evidence is usually present where an appellate court upholds murder convictions."

Peterson, 60, was sentenced last year to 38 years in prison for murdering Savio in 2004. He remains the only suspect in the 2007 disappearance of his fourth wife, Stacy, whose case prompted authorities to reopen the Savio investigation. He denies harming either woman.

The 55-page appeal also accuses former lead defense attorney Joel Brodsky of ineffective counsel. In addition to criticism for calling Smith as a defense witness, it also accused Brodsky of putting his own desire for publicity ahead of Peterson's best interests.

Brodsky has repeatedly denied the claims. Burmila also dismissed the allegations before sentencing, saying Peterson received adequate representation.

To win an ineffective counsel claim, Peterson must show his representation fell below acceptable standards and the outcome might have been different because of it. It will be an arduous task, however, given that he had five other attorneys on the trial team, and that appellate courts rarely overturn convictions based on legal strategies.
