JEFFERSON COUNTY, Colo. - Lawyers for a teen accused of killing Jessica Ridgeway in Westminster, as well as attacking a jogger months earlier, were in court Friday to argue several motions.

During the two hour hearing, attorneys questioned the first officer to arrive at Sigg's home on October 23. Sigg's attorneys want statements made to the officer banned from court. They said police failed to get a verbal consent from Sigg's mother that Sigg was waiving his rights.

The attorneys also want the trial moved saying in court documents that "massive" news coverage of the case has jeopardized his right to a fair trial.

The attorneys have also requested separate trials on the charges stemming from the death of 10-year-old Jessica Ridgeway of Westminster last year, the attack on the jogger, and charges alleging there was sexually exploitative material in Sigg's home.

The judge did not issue any rulings Friday.
 
A two-and-one-half week jury trial for the case was scheduled to start with jury selection on September 20.

If convicted, Sigg faces life in prison with the possibility of parole after 40 years. Sigg, who is 18, cannot face the death penalty because he was 17 at the time of the slaying.

GOLDEN -- An attorney for a teenager charged in the slaying and dismemberment of a 10-year-old girl in suburban Denver said Friday his client was separated from his mother and was denied the opportunity to seek her advice after he was read his rights.

Attorney Ryan Loewer said during a motions hearing that police failed to get verbal consent from Austin Sigg's mother before they told him his Miranda rights and he was taken into custody Oct. 23.

Sigg, who was 17 when he was arrested, has pleaded not guilty in the October death of Jessica Ridgeway, of Westminster. He also has denied charges stemming from an attack on a 22-year-old jogger at a lake in the girl's neighborhood five months earlier.

Officer Albert Stutson, with the Westminster Police Department's Special Enforcement Team, testified Friday he read Sigg his rights inside the teenager's home while the mother was outside. Sigg was read his rights again in his mother's presence once officers realized he was a minor, said Stutson, who added that the teen's mother shook her head "no" when he asked if she had any questions about her son's rights.

But Loewer argued that after Sigg was taken to the police department for questioning, he was never told he could ask his mother's advice or have her present.

KUSA - The teenager accused of kidnapping and killing 10-year-old Jessica Ridgeway was back in court on Wednesday.

RECENT JESSICA RIDGEWAY STORIES

Austin Sigg's defense team filed a motion to seek and interview an expert on adolescent brain development. The prosecution expressed concern that the defense is working to set up a mental-state defense in the case. The defense says it simply wants to protect its case and address all pre-trial legal issues.

The judge granted the defense's motion.

With the granted motion, the defense will have to reveal the name and credentials of the expert in one week. The experts full report will have to be disclosed on Aug. 5.

The expert may not speak directly about Sigg's state, but more generically, according to the defense team. The judge will determine whether the prosecution will bring in rebuttal witnesses.

WESTMINSTER - The mother of the teenager accused of killing 10-year-old Jessica Ridgeway took the stand during a two-day motions hearing Thursday.

Mindy Sigg, the mother of murder suspect Austin Sigg, talked about the moment her son confessed to killing Ridgeway.

She told the court that her son confessed to her that he led Ridgway into his bedroom. Ridgeway asked Austin Sigg if she was "ever going to see her mother again?" At that point, Austin Sigg strangled the 10-year-old girl and dismembered her body in the family's bathtub, a tearful Mindy Sigg told the court.

She said Austin came to her to confess the crime shortly after parts of her body were discovered in a nearby field. She said she called police "to tell somebody what my son had done." She said people working the tipline did not believe her at first.

Mindy Sigg barely looked at her son the whole time she was on the stand.

GOLDEN, Colo. — The second day of a motions hearing for Austin Sigg, the teen charged with the kidnapping, murder and sexual assault of Jessica Ridgeway, revealed graphic and disturbing details on Friday.

Those details came up when Sigg’s defense team began questioning the expertise of the three individuals who examined Ridgeway’s remains for signs of sexual assault. In response to the defense’s argument, prosecutors made it know that those examiners reported Ridgeway had been assault with a crucifix necklace.
 
The court also heard testimony from the victim of the attack at Ketner Lake on May 28, a crime that Sigg has also been charged with. That victim was only identified only as VN, and the judge in the case issued an order of protection to prevent the media from further pursuing her identity.

She testified that she identified Sigg “within 10 seconds” of being shown a lineup of six faces.

“(Sigg was) the only person I recognized,” she said.

JEFFERSON COUNTY, Colo. - The accused killer of 10-year-old Jessica Ridgeway told his brother, "I need to get punished," a Westminster police detective testified at a Thursday hearing.

Detective Mike Lynch said on the Oct. 23 night that Austin Sigg was arrested, his mother told police she had overheard Sigg talking to his brother.

"Don't let Dad get an attorney for me. I need to get punished," Sigg told his brother, according to the boys' mother.

GOLDEN, Colo. (AP) — Jurors deciding the case against a teenager accused of killing 10-year-old Jessica Ridgeway will be allowed to see evidence that Austin Sigg was searching for and viewing child pornography for more than a year before the girl was killed.

The Denver Post reports that a Jefferson County District Court judge denied a motion from Austin Sigg's attorneys to block the evidence (http://bit.ly/17qF4Vb ).

Prosecutors say Sigg searched for and accessed websites about child sex abuse, child torture and child dismemberment for more than a year. The graphic websites were accessed from a computer at Sigg's home between visits to the Arapahoe Community College website, prosecutors say.

It is sickening, Sister.  I had to take some time off from posting...so heartbreaking.  I'm surprised that his mother was so courageous and honest during her testimony; it must have been very difficult for her to testify about her son and his criminal deeds. Hope Jessica's mother and father are getting a lot of support from relatives and friends.

A Jefferson County District Court judge ruled Friday that Austin Sigg will have one trial of charges alleging he kidnapped, killed and dismembered Jessica and one on charges alleging he tried to kidnap a jogger in May. He has pleaded not guilty.

Sigg’s defense attorneys requested that Corey testify Wednesday because they wanted to call into question whether she would qualify as an expert at trial.

Corey, the chief medical examiner for the Commonwealth of Kentucky, concluded that Jessica was assaulted during the time just before or after her death.

Dr. Kathryn Wells, a child abuse expert and pediatrician with Denver Family Crisis Center, was the second to testify regarding evidence of trauma to Jessica’s body as a result of sexual assault.

Both doctors examined Jessica’s remains last October, and shared graphic details about what they found in court Wednesday.

After their testimonies, Jefferson County District Court Chief Judge Stephen Munsinger ruled that both doctors qualified as expert witnesses at trial.

Later Wednesday afternoon, the judge also ruled that statements made by Sigg and his mother over the phone to police will be admissible during trial, meaning jurors will be able to hear Sigg’s confessions in Ridgeway’s murder.

The judge found that placing the phone call to police was consensual, and that Sigg wanted to speak to law enforcement.

The next motions hearing is scheduled for August 29, and trial is set for October 3.

Jury selection will begin September 20th. The court plans to call an initial pool of 840 jurors.

I can truly say I live in one of the most amazing communities. People told me at the beginning that my nieces death will be forgotten, most likely with in a year or so, by others. My community is still morning at almost a year out. They came together and are getting a park for my beautiful niece. Not only renaming it but rebuilding it! Lucky for the community that the park was in the works to be remodeled anyway and the city already had money set aside, but my community raised/donated enough money to make this park the most beautiful park I have ever seen. It is in the process of being built as I speak.

A lot of things were donated to build the park. Companies gave not only money and time to help build but some donated benches, trees and even an almost-free custom swing set! It bothers not only me but my community when people say, "Why was she so special? Why does she get a park when there are hundreds of other children murdered? Where is their memorial?" The response is and always will be this: a single person (not of family relation to Jessica, nor did this person even know her or us) brought up the issue at a city council meeting (anyone from the public living within that city is allowed to attend the city council meeting) and suggested the park idea. This was passed by city council through Parks and Recreation council, which was then brought to the mayor and placed on a second city council meeting involving the mayor. It was passed again. Now that one person's dream of a memorial for a child who touched my entire community is becoming a reality.

I cannot tell you why Jessica touched everyone or why she was so special to my community, I can only tell you why she was special to me. Now we are almost at the one year mark - the park is almost done. We still get letters/cards/notes from people sending love and prayers, people coming to us in the community and asking to hug us and tell us they pray for us. I know the story is still in the news and that very well could be why people are still thinking of my niece, but I like to think that this little child touched my community in such a way that she truly will never be forgotten by the ones she touched.

Much love to every family who has been through the most difficult thing in life - losing someone they love more than life itself. I can only hope your communities are as amazing as mine as I am truly blessed. If you do not live in such a community I would like to extend my hand and a shoulder to lean on.

WESTMINSTER - For too many days residents would drive past the park on Moore Street in Westminster and feel nothing but sadness.

It was the park that became a memorial to 10-year-old Jessica Ridgeway after her abduction and murder last October 5. Purple ribbons were tied to the trees in the park to honor the little girl who loved that particular color.

Now as the one year anniversary of Jessica's disappearance nears, the park is being transformed into a place where the little girls smile and laughter can be remembered and celebrated.

"I've driven by here before this all started and would just sit here on the street and cry. Today I cried again, but it was just because it was so beautiful," park volunteer Candi Eperson said. "I couldn't believe how wonderful it is going to be for the community to have this gathering place, and you can hear laughter already."

 

Many of the volunteers see this park as a place where the community can heal.

"We're all here because we want to be here. We're here because we want to give back. We want to put some elbow grease into something that all of us were touched by. All of us live in the area. We all were deeply impacted. I've never met Jessica's parents. I've never met Jessica, but that doesn't matter. I live in Westminster. I'm part of the community and it is important to make it get better, to heal," park volunteer Eric Underwood said.

The park will be formally dedicated in Jessica's name at a ceremony on October 5, the one year anniversary of her disappearance and murder. Her family selected that date to dedicate the park as it will give them and the community a chance to celebrate the life of Jessica Ridgeway.

Knowing that school is starting soon at Witt, I was reminded how Jessica was when getting ready for school last year. She had a lot of fun shopping for school supplies and was always excited to find out what classroom she was in and what friends were in her class. I miss shopping for school supplies with her - I miss her so much. ~ Sarah (Jessica's mom)
