JEFFERSON COUNTY, Colo. - Austin Sigg, the teen accused of brutally murdering Jessica Ridgeway will be tried as an adult.

According to Rob McCallum, spokesman for the Colorado Judicial Department, Sigg's lawyers never filed the reverse transfer motion as they were expected to. The motion would have requested the case be moved to juvenile court.

During the hearing, the judge ruled that despite his age, Sigg should be moved from the juvenile facility where he was being held to the Jefferson County adult jail. Sigg will not be 18 until January 17.

Court testimony revealed that Sigg will be held in a SHU, a special housing unit.

Surely they aren't already setting this up for attorney imcompetence on appeal.

yuknomenot

The thought did cross my mind and my rejoicing came to a halt.  Afterall ... why would Austin Sigg's attorney not attempt to have his client tried as a juvenile?

Jessica Ridgeway Murder Suspect Eats Alone, Plays Sudoku

 ::snipping2::
Sigg, who appeared in court in a bright green jail jumpsuit, will be tried as an adult. The defense waived its right to fight for him to be tried as a juvenile in the first week after his arrest.

Nine members of Ridgeway’s family showed up for the hearing, many of them wearing the color purple,  Ridgeway’s favorite color, which they have worn at each of the hearings since Sigg’s arrest.

They showed little emotion during the two hour hearing, but were upbeat and even making jokes with their victims’ advocate and among themselves.  At one point, they exchanged notes and chuckled.

Five member of Sigg’s family were also in the courtroom, including his mother. Neither Sigg nor his family showed any emotion during the hearing.

A trial date has not yet been set.

Jessica Ridgeway Murder Suspect Eats Alone, Plays Sudoku

By CAROL McKINLEY and COLLEEN CURRY
GOLDEN, Colo. — The teenage suspect accused of murdering and dismembering 10-year-old Jessica Ridgeway was called “intelligent and mature” by his jail supervisors and deemed fit to be held at an adult jail facility in Colorado.

 ::snipping2::

Today, his jail supervisor, a security guard, and the supervisor of the Jefferson County adult jail all testified that because Sigg has demonstrated he is intelligent and mature, and has had no problems at the the juvenile facility, he could be safely transferred to the adult prison.

The witnesses testified that Sigg eats his meals alone and spends his time playing Sudoku.

Sigg’s attorney, a public defender, argued that Sigg’s small stature and the fact that other inmates could “potentially scream and yell at the child, Austin Sigg” should be kept in the juvenile facility. Judge Stephen Munsinger ruled that Sigg, who turns in 18 in January, should be transferred.

Suspect in Jessica Ridgeway case - Austin Sigg - appears in court, to be moved to an adult facility
4:32 PM, Nov 27, 2012

 ::snipping2::
During the hearing on Tuesday, Mount View facility put the director of youth corrections on the stand. That director testified they wanted Sigg moved to an adult facility due to his "high intelligence" and "high maturity." The director said Sigg has been in isolation since his arrest even though there has never been a court order to do that. The director claimed threats had been made against Sigg's life, so the facility decided to put him in isolation for his own protection. He is extremely limited outside of his isolation.

Two other witnesses took the stand and testified Sigg is well behaved and has not caused any problems with the staff. One witness said the only complaint they have heard from Sigg is him asking the staff why they check on him so late at night.

One witness also said some youth they house at Mount View may have "I've-got-nothing-to-lose" attitudes and may act on the indirect threats made towards Sigg.

The witnesses argued that the special-housing unit in Jefferson County would be a better fit for Sigg. Sigg would have access to continuing education, be able to arrange college courses, and be able to play video games, watch TV or access a library in the day room. He also would be able to be released into either an indoor or an outdoor yard.

The defense team for Sigg opposed his transfer - saying it is inappropriate to house a juvenile in an adult facility. They also said Mount View is the right facility for Sigg since they have trained counselors on staff. Since Sigg is underage, he was appointed a guardian ad litern. His guardian testified there is a "significant risk" by moving Sigg to Jefferson County.

Also during Tuesday's hearing, the court set a date for his preliminary hearing for Feb. 22 at 8:30 a.m. A preliminary hearing is where a judge gets to hear the evidence in the case and where witnesses can take the stand. In this case for the preliminary hearing, the court could hear in full detail what investigators found in Sigg's home and what Sigg may have told police during initial questioning. The preliminary hearing could be waived - as has happened in recent, high-profile cases like troubled ex-Arapahoe County Sheriff Pat Sullivan.

Ridgeway suspect Austin Sigg to be separated from adult prisoners
5:21 PM, Nov 27, 2012

GOLDEN - Austin Sigg will now be housed in the special housing unit at the Jefferson county detention center.

He is the first juvenile detainee in three years to be housed at the detention center.

Jacki Kelley, a spokeswoman for the Jefferson County Sheriff's Department told 9NEWS that Sigg will be escorted everywhere by a deputy.

Sigg will be kept away from all other adult prisoners. He will not be able to see or hear them. When being moved around the facility, the jail staff will have to lock other inmates down while Sigg is in that specific part of the facility. The restrictions will be in place for 53 days, until Sigg turns 18 in January. Then the jail staff will assess what's safe for him.
 ::snipping2::
Everyone in the special housing unit is checked every 30 minutes, 24 hours a day - at a minimum. Every person in the unit is assessed individually.

The average population in the unit is 30. On Tuesday there were 22 people in the unit, which also houses inmates who are mentally ill, disabled, on suicide watch, or have other special needs.

Austin Sigg, Jessica Ridgeway's accused killer: New mug shot, new cell -- in adult jail
Nov. 28 2012 at 8:41 AM

Update: Headlines noting that seventeen-year-old Austin Sigg has been charged as an adult in the kidnapping and killing of Jessica Ridgeway, a ten-year-old Westminster girl, are a bit redundant, since documents to that effect were filed last month; see previous coverage below. But his court visit yesterday was significant for marking his transfer from a juvenile facility to adult jail -- a move that triggered a new mug shot of the accused teen killer.

Park renamed in Jessica Ridgeway's memory
10:48 PM, Nov 29, 2012

 ::snipping2::
The Westminster City Council this week voted to rename Chelsea Park, to Jessica Ridgeway memorial park.

Balloons, stuffed animals and other items left in the 10-year old's memory were removed from the park in mid-October at the family's request, because of the changing weather conditions.

City officials say the old park sign has been removed and will be replaced in about two weeks.

A plan to redevelop the park has been moved up from 2014 to start next year.

Officials say planners are working with Jessica's family to develop a theme that will be a happy celebration of her life with some of her favorite things, such as a zip line and the color purple.

Officials say city funds are being used and donations will also be accepted.

The eight days of Hanukkah end Dec. 16 this year. According to Jewish tradition, as winter nights grow longer, the lights of the menorah remind one that even in darkness, there is light.

This year, people of all faiths are invited to join in that spirit for a community menorah lighting in remembrance of 10-year-old murder victim Jessica Ridgeway.

Chabad of NW Metro Denver is hosting the lighting ceremony 3:30 p.m. Sunday at the Orchard Town Center in Westminster. Jessica's mother, Sarah Ridgeway, will light the center candle of the menorah.

Westminster Mayor Nancy McNally said she is glad the community will have this opportunity to come together to honor Jessica's memory.

Ridgway family orders foundation stop using Jessica’s name
Posted on: 5:06 pm, November 7, 2012, by Web Staff, updated on: 05:49pm, November 7, 2012

WESTMINSTER, Colo. — The family of slain Westminster 10-year-old Jessica Ridgeway has demanded a Colorado foundation stop using her name and likeness for a fundraiser scheduled for this weekend.

A lawyer for the Ridgeway family sent a cease and desist letter to the Colorado’s Missing Children Foundation Wednesday.

According to the letter, Jessica’s name is used repeatedly by the foundation both on their website and on a Facebook event for a fundraiser called the Purple Ribbon Tattoo Event scheduled for Saturday.

“Your organization has ‘Remember Jessica’ prominently displayed on the advertisements for this Purple Ribbon Tattoo Event fundraiser and you are selling ‘Justice for Jessica’ bracelets, and ‘Jessica Ridgeway’ window decals for purchase,” the letter said.

“The family has tried to address this issue with you informally by repeatedly asking you to stop using Jessica’s name as a fundraising tool for your organization,” it continues. “You have not respected the family’s wishes and are continuing to make money off of Jessica’s name.”
 ::snipping2::

geez...the first thing that came to mind when I started reading about this foundation was...how did the Anthony's make it out to Colorado already! carpet baggers that they are..I could easily see them going to start up foundations and profiting from it...

New sex assault charge for Colorado suspect in kidnap, murder of 10-year-old
December 12, 2012

GOLDEN, COLO. –  Prosecutors said Wednesday they have filed an additional sexual assault charge against a teen accused of kidnapping and killing a 10-year-old Colorado girl.

The additional charge and a sentence enhancing charge of a crime of violence alleges that 17-year-old Austin Sigg used physical force and threats to sexually assault 10-year-old Jessica Ridgeway.
 ::snipping2::
Also during a hearing Wednesday, District Court Chief Judge Stephen Munsinger said he would bar the public and the media from a preliminary hearing for Sigg, saying he wanted to avoid influencing any potential jurors if Sigg's case goes to trial. Sigg's public defender, Mitchell Ahnstedt, argued for closing the Feb. 22 hearing because of "massive and pervasive" media coverage of the case.

Prosecutor Hal Sargent objected, arguing that juries in Jefferson County have fairly tried a number of high profile cases.

"I don't think having it (a preliminary hearing) in public will impact having a fair trial," Sargent argued.

Preliminary hearings are where prosecutors present evidence against a suspect, sometimes publicly revealing previously undisclosed information. A judge decides whether to hold a trial or release the suspect.
 ::snipping2::
Munsinger issued several orders in the case, including the preservation of evidence and investigator notes and emails sent between prosecutors and law enforcement.

 Munsinger also barred prosecutors from using the jail's electronic record keeping system to keep track of his defense team's visits to the jail or to get updates on Sigg's medical and mental condition. Munsinger granted the request after public defender Katherine Spengler raised concerns that such tracking has happened in other cases.

The next hearing in the case will be Feb. 8.

I suppose trying him as an adult means he is responsible for paying his own attorney.
