A spokesperson for the Austin Police Department tells FOX 5 News say they arrested Cleary following a traffic stop.

They confirmed that his two sons, 9-year-old Ben and 7-year-old Henry were safe. They are in the process of making arraignments to get them safely back to their mother.
 
They report that Cleary will most likely be taken to the Travis County Central Booking. They could not immediately say if Cleary would be facing any local charges stemming from the traffic stop.

Roswell Police Department spokesperson Lt. James H. McGee tells FOX 5 News that they are working to gather more information on the case and expect to have more to release later this evening.

Updated Saturday, Dec. 29, 8:02 p.m. - Daniel Cleary was pulled over and arrested in Austin, TX on Saturday, according to Fox 5 Atlanta. Ben and Henry Cleary are said to be safe and waiting to be taken back to their mother in Roswell.

The news station reports that a previously planned prayer vigil will now be a thanksgiving prayer gathering in Suwanee Town Center on Sunday at 2 p.m.

 

Wonderful news!!!      I was so afraid for the Cleary brothers after I read the article about their dad Daniel
emptying out his house and purchasing a gun.

ROSWELL, Ga. -
Police say a tip has led to the arrest of Daniel Cleary and the safe recovery of his two sons who were the subject of a nationwide child abduction alert since Thursday afternoon.
 
Police tell FOX 7 Austin that an alert citizen recognized Cleary and called police. Austin police arrived at the Crossland Economy Studios on Hymeadow Drive just after 5 p.m. local time and took Cleary into custody.
 
They report that Cleary will most likely be taken to the Travis County Central Booking. They could not immediately say if Cleary would be facing any local charges stemming from the traffic stop.
 
The mother of the two children, Theresa Nash, spoke with FOX 5 Atlanta shortly before boarding a flight to Texas. She says that her two son 9-year-old Ben and 7-year-old Henry were outside the motel playing with Nerf guns when the police arrived. They were checked out by officials and appeared unharmed.
 
Nash says they were "battling each other on their iPads and planning Henry's birthday party" the last time she talked to them. She has talked to them several times since they were found and said they were in good spirits. She expects to be in Austin early Sunday morning, but says they might stay Sunday in Austin.

Roswell Police Department spokesperson Lt. James H. McGee tells FOX 5 News that a guest at the motel in Austin recognized the car from posts through various social media sites like the Facebook page set up to help find the two boys. They were able to do a search for more information on the internet to confirm before reporting it to the front desk.

They have impounded Cleary's vehicle and trailer. They say he had a gun on him at the time of his arrest. Police plan to search the vehicle, trailer and motel room.

 A spokesperson for the Austin Police Department during a press conference Saturday evening says that Cleary faces charges of interfering with child custody both in Georgia and Federal courts. He is currently awaiting extradition in the Williamson County Jail.

Two missing Georgia boys have been found safe in Texas and their father has been taken into police custody.

Moments after pleading for her boys' return on television, the boys' mother Theresa Nash received a phone call from a citizen in Texas who said he was with her sons.

"I was in complete disbelief," Nash told ABC Atlanta affiliate WSB-TV as she was boarding a plane to pick up her sons. "He immediately put the phone to Ben and Henry and I talked to them. They were very, very shaken up."

Police in Austin, Texas, were notified when someone recognized the boys and their father at a motel after seeing them on TV.

"They were playing with a Nerf ball, went back inside, they were with Daddy and they came back out and somebody said, 'Put your hands up,' and everybody put their hands up," Nash said.

The boys' father Daniel Cleary was arrested without incident, police said.

Daniel Cleary, 46, was arrested Saturday while walking out of a hotel room in Northwest Austin, Austin police spokesman Cpl. Wuthipong Tantaksinanukij said. Police received a tip from a woman who was also staying at the hotel and who recognized the boys after seeing them on CNN and called 911 about 5:10 p.m., Tantaksinanukij said.
Cleary remains in Williamson County jail, held on two felony warrants, Tantaksinanukij said. The boys’ mother is on her way from Georgia.
Police are still trying to figure out why Cleary was in Austin, where he was staying at the Crossland Economy Studios, a hotel just off U.S. 183 near Anderson Mill Road.

Missing boys thank supporters after safe return


Theresa Nash reunited with her sons after a weeklong nationwide search

GWINNETT COUNTY, Ga. —
Friends and family gathered at the Suwanee Town Center Park to give thanks for the safe return of two brothers who were the subject of a weeklong nationwide search.

Channel 2’s Alina Muchado spoke with Theresa Nash and her sons, who said they appreciate all of the support they’ve received during the ordeal.

“Thank you,” said Ben.

“To everybody in America,” continued Henry.

Their father remains in custody at an Austin jail, facing charges of interfering with child custody. He also received a federal charge for crossing state lines.
