Some of these jurors need to understand that "reasonable doubt" does not mean any doubt.

On Friday, the Judge Maxwell Wiley declared a mistrial in the Etan Patz missing child/murder trial as the jury after deliberating for three weeks could not reach a unanimous verdict. In the end, a lobe juror was the hold out as the jury was deadlocked, 11-1. The lone holdout juror, Adam C. Sirois, said to reporters following the trial, “Ultimately I couldn’t find enough evidence that was not circumstantial to convict.  I couldn’t get there.” The lone juror, Juror #11, could not find it in himself to convict the kidnapping and murder suspect, Pedro Hernandez, who confessed to the murder? Etan Patz was the 6 year old boy who vanished while walking to a school bus stop in SoHo, NYC in 1979. His body has never been found.

Manhattan District Attorney Says He Intends to Re-try Etan Patz Murder Case
Eleven of the 12 jurors believed Hernandez was guilty; one held out against a conviction

Manhattan's top prosecutor said Monday he plans to re-try the Etan Patz murder case, which ended in mistrial earlier this month after the 12-person jury told a judge for the third time they could not reach a unanimous decision on whether 54-year-old Pedro Hernandez killed the 6-year-old boy in 1979.

Manhattan District Attorney Cy Vance made the comments on MSNBC's "The Cycle." He said he intended to officially announce plans to re-try the case at a court date in June.

A new trial for the former New York deli worker who confessed to strangling 6-year-old Etan Patz in a case that changed the way the U.S. responds to missing children will open in 2016, a judge said on Wednesday.

A month after declaring a mistrial because of a hung jury, Judge Maxwell Wiley told Pedro Hernandez that a new jury would be picked as early as December to hear the kidnapping and murder case in state Supreme Court in Manhattan.

Seven jurors from Hernandez' first murder trial, in which a single holdout declined to convict him in the 1979 killing, returned to court to hear the judge's decision. The group on Wednesday included Adam Sirois, the holdout.

"I wanted to see what happened today," Sirois told reporters outside the courtroom, saying it will be difficult for Hernandez to get a fair trial in New York.
 
"We are very frustrated and disheartened still," said fellow former juror Jennifer O'Connor, who was among the 11 jurors who voted to convict Hernandez. "We're here supporting the new DA and his team."

Opening statements from the defense, which maintains Hernandez is mentally ill and his 2012 confession to police was coerced, and the prosecution, which maintains he is a cunning criminal and his statements were voluntary, will begin in 2016, the judge said.

Hernandez, 54, confessed to strangling the boy in the basement of the deli where he worked in New York's Soho neighborhood. He said he put the boy's still-moving body in a box and left it in a nearby alley.

Despite a massive search, Patz was never found. He was declared legally dead in 2001.

His father Stan Patz has said the family was "frustrated and very disappointed" by the jury's inability to reach a verdict.

Hernandez was questioned in 2012 after investigators received a tip from his brother-in-law, who said Hernandez allegedly confessed the crime to a church prayer group in the 1980s.

The lead prosecutor for the next trial will be assistant district attorney Joel Seidemann, who replaces Joan Illuzzi-Orbon as she steps down to run as a Republican for Staten Island district attorney.

The retrial of Pedro Hernandez for the alleged 1979 murder of 6-year-old Etan Patz in New York City is scheduled to commence this fall, PEOPLE confirms.

During a hearing held Tuesday morning in State Supreme Court in Manhattan, Justice Maxwell Wiley said Sept. 6 would be the likely start date for the trial, though he said the date would be finalized during the next court date in the widely publicized case, which is scheduled for July 11.

Suspect Pedro Hernandez sat impassively as his retrial opened in a case that eluded investigators for decades, ratcheted up Americans' consciousness of missing children and now centres on whether a chilling confession was true. A jury deadlocked last year.

With Etan's father and Hernandez's wife and daughter looking on, the trial began as an echo of the haunting story that unfolded over four months last year — so haunting that many of the jurors and alternates from the last trial were in the audience Wednesday to watch.

Prosecutors say Hernandez, 55, hid a brutal secret for more than 30 years. His lawyers say he's mentally ill and falsely confessed to waylaying and killing Etan as he walked to his school bus stop on May 25, 1979.

Etan's 6-year-old face became one of the first missing-children's portraits that Americans saw on milk cartons, and the anniversary of his disappearance became National Missing Children's Day. His parents helped push for a law that modernized how law enforcement handles missing-child cases.

But his body has never been found.

Hernandez's lawyers say a decadeslong search has led to the wrong man.

"As human beings, all of us ... have sympathy for the Patz family. That is not the issue here," defence lawyer Harvey Fishbein said during jury selection. He's due to give his opening statement later Wednesday.
