The 38-year-old man who was apprehended in Florida Wednesday with a 12-year-old North Carolina girl told investigators that he and the girl had been exchanging text messages and had planned to run away and get married, according to court documents.

The girl, Abigale Lefevers of Newport, N.C., was the subject of Amber Alerts in North Carolina, South Carolina and Florida.

The man she was traveling with, Timothy H. Newman, was arrested Wednesday without incident at Interstate 95 and Hallandale Beach Boulevard in the Miami area, according to Chief Deputy Ken Raper of the Sheriff’s Office in Carteret County, N.C., which issued the initial Amber Alert.

Newman was wanted on charges of child abduction and driving a stolen car.

According to an affidivat signed by an FBI agent and filed Thursday in U.S. District Court in Florida, Newman told authorities he had known the girl since she was five years old. And she admitted she had willingly engaged in an ongoing relationship with Newman that began in July and that the two had been exchanging text messages. She also told investigators she knew he was a sex offender.

A Florida television station on Wednesday reported that Newman was arrested outside a Denny’s restaurant, and it showed video of police cuffing him and escorting the girl away from the red Chrysler Sebring convertible.

“The girl was a little shaken, but she was OK,” Raper said.

The arrest came after somebody reported seeing them in the Coral Gables area about 4:30 p.m., Raper said. An FBI agent helping the sheriff’s office alerted police in Florida, who made the arrest about 6 p.m.

“We’re kind of tickled right now,” Raper said. “They’ve been located and everybody is in custody and everything’s good.”

The girl will be flown back home this morning, with her flight paid for by volunteers, Raper said. Newman then will be brought back to North Carolina to face charges.

Abducted NC girl's father: 'It just makes me sick'

HALLENDALE BEACH, Fla. (WCSC/WBTV) -

An affidavit released by the FBI states a 12-year-old North Carolina girl who was the subject of a multi-state Amber Alert was planning to marry her abductor.

The FBI reported the girl and 38-year-old Timothy Newman, a registered sex offender, were stopped Wednesday evening in Hallandale Beach.

According to an affidavit, after investigators arrested Newman, he told investigators that it all started when the girl's father had discovered Newman messaging his daughter.

Newman was then arrested for violating his parole. The affidavit states after Newman was released from jail, he made contact with the girl and planned to run away with her and get married.

On Wednesday, authorities say Newman used a debit card in Coral Gables, Fla. which then prompted an Amber Alert for South Florida. Later that evening, an affidavit states that local law enforcement in Florida spotted the suspect's vehicle on Interstate 95 heading towards Hallandale Beach Boulevard.

"It just makes me sick," Lefevers said.

Authorities say when they conducted a traffic stop on the car, officers were able to identify both Newman and the missing 12-year-old girl.

According to an affidavit, the girl said she has known Newman since June 2012 and communicated with Newman through text messages, phone calls and personal visits. The girl told investigators that when she met Newman, he told her he was 37 years old and was a sex offender.

The girl told authorities she and Newman began a sexual relationship with each other at the end of July. The affidavit states in September, she and Newman decided to run away together and planned their escape through text messages and other forms of communication.

Investigators say Newman picked up the girl and then drove through South Carolina then to Florida. The girl said Newman threw away both their cell phones somewhere in South Carolina.

According to the girl, Newman told her he knew he was in trouble and that he would go back to prison for being with her.

"This is a man who is 38, she's 12 years old. She doesn't know enough about relationships to know what love is," Lefevers said.

IMO, they need to lock him up and throw away the key.  If he gets out, he'll do it again!

And I hope Abilgail gets the counseling and guidance in her life that she needs.
