TALLADEGA –Police are looking for the biological but non-custodial father of a 5-year-old boy who has not been seen since Saturday afternoon.

According to Capt. Leon Thomas, Thomas Eric Diggs, 35, of Oxford, met his son, Thomas Evan Diggs, and the child’s grandmother, who is the child’s legal guardian, at the Arby’s on Battle Street in Talladega Saturday. After lunch, the father said he would drive the son back to the grandmother’s house and drop him off, but never showed up, Thomas said.

Custodial interference is a Class C felony in Alabama, punishable upon conviction by one year and one day to 10 years in prison

IDK,if Gma or mother is the  legal custodian, most of the comments say mother is  the legal custodian

It is great you are posting information to help find a child, but the Information MUST be accurate. We are talking about the life of a precious child. Amanda Turner is the legal custodial mother. Wherever did you get the lies that the grandmother has custody? She is apparently part of the problem. You have plenty of comments letting you know there is a mistake. Why is it still incorrect? There is no excuse for the mistake in the first place and absolutely no excuse for the mistake continuing. Please be a responsible journalist and correct your mistakes.

sarahleann |3 Hours Ago What type of journalism is this?? Isn't the checking of facts supposed to be a major point of your job? A 10 year old would know to ask multiple people and check the story that you were given before printing such malarkey! Are you new to this maybe?? You are spreading lies and misinformation that could seriously effect how people view this case and hinder the investigation! Really? You have added to the pain for Evan's family because you did not even mention his mother (amanda turner), WHO IS THE GUARDIAN and CAREGIVER! You have made the kidnapper's Mother (debbie wesler) to be some sort of innocent victim here, when she kept the kidnapping secret from Evan's mother AND the police. It all happened on FRIDAY afternoon, not Saturday at lunch (according to the story Debbie is giving). Eric has recently lost weight and is now closer to 150 lb, not 200 lb. And no amber alert was issues, although the police are desperately trying to get one. You MUST print a corrected article and it should be run on the front page AGAIN so that the public can read the TRUTH as clearly as they have the lies. My nephew's life is at stake here Chris! This is not the time for skewing the facts. GET IT RIGHT!

Statewide lookout remains in effect for 5-year-old

The boy’s paternal grandmother, Debbie Wesler, had obtained permission from the child’s mother, Amanda Turner, for the boy, Thomas Evan Diggs, to spend the night with her, according to Talladega Police Chief Alan Watson.

The child’s father, Thomas Eric Diggs, 35, of Oxford, was with the child and grandmother at Arby’s on Battle Street in Talladega. The father volunteered to take the boy home to the grandmother’s house after they finished eating. She agreed, but the boy and his father never showed up.

Watson said Turner called Wesler the following afternoon to find out when to pick up the child. It was at this point that the mother found out the father had taken the young boy and contacted the Talladega Police Department.

Seems to me the grandmother may have had something to do with the planning of this.
