Jodi Arias is a victim of herself. JMHO
I am quite surprised and somewhat appalled that the foreman believed she was "mentally and verbally abused."
I mean, really?

This is an interesting article! Jodie's sister Angela tweeted that they were on their way to the Grand Canyon. They knew they were on verdict watch. Yet Donovan Bering says they including Donovan! Didnt know it was verdict watch.
Donovan just loves the media attention, inserting herself! As we!

The words of the jury foreman on GMA this morning ... words empathizing with Jodi Arias ... reveal that it was a given from the getgo that the scales of justice were not going to balance. Mercy for Jodi would prevail.

William Zervakos, Jodi Arias jury foreman, discusses 'gut-wrenching' trial
Posted: 9:31 AM
(May 24, 2013)
<snipped>
Zervakos said the 32-year-old defendant simply did not fit his image of a murderer. "When you look at a young woman and you think of the crime, and then you see the brutality of the crime, it just doesn't wash," he said. "It's very difficult to divest yourself from the personal, from the emotional part of it."
Though the jury did not believe Arias' story that she killed Travis Alexander in self-defense, Zervakos said he believed Alexander abused her. "I'm very sure, in my own mind, that she was mentally and verbally abused," he said. "Now, is that an excuse? Of course not. Does it factor into decisions we make? It has to."
Zervakos said Arias' 18 days on the stand hurt her case. "She was not a good witness," he said. "There were so many contradicting stories."
But he expressed sympathy for her ability to endure her time on the stand. "I think the way the prosecutor was with her -- he's known for an aggressive style -- I think it was very hard, I think it would be difficult for anybody."

I'm confused because there clearly was no proof of any documentation of domestic violence. She manipulated these four jurors! Who couldn't see the light. They were supposed to follow the evidence presented to them and not let emotion control them. I think the judge said that? Not verbatim. Am I wrong? I just am shocked how they felt she was abused.

The next jury will not have 19 days of her direct testimony or hear her voice or have seen her 4 days a week for the past 5-6 months.
That was way plenty of time for her borderline to hook the vulnerable few.
not the 2nd time....

I know Jodi was not abused yet I am not surprised some of the jurists believe she was. Travis's written emails and texts, taken out of context, absolutely sound abusive. I always felt that it would be difficult to overcome those written words and Juan was unable to do so.
In closing Juan should have stated "Jodi would not leave Travis alone. He distanced himself from her, he asked her to leave the state of Arizona, he finally resorted to being mean and hurling insults in an effort to get her to leave him alone. Travis did not realize he was a victim of a stalker and sadly did not take legal recourse, instead attempting to end the matter on his own. Now he is a victim of a murderer."
The defense played the phone conversation Jodi surreptitiously recorded and LaViolette went over in minute death by boredom detail the words of Travis. These obviously had an impact on the jury who did not have access to all the information we did.
My hunch is that Juan's earlier aggressive tactics may have also affected some of the jurors which could easily be surmised from the foreperson's interview today.

In the video below, it is reported that Willmott stated her
defense team will remain on Jodi's case throughout the remainder of the trial.
Also, it was reported that Chris and Sky Hughes spoke to the family and they
do not want to give up on the death penalty
for Jodi.

From the video, there is a markup of the jury:
Also, someone wanted to see Willmott's smirk at the jury when the verdict was read, I got a good shot of it:

Something akin to her deceptive defense attorneys ... in Jodi Arias' post conviction interview she attempts to draw attention to only Travis' end of recorded conversations regarding sexual fantasies ... sexual fantasies that were obviously mutual.

Jodi Arias says she prefers a death sentence
Wed May 8, 2013 10:44 PM
Jodi Arias was on suicide watch in her Maricopa County cell Wednesday night after telling a local TV station she would prefer death to life in prison after her conviction of first-degree murder in the death of her former boyfriend.
<snipped>
Instead, the trial drew back a curtain and exposed his “hypocrisy,” she said.
Arias defended her assertion at trial that she found him masturbating to a photo of a boy.
“Again, he’s fantasizing about having sex with a 12-year-old … That’s a pedophile by definition,” she said.

Jodi Arias Said She Liked 'Debasing' Phone Sex Talk With Ex-Boyfriend
Feb. 12, 2013
<snipped>
But the tape also shows Arias' willingness to please Alexander, agreeing with all of his suggestions for their sex life.
The pair discussed a pornographic-type movie that Alexander would like to shoot with Arias, coming up with storylines and costumes they each could wear. He tells her he wants to take pictures of her as ejaculates on her, and Arias tells Alexander he is "so creative" for coming up with ideas for what he wanted to be a "legitimate porn."
Arias describes on the recording how she liked wearing pig-tails while the pair had sex in a bathtub, to which Alexander responded that the pigtails were "so hot."
Eventually, Arias orgasms, and Alexander tells her, "You sound like a 12 year old having an orgasm, that's so hot, like little girl."
"You're bad, you make me feel so dirty," Arias responded.

I was thinking about Jodi's time on the stand last night, after the jury hung. I hadn't been following this case closely until I got sick and was in bed away from work. When I started watching it, Jodi was on the stand. I have to say that my first impression, without knowing much else about it, was that she was a credible witness and that Juan's manner would make it difficult on anyone. As day after day passed, a different perspective came to the forefront and I began to see Jodi for what she was. Then, when Juan was able to show the holes in her story (and by then, even from her own mouth, there were clear holes) the picture of what happened was obvious.
I'm not sure that less time on the stand wouldn't help her case. The more she talked, the worse she looked, IMO. However, my understanding is that if a new jury is selected, they won't hear the entire trial. They'll hear the determining factors for what this jury decided: premeditation, and especially cruel manner of murder, but that's it. I'm sure there will be pre-trial arguments for how wide those factors go, but my hope is that the mental garbage won't be part of it. If my understanding is right, then I think that would favor the State's effort to get a death sentence. The new jury won't be asked to determine guilt or innocence; that's already decided at the level of first degree premeditated. I would think her claim of self defense wouldn't be allowed. They won't be asked to determine the level of cruelty of the murder; that's been determined to be especially cruel. The defense barely made an argument on that. They just need to be aware of the factors that determined those decisions so they can recommend a sentence. Of the mitigating factors the defense listed, mental problems wasn't one of them, so I'm hoping we've seen the last of LaLaViolet. Maybe I'm wishful thinking, but I hope that's the case, anyway!
BTW......... congrats to those who called it a hung jury in the poll!

I fail to comprehend "aggravating factors" and "mitigating factions" that have the ability to apply mercy to an established premeditated verdict ... an established premeditated verdict that carries the death penalty.
Aggravating Factors:
The victim has been premeditatedly denied the right to life whether he/she slips away from an overdose of sleeping pills or he/she is stabled 27 times and shot in the head.
Mitigating Factors:
What happen to the rule of law rather the "feelings" of each juror? What happen to justice for the victim?

I agree with you, Amys Sister! I feel sure Juan will polish up his closing argument this time. He wasn't on his best game, IMO, during it.

The jury breakdown was 8 for death, 4 for life.
That was an impossible breakdown to hope for a verdict.
Thank you for the information, CBB.
You're welcome grace-land! I'm sure that split made things really hard. Each side had support enough to stay put. I really do believe that if a new jury is selected that Juan can bring it home for Travis's family. I do believe that.
She looks like a Librarian, and she sounds one with her soft voice, she hides the monster, that she is. IMO
I can understand, how the four jurors, voted, against common sense. I am just saying, I can understand, I do not agree, with their vote.
The jury knew this could be a death penalty case. I wonder if it's just not harder for some to sentence not only a female, but a young female to death.
You nailed it, Muffy
The jurors may have thought of her as their daughter

I admire those of you who can accept the hung jury, I wish I could. My head can but my heart just isn't ready I suppose. My thoughts almost always agree with Kermit and I love her last statement
After ca I gave up on the judicial system and the general public and swore I would never get caught up in another case but here I am! I am sick of rulings from the heart and not the head! I know I am not in charge of this but ja needs to be punished in the harshest manner imho. I am sick for the Alexander family and Juan. By the way I love all you Monkeys and read all of your comments on all the cases I follow. I just needed to vent, glad You are here for me!

Hi MAca
I know what you mean about giving up on the judicial system and the general public after CA. Yeah, boy howdy.
Obviously, the school marm look and the made up scenarios provided by the defense worked in both cases. In CA's case, Baez put it out in his opening that Caylee drowned in the pool and George took care of things after that. Yet there was no evidence of that, nothing to tie back into it. Same thing with Travis's alleged abusing of Jodi. There was nothing anywhere except the words of a proven liar (Jodi herself). Travis had no history of being abusive. The defense trotted in some folks to testify, but none of it was anyone that saw or heard Jodi herself being abused. Where was the evidence? To me, it was more of what abuse could be like and the damage it could do. What the defense did imo anyway, was turn things around to where Jodi appeared as the victim, instead of the poor young man that was brutally murdered three times.
And it worked, both times. JMHO

The saving grace in this case is the jury found Jodi guilty, and it's now a matter of which punishment. She will be in prison one way or the other. In CA's case, well, she got off imo.

Arias Foreman: Sentencing Decision Unfair to Jury
PHOENIX May 24, 2013
The jury foreman in Jodi Arias' trial says the panel just couldn't decide whether the killing of her boyfriend was enough to merit a death a sentence.
William Zervakos tells The Associated Press jurors struggled with what they called a flawed system, explaining Arias wasn't "Jeffrey Dahmer or Charles Manson." They thought it was unfair that 12 average Americans who aren't lawyers had to make such a crucial decision.
The 69-year-old said Friday the entire panel believed the slaying was no doubt brutal. But he says they had to take into account Arias' lack of a criminal history or any previous violent behavior.
