Just heard that her fathers in court today and of course it's not starting on time . Nurmi filed for mistrial motion.

Could it be that members of Jodi Arias' family will be called in the mitigation phase ... called to plea on her behalf?  Could the mitigation factor regarding mental illness be added to the existing list compiled by the defense?

NANCY GRACE
Arias Parents in Police Interrogation
Aired April 29, 2013 - 20:00   ET

NANCY GRACE, HOST: We`re taking you inside the police interrogation room as they question Arias`s parents just two months after Travis Alexander`s brutal killing. This is interrogation, moments that even the jury has not seen,

Excerpts:

SANDRA ARIAS: Because (INAUDIBLE) one of the things when she was here (INAUDIBLE) I called (INAUDIBLE) she`s a member of the Mormon church, and I called the bishop here and wanted to know if there`s any way he could find out where she was going down there to the church because I wanted to talk to him and see if he could talk to Jodi and find out what`s going on because, like I said, she would just totally flip out on me.

SANDRA ARIAS: She would call me in the morning all happy, and call me an hour or two later in tears, crying and sobbing about something she didn`t want to talk about. And that happened constantly, and her friends thought -- too -- I had one friend call me in the middle of the night, and he even called a hotline for bipolar people and said Jodi is bipolar and she needs help. And that`s when we talked her into coming back here so she could be around family.

WILLIAM ARIAS: She`s a strange person because (INAUDIBLE) after she left the house, you know, just kind of (INAUDIBLE) strange. You know, she was really friendly. Sometimes she`ll call and real sweet, and 10 minutes later, she`ll call in a rage, you know, just screaming at my wife. She did that for (INAUDIBLE) for the last year-and-a-half, she was doing that a lot.

Jodi Arias must be directing her own defense.

If not ...

It would make sense that Jodi's attorneys would have her parents take the stand and apologize to Travis' family for recognizing their daughter had mental problems but failed to be more forceful in regards to seeking professional assistance.  Maybe Travis would still be pursuing his dreams.

It would make sense that Jodi's attorneys to have her siblings take the stand and share memories with the jury ... memories of good times in the past with their sister.

It would make sense that Jodi's parents openly address their daughter by assuring her that while they do not condone her actions ... actions to which there is accountability ... their love for her is unconditional nevertheless.

All the defense is accomplishing is revealing to the world ... revealing to the jury ... Jodi Arias has NOBODY significant in her corner.  IMO

If the scales of justice are to balance ... I believe Jodi Arias should receive the death penalty for the premeditated  murder beyond brutal of Travis Alexander.  On one hand ... I am thankful the defense attorneys are blowing it by preventing mitigating circumstances encompassing Jodi's mental health to be revealed.  On the other hand ... I just hope this is not an avenue for an appeal.

REBECCA MITKIN, CRIMINAL DEFENSE ATTORNEY: If the penal code says that she has diminished mental capacity which doesn`t rise to the level of not criminally responsible, which we already know that she`s way past that, then you get to use it as a mitigator.

VELEZ-MITCHELL: This mitigation process. I didn`t hear them stress, she is sick; she`s not all there. She -- they made some vague reference to borderline personality disorder, which they had already argued against, because that was the prosecution theory. I mean, have they dropped the ball on the mental illness?

MONICA LINDSTROM, FORMER PROSECUTOR: Jane, that is such a great point. Because that is something that they could sink their teeth into. Because they`ve had three experts -- well, four experts up there -- talk about her mental issues or her mental sickness or disability. So it could be helpful to them.

GRACE: ... I expect the mitigation to go on next week. I expect we will hear from Jodi Arias, even though her last turn on the stand did her no favors. I expect to hear from her mother and/or grandmother, from friends and lovers, but I would put my money on the mother and the grandmother. If anyone can save Arias now, it`s them.

I wish that if there were going to be "in chamber" stuff to resolve before the continuance of trial, the court would require the attorneys to do that BEFORE the set time for court to begin. Somewhere, somehow, the jurors should be considered in this process. They've given a huge chunk of their lives to do this and it seems to me their consideration is constantly ut last to everything else. Judge on the Bench!

Nurmi's mistrial motion being heard in open court.

Grounds seem to be that the jury was not sequestered and that it was televised.

I guess they're trying for whatever they can at this point.

Juan's arguing the other side now. He has a different take on why Womack isn't testifying. Brings up her drug use.

Hmm.  Patricia Womack should be much more afraid of Jodi IMO.  After all, she's a known murderer.  I wouldn't want to cross her.

Patty wanted to assert her 5th amendment rights because she would face some prosecution regarding the photographs & drug use. #JodiArias

Juan says that Patty failed to answer his questions on two separate interviews, he asked about her drug use but she was silent. #JodiArias

Juan suggests to the court that Womack could subject herself to prosecution for drug use should she testify and also perhaps have some unreported income that would make her reluctant to testify. He also asserts that the defense attys acted as her legal counsel which would be unethical.

Mistrial denied.

Sentencing phase goes forward.

Nurmi asks the court to dismiss himself and Willmott.

Oh for heaven's sake!

Motion to withdraw denied.
