Hmmm.... Defense asking for mistrial because of Juan's demeanor/misconduct.....I am concerned
I believe they tried that last week & the week before.

Yup.

Doesn't worry me.

I am not as concerned about a mistrial as I am about the jury not liking Juan and his approach.  Am remaining optimistic. After the Casey disaster, I am not going to be thinking that any  case is a slam dunk...know what I mean ?

I definitely know what u mean. Im afraid this verdict is going to piss us all off too. We cant blame the prosecutors though in either case. We need to blame the stupid people that render these verdicts. Unfortunately there has been a big dumbing down of people in our country. People who are easily fooled by the throw everything at the wall & see what sticks tactic. Maybe with some luck, this jury will have more common sense than the pinellas idiots. Im so tired of hearing in these high profile cases from defense attorneys who keep bringing up the "they overcharged" crap. This case was quite worthy of the death penalty 1st degree charge as was the casey anthony case.

Wow. They are just grasping at straws here. How pathetic. Are they implying that someone has changed the shelving since then? Really? Yes its a conspiracy so they went in & staged the crimescene to fit their needs. These attorneys on the defense side are so incompetent its laughable!

I read it, understood some of it. It amazes me how murder has become such a lucrative business. These people are so sick. I cant imagine trying to profit off a murder my child committed. Id be inconsolable for raising someone who did that not thinking about how i could live a better lifestyle off of it. Every single day i am reminded how far away from god this world has become & how full of disgusting people our world is full of. It makes me sad. I hope all of these people are enjoying the evil they have become here on earth because at some point they will have to answer to a much higher power. Sorry if i offend with religion.

Thanks pharlap I am like kcrn read it and understead most of it. It gets confusing with all the different names. The only pictures I remember of the closet are I think at the beginning of the thread. I remember Blondie commenting that she had shelves kind of like them. Sorry I wasn't more help. I liked the bit about the trial being turned into a circus. Because of the way Mr. Martinez goes after their witnesses. But it was okay to go into great detail about her sex life.  Should be interesting today.

They r saying that things removed from the shelves makes it different. Yes idiots it actuslly means there is less weight on them & would make them able to hold more weight like a person stepping on them. Me thinks they are not too bright.

I have shelves like that & have stepped on them. Boom, it went down with only me.
If I remember correctly JA said she sort of jumped up?? Well by doing that, there would be more weight put on the shelf.
Also how can u jump up and get gun, which is way  back of the shelf ?
We all know this didn't happen.
Is it time for the verdict yet?    albino

ABC 15 - Phoenix, AZ -- pdf: Motion to Preclude dated 4/7/13

Juan Martinez had a brilliant day yesterday on the cross with Alyce LaViolette.  Should he continue to proceed in that manner he stands a greater chance of achieving full justice for Travis.  LaViolette was combative and evasive yet Juan was able to nail the points intended for the jury and did not resort to aggressive behavior to do so.  I knew he was good and he proved it yesterday.

That said, I'm not surprised the defense has written these motions.  I don't think they will get what they want, nor should they.  Nurmi postulates that Juan's courtroom manner is the reason the defense experts have been emailed and discussed on forums by the public.  That is laughable... the experts are on the stand in a public death penalty trial defending an indefensible witness and they know it.  The public also knows it and are calling them out on the sham.  Juan has nothing to do with that.

Regarding the shelving unit... well, it's not rocket science.  Either the shelves can hold Jodi's weight as she stands on the edge grabbing an invisible gun or they cannot.  This evidence absolutely must be heard by the jury for them to come to a fair verdict.  Jodi is the one who brought the shelves into question during her testimony and it would only be fair for the prosecution (and the murder victim) to test the accuracy of her story.

The defense would be remiss if they were not doing these things, whether we like it or not, it's how our justice system works.  That said, I did see a petition somewhere about not allowing evidence or testimony slandering a victim without evidence to support the accusations.  I agree that if the same cannot be done to the defendant, the defense should also not be allowed to do say anything they want about the victim without showing cause for the accusations, especially if the victim is deceased and unable to respond.

The worst part of this is that Arizona tax payers are funding Jodi's very expensive defense.

Can u imagine if they get a mistrial? Its already cost the state of arizona over a million dollars to defend this wretched human once. That would make me mad as hell if i lived there. Like i said, i think the state would have been willing to take a plea of 1st degree with no death penalty, so if all they want is to save her life they should have considered that.

I so much agree with this post, especially the bolded (by me) part.

Very well-stated.

kcrn, a mistrial would be a travesty and that is not being overly dramatic.  I don't think they will get it but I see years of appeals ahead.

Right off the bat LaViolette is continuing with her evasive combative attitude.  Why won't she just answer the question?  She won't admit to finding Jodi to be truthful but she found her to be credible and believable??  She's just wasting everyone's time and I'm sure the jury is becoming frustrated with this witness.

Thank you Ms. Brandi... I read your posts from yesterday and found myself nodding in agreement with each one.  I hope the jury is seeing what we're seeing but it's hard to know since their information is limited compared to ours.
