Judges and lawyers at Vatican City State Tribunal: guaranteeing a fair trial - Note of Father Federico Lombardi

In recent weeks, since the opening of the trial for the dissemination of reserved documents commonly known as “Vatileaks 2”, many observations and evaluations have been written regarding the judicial system of Vatican City State and in particular on the Tribunal where this trial and its related procedures are taking place. Since many of these observations are inappropriate, or at times entirely unjustified, it would appear opportune to offer some considerations enabling a clearer view and a more just evaluation of this fundamental aspect of the situation.

Firstly, although this should be self-evident, it is necessary to recall that Vatican City State has its own legal order, entirely autonomous and separate from the Italian legal system, and has its own judicial bodies for the various levels of judgement and the necessary legislation in terms of criminal matters and procedure.

Vatileaks II Trial: More evidence to be submitted

(Vatican Radio) The Vatican tribunal hearing the criminal case in the leaking of confidential documents – the so-called “Vatileaks II” case – resumed work on Monday morning.

The defendants - three officials and two journalists – were at the trial, with their lawyers.

According to a statement released by the Holy See Press Office, the morning’s session dealt primarily with the requests submitted the previous week by the defense.

The Court refused a request by Francesca Immacolata Chaouqui for dismissal of charges based upon lack of jurisdiction – reaffirming the laws place the case “without uncertainty” in the jurisdiction of the Court of the Vatican City State, and noting she had previously acknowledged this fact.

The Court refused a request for a psychological expert for Msgr. Lucio Angel Vallejo Balda, since the court only admits “psychiatric” experts, not “psychological” ones – but adding any relevant personality and behaviour issues of the accused would be adequately ascertained from the trial.

However, the Court allowed almost all of the other requests: An expert requested by Ms. Chaouqui to look at computers and mobile phones; and the acquisition of several documents requested by the defence (texts of e-mails, text messages, various newspaper articles, and previously performed psychiatric evaluation pertaining to Msgr. Vallejo Balda)

The Tribunal also admitted the request presented by the defence for additional witnesses to be called, including figures such as Cardinals Abril y Castelló and Parolin, among others.

(Vatican Radio) Pope Francis requested the ancient Ukrainian icon "Doors of Mercy" to be brought to the Vatican for the opening of the Jubilee Year of Mercy. This icon, which combines both Western and Eastern traditions, is particularly symbolic and encourages all Christians to unity and peace for the sake of charity.

The Icon was met at the airport by the Ambassador of Ukraine to the Holy See, Tatyana Izhevska; and Ambassador of Poland to the Holy See, Piotr Novina-Konopka; and representatives from the Vatican.

The image of the Virgin Mary and Jesus Christ, which dates from the seventeenth century, comes from the cathedral of the Ukrainian Greek Catholic Church in the Polish city of Jaroslaw. The icon, which takes its name from the Byzantine Lenten liturgical text, "Open the Doors of Mercy to me, O Mother of God." is considered miraculous and was given a crown by St. John Paul II in 1996.

(Vatican Radio) Pope Francis on Tuesday opened the Holy Door in St. Peter’s Basilica, inaugurating the Jubilee of Mercy. The ceremony took place after he celebrated Mass for the Solemnity of the Immaculate Conception in St. Peter’s Square.

The rain did not keep the people away: Over 50 thousand arrived, including the President and Prime Minister of Italy, Sergio Mattarella and Matteo Renzi; as well as King Albert II of Belgium with Queen Paola.
 
After Mass, Pope Francis opened the Holy Door to St. Peter’s, where he was met by his predecessor, Pope-emeritus Benedict XVI, whom he embraced.

The Jubilee will continue this Sunday, when Pope Francis opens the Holy Door in his Cathedral, St. John Lateran, and bishops around the world open Holy Doors in their own Cathedrals, and other designated Churches.

Two things are necessary to fully celebrate the day’s feast, the Pope said: first, “to fully welcome God and His merciful grace into our life; second, to become in our own times ‘workers of mercy’ through an evangelical journey.” In imitation of Mary, he said, “we are called to be ‘bearers of Christ’ and witnesses of His love,” especially towards those who are most in need.
 
Following the Angelus, Pope Francis called on the crowd to greet Benedict XVI, the pope emeritus, who was present for the Liturgy and who was one of the first pilgrims to pass through the Holy Door.

(Vatican Radio) The final event of the opening of the Holy Year was a light show on the facade of St. Peter’s Basilica, which was inspired by Pope Francis’ ecological encyclical Laudato Si’: On Care for our Common Home.

The three-hour event on Tuesday evening was called “Fiat Lux: Illuminating Our Common Home.” It involved a changing display of animals (many of them endangered), nature scenes, and other images highlighting the fragility of our environment.

The show was sponsored by the World Bank Group (Connect4Climate), by Paul G. Allen's Vulcan Productions, by the Li Ka-shing Foundation and by Okeanos.

Yesterday evening's light show, "Fiat Lux, Illuminating Our Common World", generated a strong reaction among the faithful.

The hour-long, twice repeated show of images projected onto St. Peter’s basilica replete with new age music and sounds from the animal kingdom, was undoubtedly remarkable and technologically impressive. The natural world was showcased in a way that underscored the beauty of creation and the need to safeguard it.

Meant to link Pope Francis’ environment encyclical Laudato Si’ with the United Nations Climate Change Conference (COP21) currently underway in Paris, it was also supposed to underline the theme of mercy.

Many enjoyed the spectacle, but equally many others found it highly inappropriate. What caused most of the consternation was that one of Christianity’s most sacred and iconic buildings was used as the backdrop to climate change advocacy — a science that remains highly contested — on the Solemnity of the Immaculate Conception. The event was part-sponsored by the World Bank, well known for its promotion of abortion and contraception.

(Vatican Radio) Reflecting on the meaning of the Jubilee of Mercy Pope Francis on Wednesday said that “especially in our times, in which forgiveness is a rare guest in the areas of human life, the call to mercy becomes more urgent”.

The Pope was addressing the crowds gathered in St. Peter’s Square for the weekly General Audience.


He said that mercy can contribute much in building a more human world and has a fundamental role to play everywhere: “in society, institutions, at work and even in the family”.

Recalling the fact that on Tuesday, December 8th, he opened the Holy Door of the Jubilee of Mercy in St. Peter’s Basilica after having already done so in the Cathedral of Bangui in Central Africa, Pope Francis said “today I would like to reflect with you on the meaning of this Holy Year, and answer the question: why a Jubilee of Mercy?”

He explained that in our age of profound changes, the Church needs the extraordinary moment offered by a Holy Year in which to offer her special contribution and make visible signs of the presence and closeness of God.

Pope Francis: God is merciful and steadfast in His love

(Vatican Radio) During morning Mass at the Casa Santa Marta on Thursday,Pope Francis spoke of God’s love and encouraged the congregation to allow themselves to be “embraced by God’s mercy”.

The Holy Father based his homily on a passage from Isaiah in which we are told that God chose His people out of love. He explained that he chose them “not because they were big and powerful but because they were the smallest and most wretched of all”.

He compared God’s love to that of a mother or father when they speak to their child after he or she has woken after a nightmare. Just as our parents reassured us saying “don’t be scared, I’m here”, so God says “do not be afraid of your sins, I love you; I am here to forgive you”. “This is the mercy of God”, the Pope explained.

Pope Francis exemplified the extent of God’s mercy by referring to the passage in Matthew in which Jesus says, “Come to me, all who labour and are heavy laden, and I will give you rest”.

(Vatican Radio) The Vatican’s Commission for Religious Relations with Jews has released a new document exploring the unresolved theological questions at the heart of Christian-Jewish dialogue.

The new document, entitled ‘The Gifts and Calling of God are irrevocable’, marks the 50th anniversary of the ground-breaking declaration ‘Nostra Aetate’. It was presented at a press conference in the Vatican on Thursday, by Cardinal Kurt Koch, Fr Norbert Hofmann of the Vatican Commission, together with two Jewish representatives, Rabbi David Rosen, International Director of Interreligious Affairs for the American Jewish Committee, and Dr Ed Kessler, founding director of the Cambridge Woolf Institute.

The visit will take place in the afternoon of 17 January 2016, and will be the third visit by a Pope to the Great Synagogue of Rome, following John Paul II and Benedict XVI.

“We look at this visit with renewed joy because it is the third visit but, obviously, every step must be accomplished, and nothing should be taken for granted,” said Fabio Perugia, the spokesman for the Jewish Community of Rome. “It is a great sign in the path of dialogue that began with John Paul II, continued with Pope Benedict XVI, and is now renewed with Pope Francis.”

(Vatican Radio) For the first time since the Second Vatican Council changed Christian teachings toward Judaism and the Jewish people 50 years ago, a group of Orthodox rabbis have issued a public statement advocating partnership with Christians and appreciating the religious value of Christianity.

Published on December 3rd on the website of the Center for Jewish-Christian Understanding and Cooperation (CJCUC) in Israel, “To Do the Will of Our Father in Heaven: Toward a Partnership between Jews and Christians” is signed by over 25 prominent Orthodox rabbis in Israel, United States and Europe and calls for cooperation between Jews and Christians to address the moral and religious challenges of our times. The proclamation’s authors are inviting fellow Orthodox rabbis to join in signing the statement.

 “The real importance of this Orthodox statement is that it calls for fraternal partnership between Jewish and Christian religious leaders, while also acknowledging the positive theological status of the Christian faith. Jews and Christians must be in the forefront of teaching basic moral values to the world,” said Rabbi Shlomo Riskin, one of the statement’s initiators, and founder of CJCUC, member of the Israeli Rabbinate and the Chief Rabbi of Efrat. While not a direct response to the Church’s 1965 “Nostra Aetate,” “To Do the Will of Our Father in Heaven” was clearly influenced by Christianity’s new affirmation of the eternity of the Jewish covenant and the respect that Christian leaders have demonstrated toward Judaism and Jews in contemporary dialogues and religious encounters.
