Jonathan Daniel Holt, who allegedly murdered and kidnapped a Gresham barista in October, now faces additional charges of burglary and possession of child pornography.

Holt pleaded not guilty to 10 counts of second-degree encouraging child sex abuse and one count of first-degree burglary Thursday, Jan. 10, in Multnomah County Circuit Court.

Gresham police arrested Holt, 25, of Gresham, on Oct. 19 for allegedly kidnapping and killing his neighbor Whitney Heichel, 21.

Police discovered evidence for the new charges while investigating Holt in connection with Heichel's disappearance.

After confessing to the murder during an interview at the Gresham Police Department, Holt told authorities he broke in Heichel's apartment, which she shared with her husband, and stole an iPhone from a dresser drawer, according to a search warrant affidavit.

The court's charging documents say the incident happened between Aug. 26 and Sept. 4.

Holt said he put a new SIM card in the phone and used it as his own before discarding it at Roslin Lake, where he allegedly murdered Heichel on Tuesday, Oct. 16.

Authorities searched Holt's apartment shortly after his confession and seized an iPad, a gaming laptop and several external computer and flash drives, which Holt said contained child pornography.

The 10 new counts of encouraging child sexual abuse are for each of the pornographic videos and images found in Holt's electronics. The burglary charge is for him reportedly breaking into Heichel's apartment and stealing the phone.

Holt is being held in Clackamas County Jail on six counts of aggravated murder with a firearm, as well as two counts of robbery, one count of kidnapping and one count of sexual assault.

A trial for the murder is scheduled to begin April 1, 2014, in Clackamas County Circuit Court before Judge Ron Herndon. The new charges are being prosecuted in Multnomah County and the trial date is set for Feb. 25.

The hearing is scheduled for two hours and will be before the Honorable Robert D. Herndon. Prosecuting attorney is Multnomah County Deputy District Attorney Don Rees.

PORTLAND, Ore. (KOIN) — The man accused of murdering 21-year-old Whitney Heichel last year and then dumping her body is set to change his plea.

Court records show that 25-year-old Jonathan Holt is scheduled to change his plea in Clackamas County Court on July 2.

On the morning of Oct. 16, Heichel left her Gresham apartment complex to go to her job at a nearby Starbucks. She never arrived. On Oct. 19, her body was found by searchers on Larch Mountain, located east of Corbett in rural Multnomah County. Holt was arrested on multiple aggravated murder charges that same day.

Holt and his wife resided in the same complex as Heichel and her husband. They also occasionally attended the same church.

According to a probable cause affidavit, on the day of his arrest, Holt confessed to an Oregon State Police sergeant that he was responsible for Heichel’s murder.

 

He was scheduled to appear in Multnomah County Court Thursday on a separate burglary charge.

Jonathan Daniel Holt is expected to plead guilty next month to kidnapping, sexually assaulting and murdering his 21-year-old neighbor Whitney Heichel.

Holt was arrested in October and charged with the crimes. Holt, 25, and Heichel lived in the same Gresham apartment complex and attended the same church.

According to court records, Holt is scheduled to enter a plea and be sentenced on July 8.

Clackamas County prosecutor Steven Mygrant and Holt's attorney, Conor Huseby, declined comment on a possible plea agreement.

 

Holt is scheduled for trial in April. By pleading guilty, Holt can avoid a death sentence. He is likely to serve a true life sentence.

It's possible he could receive a life sentence with a possibility of parole after 30 years. Given the nature of his crimes, it is unlikely Holt would get the lesser sentence.

Holt also faces charges of  first-degree burglary and encouraging child sex abuse in Multnomah County.

 

It isn't clear whether the Multnomah County charges would be dropped if Holt pleads guilty to the murder.

PORTLAND, Ore. – Jonathan Holt pleaded guilty and received a life sentence on Monday for charges related to the murder of 21-year-old Whitney Heichel in October.

Members of Heichel's family were in the courtroom Monday. Holt lived in the same apartment complex as Heichel and her husband, Clint, and was a member of their church.

"I will see her again," Clint Heichel told Holt. "You will not."

Holt pleaded guilty to three counts of aggravated murder, one count of first-degree kidnapping and two counts of first-degree robbery. He will serve life without the possibility of parole.

"I want to say that I'm sorry, but at the same time I know that doesn't mean anything," Holt said in court

 

Though it’s unclear why Holt decided to change his plea, a legal analyst said it’s likely because Holt was potentially facing the death penalty and his lawyers decided prosecutors have a solid case. Court documents show Holt confessed to the crime, but still planned to plead not guilty until last month.

Prosecutors might have worked out the agreement to save Heichel’s family from the ordeal of a trial.

When it came time for Clinton Heichel to address the man who murdered his wife, he sat silently staring at the killer, Jonathan Daniel Holt, for a long minute.

Holt had just admitted kidnapping and shooting 21-year-old Whitney Heichel of Gresham and was sentenced to spend his life in prison with no possibility of parole.

"What do you say to the man who has taken the love of your life?" Clinton Heichel asked. "My life has been ripped apart and turned upside down," because of your selfishness. "But know this: I will see her again," said Heichel, a devout Jehovah's Witness.

More than 60 members of Whitney Heichel's family and church attended Holt's sentencing Monday before Clackamas County Presiding Judge Robert Herndon. Holt pleaded guilty to aggravated murder, first-degree kidnapping and first-degree robbery.

The shaggy-haired Holt, flanked by his two defense attorneys, sat with his head bowed, through almost all of the 50-minute hearing.

Holt sobbed as the victim's mother, sister and mother-in-law told him how his actions had affected them. But his tears flowed most freely when Clinton Heichel spoke.

During the silence, Holt lifted his head three times, locked eyes with Clinton Heichel then dropped his head. "I wanted him to look me in the eye before I said anything. A man should be owning up to the things that he's done. You should be able to look a man in the eye. It's about as simple as that," Clinton Heichel said outside the courthouse.

 

Holt made a short statement, saying he deserved whatever sentence was imposed on him. "All the things that were said about me are true. Because of my selfishness, I have stolen a daughter, a sister and wife," Holt said, speaking meekly and staring down. "I'm sorry for what I did."

Herndon acknowledged Holt's obvious emotional distress and commended him for taking responsibility, admitting his guilt and "not torturing your victim's family for months and months" making them await a trial scheduled for early next year.
