A judge in Aruba ruled Friday that the highest-ranking Venezuelan official ever arrested on a U.S. warrant will remain behind bars pending an extradition request on drug charges.

Hugo Carvajal, a former head of Venezuelan military intelligence and close confidant of the late president Hugo Chavez, was arrested upon arriving at Aruba's airport, officials said Thursday. U.S. authorities allege he's one of several high-ranking Venezuelan military and law enforcement officials who provided a haven to major drug traffickers from neighboring Colombia and helped them export large amounts of U.S. bound cocaine through Venezuela.

His surprise arrest has cast a spotlight on what's known in Venezuela as the "Cartel of the Suns," referring to rogue, high-ranking military officers believed to have grown rich from drug-running. Top Venezuelan officers wear sun insignia on their uniforms.

Together with the unsealing Thursday of a drug indictment against two other Venezuelan officials, Carvajal's arrest is likely to ratchet up tensions between the U.S. and Venezuela's socialist government, which frequently accuses Washington of conspiring against it and using the drug war to apply pressure on Latin America.

President Nicolas Maduro has already threatened to retaliate against Aruba, just 15 miles off Venezuela's coast, unless Carvajal is freed. The president likened Carvajal's arrest to an "ambush" and "kidnapping" that violates international law because he had been appointed the country's consul to the Caribbean island. Prosecutors in Aruba say that while Carvajal was carrying a diplomatic passport he isn't entitled to immunity because he was not yet accredited by the Netherlands, which runs foreign affairs for its former colony.

"We won't let our honor or that of any Venezuelan be sullied by campaigns orchestrated from the empire," Maduro said in a speech Thursday night.

Carvajal's attorney, Chris Lejuez, told The Associated Press on Friday that his client denies all charges against him and will seek diplomatic immunity from extradition.

Later Friday, judge Yvonne van Wersch ruled that Carvajal must remain in custody until there's a decision in his extradition case.

Chief prosecutor Peter Blanken said the judge determined that Carvajal does not have diplomatic immunity. Following the ruling, Lejuez did not return a message seeking comment.

Carvajal, who earned Chavez's trust as a military cadet in the early 1980s, has long been a target of U.S. law enforcement.

Fitch Ratings lowered its debt ratings on Aruba to the brink of junk status, citing the negative impact of recurring suspensions of Valero Energy Corp.'s VLO +1.07% refinery operations on the Caribbean island's growth.

The credit-rating firm has Aruba at triple-B-minus, one notch above junk status. Fitch said the impact of refinery suspensions highlights the island's narrow economic structure and vulnerability to external shocks.

 

The ratings and outlook also factor in a recovery in the U.S. tourism market but a deceleration in arrivals because of less frequent flights and stricter foreign exchange quotas for Venezuelan tourists. The U.S. and Venezuela account for 76% of tourist arrivals in Aruba.

Aruba detains Venezuelan general on US drug trafficking list

A top Venezuelan official, Gen Hugo Carvajal, has been detained in the Dutch Caribbean island of Aruba at the request of the American government.

He had been accused by the US Treasury of assisting Colombian Farc rebels in their drug trafficking activities.

The Venezuelan government said Gen Carvajal had a diplomatic passport and that his arrest was illegal.

He had been appointed by Venezuela as its consul in Aruba.

But the Dutch government had rejected the appointment for over a year.

Just last weekend, the Aruban prime minister, Mike Eman, other cabinet ministers and high officials ended a week-long hunger strike to protest what authorities said were efforts by the Netherlands, the island’s so-called mother country, to sabotage the 2014-15 budget.

The hunger strike had much to do with different approaches to what austerity measures the budget should contain. The Netherlands wants the administration of the island of 102,000 people to implement tough measures, similar to those imposed by the International Monetary Fund on economically ill third world countries. The cabinet resisted, arguing that it had its own independent approach to correcting an underperforming economy and would not bow to Dutch dictates.

The standoff led to the Hague advising the island’s governor, Fredis Jose Refunjol, not to sign off on the estimates, forcing officials to spend contingency funds at levels similar to those of 2013.

(CNN) -- A retired Venezuelan military general will be released from custody in Aruba, days after authorities arrested him there, Venezuela's foreign minister said Sunday.
In remarks broadcast on state television, Venezuelan Foreign Minister Elias Jaua said Dutch officials had admitted that the detention of Hugo Carvajal violated his diplomatic immunity.
Carvajal, who is wanted in the United States for alleged drug-trafficking ties, was Venezuela's head of military intelligence from 2004 to 2008 and was tapped as the country's consul to Aruba this year.
He was arrested Wednesday night on his arrival in the Caribbean island.
Peter Blanken, chief prosecutor in Aruba, told CNN en Español last week that a judge decided the arrest was "legal and correct."
The arrest was based on a formal request from the United States. Blanken said Aruba was "obliged to cooperate" because of a treaty with the United States.
Venezuelan President Nicolas Maduro had said Carvajal was "illegally kidnapped." And Chris Lejuez, Carvajal's lawyer, argued that his client has diplomatic immunity, state media in Venezuela reported last week.
"No country can help another violate international treaties," he said, according to the state-run AVN news agency.
Carvajal had a diplomatic passport and a regular passport.
Venezuela's Foreign Ministry condemned what it called an unjust and unprecedented arrest and said officials were working through diplomatic channels to resolve the matter.

Ann Angela, a spokeswoman for the prosecutor's office, said the Netherlands, of which Aruba is a part, ruled that Mr. Carvajal had diplomatic immunity. Mr. Carvajal's release was announced at a news conference on the island by Arthur Dowers, the justice minister, and the chief prosecutor, Peter Blanken.

Mr. Blanken last week said Mr. Carvajal didn't have diplomatic immunity, and that he would remain jailed while the U.S. worked on extraditing him to face charges.

But he said officials in the Netherlands overruled judicial authorities on the island, with the foreign minister in The Hague explaining in a letter delivered on Sunday.

"There's a new point of view from foreign affairs in Holland," Mr. Blanken said. "Foreign affairs is not an Aruba matter, but a Dutch matter. They changed their mind."

Mr. Blanken added that Mr. Carvajal wouldn't be allowed back to Aruba. "He's a persona non grata."


Mr. Maduro thanked the Netherlands and called it "brave" for overruling the decision.

A senior U.S. official said the U.S. had been blindsided by the Dutch decision to free Mr. Carvajal. The official expressed enormous frustration that a man the U.S. considers a dangerous criminal is returning to freedom in Caracas.

"We don't agree with or understand the reasoning of the government of the Netherlands," said the official. "We totally disagree with their interpretation of the Vienna convention that Carvajal had to be released."

The official said that since the arrest, Venezuela had exerted enormous pressure on Aruba, threatening to shut commercial air service to the island, which Arubans say depends on large numbers of Venezuelan tourists.

Meanwhile, the U.S. official said Venezuela's state-owned oil company also warned it would walk away from a refinery it runs on the neighboring island Curaçao, which is also Dutch, threatening 8,000 jobs.

Venezuelan officials couldn't be reached for comment on the allegations. But Mr. Maduro last week said Venezuela would try to win Mr. Carvajal's release employing "all the force of the state."

The fast turn of events is a setback for American efforts to fight narcotics in the region. On Thursday, a day after Mr. Carvajal was detained at the airport in Oranjestad, indictments were unsealed in Miami and New York accusing the former general of helping traffic cocaine to the U.S.

In the Miami indictment, Mr. Carvajal was accused of taking bribes from late Colombian kingpin Wilber Varela, who was killed in 2008, in return allowing Mr. Varela to export cocaine to the U.S. from Venezuela and avoid arrest by Venezuelan authorities. In the New York indictment, prosecutors accused him of coordinating the smuggling of more than 12,000 pounds of cocaine in April 2006 from Venezuela that was bound for the U.S.

In 2008, the U.S. Treasury Department put Mr. Carvajal on a blacklist that sanctions Americans for doing business with him, alleging he had protected the drug-trafficking operations of a Colombian rebel group and assisted the guerrillas with weapons and logistical help.

Mr. Carvajal couldn't be reached for comment, but he and the Venezuelan government have denied American claims of wrongdoing, saying his reputation was being tarnished for political reasons.

Mr. Maduro said that in coming days he would refute all allegations made against Mr. Carvajal, which he said were being trumped up by evidence fabricated by international foes trying to topple the Venezuelan government.

CARACAS—The Netherlands' release of a former top Venezuelan official wanted by the U.S. for alleged drug trafficking came after Venezuela raised economic and military pressure on two Dutch islands in the Caribbean, a top Aruban official said Monday.

Aruba's chief prosecutor Peter Blanken said that Venezuelan navy ships neared Aruba and Curaçao over the weekend as Dutch officials were debating what to do with Hugo Carvajal —Venezuela's former chief of military intelligence who was jailed in Aruba last week on a U.S. warrant.

"The threat was there," Mr. Blanken said. "We don't know what their intentions were, but I think a lot of people in Aruba were scared that something would happen."

Mr. Blanken said Venezuela's government also had threatened to sever Venezuela's vital commercial air links to Aruba and Curaçao. Venezuela's state oil company also threatened to withdraw from a contract to manage Curaçao's refinery, Mr. Blanken said, which would have put at risk some 8,000 jobs.

"We are disturbed by credible reports that have come to us indicating the Venezuelan government threatened the governments of Aruba, the Netherlands and others to obtain this result," said Susan Bridenstine, a U.S. State Department spokeswoman. "This is not the way law enforcement matters should be handled."

She said the Dutch decided to release Mr. Carvajal "on the basis of claims of immunity that are beyond established international norms."

Manhattan federal prosecutors, who unsealed an indictment against Mr. Carvajal late Thursday, were blindsided by his release, said a person familiar with the matter. Prosecutors wouldn't have filed a provisional arrest warrant without believing there was a high likelihood of successfully extraditing Mr. Carvajal, the person said.

Officials in the Manhattan U.S. attorney's office feel the Dutch caved in to pressure from Venezuela, the person said. The officials fear the release could hurt the office's relationship with its network of confidential sources, who could be reluctant to share further information if it doesn't lead to results, the person said.

Andy Lee, director of Aruba's foreign affairs department, said Mr. Carvajal was deemed "persona non grata" and won't be permitted back to Aruba, a decision he said was passed down from Foreign Ministry officials in The Hague.
