Full 'transparent' investigate sought

Members of Congress are targeting an international child-trafficking scandal, asking Turkey to provide evidence and seeking a full and “transparent” investigation in the Netherlands over allegations that a top justice officer there has been involved in child rape.

U.S. Rep. Christopher Smith, R-N.J., issued a statement calling the case “shocking and horrible,” but the suspect, Secretary General of the Ministry of Justice Joris Demmink, who apparently has been defended by the U.S. State Department’s Hague office, is facing credible allegations.

While Demmink has been accused multiple times, “the investigation into these accusations was suddenly and inexplicably halted, and law-enforcement officials involved were allegedly sworn to secrecy,” Smith said at a recent hearing on the issue of child trafficking.

He noted the accusations, among others, have been that Demmink raped two Turkish boys, now adults.

“The allegations are shocking and horrible, Mr. Demmink has a right to be presumed innocent until proven guilty in a court of law, and that is a sacred right that I’m sure we all want to protect. At the same time, the allegations, when taken in their full context, are credible, and deserve to be properly investigated so that a prosecutor can make a responsible decision whether to proceed with a case against Mr. Demmink. That investigation has never happened – the investigations that have taken place have been a travesty and have done nothing to clear Mr. Demmink’s name. Rather, they have raised further questions,” he said.

The request to Turkey for its evidence comes from Rep. Ted Poe, R-Texas. He submitted the request because the allegations are that Demmink assaulted children in Turkey when he traveled there .

“It has come to my attention that Secretary General of the Dutch Ministry of Justice, Mr. Joris Demmink, allegedly made an agreement in the mid-1990s with the government of Turkey to cover up multiple complaints of child sexual abuse filed against him,” said the letter to Prime Minister Recep Tayyip Erdogan.

“Investigations into the matter reportedly have found that Turkish police officers provided Mr. Demmink with minor boys during his visits to Turkey in the 1990s. According to law enforcement officers in Turkey and the Netherlands, Mr. Demmink used the power of his position to obstruct efforts to file complaints against him and used investigations as a way to deter his accusers,” the letter said.

An attorney in the Netherlands, Adele van der Plas, is representing several of the men who remember being victimized by Demmink. She told WND today the Netherlands has decided to back Demmink “in spite of all the overwhelming proof.”

She cited four police reports naming Demmink as a suspect and said six victims have come forward to identify him. She said a Turkish policeman who was assigned to provide security but instead was asked to kidnap boys from the street for Demmink to rape has come forward.

The U.S. Embassy in the Hague even apparently has defended Demmink. A WND source reported that the State Department’s operation there argued to members of Congress that “the allegations have repeatedly been investigated but proof was never found for his having committed criminal offenses.”

The report said “the prosecutor’s office … concluded that there was no evidence to substantiate the allegation.”

The report forwarded to members of Congress said prosecutors decided against a case because the testimony of one of the alleged victims represented by van der Plaswas was deemed “unreliable.”

“If there was anything to it, it would have come out after all these years,” the report said.

But van der Plas told WND, “There has never been a credible investigation into his behavior.”

She said the investigations simply are halted.
“The Dutch Ministry of Justice doesn’t take any child abuse case seriously at all,” she said. “All the pedophile rings in Europe have been investigated and some have gone to jail. Not in the Netherlands. The Dutch have been cited by the U.N. as a center of child trafficking.”

She said the reason is that the criminal case would “touch the top power elite.”

“If they investigate they will find massive fraud and corruption that Demmink has been able to deflect and insulate himself and many others,” she said.

Marchers from the Rebecca Project for Human Rights say they are staging a protest in front of the New York City offices of APG Asset Management, in the Chrysler Building, against a high-ranking government official in the Netherlands who is suspected of child rape.

WND has reported on the case of Joris Demmink, the secretary general of the Ministry of Justice in the Netherlands. Just yesterday, it was reported that the U.S. State Department had launched a defense of the suspect in multiple child rape cases.

WND reported that members of Congress are inserting themselves into the case, asking the Dutch for a “transparent” investigation and even calling on Turkey to deliver any evidence it has in the claims being made against Demmink.

Kwame Fosu, the policy director for the Rebecca Project, said in a statement to WND today that the march is to call “the world’s attention to a shocking and outrageous situation in the Netherlands.”

“For years, Mr. Demmink has used the power of his office to thwart investigations into this despicable behavior,” he said. “This year, as more of Demmink’s victims speak up and demand justice, The Rebecca Project is leading a series of worldwide actions to force the Dutch government to deal with this matter as is required in a civilized world.

“One of the most frustrating aspects of Demmink’s reign of terror is his plan to retire from the Dutch government – WITH HONOR – very soon. When he does, it is widely anticipated that he will escape punishment for his crimes by fleeing to a non-extradition nation, where he will continue his perverse activities while being supported by the Dutch pension system, APG Asset Management,” he said.

He said the march is scheduled for Friday, when dozens of activists will protest in front of the APG offices in the Chrysler Building in New York City, “demanding that APG affirm it will not release Demmink’s pension until and unless his alleged crimes are investigated and adjudicated properly. ”

WASHINGTON -- A high-ranking Dutch official, who's retiring this week, is being honored for his work. But human rights advocates say Dutch Justice Ministry Secretary-General Joris Demmink doesn't deserve praise; he deserves prison.

Demmink is being accused of raping two teenage boys, now men, during a visit to Turkey in 1990s. One of them recently shared his story on Capitol Hill.

Emotional Testimony

Much like a court room, witnesses at an Oct. 4 Helsinki Commission briefing presented their testimonies to a Capitol Hill audience. But Demmink, the man they've accused, has yet to stand trial.
 
"I was afraid to say no, and I was very young and very innocent," one victim testified, describing the emotional scars from childhood.

His identity is being protected because he barely survived an assassination attempt. That attack followed his allegations against what's been called "the Dutch Super Elite."

The Dutch government acknowledged investigating several complaints against Demmink, both in the Netherlands and Turkey, dating back to the 1990s.

It's official finding: "The outcome of these investigations has always been that the rumors and allegations are utterly baseless."

H.P. Schreinemachers, a representative from the Dutch Embassy, attended the congressional hearing and criticized the panel's findings.

"The Netherlands takes the fight against child sex trafficking very seriously," he said.

Commission Chair: 'Talk is Cheap'
     
Rep. Chris Smith, R-N.J., chairman of the commission and a leading advocate for human rights, believes that statement can only be backed up by taking action.

"If all of this evidence does not suggest that crimes have committed, I would be shocked, frankly," he said.

News of the case is spreading across the Web with sites like ArrestDemmink.com. Its creators want to stop the Netherlands from honoring him when he retires as early as this week.

Meanwhile, Van der Plas continues to call for justice against Demmink and wonders just how high the case may go.

Turkish Victims Ask Netherlands Court to Prosecute Dutch Justice Ministry Secretary General Joris Demmink
October 25, 2012

AMSTERDAM, OCT.25, 2012 — /PRNewswire-USNewswire/ -- Two Turkish men who previously pressed charges against Secretary General Joris. Demmink of the Ministry of Justice for rape and sexual abuse of minors (i.e. children under sixteen years of age), lodged an appeal to the Court of Justice in the Hague on October 24 requesting that Demmink be indicted.

The two men, Mustafa Y. and Osman B., had been victims of Demmink themselves. When they were 12- and 14-years-old, the victims have testified that Turkish police had lured them to a hotel room where Demmink raped them. In September 2008 and May 2010, the victims officially reported the crime to the National Public Prosecution Service in Rotterdam. After Mustafa Y. pressed charges in 2008, he has been repeatedly harassed and mistreated in Turkey by a former senior police officer so that he will drop the charges against Demmink. Osman has also been accosted, in hopes that he will drop the charges.

In February 2012, the National Public Prosecution Service communicated to Osman B. that Demmink would not be prosecuted, because his statement was deemed too unreliable and it could not be confirmed that Demmink had been in Turkey during the time when the sexual abuse was alleged to have occurred. The National Public Prosecution Service has informed Mustafa Y. that it will not launch an investigation into his charges as long as he refuses to travel to the Netherlands to explain his allegations.

Both victims are opposed to this decision.

Mustafa Y. informed the Court that the National Public Prosecution Service's refusal to investigate his claim is in violation of the Lanzarote Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse. This Treaty clearly states that prosecution of sexual abuse should never be made dependent on the fact of whether charges were filed or not.

Osman B. criticizes the fact that the National Public Prosecution Service has limited itself to a "exploratory" review of the charges. Such an investigation provides no opportunity for instituting coercive measures rooted in criminal law, such as recording witnesses accounts and testimony in Turkey.

Evidence


There is plenty of supporting evidence available, according to both victims. Both men have identified Mehmet Korkmaz as the policeman who brought them to Demmink, while Korkmaz himself stated in a video interview that he had brought Mustafa and other boys to Demmink for sexual abuse. Korkmaz's then boss, the former police chief of Istanbul, confirmed that his police protected Demmink during his visits to Turkey during the 1990s. In a report, the senior Turkish security officer Huseyin Celebi describes Demminks' vulnerability to blackmail after he was caught engaging in child abuse in 1995 in Turkey. Celebi also laid out the dates from 1990s during which Demmink had visited Turkey. These dates cover the period mentioned in both police reports. The Dutch National Public Prosecution Service additionally received a similar list of dates of Demmink entering the country from the Governor of Istanbul. Turkish victims threatened after Demmink request to prosecute

The two Turkish men, Mustafa Y. and B. Osman, on 24 October 2012 the Court of Appeal in The Hague have requested still prosecuting Demmink recommended for sexual abuse mid nineties - when they were 12 or 14 years old - in Turkey seriously threatened and abused.

That says their lawyer Adèle van der Plas. Their request was also in the Turkish media reported.
