(Reuters) - U.S. prosecutors paraded hit men, drug dealers, bookies, and cops from a bygone era before a jury, painting ex-mobster James 'Whitey' Bulger as a cold-hearted killer and a government snitch before wrapping up more than six weeks of testimony on Friday.

Once the most feared criminal in Boston's underworld, Bulger, 83, faces life in prison if convicted on charges related to 19 murders he is accused of committing or ordering as boss of the Winter Hill Gang in the 1970s and 80s.

Prosecutors put some of Bulger's closest partners in crime on the stand. They recalled an era when gun-toting gangsters dumped bodies under bridges or buried them in earthen basements and exchanged information with corrupt FBI agents in a bloody struggle for money and power.
 
Bulger's defense lawyers have said he is not guilty, and are poised to sow doubt about the witnesses, many of whom were neck-deep in crime themselves and may be seeking reduced sentences.

His attorneys plan to call a handful of witnesses starting on Monday, but they have not made clear whether Bulger, whose story inspired Martin Scorsese's Academy Award-winning film "The Departed," will take the stand himself.

Bulger fled Boston after a 1994 tip from a corrupt FBI official and spent 16 years as a fugitive before law enforcement caught him hiding out in a seaside apartment in California in 2011, with a stash of money and guns.

Scott Garriola, a special agent with the FBI in Los Angeles, testified on Friday that the ageing criminal swore at the arresting agents when they confronted him and refused their demands he kneel down "because there was grease on the ground."

INNOCENT VICTIMS

The trial took an alarming turn last week, when the body of alleged Bulger extortion victim Stephen Rakes was found in a Boston suburb. Police are still investigating the cause of his death, though a lawyer for Rakes' family said he did not believe the death was linked to the trial.

Some of the most riveting testimony came from Bulger crony and long-time friend Stephen Flemmi, who is serving a life sentence for 10 murders he confessed to a decade ago in a plea deal that spared him execution.

Will notorious Boston gangster James “Whitey” Bulger testify in his own defense? The answer is still unclear.

Bulger’s defense team disclosed today more of the witnesses they will call in the coming days, but did not tell a federal judge whether Bulger will testify.

“That may not be the limit to the defense,” said defense attorney Jay W. Carney after talking about the other witnesses.

US District Court Judge Denise Casper is presiding over the racketeering trial of Bulger in federal court on Boston’s waterfront.


Bulger’s attorneys said before the trial that he planned to testfy. But as the trial has worn on for weeks, there has been no further word on Bulger’s plans.

Assistant US Attorney Fred Wyshak told Judge Casper this morning that the government has a right to know if Bulger is going to testify. He asked if prosecutors will be asked to deliver closing arguments in the case Friday or to cross-examine Bulger.

“He’s had two months to make that decision,” he said.

A batch of photos of accused mobster James "Whitey" Bulger released today in an apparent effort to show him in a good light included a picture of Bulger with a Catholic monsignor who has been defrocked for abusing young boys.

The pictures were introduced as Bulger's trial for 19 murders and other crimes nears an end and the judge gave him until Friday to decide whether to testify in his own defense.

Prosecutors were angry over the emergence of the photos, but federal Judge Denise Casper told the court that the photographs would be allowed, adding, however, that "Mr. Bulger will have to make a decision" about whether he will take the stand Friday.

A potential witness in the James "Whitey" Bulger trial whose body was found in the woods of a Boston suburb last month was poisoned, authorities said Friday.

William Camuti, 69, was charged with attempted murder in the death of Stephen Rakes, who reportedly owed him money.

When asked if the alleged murder was linked to the Bulger case, Middlesex District Attorney Marian Ryan said, “our investigation indicates that Mr. Camuti acted alone.”

A statement from Ryan’s office said Rakes and Camuti met for coffee at a McDonalds in Waltham on July 16 and Camuti purchased two iced coffees, one of which he allegedly laced with two teaspoons of potassium cyanide before giving it to Rakes to drink.

He then allegedly drove around with Rakes in his car before dumping the body in a wooded area of Lincoln, where it was found by joggers the next day.

A murder charge has not been filed because the medical examiner is still waiting on test results.

Prosecutors say Rakes and his former wife were forced to sell Bulger their South Boston liquor store in 1984 to use as a headquarters for his gang.

Rakes had looked forward to testifying but learned the day before his body was found that prosecutors wouldn't call him.

At 83, "Whitey" Bulger could spend the rest of his life in prison for crimes his lawyers did little to dispute. He complains he wasn't allowed to make his case: that he was promised immunity.

BOSTON – As closing arguments begin Monday morning in the murder and racketeering trial of James "Whitey" Bulger, the notorious Boston mobster ranks among those not expecting an acquittal.

"I feel that I've been choked off from having an opportunity to give an adequate defense," Bulger said in court Friday, dismissing his trial as "a sham."

He claims a former Justice Department strike force chief promised him immunity from prosecution in exchange for protection against deadly threats, but Judge Denise Casper wouldn't allow that argument. On Friday, Bulger declined to testify.

Now, as the trial nears its climax, success for the Bulger defense could mean something less than a "not guilty" verdict on all 32 counts.

Federal prosecutors spent this morning trying to convince a jury that the summer-long trial of James "Whitey" Bulger came down to these simple questions:

"Follow the evidence…it's like putting a puzzle together. Who shot who? Why did it happen? Who extorted who? Who shook down who?" federal prosecutor Fred Wyshak told the jury were the important questions to remember.

And, in the government's closing arguments, Wyshak insisted that the answer to those questions was Bulger and his criminal cohorts in the Winter Hill Gang.

"This is not some Robin Hood story about some man who keeps angel dust and heroin out of South Boston,'' Wyshak told the jury. "It demonstrates the cold calculated approach that men like… Jim Bulger have toward their fellow men."

BOSTON — Jurors began their deliberations Tuesday in the trial of James “Whitey” Bulger, the reputed crime boss who is accused of participating in 19 slayings during a two-decade reign over Boston's underworld.

The jury deliberated for nearly six hours before being dismissed for the day. Deliberations will resume Wednesday morning.

Bulger is charged with orchestrating or committing the killings during the 1970s and '80s while he allegedly led the notorious Winter Hill Gang, a crew of mostly Irish American gangsters.

BOSTON — As jurors in the racketeering trial of reputed gangster James “Whitey” Bulger started their second day of deliberations on Wednesday, they asked the judge for clarification on the culpability of someone who helps in the commission of a crime.

The jury asked Judge Denise Casper to explain joint venture, which essentially means being a co-conspirator or a member of a racketeering organization that commits a crime. It also asked about aiding and abetting, which means assisting in the commission of the crime.

Bulger, 83, is accused in a sweeping racketeering indictment of playing a role in 19 killings while allegedly leading the Winter Hill Gang, sometimes as the triggerman and other times helping to plan or orchestrate the slayings, or driving a car used as part of the plan.

Casper had told the jurors during her instructions that prosecutors don’t have to prove that Bulger himself committed the 19 killings, but they may find him guilty if they find he aided in the killings. In response to their question Wednesday, she referred them to copies of her instructions.

Whitey Bulger convicted of racketeering, conspiracy
Whitey Bulger was convicted Monday of racketeering and conspiracy by a Boston jury that found he committed 11 murders and a raft other crimes as an iron-fisted crime boss.

Although Bulger now faces a possible life sentence, his lawyers said he was happy about the trial result because it exposed government corruption. He intends to appeal on the grounds that he was not allowed to argue he had immunity from the feds.

BOSTON –  Prosecutors in Massachusetts plan to meet with their federal counterparts to determine whether murder or other charges can be brought against James "Whitey" Bulger or his associates at the state level now that his federal trial is over.

A spokesman for Suffolk's district attorney says the office is "always looking for evidence that can help us investigate and prosecute" homicides.

Bulger was convicted Monday in 11 killings. He's never been charged with murder in a Massachusetts court.

State prosecutors tell The Boston Globe Bulger's associates could also face trial, including one who allegedly took part in several slayings but was never charged.

(Reuters) - More than a dozen relatives of James "Whitey" Bulger's murder victims hope to testify at the convicted mob boss' sentencing hearing in November, U.S. prosecutors told a judge on Tuesday.

Bulger, 84, faces the possibility of life in prison after being convicted last month of 31 criminal counts, including 11 murders he committed or ordered while running Boston's notorious "Winter Hill" crime gang in the 1970s and 80s.

Prosecutors intend to submit statements from family members of all 19 people Bulger was accused of killing or ordering murdered, Assistant U.S. Attorney Brian Kelly told U.S. District Judge Denise Casper. The jury found him guilty on 11 of those 19 murder charges.

Bulger was not present in court on Tuesday. His sentencing is scheduled to begin November 13.
Casper said she expected any family members of victims to control their anger if they testify.

BOSTON (AP) — Defense costs for convicted Boston mobster James "Whitey" Bulger totaled more than $2.6 million through June, according to a court filing Friday.
The accounting includes fees for his court-appointed attorneys, J.W. Carney Jr., and Hank Brennan, and other expenses totaling about $17,000.
Bulger, 84, was convicted Aug. 12 of racketeering, including 11 killings, as well as extortion, money laundering and weapons charges, in the 1970s and '80s. He faces the possibility of life in prison when he is sentenced in November.
 

Taxpayers can expect more bills for Bulger's defense: the expenses disclosed Friday begin with the end of June 2011, when Bulger was captured in Santa Monica, Calif., through the beginning of his trial. They don't include July and August when his trial was ongoing.
Bulger's attorneys were paid the standard rate of $125 an hour. Other costs included $139,000 for paralegal services, $62,000 for investigative services and $36,000 for transcripts.
Prosecutors have said the criminal operations Bulger controlled made millions, and more than $800,000 in cash was found hidden in his California apartment. He was granted public defenders when he said his assets had been seized by the government.

The U.S. Attorney’s office made a detailed tally of testimony from Bulger victims who recounted form the stand extortion and drug-deal shakedowns, and “rent” paid by other criminals. Prosecutors determined the earnings of Bulger and his criminal compatriots “spanned decades” and totaled $25,162,800 in ill-gotten gains.
The government wants a judge to force Bulger to reveal where his money may be hidden. The mob boss had opened safety deposit boxes around the world.
Bulger was convicted last month of murdering 11 people, extortion, money laundering and weapons charges after a trial that came nearly twenty years after he was tipped off to a pending federal indictment by a corrupt FBI agent.
Police found $822,000 in cash secreted in the walls of his Santa Monica hideout, where he and his longtime companion spent 14 years living a life on the lam. Bulger was second only to Osama Bin Laden on the FBI’s Most Wanted List.
In his opening statement, Bulger defense attorney Jay Carney admitted his client made “millions upon millions upon millions” of dollars, and now the government wants the 83-year-old to relinquish any assets. He is slated to be sentenced in November.

BOSTON (AP) - The Massachusetts medical examiner's office determined that cyanide poisoning killed an alleged extortion victim of Boston gangster James "Whitey" Bulger who had hoped to testify at Bulger's trial, prosecutors said Sunday.

The medical examiner's office concluded that Stephen Rakes, 59, of Quincy, died of acute cyanide toxicity in July and ruled his death a homicide, according to MaryBeth Long, a spokeswoman for the Middlesex district attorney's office.

Authorities said Rakes' death wasn't related to the Bulger case.

Rakes' business associate, William Camuti, 69, of Sudbury, is charged with attempted murder and other crimes for allegedly poisoning Rakes' iced coffee. Camuti has pleaded not guilty.

Prosecutors said Camuti owed Rakes money and lured him to a meeting where he poisoned his drink then drove Rakes around for hours before dumping his body.

Long said the district attorney's office intends to file additional charges against Camuti based on the new findings by the medical examiner.
 
Rakes' body was found in a wooded area of the Boston suburb of Lincoln on July 17, just a day after he learned he wouldn't be called as a witness against Bulger. Rakes openly despised Bulger and blamed him for seizing control of his South Boston liquor store to use as headquarters for Boston's Irish mob in 1984.

Bulger was convicted in August of 11 killings and dozens of other gangland crimes. He is set to be sentenced next month.

Notorious Boston gangster James “Whitey” Bulger was sentenced today to two life sentences in prison plus five years by a federal judge who cited the lives Bulger wrecked as he rampaged for decades through the city’s underworld under the protection of corrupt FBI agents.

“The testimony of human suffering that you and your associates inflicted on others was at times agonizing to hear and painful to watch,” said US District Court Judge Denise J. Casper, who recited, one by one, the names of the people Bulger murdered.

“The scope, the callousness, the depravity of your crimes, are almost unfathomable,” she said in the stillness of a courtroom filled with teary-eyed relatives of the killer’s victims.

Bulger, 84, was convicted earlier this year of charges that he participated in 11 murders, drug trafficking, racketeering, money laundering, extortion, and other crimes. Bulger fled Boston shortly before his 1995 racketeering indictment. One the FBI’s 10 Most Wanted — along with Osama bin Laden — he eluded a worldwide manhunt until he was captured in June 2011 in Santa Monica, Calif.

Bulger was able to operate with impunity for years as a prized informant for the FBI who had a cozy relationship with corrupt agents.

Showing no emotion, Bulger listened intently to Casper’s remarks and then stood, flanked by his lawyers, in his orange jail jumpsuit, for sentencing. He folded his hands in front of him halfway through the judge’s words.

“You are hereby committed to the Bureau of Prisons for the term of life,” the judge told him.
 
Casper also ordered Bulger to pay $19.5 million in restitution to his victims’ families. And she ordered him to forfeit $25.2 million to the government. The awards appeared to be largely symbolic because law enforcement has not uncovered anywhere near that amount of money stashed away by Bulger.

Noting the publicity that has been given to Bulger’s story in recent years, Casper said, “You have, in some ways, over time become a face of this city. .... It’s regrettable.”

Referring to the city’s response to the Boston Marathon bombings this year, Casper said Bulger should not represent the city. “You and your cohorts should not and do not represent the city,” she said.

Casper said she hardly knew where to begin in discussing Bulger’s crimes and that she had “struggled with what would ever be just punishment for the unfathomable harm that you have caused.”

Casper’s remarks took only about a half-hour. After a sidebar conference, Bulger hugged his lawyers before being led away in handcuffs. He did not look back or say a word.

Defense attorneys have said they plan to appeal. Attorney Hank Brennan said after today’s hearing that Bulger should have been able to present in court his claim that he had been given immunity for his crimes by a federal prosecutor.

In August, jurors found that Bulger participated in 11 murders while operating a sprawling criminal enterprise from the 1970s through the 1990s that trafficked in cocaine and marijuana; extorted drug dealers, businessmen, and bookmakers; and corrupted FBI agents and other law enforcement officials. He was convicted of 31 counts of racketeering, extortion, money laundering, and weapons possession.

Jurors found that prosecutors proved Bulger participated in 11 of 19 murders he was accused of, including the strangulation of Deborah Hussey; the assassination of Tulsa businessman Roger Wheeler; and the slayings of Edward Connors, Paul McGonagle, Thomas King, Richard Castucci, Edward “Brian” Halloran, Michael Donahue, John Callahan, Arthur “Bucky” Barrett, and John McIntyre.

But jurors found prosecutors failed to prove Bulger participated in seven additional murders: Michael Milano, Al Plummer, William O’Brien, James “Spike” O’Toole, Al Notarangeli, James Sousa, and Francis “Buddy” Leonard. The jury was unable to reach a verdict on whether Bulger was involved in the 1981 strangulation of another woman, Debra Davis.
 
Bulger has been held at the Plymouth County House of Correction. He is expected to return there today and eventually be transferred to a federal prison

Boston mobster 'Whitey' Bulger to appeal conviction

(Reuters) - Lawyers for mobster James "Whitey" Bulger on Wednesday said they plan to appeal his August conviction on charges including 11 murders, less than a week after a U.S. judge sentenced the former leader of Boston's "Winter Hill" gang to two consecutive life terms in prison.

In a brief, two-page filing in U.S. District Court in Boston, Bulger said he was appealing the jury's verdict that found him guilty of 31 of 32 criminal counts, including racketeering, extortion and drug dealing.

The filing does not detail the 84-year-old gangster's specific objections, but U.S. District Judge Denise Casper before the trial prevented his lawyers from mounting the case that Bulger had been granted immunity for his crimes. Casper reasoned that no immunity deal would allow a person to commit murder.
